Minutes

The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, OCTOBER 10, 2022, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Craig Smith, President, Oliver “Ollie” Overton, Jr., Vice President and Police Jurors: Joe Bishop, Davron “Bubba” Moreau, Theodore Fountaine, III, Rusty Wilder, Sean McGlothlin, David Johnson and Jay Scott.

Also present were Theresa Pacholik, Secretary/Treasurer; Shane Trapp, Courthouse Building Superintendent; Donna Andries, Sales and Use Tax Administrator; Cory Ashmore, Public Works Director; Linda Sanders, Civil Service Director; Angie Branton, 911 Communications and OEP Director; Dr. Jonathan Hunter, Coroner – Rapides Parish; Greg Jones, Legal Counsel; Chief Joseph Glorioso and Chief David Corley.

The invocation was given by Mr. David Johnson.

The Pledge of Allegiance was led by Mr. Joe Bishop.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any public comment on any agenda item, to which there was no response.

The first item on the agenda Mr. Craig Smith presented the family of former Rapides Parish Police Juror Eugene Arnold “Tunk” Andries, Jr. a Memoriam plaque for his dedicated service as stated below:

IN MEMORIAM

WHEREAS, Mr. Eugene Arnold “Tunk” Andries, Jr. was called by his Creator on Tuesday, May 3, 2022; and WHEREAS, Mr. Andries was a native and lifetime resident of Rapides Parish, and a lifelong parishioner of St. Margaret’s Catholic Church and St. Rita Catholic Church; and WHEREAS, Mr. Andries is preceded in death by his wife, Nanette Andries of 59 years and daughter, Kathy Andries Holt; and leaves behind his children Sandra Thiels, Robbie Andries, Dale Andries, and a numerus amount of grandchildren and great-grandchildren; and WHEREAS, Mr. Andries was a lifetime farmer and cattleman on Bayou Rapides where he shared his love of livestock and arming with his children and countless 4-H children in Rapides Parish; and WHEREAS, Mr. Andries was the last surviving charter member of the Rapides Fair Association and he served as president on numerous committees; and REGULAR MEETING OCTOBER 10, 2022

WHEREAS, Mr. Andries served on the Rapides Parish Police Jury for two

• (2) terms and was instrumental in the passing of a tax for the construction of the Rapides Parish Coliseum and served as Justice of the Peace for Ward 8; and WHEREAS , Mr. Andries served on the board of the Rapides Island Water Association and helped bring a water system to the Bayou Rapides community; and WHEREAS, Mr. Andries helped to form the Dixie Your Baseball League and build Cruikshank Park for children of the community; and WHEREAS, Mr. Andries was a member of the LA Prison Enterprise Board, LA and Rapides Cattleman Association, and McNutt Gin Board of Directors; and WHEREAS, Mr. Andries built Kincaid Boat Landing and Grocery which he operated with his wife for many years and constructed the Tunk’s Cypress Inn Restaurant on Kincaid Lake; and WHEREAS, the Rapides Parish Police Jury does hereby recognize Mr. Eugene Arnold “Tunk” Andries, Jr. for his dedication and hard work in serving the citizens of Rapides Parish; and NOW, THEREFORE, BE IT RESOLVED, that the Rapides Parish Police Jury does hereby order that this formal expression of honor for the late Mr. Eugene Arnold “Tunk” Andries, Jr. and sympathy for his family be spread upon the minutes of this meeting.

Mr. Roy Provost, Director of La Forensics, gave a presentation to the Jury and those in attendance on the status of backlog of autopsies and lack of forensic pathologists in Louisiana. Mr. Provost stated an additional forensic pathologist was being hired and one (1) Locum Tenens Pathologist was secured. As a result, fees for autopsies will increase effective October 15, 2022. Mr. Joe Bishop inquired on the effect this will have on the billing to various municipalities. Dr. Jonathan Hunter, Rapides Parish Coroner, stated a formal letter will be sent out to all municipalities so they may amend their budgets accordingly. Dr. Hunter stated he will make sure they are fiscally responsible and only request the necessary test for each case.

Mr. Dustin Hinds, Enterprise Fleet Management provided an update to the Jury on leased vehicles for Juvenile Probation, Public Works Department and current status of the industry.

Sheriff Mark Wood spoke to the Jury on the dangers of the drug Kratom and he appreciated the Jury’s quick action to get ahead of the issues it will impose on our communities.

OFFENSES-MISCELLANEOUS; SECTION 71 – PROHIBITING THE SALE OF MITRAGYNA SPECIOSA KORTH (KRATOM) IN RAPIDES PARISH

Chapter 19 – OFFENSES – Miscellaneous

Section 71 - Prohibiting the Sale of Mitragyna Speciosa Korth (Kratom)

WHEREAS, Kratom is an herbal extract that comes from the leaves of an evergreen tree (Mitragyna speciosa) grown in Southeast Asia. Although people who take kratom believe in its value, researchers who have studied kratom think its side effects and safety problems more than offset any potential benefits; and

WHEREAS, Kratom has been reported to cause abnormal brain function when taken with prescription medicine. The effects of Kratom become stronger as the quantity taken increases and is known to cause death. Kratom is not currently regulated in the United States, and federal agencies are taking action to combat false claims about kratom; and studies on the effects of kratom have identified many safety concerns and no clear benefits.

