The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 70 1 Murray Street, Alexandria, Louisiana, on Monday, October 9, 2023, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Joseph “Joe” Bishop, President, Sean McGlothlin, Vice President and Police Jurors: Davron “Bubba” Moreau, Craig Smith, Rusty Wilder, Oliver “Ollie” Overton, Jr., David Johnson and Jay Scott.

Absent: Theodore Fountaine, III

Also present were: Ms. Theresa Pacholik, Secretary/Treasurer; Mr. Cory Ashmore, Public Works Director; Mr. Shane Trapp, Building Superintendent; Ms. Betty Joe Bourgeois, Sales & Use Tax Administrator; Ms. Angie Branton, 911 & OEP Director; Ms. Linda Sanders, Civil Service Director; Marla West, Purchasing Agent; Judge Greg Beard; Mr. Wesley Miller, Pan American Engineer; and Mr. Greg Jones, Legal Counsel.

The invocation was given by Mr. David Johnson.

The Pledge of Allegiance was led by Mr. Rusty Wilder.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened a s the governing authority of said Parish by Hon. Joe Bishop, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

President Joe Bishop asked if there were any public comments on any agenda items, to which there was no response.

President Joe Bishop asked if there were any juror comments . President Bishop reminded everyone to vote on Saturday, October 14th and wished all running for reelection the best of luck.

On motion by Mr. Ollie Overton, seconded by Mr. Rusty Wilder to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on September 18, 2023, as published in the Official Journal. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Jay Scott that approved bills be paid. On vote the motion carried.

On motion by Mr. Jay Scott, seconded by Mr. Rusty Wilder to discuss and take action to accept or deny the Industrial Tax Exemption Application No. 20230120-ITE Beaver Lake Renewable Energy, LLC. Discussion ensued.

Mr. Lafe Jones with Louisiana Central introduced Mr. Brian Moreau with Alliance Power to discuss the ITEP Application for Beaver Lake Renewable Energy. Mr. Moreau stated they are excited about establishing a facility in Central Louisiana a t the old International Paper site in Pineville, Louisiana. The construction will cost an estimated $1.9 billion and will bring in about one thousand one hundred and fifty jobs (1,150) during the construction phase. Once construction is complete, they are estimating about one hundred (100) permanent jobs and three hundred and ninety REGULAR MEETING OCTOBER 9, 2023

(390) indirect jobs. It is estimated for the project to be complete and operational by 2027.

On motion by Mr. Bubba Moreau, seconded by Mr. Sean McGlothlin to accept the Industrial Tax Exemption Application No. 20230120 -ITE Beaver Lake Renewable Energy, LLC. On vote the motion carried.

On motion by Mr. Jay Scott, seconded by Mr. Ollie Overton to waive the thirty

• (30) day announcement rule and reappoint Idell Norman to the Alexandria Central Economic Development District for a four (4) year term. New t erm will expire October 14, 2027. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Bubba Moreau to waive the thirty (30) day announcement rule and reappoint Mr. Daniel Lonsberry on the Rapides Fire District No. 4 Civil Service Board for a three (3) year term. New term will expire November 11, 2026. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. David the following ordinance was presented and unanimously adopted:

AUTHORIZING THE RAPIDES PARISH POLICE JURY

TO SELL

FOR THE

CONSIDERATION OF $1,666.67 CASH

WHEREAS, the City of Alexandria and/or the City of Pineville and/or Parish of Rapides owns property described as

said property having been adjudicated to either of afore mentioned Cities and/or the Parish for unpaid property taxes; and

WHEREAS, a request has been received from Roy Prenell, to purchase said property for the consideration of $1,666.67 (One Thousand Six Hundred Sixty -Six Dollars and Sixty-Seven Cents) cash, at the time of sale, said consideration representing the total of the statutory impositions, governmental liens, and costs of sale or two-thirds (2/3) of the appraised value of the property; and,

