The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Cou rthouse, 701 Murray Street, Alexandria, Louisiana, on Monday, April 8, 2024, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Joseph “Joe” Bishop , President and Police Jurors: Davron “Bubba” Moreau, Craig Smith , Ernest Nelson, Danny Bordelon, Oliver “Ollie” Overton, Jr., Sean McGlothlin and Parrish Giles.

Absent: Jay Scott

Also present were: Ms. Theresa Pacholik, Secretary/Treasurer; Mr. Shane Trapp , Courthouse Building Superintendent; Mr. Ryan Elkins, Public Work s Highway Superintendent; Ms. Angie Branton, 911 Communications & OHSEP Director; Ms. Sandy Bonnette, Registrar of Voters; Chief Jody Glorioso, FD#2; Mr. Wesley Miller and Mr. Rhett Desselle, Pan American Engineers; Mr. Matt Johns, RAPC Executive Director; Ms. Marla West, Purchasing Agent; and Greg Jones, Legal Counsel.

The invocation was given by Mr. Ollie Overton.

The Pledge of Allegiance was led by Mr. Craig Smith.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly con vened as the governing authority of said Parish by Hon. Joe Bishop, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

Mr. Rick Reno was unable to attend the meeting.

On motion by Mr. Craig Smith, seconded by Mr. Bubba Moreau to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on March 1 1, 2024 as published in the Official Journal. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton that approved bills be paid. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Sean McGlothli n to rescind a certain motion to purchase two (2) vehicles for Rapides Parish Fire District No. 2 passed on September 18, 2023, as recommended by the Fire Chief and Purch asing Agent. The vehicles were ordered incorrectly by the vendor and the correct ones are no longer available. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Ernest Nelson to authorize the participation in an upcoming auction, date to be determined, as re quested by the Purchasing Agent and various departments. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith to de lete from the Rapides Parish Sales & Use Tax Asset/Inventory program the equipment l isted below as it is no longer suitable for public use. On motion by Mr. Bubba Moreau, seconded by Mr. Parrish Giles to delete from the Ward Nine Recreation Park Asset/Inventory the following equipmen t. This equipment will be used as a trade-in to purchase a new tracto r/lawnmower from Louisiana State Contract No. 4400026020 as requested by Park D irector, approved by Legal Counsel and pending approval from the Recreation Board. On motion by Mr. Ollie Overton, seconded by Mr. Ernest Nelson to authorize an amendment to the concession agreement between the Rapides Parish Police Jury and the Louisiana Workforce Commission – Randolph Sheppard Management – Office of Rehabilitation Services and authorize the Parish President all nece ssary documents. On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith to t ransfer the responsibility of one (1) Enterprise Fleet Management Leased 2022 Chevrolet Malibu from 9th JDC Juvenile Probation to the Rapides Parish Sales Tax Office, as recommended by the Chief Judge and Sales Tax Administrator. On motion by Mr. Craig Smith, seconded by Mr. Bubba Moreau to exten d parish maintenance on A.B. Porter Road, Ward 11, District C, one tenth (.10) of a mile, as recommended by the Public Works Department and Legal Counsel . On vote the motion carried.

On motion by Mr. Parrish Giles, seconded by Mr. Bubba Moreau to approve striping on McNary Cutoff (West Cady) and Melder Cutoff, within the village limits of McNary, cost not to exceed $6,500.00, to be paid out of Road Dis trict 1A, District

On motion by Mr. Craig Smith, seconded by Mr. Ernest Nelson to authorize Fire District No. 4 – Holiday Village VFD to submit a grant application to Fire house Subs Public Safety Foundation and authorize the Parish President and Fire Chief to sign all necessary documents, as recommended by the Fire Chief. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith to ra tify authorization for Fire District No.18 to submit an applicati on to the Assistance to Firefighters Grants (AFG) Program, thru FEMA GO, for a tanker truck, cascade system and turnout gear/extractor, with matching funds to be paid from Fire District No. 18 budget and authorize the Fire Chief and Parish President to sign all necessary documents. On vote the motion carried.

On motion by Mr. Parrish Giles, seconded by Mr. Ernest Nelson the following resolution was unanimously adopted:

RESOLUTION

BY THE

WHEREAS, the Rapides Parish Police Jury requires professional services to update the Master Plan, Airport Layout Plan (ALP) & Exhibit "A" Airpo rt Property Inventory Map at the Esler Regional Airport; and,

WHEREAS, the projected cost for this project is anticipated not to exceed $560,001; and,

WHEREAS, 100% of funding for this project is provided throu gh grants by the Federal Aviation Administration and the State of Louisiana Aviation Trust Fund.