WHEREAS, the Rapides Parish Police Jury does hereby declare that the use of Mitragyna Speciosa Korth (Kratom) is a serious problem affecting the health and welfare of all citizens. The Rapides Parish Police Jury does further declare and determine that all reasonable steps should be taken to prohibit the sale of Mitragyna Speciosa Korth (Kratom) in Rapides Parish; and

WHEREAS, the Rapides Parish Police Jury hereby deems it necessary and proper for good government, order and protection of persons and property, and for the preservation of public health, safety and welfare of the Parish and its inhabitants; and

NOW, THEREFORE:

BE IT ORDAINED, by the Rapides Parish Police Jury of the Parish of Rapides, State of Louisiana in regular session convened, as follows: to wit:

Section 1. It shall be illegal for any person, vendor, seller or retailer licensed to do business in Rapides Parish to sell Mitragyna Speciosa Korth (Kratom). in the Parish of Rapides.

Section 2. Penalties.

• (1) Whoever violates the provisions of this section shall be fined not more than five hundred dollars ($500.00) or imprisoned for not more than six (6) months, or both.

• (2) Whoever violates the provisions of this section for a second offense shall be fine one thousand dollars ($1,000.00) or imprisoned for not more than six
• (6) months, or both.
• (3) Whoever violates the provisions of this section for a third or subsequent offense shall be fine one thousand five hundred dollars ($1,500.00) or imprisoned for not more than six (6) months, or both. However, if the offender is a vendor, seller or retailer licensed to do business in Rapides Parish it shall forfeit and/or have all business licensed revoked by the Parish in addition to the above-stated penalties.

This Ordinance shall become effective immediately upon approval and adoption by the Rapides Parish Police Jury.

WHEREAS, the Rapides Parish Police Jury hereby deems it necessary and proper for good government, order and protection of persons and property, and for the preservation of public health, safety and welfare of the Parish and its inhabitants; and

WHEREAS, the Rapides Parish Police Jury have concluded that to protect the health, welfare, and safety of the citizens of the Parish of Rapides, State of Louisiana, the possession of Kratom should be incorporated as a municipal misdemeanor crime within the Parish of Rapides.

NOW, THEREFORE, BE IT ORDAINED, by the Rapides Parish Police Jury of the Parish of Rapides, State of Louisiana in regular session convened, as follows: to wit:

Section 1. It shall be illegal for any person to possess Mitragyna Speciosa Korth (Kratom) in the Parish of Rapides.

Section 2. Penalties.

• (1) On a first conviction, wherein the offender possesses Kratom in violation of the provisions of Section 1 shall be fined not more than five hundred dollars ($500.00) or imprisoned for not more than six (6) months, or both.
• (2) On a second conviction, wherein the offender possesses Kratom in violation of the provisions of Section 1 shall be fined one thousand dollars ($1,000.00) or imprisoned for not more than six (6) months, or both.
• (3) On a third or subsequent offense conviction, wherein the offender possesses Kratom in violation of the provisions of Section 1 shall be fined one thousand, five hundred dollars ($1,500.00) or imprisoned for not more than six (6) months, or both.

Section 3. If any provision or item of this Ordinance or the application thereof is held to be invalid, such invalidity shall not affect other provisions, items, or applications of this Ordinance which can be given effect without the invalid provisions, items or application, and to this end the provisions or items of this Ordinance are hereby declared severable.

This Ordinance shall become effective immediately upon approval and adoption by the Rapides Parish Police Jury.

WHEREAS, the Bids have been checked and tabulated by Pan American Engineers, LLC, with a recommendation of awards for the following contracts:

NOW, THEREFORE BE IT RESOLVED, that the above contracts are hereby awarded for Mowing Services Annual Contract (2022 Procurement #2) (RFP No. 3061).

BE IT FURTHER RESOLVED, that the President is hereby authorized to execute contracts and change orders between the Rapides Parish Police Jury and the successful Bidders.

On motion by Mr. Ollie Overton, seconded by Mr. David Johnson to accept a Volunteer Fire Assistance Grant administered by Louisiana Department of Agriculture and Forestry for $5,228.00 for Rapides Parish Fire District No 16. The purpose of the U.S. Forest Service Grant is to assist rural fire departments in their building of firefighter capacities. On vote the motion carried.