WHEREAS, this Jury is of the opinion that it would be in the public interest to convey the above -mentioned property to Roy Prenell, 710 Willow Glen Road,

NOW, THEREFORE, BE IT ORDAINED by the Rapides Parish Police Jury that: REGULAR MEETING OCTOBER 9, 2023

Section 1. A certain piece, parcel or tract of land together with all buildings and Improvements thereon situated and all rights, way and privileges thereon appertaining, being, lying and situated in Rapides Parish, Louisiana, and Lot Six (6), Square Four (4) Green Oak Subdivision, the City of Alexandria, records of Rapides Parish, Louisiana.

Rapides Parish, Louisiana, should be re-entered into the stream of commerce thereby serving the public interest.

Section 2. The acquiring person shall certify, in writing, to the Purchasing Department that he/she or his/her agent has searched for all names and last known addresses of all owners, mortgages, and any other person(s) who may have a vested or contingent interest in the property, or who have filed a request for notice as indicated in those records and has so examined:

• • the mortgage and conveyance records of Rapides Parish,
• • the current telephone book,
• • any other examination resources, including Internet search engines, if any, the records of the Louisiana Secretary of State and the Secretary of States se t forth by the names of identified entities

Section 3. The acquiring person shall submit the required notifications (R.S. 47:2206 A and B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. * Copies of the “green and white receipts” should be maintained by the purchaser as indicia of compliance with the notice requirements;

Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or otherwise challenge in a court of competent jurisdiction the potential sale or donation:

• (a) Sixty days from the date of the notice provided in this Subsection, if five years have elapsed from the filing of the tax sale certificate (formerly “process verbal”), or six months after the date of the notice provided for in this Subsection, if five years have not elapsed since the filing of the tax sale certificate (formerly “process verbal”);
• (b) The filing of the sale or donation transferring the property.
• (c) The written notice required by this Section shall be that which is included in R.S. 47: 2206 A. (2).

Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:

• (a) Sixty days, for property on which a tax sale certificate (formerly “process REGULAR MEETING OCTOBER 9, 2023

verbal”) was filed over five years previous of the first publication, or six mont h if the tax sale certificate (formerly “process verbal”) was filed less than five years before the first publication of the notice provided for in this Subsection.

• (b) The filing of the sale or donation transferring the property.
• (c) The publication required by this Section shall be that which is included in R.S. 47: 2206 B. (2).

Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the not ice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.

Section 7. At any time after the expiration of the sixty -day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney’s office has certified in writing to the President, that purchaser or donee has complied with the mandates of this Ordinance. The sale price shall be paid by cashier’s check or money order at the time of the sale.

NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.

NOTE: The City of Alexandria and/or the City of Pineville and/or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.

Section 8. The acquiring person shall be responsible for filing the sale or donation and payment of all filing fees.

Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.

• (a) All sales and donations shall be without warranty, either expressed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against exhibitory defects or vices and the warranty that the thing sole is reasonable fit for its ordinary purpose or the acquiring person’s intended or particular purpose.
• (b) These waivers or exclusions of warranties shall be self -operative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardless of whether they are brought to the attention of the acquiring person. This provision supersedes REGULAR MEETING OCTOBER 9, 2023

the requirements of any other law.

• (c) The writing constituting the sale shall be in the form as provided in R.S. 47: 2207 B. and the writing constituting the donation shall be that which is included in R.S. 47: 2207 C.

Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.

Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.

Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties w hose interest the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.