NOW, THEREFORE, BE IT RESOLVED, that the Rapides Parish Police Jury hereby authorizes the President to accept the grants, execute grant ag reements and amendments as may be necessary, and furnish such additional informat ion as may reasonably be required in connection with the grants for said project.

On motion by Mr. Ollie Overton, seconded by Mr. Ernest Nelson to authorize the President to sign a contract between the Rapides Parish Police Jury an d the Department of Public Safety and Corrections/Office of Juvenile Justice to allow the Ninth Judicial District Court to continue to participate in the Title IV-E Federal REGULAR MEETING APRIL 8, 2024

Foster Care Reimbursement Program, CFDA Number 93.658, for the period of July 1, 2023 through June 30, 2026. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Ollie Overton to authorize the remodeling of the Police Jury Administrative entrance to create secu re entrances with lobby seating for patrons, to be in conformity with the other public agencies located within the Rapides Parish Courthouse. On vote the motion carried.

On motion by Mr. Parrish Giles, seconded by Mr. Ernest Nelson to enter into an agreement with the University of Louisiana at Monroe (ULM) for th e Louisiana State Mesonet Project and authorize the Parish President to sign al l necessary paperwork, pending legal counsel approval. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Sean McGlothlin to appoint Mr. Danny Bordelon to the Rapides Area Planning Commission Board for a four (4) year term, term will expire January 10, 2028. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Parrish Giles to appoint Mr. Ollie Overton to the Transportation Policy Committee for a four (4) year t erm, term will expire January 10, 2028. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Ernest Nelson the following proclamation was unanimously adopted:

PROCLAMATION

WHEREAS, the week of May 5-11, 2024, has been designated as Pub lic Service Recognition Week, to honor employees of the Federal Government and Stat e and Local governments; and

WHEREAS, ‘‘Public Service Recognition Week’’ provides an opportunity t o recognize and promote the important contributions of public servants and honor the diverse men and women who meet the needs of the United States th rough work at all levels of government; and

WHEREAS, millions of individuals work in government service, i n every State, county, and city across the United States and in hundreds of cities abroad; and

WHEREAS, public service is a noble calling involving a variety of challenging and rewarding professions; and

WHEREAS, the ability of the Federal Government and State and local governments to be responsive, innovative, and effective depends on outstandin g performance of dedicated public servants; and

WHEREAS, public servants have much to offer, as demonstrated by their expertise and innovative ideas, and serve as examples by passing on inst itutional knowledge to train the next generation of public servants; and

WHEREAS, amid the COVID–19 pandemic, federal workers continue to serve on the frontlines to keep our country running; and

REGULAR MEETING

APRIL 8, 2024

WHEREAS, the commitment and perseverance of public servants during the pandemic have allowed essential services to continue, mitig ated the disruption to Americans’ daily lives, and played a critical role in protecting pub lic health and safety; and

WHEREAS, the week of May 5- 11, 2024, marks the 40th anniversary of ‘‘Public Service Recognition Week’’.

NOW, THEREFORE, be it resolved, that the Rapides Parish Police Jury supports the designation of ‘‘Public Service Recognition Week’’;

• (27) hours per week, hourly rate of $14.00 per hour. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Sean McGlothlin to approve a twopercent (2%) hourly rate increase effective March 24, 2024 for the active par t-time Maintenance Technicians for the Courthouse Maintenance Department and approve an annual two-percent (2%) increase on their anniversary date begin ning in 2025. On motion by Mr. Parrish Giles, seconded by Mr. Bubba Moreau to enter into a Joint Use Agreement between the Rapides Fire District No. 5, Oak Hill Volunteer Fire Department and the Louisiana Department of Agriculture and Fore stry, under the Federal Excess Personal Property Program for the use of a MPRV 2004 International Rescue Truck, VIN No. 1HTMMAAL25H147775, for the purpose of Resc ue and Services, as requested by the Oak Hill Volunteer Fire Department and authorize the President to sign any necessary documents. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Sean McGlothlin to waiv e the insurance requirements for sewer effluent discharge permit at 112 Carly on Lane, Alexandria, LA, for Mr. Clifford Cassa, as requested by the Rapides Area Planning Commission and approved by the Public Works Director and the Rap ides Parish Health Department. On motion by Mr. Bubba Moreau, seconded by Mr. Ernest Nelson the following resolution was unanimously adopted:

TERMINATION of STATE OF EMERGENCY REGULAR MEETING APRIL 8, 2024

RAPIDES PARISH

WHEREAS, on August 14, 2023 the Parish of Rapides issued State of Emergency due to Extreme Heat related Emergencies resulting in ex cessive heat indices in the 100’s as well as extreme drought that resulted in numerous wildfires; and

