The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, on Monday, September 18, 2023, at three (3:00) o'clock p.m. (Central Standard Time).

Mr. Rick Ducote, Rapides Parish Tax Assessor, provided an update on the tax assessment for 2024. Mr. Ducote is projecting a five percent (5%) increase in collections for 2024.

Mr. Rick Reno provided an update on the Rapides Parish Coliseum. Mr. Reno stated he was continuing to travel and meet with promoters to negotiate to bring shows and events to Rapides Parish. Mr. Reno stated he is working with GAEDA for sponsorship and grant opportunity for the New Year’s Eve event featuring Chapel Heart.

Mrs. Sandra Franklin, candidate for State Representative – District 26 thanked the Jurors for allowing her to speak at today’s meeting. She stated is very important to connect with the local people and discuss tough issues that the communities are facing.

President Joe Bishop r ecognized the Rapides Parish Office of Emergency Preparedness and Rapides Parish Fire Departments for their hard work and assistance on the wildfires. President Bishop thanked Ms. Angie Branton and Ms. Sherry Ledington for their hard work and leadership during this difficult time for Rapides Parish and other surrounding parishes.

Rapides Parish Police Jury for the ad valorem taxes of the year 2022, and authorize Theresa Pacholik, Treasurer, to issue said quietus.

RESOLUTION

WHEREAS, Mark Wood, Tax Collector, has exhibited to the Rapides Parish Police Jury satisfactory evidence that all taxes due to the Parish governing authority shown on the ad valorem tax rolls of Rapides Parish for the year 2022 have been paid or accounted for, and

WHEREAS, the said Rapides Parish Police jury has by resolution, a copy of which is annexed hereto, authorized me to issue this quietus on behalf of the Rapides Parish Police Jury in favor of the said Mark Wood, Tax Collector, and a gainst any claim on the part of the Rapides Parish Police Jury for the ad valorem taxes of the year 2022.

This resolution having been submitted to a vote, the vote thereon was as follows:

RESOLUTION

WHEREAS, the Rapides Parish Police Jury received the following Bids on Wednesday, August 30, 2023 for District A – District Wide Asphalt Roadway Improvements.

WHEREAS, the Bids have been checked and tabulated by Pan American Engineers, LLC, with a recommendation of award being made to the low Bidder;

NOW, THEREFORE BE IT RESOLVED, that the contract for said construction project is hereby awarded to the low Bidder, Apeck Construction, LLC, for the Base Bid of $1,116,030.00.

BE IT FURTHER RESOLVED, that the President is hereby authorized to execute contracts, change orders and other documents related to the project between the Rapides Parish Police Jury and the successful Bidder.

National Bridge Inspection Standards and that an inventory of these bridges be maintained by each State; and,

WHEREAS, the responsibility to inspect, rate and load post those bridges under the authority of Rapides Parish in accordance with those Standards is delegated by the Louisiana Department of Transportation and Development to Rapides Parish.

THEREFORE, BE IT RESOLVED by the governing authority of Rapides Parish (herein referred to as the Parish) that the Parish in regular meeting assembled does hereby certify to the Louisiana Department of Transportation and Development (herein referred to as the DOTD) that for the period October 1, 2022 through September 30, 2023:

1. The Parish has performed all interim inspections on all Parish owned or maintained bridges in accordance with the National Bridge Inspection Standards.
2. All bridges owned or maintained by the Parish have been structurally analyzed and rated by the Parish as to the safe load capacity in accordance with AASHTO Manual for Maintenance Inspection of Bridges. The load posting information that has been determined by the LA DOTD for all bridges where the maximum legal load under Louisiana State law exceeds the load permitted under the operating rating as determined above has been critically reviewed by the Parish. Load posting information has been updated by the Parish to reflect all structural changes, any obsolete structural ratings or any missing structural ratings.
3. All Parish owned or maintained bridges which require load posting or closing are load posted or closed in accordance with the table in t he DOTD Engineering Directives and Standards Manual Directive No. 1.1.1.8. All DOTD supplied load posting information concerning a bridge has been critically reviewed by the Parish Engineer prior to load posting.
4. All bridges owned or maintained by the Parish are shown on the attached list in the format specified by the DOTD. Corrections to data supplied to the Parish by the LA DOTD are noted.