• (a) The affidavit may also contain a statement of the interest to which the purchaser or donee takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debtor, as mortgagors.
• (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47: 2208.
• (c) With respect to a sale, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
• (d) With respect to a donation, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all sta tutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
• (e) Upon filing of the affidavit, the recorder of mortgages or the recorder of conveyances shall treat as canceled, terminated, released, or erased, all those liens, privileges, mortgages or other encumbrances canceled, terminated, released or erased under subsections (c) or (d) of this Section, only insofar as they affect the property.
• (f) The owner filing the affidavit shall be liable to and indemnify the recorder of mortgages, the recorder of conveyances, and any other person relying on the cancellation, termination, release, or erasure by affidavit for any dames that they may suffer a s a consequence of such reliance if the recorded affidavit contains materially false or incorrect statements that cause the recorder to incorrectly cancel, REGULAR MEETING OCTOBER 9, 2023

terminate, release, or erase any interest listed in the affidavit. The recorder of mortgages and the recorder of conveyances shall not be liable for any damages resulting to any person or entity as a consequence of the cancellation, termination, release or erasure of any interest in compliance with this Section.

This equipment will be sold in a sealed bid process to the highest bidder with a minimum bid amount of $140,000.00 each as requested by the Fire Chief and the Ruby -Kolin Fire Department Board of Directors. On motion by Mr. Craig Smtih, seconded by Mr. Bubba Moreau to authorize to advertise, receive bids and award the purchase of a Fire Truck for Rapides Parish Fire District No. 6, cost not to exceed $530,000.00 and authorize to secure financing and allow the Parish President to sign all necessary documents as reques ted by the Fire Chief and Deville Volunteer Fire Department Board. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith to ratify authorization of the issuance of a letter of no objection and a pipeline/utility project permit for the installation of a sewer force main within the undeveloped rights -ofways within Cotton Gin Road and Lincoln Road for the purposes of providing sewer service for LSUA and environs. Further, the Parish recognizes the City’s authority to gain access to the undeveloped right-of -way for operation and maintenance purposes from either Eddie Wi lliams Road or Lincoln Road. On motion by Mr. Craig Smith, seconded by Mr. Ollie Overton to rescind a certain motion to enter into an agreement with Steve Jenkins Contraction LLC, for repairs to Shady Crest Lane done on May 8, 2023 because of contractors’ workload and ratify the award to Descant’s Excavating and Construction Services for the amount of $47,498.00 to be paid from Road District 2B -2, District C funds, and authorize the Parish President to sign the necessary documents as recommended by Parish Engineer, Pan American Engineers, LLC. On vote the motion carried.

On motion by Mr. Jay Scott, seconded by Mr. Ollie Overton the following resolution was presented and unanimously adopted:

WHEREAS, the Rapides Parish Police Jury has been afforded the opportunity to apply and participate in the State of Louisiana 2024/2025 Community Development Block Grant Program administered by the Division of Administration; and,

WHEREAS the STATE requires the establishment of uniform procedures in compliance with OMB Circular A-102;

NOW THEREFORE BE IT RESOLVED, by the Rapides Parish Police Jury, that the attached policy entitled “Procurement Procedures Relative to the LCDBG Program” is hereby adopted.

On motion by Mr. Ollie Overton, seconded by Mr. Jay Scott the following resolution was presented and unanimously adopted:

WHEREAS, the Rapides Parish Police Jury has been afforded the opportunity to apply and participate in the State of Louisiana 2024/25 Community Development Block Grant Program administered by the Division of Administration; and,

WHEREAS, the STATE requires Grantees to establish procedures to ensure adequate citizen participation with the program; NOW THEREFORE BE IT RESOLVED, by the Rapides Parish Police Jury, that the attached policy entitled “Citizen Participation Plan” is hereby adopted. Passed, approved and adopted by the Rapides Parish Police Jury, State of Louisiana, on the 9th day of October, 2023. On motion by Mr. Craig Smith, seconded by Mr. Rusty Wilder the following resolution was presented and unanimously adopted: WHEREAS, RPPJ Ordinance 22 -110(a)(7)(d) states that "Prior to submission of the proposed subdivision for review by the area planning commission, the developer will obtain a written report from a firm that has been approved or accepted by the United States Corps of Engineers as an expert in the evaluation and determination of wetlands that documents whether the proposed development involves areas that meet the definition of wetlands by the corps of engineers, the report shall delineate the areas of wetland on the plat. If the development does involve areas that are considered wetlands by the corps of engineers, then the developer shall obtain corps of engineers' approval to proceed with the development", and

