The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 70 1 Murray Street, Alexandria, Louisiana, on Monday, May 13, 2024, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Joseph “Joe” Bishop , President and Police Jurors: Davron “Bubba” Moreau, Craig Smith , Ernest Nelson, Danny Bordelon, Oliver “Ollie” Overton, Jr., Sean McGlothlin, Parrish Giles and Jay Scott.

The invocation was given by Mr. Ernest Nelson.

The Pledge of Allegiance was led by Mr. Jay Scott.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened a s the governing authority of said Parish by Hon. Joe Bishop, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

Honorable Phillip Terrell welcomed Ms. Laura Seabaugh, Outreach Liaison for Honorable Liz Murrell office. Ms. Seabaugh introduced herself and stated she is available for any assistance the Police Jury may need.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on April 8, 2024, as published in the Official Journal. On vote the motion carried.

On m otion by Mr. Ollie Overton, seconded by Mr. Craig Smith to adopt an “In Memoriam” for the late Mr. Clyde D. Linzay, Jr., former Police Juror of the Rapides Parish Police Jury. The following was presented and unanimously adopted:

IN MEMORIAM

WHERAS, Mr. Clyde D. Linzay, Jr. was called by his Creator on S aturday, March 30, 2024; and

WHEREAS, Mr. Linzay was born in Cheneyville, LA, to the late Clyde Daniel Linzay, Sr., and Clara Rush Linzay; and

WHEREAS, Mr. Linzay was a devoted husband, loving father, grandfather, and REGULAR MEETING MAY 13, 2024

great-grandfather, leaving behind a legacy of love and memories; and

WHEREAS, Mr. Linzay was a graduate of Poland High School and attended Repperts Auctioneer School in Decatur, Indiana; and

WHEREAS, Mr. Linzay served in the Army from 1951 to 1953, achieving the rank of CPL; and

WHEREAS, Mr. Linzay gave twenty-one (21) years of dedicated services to the Rapides Parish Police Jury where he was instrumental in starting the Buckeye Recreation Complex and in building the first field; and

WHEREAS, Mr. Linzay was also an Executive Board Member of the Louisiana Police Jury Association; and

WHEREAS, the Rapides Parish Police Jury does hereby recognize Mr. Clyde D. Linzay, Jr. for having served as a Juror of the Rapides Parish Police Jury and for his dedication in serving the citizens of Rapides Parish;

NOW, THEREFORE, BE IT RESOLVED that the Rapides Parish Police Jury does hereby order that this formal expression of honor for the late Clyde D. Linzay, Jr. , and sympathy for his family be spread upon the minutes of this meeting;

ORDINANCE

AN ORDINANCE TO AMEND AND REENACT SECTION 18 -4.2

• (B) SPEED LIMIT SO AS TO SET A 50 MPH SPEED LIMIT ON CHENEYVILLE-ECHO ROAD, DISTRICT H

BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 13th day of May, 2024, that Section 18-4.2 (b) of the Rapides Parish Code of Ordinances is hereby amended and reenacted to set a 50 mph speed limit on Cheneyville-Echo Road, District H as follows:

Chapter 18. MOTOR VEHICLES AND TRAFFIC

Section 18-4.2. Speed limits designated on certain streets: …

• (b) Fifty miles per hour. It shall be unlawful for any person to drive or operate a vehicle upon the following parish road in Rapides Parish in excess of fifty (50) miles per hour. … Cheneyville-Echo Road, District H … (b). Whoever violates the provisions of this section shall be punished by a fine not to exceed one hundred dollars ($100.00), or imprisoned in the Rapides Parish Jail for a period not to exceed thirty (30) days, or both.

BE IT FURTHER ORDAINED that this ordinance is to be effective immediately.

BE IT FURTHER ORDAINED in all other respects Section 18 -4.2 of the Rapides Parish Code of Ordinances shall remain unchanged.

BE IT FURTHER ORDAINED that the Parish Highway Department is hereby authorized to erect the speed limit signs on the Road and a copy of thi s ordinance sent to the Rapides Parish Sheriff Office.

On motion by Mr. Parrish Giles, seconded by Mr. Bubba Moreau, the following resolution was unanimously adopted:

RESOLUTION

A resolution ordering and calling a special election to be he ld in Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana, to authorize the levy of a sales and use tax therein, making application to the State Bond Commission, and providing for other matters in connection therewith.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisian a (the "Governing Authority"), acting as the governing authority of Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana (the "District"), that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission and under the authority conferred by the Constitution of the State of Lou isiana of 1974, including Article VI, Section 30 thereof, the applicable prov isions of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the District on TUESDAY, NOVEMBER 5, 2024, between the hours of six o'clock (6:00) a.m. and eight o'clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

PROPOSITION

(SALES TAX)

Shall Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana (the "District"), be authorized to levy and collect a tax of 2% (the "Tax") in accordance with Louisiana law (an estimated $376,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), in perpetuity, commencing January 1, 2025, with the avails and proceeds of the Tax (after paying reasonable and necessary costs and expenses of collecting and administering the Tax) to be dedica ted and used for the purpose of constructing, improving, maintaining and keeping in repair the public roads, highways, bridges and related drainage facilities in the District?

SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the official journal of the District once a week for four consecutive weeks, with the first publication to be made not less than forty -five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as "Exhibit A" and incorporated herein by reference the same as if it were set forth herein in full.

Notwithstanding the foregoing, prior to the publication of the Notice of Election, the President is authorized and directed to make any amendments to the foregoing propositions that may be required to comply with any state or federal regula tory agencies. REGULAR MEETING MAY 13, 2024

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Police Jury Room of the Rapides Parish Courthouse, 701 Murray Street, 2nd Floor, Alexandria, Louisiana, on TUESDAY, NOVEMBER 12, 2024 , at THREE O'CLOCK (3:00) P.M. , and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.

SECTION 4. Polling Places. The polling places for the precincts set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners -in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.

SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners -in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held as provided in Section 3 hereof. All registered voters in the District will be entitled to vote at the special election, and voting machines shall be used.

SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election.

SECTION 7. Furnishing Election Call to Election Officials . Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Rapides Parish and the Registrar of Voters of Rapides Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.

SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the sales and use tax provided for th erein. BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of L ouisiana (the "Governing Authority"), acting as the governing authority of Road District No. 1A of the Parish of Rapides, State of Louisiana (the "District"), that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the District on SATURDAY, APRIL27, 2024 (the "Election"), to autho rize the renewal of a special tax therein pursuant to the following proposition (the "Proposition"):

for the purpose of constructing, maintaining, and keeping in repair the public roads, highways, and bridges within the District?

This Governing Authority does further proceed to examine and canvass the r eturns of the Election thereof.

SECTION 2. Election Results. According to the official certified tabulation of votes cast at said Election, there was a total of 243 votes cast IN FAVOR OF the Proposition and a total of 97 votes cast AGAINST the Proposition, resulting in a majority of 146 votes cast IN FAVOR OF the Proposition. The Proposition was therefore duly CARRIED by a majority of the votes cast by the qualified electors voting at the Election.

SECTION 3. Promulgation of Election Result. The results of said election shall be promulgated by publication in the manner provided by law, after receipt f rom the Secretary of State’s office of the actual costs of the election, as required by §18:1292 of the Louisiana Revised Statutes of 1950, as amended.

SECTION 4. Declaration. The foregoing results of the Election are hereby declared by this Governing Authority and shall be published as required by law.

SECTION 5. Procès Verbal. A Procès Verbal of the canvass of the returns of the Election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in her office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

On m otion by Mr. Parrish Giles, seconded by Mr. Ollie Overton to authorize to execute an Engineering Agreement with Pan American Engineers, LLC. to develop bidding documents for road slope failure repairs to Lone Pine Road a nd authorize Pan American Engineers, LLC. to advertise and receive bids for the same. The estimated cost of the project is $330,000.00. Project to be funded from Road District 3A, District H. On vote the motion carried.

On motion by Mr. Danny Bordelon, seconded by Mr. Ollie Overton to authorize the payment for two (2) Rapides Parish Sheriff’s Deputies for security detail at Cotile Lake Recreation for Memorial Day weekend, Saturday, May 25th, Sunday, May 26th and Mondy, May 27 th, for the hours of 10:00 am – 8:00 pm. On vote the motion carried.

On m otion by Mr. Parrish Giles, seconded by Mr. Danny Bordelon to ratify authorization for the submission of two (2) forestry grants: one (1) Smokey Bear Fire Danger Sign Project and one (1) reimbursable Volunteer Fire Assistance Grant; for Fire District No. 5 – Oakhill VFD and authorize the Fire Chief and Parish President to sign all necessary documents. On vote the motion carried.

On m otion by Mr. Ollie Overton, seconded by Mr. Parrish Giles to accept the donation of used bunker gear from Westlake Chemical to Rapides Parish Fire District #5- Oakhill VFD, as recommended by the Fire Chief. The gear is no longer usable by Westlake Chemical but can be used by the Fire Department. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Danny Bordelon to amend the FY2024 Police Jury travel budget from $25,000.00 to $45,000.00 for Police Juror travel expenses, for continuing education, said total to be divided equally between the nine (9) Police Jurors. Discussion ensued.

On substitute motion by Mr. Jay Scott to amend the FY2024 Police Jury travel budget from $25,000.00 to $45,000.00 for Police Juror travel expenses, for continuing education. Motion died for lack of second.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith to grant 2% annual longevity pay increase mandated by the State for eligible Rapides Parish Fire Protection District No. 3 employees effective July 28, 2024 as recommended by Alpine Volunteer Fire Department Board of Directors, to be paid out of Fire Protection District No. 3 funds. WHEREAS, the Rapides Parish Police Jury received the Bids on Wednesday, April 17, 2024 for the Blue Lake Roadway Improvements,

WHEREAS, the Bids have been reviewed and tabulated by Pan American Engineers, LLC, with a recommendation of rejection of all bids due to exceeding the previously approved budget and a request for additional road work,

NOW, THEREFORE BE IT RESOLVED, that all bids received be rejected.

BE IT FURTHER RESOLVED, that the budget for this project be increased to not exceed $160,000.00; the scope of work be expanded; and the bid documents be revised and reissued.

Mr. Reno spoke on past events and upcoming events this year held at the Coliseum and stated he is looking forward to the shows that will be held at the renovated Exhibition Hall.