WHEREAS, the Rapides Parish Police Jury intends to construct the Esler Regional Airport-Rehabilitate Terminal Building project and;

WHEREAS, bids have been received for the Esler Regional Airport - Rehabilitate Terminal Building project and have been previously received and read aloud;

WHEREAS, the Rapides Parish Police Jury has received a recommendation from the Engineer for the project that the contract be awarded to the lowest responsible bidder,

THEREFORE, BE IT RESOLVED , by the Rapides Parish Police Jury, that the contract be awarded to the responsible low bidder, as follows, subject to the satisfactory receipt of all forms and information required under the contrac t provisions, subject to approval and funding from FAA and LA DOTD.

WHEREAS, Gregory L. Jones is in need of the expertise of The Keiser Law Firm and attorney Randall B. Keiser in the area of Federal Civil Rights Litigation in Federal Court; and

WHEREAS, a Civil Rights Federal Court complaint has been filed in Civil Action No. 1:23cv-00899; U.S. D.C. Western Division of Louisiana, against the Rapides Parish Police Jury; and

WHEREAS, Randall B. Keiser, Keiser Law Firm PLC, of Alexandria, Louisiana, has represented the Rapides Parish Jury in previous legal matters in Federal Court and the employment of private counsel will greatly assist the Police Jury in the defense of this Federal Complaint; and

WHEREAS, Randall B. Keiser, Keiser Law Firm, PLC, be hereby retained as co - counsel for the Rapides Parish Police Jury; at the compensation schedule published and approved by the attorney general not to exceed $225.00 per hour together w ith incurred expenses for court cost advances, subpoena and deposition fees, and other like out-of-pocket expenditures, subject however to the approval of the Louisiana Attorney General pursuant to R.S. 42:263; and

WHEREAS, the Randall B. Keiser, Keiser Law Firm, PLC, is hereby retained for a term of one (1) year beginning July 1, 2023 and ending June 30, 2024; and

WHEREAS, in the event of claims brought in federal court seeking equitable relief, these claims may implicate the interests of the State of Louisiana, and so the Rapides Parish Police Jury agrees to provide advance written notice to the Louisiana Attorney General ten (10) business days before the next meeting and an opportunity for the Attorney General to express concerns directly to the Board in writing or in executive session before the Board:

• (1) proposes a settlement, accepts a proposed settlement, agrees to a consent decree, or enters any other agreement with any party in any federal action for declaratory or injunctive relief that is going to be or has been filed; or
• (2) files any document in any federal case in which(a) declaratory or injunctive relief has been granted against the Board, (b) final judgement dismissing the case has not been entered, and (c) at least 3 years have passed since any party seeking relief, including the USDOJ in an amicus capacity, filed any document in the case.

Accordingly, the Rapides Parish Police Jury authorizes and directs Randall B. Keiser, Keiser Law Firm, PLC to provide the required notice to the Attorney General, release such information and documentation as the Attorney General m ay request in response to the notice, and generally cooperate with the Attorne y General in regard to the notice

WHEREAS, this resolution shall take effect immediately; and

On motion by Mr. Sean McGlothlin, seconded by Mr. Ollie Overton the following resolution was presented:

Resolution

WHEREAS, the Teche -Vermilion Watershed is occasionally threatened by significant rain events caused by tropical weather systems, stalled frontal passages, and other weather systems that may be impacted by inadequate drainage and retention that could result in potential flooding impacts to a significant part of the Teche-Vermilion Watershed; and