WHEREAS, through years of precedent the Rapides Parish Police Jury (RPPJ) has required formal wetlands determinations from the United States Army Corps of Engineers (USACoE) prior to consideration of approval of subdivision applications, and

WHEREAS, the recent ruling by the US Supreme Court in Sackett v Environmental Protection Agency (EPA) offers a much more specific and narrower rule for wetlands determinations than what has previously been utilized by the EPA and USACoE, and

WHEREAS, in response to Sackett v EPA, the USACoE has paused the issuance of wetlands determinations, and

WHEREAS, the Rapides Area Planning Commission (RAPC) Staff, the Subdivision Technical Advisory Review Committee (STAR), and the RAPC Board of Commissioners have the technical capacity to reasonably apply the two-pronged rule for wetlands determination established by the Sackett v EPA ruling and allow for required public hearing, and

WHEREAS, the RPPJ wishes to balance environmental protection with economic development;

NOW, THEREFORE, BE IT RESOLVE, that until the USACoE resumes the issuance of wetlands determinations, the Rapides Parish Police Jury hereby waives the precedent of obtaining a wetlands determination from the USACoE prior to consideration of approval of subdivisions. However, RPPJ will continue to require the developer to submit the wetlands delineation map from a qualified firm that is an expert in the evaluation and determination of wetlands and accept as "best available data" and note it as "preliminary" on the plat. the two-pronged rule as established by Sacket v EPA ruling.

AN ORDINANCE TO AMEND AND REENACT CHAPTER 2 –

ADMINISTRATION, ARTICLE I. – IN GENERAL, SEC. 2-5.1 – TIME LIMIT ON PUBLIC ADDRESSES TO POLICE JURY

The following times limits are established for public addresses to the police jury:

• (1) For individuals, ten (10) three (3) minutes.
• (2) For a group appearing on a subject, twenty (20) ten (10) minutes.

ANIMALS AND FOWL, ARTICLE I. – IN GENERAL, SECTION 6-

1. – CATS ROAMING AT LARGE.

Chapter 6 - ANIMALS AND FOWL ARTICLE I. - IN GENERAL

Sec. 6-1. - Cats roaming at large.

• (a) Community cat. Any domestic cat without indication of ownership which lives primarily outside.
• (b) Response to outdoor cats. Declaration of nuisance; impoundment; redemption fee. Any cat that habitually roams at large on property belonging to one other than the cat owner, is hereby declared to be a nuisance and law enforcement officials are hereby empowered to impound such animal. Community cats shall be eligible for return to the location where they were found prior to any stray hold provision so long as the cat is sterilized, ear-tipped, and vaccinated for rabies. A community cat that has been impounded which has already been ear-tipped shall be returned immediately to the location where it was found unless veterinary care is REGULAR MEETING OCTOBER 9, 2023

required. Community cats shall not be impounded under other circumstances.

• (c) A cat with identifiable owner shall be held the impounding officer is to hold the cat for a minimum period of three (3) days during which time the owner or keeper of such animal may claim the same by payment of an impounding fee of five dollars ($5.00), plus one dollar ($1.00) for each day of impoundment.
• (d) Disposition. Adoption by nonowner; destruction and disposal If the animal is not claimed by its owner in accordance with paragraph (a) above , the cat may be adopted by a willing individual(s); transferred to another animal shelter or rescue organization; or may be sterilized, ear -tipped, vaccinated for rabies and returned to the location where it was t rapped. or the impounding officer, or other officer or person appointed by him, may destroy the animal in a humane manner and cause the body thereof to be disposed of as provided by law for the disposal of bodies of ot her dead animals.

BE IT FURTHER ORDAINED that this ordinance is to be effective immediately.