AND WHEREAS, the Bayou Darrow and Bayou Rigolette Flow Control Structures have been determined to be acceptable by the USACE, the LADOTD, RRABB, the 19th Louisiana Levee District and the Engineers and the project has been found to be substantially complete;

THEREFORE, BE IT RESOLVED, by the Rapides Parish Police Jury, that the project be considered Substantially Complete in accordance with the stipulations of the project contract,

SUBMIT AN APPLICATION FOR THE STATE OF LOUISIANA

DEVELOPMENT LOCAL GOVERNMENT ASSISTANCE

PROGRAM

WHEREAS, the Rapides Parish Police Jury has been informed that the State of Louisiana, Division of Administration, Office of Community Development will be accepting applications for FY 2022/2023 Local Government Assistance Program (LGAP);

NOW THEREFORE BE IT RESOLVED, that the Parish President is hereby authorized to submit an LGAP Application for the purchase of a skid steer with mower and various attachments, up to $100,000 and to execute all assurances and certifications required for the application; and,

BE IT FURTHER RESOLVED, that the Parish President is hereby authorized to work with Pan American Engineers, LLC on the development of the LGAP Application.

The purpose of the U.S. Forest Service Grant is to assist rural fire departments in their building of firefighter capacities. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. David Johnson to enter into an Intergovernmental/Cooperative Agreement with Rapides Parish School Board for the engineering, design, and construction of a traffic stacking lane for safety purposes to circumvent unsafe traffic on Shreveport Hwy as it relates to Mary Goff Elementary and authorize the Parish President to sign any necessary documents. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Sean McGlothlin to enter into a Cooperative Endeavor Agreement between the State of Louisiana-Disaster Supplemental Nutrition (DSNAP) and the Rapides Parish Police Jury for use to administer disaster related DSNAP benefits at the Rapides Parish Coliseum and authorize the President to sign any necessary documents. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton to enter into a master Cooperative Endeavor Agreement with the City of Pineville for joint work projects serving a joint public purpose for the benefit of the Parish and the Municipality. On vote the motion carried.

On motion by Mr. Jay Scott, seconded by Mr. David Johnson authorizing the Parish President to issue a burn ban for Rapides Parish, to cease and desist all private burning due to extremely dry conditions. (Private burning shall only be allowed by permission of the local fire dept or local government). This ban is effective, October 3, 2022 thru November 14, 2022. On vote the motion carried.

WHEREAS, Mr. Smith is currently serving his third term as Police Juror of the Rapides Parish Police Jury representing District C, which includes all of Ward 11 and parts of 9 and 10; and

WHEREAS, Mr. Smith is a member of the National Association of County Officials, where he currently serves on the Community, Economic and Workforce Development Steering Committee and Rural Action Caucus Committee; and

NOW, THEREFORE BE IT RESOLVED, that the Rapides Parish Police Jury does hereby go on record to endorse and support Mr. Craig Smith, in his candidacy as 3rd Vice-President of the Police Jury Association of Louisiana.

Resolution authorizing the filing of an application with the Louisiana Department of Transportation and Development for a grant under any of the following FTA programs managed through Louisiana Department of Transportation an d Development.

WHEREAS, the Secretary of Transportation and Development is autho rized to make grants for mass transportation projects;

WHEREAS, the contract for financial assistance will impose certain o bligations upon the applicant, including the provisions by it of the local share of project costs;

WHEREAS, it is required by the Louisiana Department of Transportatio n and Development in accord with the provisions of Title VI of the Civ il Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and

WHEREAS, it is the goal of the Applicant that minority bu siness enterprise be utilized to the fullest extent possible in connection wi th this project, and that definitive procedures shall be established and administered to e nsure that minority businesses shall have the maximum feasible opportunity to comp ete for contracts when procuring construction contracts, supplies, equipment, or consultant and other services:

WHEREAS, the District Attorney for the Rapides Parish Police Jury , and particularly Assistant D.A., Gregory L. Jones have provided legal representation to the Rapides Parish Police Jury; and

WHEREAS, a Civil Rights Federal Court complaint has been filed in Civil Action No. 1:22- cv-02105; U.S. D.C. Western Division of Louisiana, against the Rapides Parish Police Jury; and

WHEREAS, Gregory L. Jones is in need of the expertise of The Kei ser Law Firm and attorney Randall B. Keiser in the area of Federal Civil Rights Liti gation in Federal Court; and

WHEREAS, Randall B. Keiser, Keiser Law Firm PLC, of Alexandria, Louisiana, has represented the Rapides Parish Jury in previous legal matters in Federal Court and the employment of private counsel will greatly a ssist the Police Jury in the defense of this Federal Complaint.

NOW, THEREFORE, BE IT RESOLVED that a real necessity exists for the employment of outside counsel and that Randall B. Keiser, Keiser Law Firm, PLC, be hereby retained as co-counsel for the Rapides Parish Police Jury; at the compensation schedule published and approved by the atto rney general not to exceed $225.00 per hour together with incurred expenses for court cost advances, subpoena and deposition fees, and other like out- of-pocket expenditures, subject however to the approval of the Louisiana Attorney General pursu ant to R.S. 42:263; and REGULAR MEETING OCTOBER 10, 2022