WHEREAS, the negative impact of these weather systems may be increased by inadequate drainage and retention issues that result in flooding events that are detrimental to the public affecting residential, businesses, agriculture, and governmental entities, and even may threaten the lives of our citizens; and,

WHEREAS, the National Weather Service (NWS) usually issues an accurate forecast for these sorts of events usually at a minimum of 72 hours or greater in advance; and,

WHEREAS, the drainage out of Bayou Courtableau is limited by the following issues:

• (a) The West Atchafalaya West Guide levee flood gates for Bayou Courtableau that have insufficient flow capabilities as identified by a report to the Mississippi River Commission by the US Army Corp of Engineers (USACE) in 2007 and operation of these gates are dependent on Lake Pelba water levels; and REGULAR MEETING SEPTEMBER 18, 2023
• (b) The undersized and obsolete flood gate south of Butte La Rose Bridge on the inside of Borrow Pit Canal; and,
• (c) Two five-hundred-foot overflow weirs with and elevation set at 18.0 feet, which empty into Bayou -Amy, Lake Catahoula, and the Lake Fausee Point System; and,
• (d) Levels in Lake Pelba occasionally prohibit use of the Bayou Courtableau floodgates on the West Atchafalaya West Guide levee for drainage of the Bayou and the Northern and Central Areas of the watershed; and,
• (e) The Bayou Teche’s drainage capability is restricted by a dam at Keystone in St. Martin Parish; and,
• (f) The Vermilion River as shown by May 2017 and August 2019 USACE depth surveys indicating severe shoaling that inhibits drainage for the river for most of Lafayette Parish and portions of Vermilion Parish; and,

WHEREAS, the flood of August 2016 brought great loss of homes, businesses, and agricultural crops, equipment, and structures in the entire Teche -Vermilion Watershed; and

WHEREAS, active management of drainage control structures and systems as stated herein prior to a significant weather system as defined herein will accommodate additional drainage and retention resulting therefrom; and,

WHEREAS, all actions proposed herein would occur while all water levels in the Teche-Vermilion Watershed are at or below their defined flood stages; and,

NOW THEREFORE BE IT RESOLVED that the Rapides Parish Police Jury requests that the US Army Corp of Engineers, Tech -Vermilion Fresh Water District (TVFWD), and St. Martin Parish Government proactively and immediately address a threat of a forecast by the National Weather Service of 5 inches or greater rain event across any significant area of the Teche-Vermilion Watershed by lowering the pool stage of Bayou Courtableau at the West Atchafalaya West Guide levee flood gates to 15.65 through the following actions:

• (a) Ceasing any pumping operation by TVFD when pool stages exceed 15.65
• (b) Open gates that drain Bayou Courtableau into the West Atchafalaya Floodway by the USACE if basin levels allow
• (c) Open gates that drain Lake Henderson by the St. Martin Parish Government
• (d) Open gates that drain Bayou Teche into Lake Fausse Pointe By TVFD if lake levels allow

The objective of lowering pool stages in Bayou Courtableau to 15.65’, which is the operational pool stage during the month of December, would allow the Bayou Courtableau watershed to store some of the anticipated rainfall accommodating anticipated drainage needs from the weather event and potentially reducing flooding threats. We request that these drainage accommodation operations begin at a minimum of 72 hours or immediately after the forecast by the National Weather Service has been issued or if river flooding causes the level in Lake Pelba to exceed 17.5 feet.

A similar pool stage lowering operation was undertaken when Hurricane Barry struck the area in July 2019 which resulted in success in minimizing flood impacts.

BE IT FURTHER RESOLVED that the Rapides Parish Police Jury requests the US Army Corp of Engineers, the Tech -Vermilion Fresh Water District, and St. Martin Parish immediately adopted these drainage accommodation operations.

BE IT FURTHER RESOLVED that this resolution be sent to each parish governments that will be affected by this request for their consideration and support and that this resolution be sent to the Louisiana Congressional Delegation seeking their support and their intervention with the US Army Corp of Engineers, Teche-Vermilion Fresh Water District, and St. Martin Parish in causing these operational guidelines to be adopted promptly.