WHEREAS, the Louisiana Homeland Security and Emergency Assistance and Disaster Act, La. R.S. 29:727, et seq., confers upon the Parish President emergency powers to deal with emergencies and disasters, including those caused by fire, flood, earthquake, or other natural or man-made causes, in order t o ensure that preparations of the Parish will be adequate to deal with su ch emergencies or disasters and to preserve the lives and property of the people of Rapides parish; and

WHEREAS, when the President determines that a disaster or emergency has occurred, or the threat thereof is imminent, La. R.S. 29; 727(D) empower s the President to declare a state of emergency by executive order or proclamatio n, or both; and

WHEREAS, when the President determines that the threat of danger has been dealt with to the extent that emergency conditions no longer exists, the state of emergency may be terminated by executive order or proclamation; and

WHEREAS, there is no longer a need to continue certain specific emergency orders.

NOW THEREFORE, I, Joe Bishop, President of the Rapides Parish Police Jury by authority vested in me by the Parish Charter and the Louisiana Disaster Act of 1993, did hereby terminate the Emergency Declaration made August 14, 2023, in December, 2023 when there were no longer drought conditions.

The following ordinance was offered by Mr. Parrish Giles, seconded by Mr. Bubba Moreau: ORDINANCE REGULAR MEETING APRIL 8, 2024

An ordinance creating Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana; and providing for other matters in connection therewith.

WHEREAS, Section 338.54 of Title 47 of the Louisiana Revised Statutes of 1950, as amended, authorizes the Police Jury of the Parish of Rapide s, State of Louisiana (the "Police Jury"), to create a sales tax district wit hin the Parish of Rapides, State of Louisiana (the "Parish"); and

WHEREAS, it is now the desire of the Police Jury to create a sales tax district in the Parish containing all of the territory described in Section 1 of this Ordinance, all for the purpose of submitting to the electorate of said sales tax district the question of the imposition of a sales and use tax in said sales tax d istrict in the manner provided by the aforesaid statutory provision and Article VI, Section 30 of the Constitution of the State of Louisiana of 1974;

NOW, THEREFORE, BE IT ORDAINED by the Police Jury, acting as t he governing authority of the Parish, that:

SECTION 1. In accordance with the provisions of Section 338.54 of Title 47 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority supplemental thereto, there is hereby created a sales tax district in the Parish, which sales tax district shall comprise all t he territory within the boundaries of Road District No. 5A of the Parish of Rapides, State of Louisiana, as such boundaries presently exist.

SECTION 2. The sales tax district hereby created shall be k nown and designated as "Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana" (the "District"); and the seal of the Parish is hereby adopted a s the seal of the District. The governing authority of the Dis trict shall be the Police Jury, the domicile shall be the regular meeting place of the Police J ury and the officers of the Police Jury shall be the officers of the District.

SECTION 3. The District shall have all powers granted to it under Louisiana law, including the power to levy a sales and use tax in accord ance with Section 338.54 of Title 47 of the Louisiana Revised Statutes of 1950, as amended, and Article VI, Section 30 of the Constitution of the State of Loui siana of 1974, and to fund the proceeds thereof into bonds for the purposes for which the sales and use tax is authorized to be used.

SECTION 4. In case any one or more of the provisions of this ordinance shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any other provisions of this ordinance, but the same shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provisions enacted after the date of this ordinance which validate or make legal any provisions thereof shall be deemed to apply hereto.

WHEREAS, the Rapides Parish Police Jury has been informed that th e U.S. Department of Energy, Office of State and Community Energy Programs wi ll be accepting applications for Energy Efficiency and Conservation Bloc k Grant (EECBG) Program;

NOW THEREFORE BE IT RESOLVED, that the President is hereby authorized to submit an Application for conversion to LED l ight fixtures and other energy efficiency improvements at Parish facilities to reduce the Pari sh’s total energy usage and to improve the energy efficiency of Parish facilities and to execute all assurances and certifications required for the application; and,

BE IT FURTHER RESOLVED, that the President is hereby authorized to work with the Parish Engineer, Pan American Engineers, LLC, on the development of the EECDG Application; and,

On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton to ad opt a resolution to designate the Rapides Senior Citizen Centers, Inc., to be the contractor to prepare a grant with the Louisiana Department of Transportation and Development for FY 2024-2025 Operational Grant, CFDA No. 20.509, State Project No. RU 18-40-25, operational funding to provide rural transportation services in rural parts of Rapides Parish and authorize the President to sign any necessary documents. On motion by Mr. Parrish Giles, seconded by Mr. Craig Smith to autho rize reimbursement to the Town of Woodworth for reconstruction work on Megan Lane,to be paid out of Road District 2C, District H Maintenan ce Funds, reimbursement not to exceed $10,000.00. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Parrish Giles to approve hourly rate increases for certification pay for Fire District #5 firefighters based on the following tiers, to be paid for the highest five (5) certification s they obtain as recommended by the Fire Chief:

Tier 1 - $0.07 per hour - EMR, Hazmat Awareness, Fire Instructor I, Public Fire Educator I, ADO Mobile Water Supply

Tier 2- $0.10 per hour - EMT-B, Hazmat Operations, Firefighter I, Inspector I, Fire Instructor II, Fire Officer I, ADO-Pumper

Tier 3- $0.14 per hour - EMT-P, Hazmat Technician, Hazmat ICS, Firefighter II, Inspector II, Fire Instructor III, Fire Investigator, Public Fire Educator II, Fire Officer II, Fire Officer III, Safety Officer On vote the motion carried.

On motion by Mr. Parrish Giles, seconded by Mr. Bubba Moreau to author ize the Rapides Parish Public Works Department, to provide labor and equ ipment, to perform fifty (50) hours of ditching and fifty (50) hours of pot hole patching on various roads under the annual intergovernmental agreement, as requ ested by the REGULAR MEETING APRIL 8, 2024

Town of Glenmora, to be paid out of the Town’s portion of Ro ad District 1A Maintenance Funds. On vote the motion carried.

On motion by Mr. Danny Bordelon, seconded by Mr. Craig Smith to approve an $1.00 per hour rate increase for part-time employees at Cotile Recreation Park. On vote the motion carried.

On motion by Mr. Danny Bordelon, seconded by Mr. Craig Smith to adopt an ordinance to amend and reenact Sec. 19 ½ - 2 – Cotile Lake and Recreation Area – Fees (a) (1) Regular admission (gate fee): Citizens sixty (60) years of ag e or over may enter for the purpose of fishing within the recreation area without $3.00 charge;

• (2) Boat Launching: Citizens over sixty (60) years of age may launch boats without $3.00 charge, to be effective March 1, 2024. Discussion ensued.

Ms. Pauline Amend, resident in Cotile area questioned the Jury on the cost to enter the gate if she wanted to just drive thru the park. Mr. Bishop stated she would have to pay the fee to drive thru.

RESOLUTION

FOR

RECOMMENDATION TO THE LOUISIANA DEPARTMENT OF

WILDLIFE AND FISHERIES

WHEREAS, the Saline-Larto Complex is a large natural backwater complex located in east-central Louisiana with the watershed of approximately 90,880 acres; and WHEREAS, the Saline-Larto Complex is located in Catahoula, LaSalle, Avoyelles and Rapides Parish; and WHEREAS, the Saline-Larto Complex is used by residentials an d nonresidentials for recreational fishing, commercial fishing, recreational watersports, scuba diving, swimming, hunting and irrigation; and WHEREAS, the Saline-Larto Complex, Crappie fish population has declined in the last couple years; and WHEREAS, the Rapides Parish Police Jury urges the Louisiana Depart ment of Wildlife and Fisheries to change the Crappie fish limit of fifty (50) fish per day to a limit of twenty-five (25) fish per day to help population f or the Saline-Larto Complex; and WHEREAS, the Rapides Parish Police Jury urges the Louisiana Depart ment of Wildlife and Fisheries to change the size limit of Crappie fish from no size limit to a ten (10) inch size limit to help the growth and pop ulation for the Saline-Larto Complex. NOW THEREFORE BE IT RESOLVED, the Rapides Parish Police Jury respectfully request that Catahoula, LaSalle and Avoyelles Parish t o support the change of daily limit and size restrictions on Crappie fish in the Saline-Larto Complex; and NOW THEREFORE BE IT RESOLVED, the Rapides Parish Police Jury respectfully request that the Louisiana Wildlife and Fisheries t o consider changing the daily limit and size restrictions on Crappie fish in the Saline-Larto Complex. FURTHER BE IT RESOLVED, that copies of this resolution be forwarded to Catahoula, LaSalle and Avoyelles Parish, for their support and adopt a resolution by their Jury. THUS DONE AND ADOPTED on this 8th day of April, 2024.

On motion by Mr. Craig Smith, seconded by Mr. Danny Bordelon to approve cutting dead trees in a parish right of way as a result of drought co nditions, bugs and/or lightning strikes and obtain landowner’s written permission to leave on premises, to be paid out of Public Works Fund. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Bubba Moreau to purchase one (1) broom/sweeper attachment for skid steer, not to exceed $10,000.00, to be paid from Public Works Fund. Discussion ensued.
