There were present : Joseph “Joe” Bishop, President, Sean McGlothlin, Vice - President, Davron “Bubba” Moreau, Craig Smith, Oliver “Ollie” Overton, Jr, and Rusty Widler, David Johnson and Jay Scott.
Absent were Police Jurors: none.
Also present were : M rs. Theresa Pacholik , Secretary/Treasurer; Mr. Gregory L. Jones, Legal Counsel; Mr. Cory Ashmore, Public Works Director; Ms. Sharon Neal, WOD/OEWD Director, Mrs. Betty Jo Bourgeois, Tax Administrator; and Ms. Wendy Ammons.
The invocation was given by Mr. David Johnson.
The Pledge of Allegiance was led by Mr. Rusty Wilder.
The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Joe Bishop, President, who welcomed all present and then stated that the Police Jury was ready for the transaction of business.
The President asked if there was any public comment on any agenda item, to which there was no response.
On motion by Mr. Sean McGlothlin, seconded by Mr. Ollie Overton to approve and award contract to Sam’s A/C, for exigent Coliseum HVAC pipe SPECIAL SESSION NOVEMBER 28, 2023
repairs discovered during current roofing project. Discussion ensued.
Mr. Tommy David with Pan American Engineers stated the repairs were necessary to prevent any further damage. He said the repairs would qualify as exigent repairs under the Federal Procurement laws. His major concern would be a pipe breaking during a show that is currently scheduled. He has spoken with the current contractor at the Coliseum and received a quote of $110,000.00 from Sam’s A/C to complete the repairs.
On amended motion by Mr. Sean McGlothlin, seconded by Mr. Craig Smith to award the pipe repair project at the Coliseum to Sam’s A/C, co st not to exceed $110,000.00. On vote the amended motion carried.
On motion by Mr. Jay Scott, seconded by Mr. Craig Smith to set a date to call a special election for the vacancy of Police Juror District D per the instructions of the Louisiana Secretary of State. Discussion ensued.
Mr. Greg Jones, Legal Counsel, stated it was too late to call for an election on in the Spring of 2024 and the election for District D would need to placed on the ballot for the primary election to be held on November 5, 2024 or the general election to be held on December 7, 2024.
Mr. Bishop asked if a recommendation to appoint or nominate someone for the vacancy could be done at this meeting. Mr. Jones replied yes and asked if there were any nominations.
On motion by Mr. Ollie Overton, seconded by Mr. Sean McGlothlin to nominate Mr. Ernest Nelson, resident of District D, to fill the vacancy of the late Mr. Theodore Fountaine, III.
On motion by Mr. Jay Scott to nominate Reverend Randy Harris, resident of District D, to fill the vacancy of the late Theodore Fountaine, III . Motion failed for lack of second.
There being no other nominations, motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton to close nominations.
On motion by Mr. Ollie Overton, seconded by Mr. Joe Bishop, the following resolution was presented and adopted:
RESOLUTION
APPOINTMENT TO FILL THE VACANCY IN THE
OFFICE OF POLICE JUROR, DISTRICT D
PARISH OF RAPIDES
WHEREAS, on November 13, 2023, the honorable THEODORE FOUNTAINE, III, duly elected Police Juror for Rapides Parish, District I, whose term of offic e will begin on January 1, 2024 for a term of four (4) years, passed away in Alexandria, Louisiana, creating a vacancy in the office of the Police Juror for District D of Rapides Parish, and the Louisiana Secretary of State notified the Police Jury th at said vacancy must be filled by appointment on or before December 4, 2023, and a SPECIAL SESSION NOVEMBER 28, 2023
special election shall be set to fill the unexpired term;
WHEREAS, the Rapides Parish Police Jury at a duly noticed and posted Special Meeting held on November 28, 2023, with a legal quorum present, have appoin ted Ernest Nelson, to fill the vacancy pending the special election to fill the unexpired term, pursuant to LSA-R.S. 18:602; and
WHEREAS, the death of Police Juror Theodore Fountaine, III, has caused a vacancy in his elected office as Police Juror for District D of Rapides Parish, and pursuant to LSA-R.S. 18:602, an election must be ordered and called to fill the unexpired term of office which exceeds 18 months; and
NOW THEREFORE, BE IT HEREBY PROCLAIMED that the Rapides Parish Police Jury does hereby appoint Ernest Nelson to fill the vacancy and serve as the interim Police Juror for District D of Rapides parish, State of Louisiana, until a special election is had as required by LSA-R.S. 18:02.
FURTHER RESOLVED that certified copies of this Resolution shall be sent to the Louisiana Secretary of State;
The Resolution introduced at a properly posted and held Special Meeting, after a proper motion, and second, and received majority vote of approval on the 28th day of November, 2023.
Roll call was as follows: YEAS: O liver “Ollie” Overton, Craig Smith, Rusty Wilder, David Johnson, Jay Scott, Davron “Bubba” Moreau, and Joe Bishop. NAYS: Sean McGlothlin ABSTAINED: n one ABSENT: none On roll call vote the motion carried at 2:08 p.m.
On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton to ratify the lifting of the Burn Ban on November 16, 2023.
On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton there being no further business, the meeting was adjourned at 2:10 p.m.