BE IT FURTHER RESOLVED that certified copies of this Resolution be forwarded to the Executive Director of the Police Jury Association, Governor John Bell Edwards, CPRA, and any other persons, firms or entities as deeme d fit and proper.

A resolution approving the holding of an election in Ward 10 Recreation District, Rapides Parish, Louisiana, on Saturday, March 23, 2024, to authorize the renewal of a special tax therein.

WHEREAS, the Board of Commissioners of Ward 10 Recreation District, Rapides Parish, Louisiana (the "Governing Authority"), acting as the g overning authority of Ward 10 Recreation District, Rapides Parish, Louisiana (the "District"), adopted a resolution on August 22, 2023, calling a special election in the District on Saturday, March 23, 2024, to authorize the renewal of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Rapides, State of Louisiana, give its consent and authority for the District to hold the aforesaid REGULAR MEETING SEPTEMBER 18, 2023

election, and in the event that the election carries to continue to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to continue to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana, acting as the governing authority of said Parish, that:

WHEREAS, on August 11, 2023, Governor John Bell Edwards issued a State of Emergency – Heat Related Emergencies, Proclamation Number 141 JBL 2023;

WHEREAS, the Parish of Rapides is currently faced with a pending emergency due to Extreme Heat related Emergencies;

WHEREAS, the Nation Weather Service has issued a record number of excessive heat warnings, with heat indices in the 100’s since June 27, 2023;

WHEREAS, in addition to the extreme heat, minimal rainfall has led to drought conditions throughout Rapides Parish, stressing the abilities of water district a nd increasing the threat of wildfires;

WHEREAS, Rapides Parish issued a Parish Wide Burn Ban on August 7, 2023, following the Statewide ban by the La. State Fire Marshal, same date;

WHEREAS, the potential to exhaust local resources exists due to damage to roadways and property limiting Emergency Response access to the Citizens of Rapides Parish;

THEREFORE, I, Joseph “Joe” Bishop, President of the Rapides Parish Police Jury by authority vested in me by the Parish Charter and the Louisiana Disaster Act of 1993, do hereby proclaim.

A State of Emergency exists within the Parish of Rapides and that all Emergency Preparedness Plans and the Parish All Hazard Emergency Operations Plan be activated if necessary.

Mr. Tommy David with Pan American Engineers briefed the Jury of the status of the current construction and repairs at the Exhibition Halls . Mr. David stated Mr. Bill Aldridge with Ballard CLC provided a list of items for the proposed “party ready” change order for the Jurors to review . The only item that was not included on the proposed change order was the flexible curtain Mr. Reno mentioned in his discussion earlier in the meeting. If the Jury elected to add flexible curtain it would increase the estimated cost of the change order by $30,000.00. The new total estimated cost for the proposed change order would now be $680,000.00. Mr. David would recommend the Jury to consider proceeding with authorization for Ballard to advertise for bids for the proposed change order. Discussion ensued.

Mr. Tommy David stated he recently spoke to someone at the State Historical Preservation Office and they recommend having a mason climb the exterior of the Courthouse to check the joints for any cracks. He would ask the Jury to layover this motion until more research can be done. He does not see an issue with moving forward with cleaning the exterior windows of the Courthouse.

Project to be funded by Road District 2B-1, District C. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. David Johnson to grant approval of Cypress Pond Subdivision (Formerly Green Acres), located at Frost & Leigh Drive, Pineville, as recommended by the Rapides Area Planning Commission and authorize signing of the plat upon Legal Counsel review and approval. On vote the motion carried.

On m otion by Mr. Jay Scott, seconded by Mr. Bubba Moreau to adopt a resolution to allow Capital Area Finance Authority (CAFA) to offer a bond program in addition to their current grant programs to citizens looking to purchase homes in Rapides Parish . CAFA is a Local Housing Finance Agency, not a state agency and has a Cooperative Endeavor Agreement with Rapides Finance Authority. On vote the motion carried.

On motion by Mr. Jay Scott, seconded by Mr. Ollie Overton to permanently relocate Precinct C01 from Alexandria City Hall, located at 915 Third Street, Alexandria, LA 71301, to Precinct C02 at Peabody Montessori School located at 2416 Third Street, Alexandria, LA 71032. The reason for combining Precincts C01 and C02 is because of the number of voters at Precinct C01, is less than 300 . A copy of this resolution to be sent to Secretary of State, Elections Divisio n, Clerk of Court and Registrar of Voters. On vote the motion carried.

On motion by Mr. David Johnson, seconded by Mr. Jay Scott, the following ordinance was presented and on vote unanimously adopted:

ORDINANCE

AN ORDINANCE TO AMEND AND REENACT SECTION 18 -4.2

• (E) SPEED LIMITS AS TO ESTABLISH A 35 MPH SPEED LIMIT ON BERT PAUL ROAD, WARD 11.

NOW, THEREFORE, BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 8th day of August, 2005, that Section 18 -4.2

• (e) of the Rapides Parish Code of Ordinances is hereby amended and reenacted to include the following road, as follows:

Chapter 18. MOTOR VEHICLES AND TRAFFIC

REGULAR MEETING

SEPTEMBER 18, 2023

Section 18-4.2. Speed limits designated on certain streets: ...

• (e) Thirty -five miles per hour. It shall be unlawful for any person to drive or operate a vehicle upon the following parish roads in Rapides Parish in excess of thirty-five (35) miles per hour. ... Bert Paul Road, Ward 11 ...

(l). Whoever violates the provisions of this section shall be punished by a fine not to exceed one hundred dollars ($100.00), or imprisoned in the Rapides Parish Jail for a period not to exceed thirty (30) days, or both.

BE IT FURTHER ORDAINED that this ordinance is to be effective immediately.

BE IT FURTHER ORDAINED in all other respects Section 18 of the Rapides Parish Code of Ordinances shall remain unchanged.

BE IT FURTHER ORDAINED that the Parish Highway Department is hereby authorized to erect speed limit signs on the Road.

On motion by Mr. Sean McGlothlin, seconded by Mr. Jay Scott to adopt a resolution to update the policy language for the Parish medical plan in accordance with prior and current jury resolutions in accordance with the new current policy and any future policy.

This Resolution being submitted to a vote, the vote thereon was as follows:

On motion by Mr. Jay Scott, seconded by Mr. Ollie Overton to authorize roadway improvements and sinkhole repairs on the following streets within the Town of Lecompte’s Corporate Limits; Ford Street, Holly Street, St Charle s Avenue and Canal Street, not to exceed $150,000, to be paid out of Road District 3A funds, Town’s portion , contingent on the Town of Lecompte approval of project resolution. Discussion ensued.

Mr. Overton stated he spoke to the Mayor and thought he would be in attendance today, however, the Town Council has not formally approved the work yet. Mr. McGlothlin stated he would like to see the various Mayors in Rapides Parish attend REGULAR MEETING SEPTEMBER 18, 2023

at least one meeting during the current year. On vote the motion carried.

On m otion by Mr. David Johnson, seconded by Mr. Bubba Moreau to authorize the Purchasing Agent to receive price quotes for asphalt overlay for Price Crossing Road Bridge, (Ward 5A, District H) and award to the lowest bidder, cost of project not to exceed $70,000.00. Project to be funded from the Public Works General Fund. Discussion ensued.

On amended motion by Mr. David Johnson, seconded by Mr. Bubba Moreau to authorize the Purchasing Agent to receive price quotes for asphalt overlay for Price Crossing Road Bridge, (Ward 5A, District H) and award to the lowest bidder, cost of project not to exceed $70,000.00. Project to be funded from District H Reseal Funds. On vote the motion carried.