On motion by Mr. Ollie Overton, seconded by Mr. Bubba Moreau to create a paid internship for the position of Auditor at the Rapides Parish Sales & Use Tax Department, not to exceed forty (40) hours per week, beginning in August and ending in May. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Bubba Moreau to adopt a resolution to authorize Pan American Engineers to advertise for bids for ARPA – Work Order No. 2 – Courthouse and Jail HVAC, Ceiling and Light Improvements. On vote the motion carried.

On motion by Mr. Rusty Wilder, seconded by Mr. Ollie Overton to accept the “Hoyt Road Asphalt Roadway Improvements” as “Substantially Complete”, and authorize the Parish President to sign and record the “Substantial Completion” certificate, and authorize the Parish President to sign a Final Recap Change Order adjusting the final contract quantities and time period as necessary, as recommended by the Parish Engineer, Pan American Engineers, LLC. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith the following resolution was presented and unanimously adopted:

RESOLUTION AUTHORIZING SUMMITAL OF FY 2024/25 LOUISIANA COMMUNITY DEVELOPMENT BLOCK GRANT APPLICATION, AND ENTERING INTO AGREEMENTS ASSOCIATED WITH ADMINISTRATION AND ENGINEERING SERVICES

WHEREAS, the Rapides Parish Police Jury (“Parish”) desires to submit a fiscal year 2024/25 Louisiana Community Development Block Grant (“LCDBG”) Public Facilities Application for Road Improvements (the “Project”); and,

WHEREAS, the Parish intends to use local funds from the corresponding road district(s) to pay for all administrative costs, including application preparation, administrative consultant fees, and any other administrative costs associated with the Project; and,

WHEREAS, the Parish intends to use local funds from the corresponding road district(s) to pay for all engineering costs, including application preparation, ba sic engineering design, surveying, permitting, project representation, and constructi on phase services associated with the Project; and,

WHEREAS, the Parish desires to enter into an agreement with Frye Magee, LLC, to perform all administrative consulting services associated with the Project, which includes assistance with developing the application and performing all LCDBG administrative consulting duties following a grant award; and,

WHEREAS, the Parish desires to enter into an agreement with Pan American Engineering, LLC to perform all engineering consulting services associated with the Project, which includes assistance with developing the application and performing all necessary engineering consulting services following a grant award.

NOW, THEREFORE, BE IT RESOLVED BY THE RAPIDES PARISH POLICE JURY:

1. The Parish enters into an agreement with Frye Magee, LLC to develop the Application, and perform all LCDBG administrative consulting duties following a grant award.
2. The Parish enters into an agreement with Pan American Engineering, LLC to develop the Application, and perform all necessary engineering consulting services following a grant award.
3. The President is hereby authorized to execute the respective agreements with Frye Magee, LLC and Pan American Engineering, LLC.
4. The President is hereby authorized to execute and submit the FY 2024/25 LCDBG Application, as well as all related documents, and to do all things necessary and proper to carry out this Resolution and to fulfill its objectives and purposes.

On motion by Mr. Jay Scott, seconded by Mr. Bubba Moreau to authorize the President to sign and approve Amendment No. 1 to the contract between the Rapides Parish Police Jury and the Louisiana Workforce Commission (LWC) for the PY22/FY23 Workforce Innovation and Opportunity Act (WIOA) Program in the total of $55,934.62(Dislocated Workers and Youth) and for the Treasurer to amend the budget as necessary. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Sean McGlothlin to award Bid No. 3189 – Purchase Used Basketball Floor for the Rapides Parish Coliseum to the sole bidder, Praters Incorporated, for $89,800.00 as recommended by the Purchasing Agent. On vote the motion carried.

WHEREAS, the Secretary of Transportation and Development is authorized to make grants for mass transportation projects;

WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provisions by it of the local share of project costs;

WHEREAS, it is required by the Louisiana Department of Transportation and Development in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and

WHEREAS, it is the goal of the Applicant that minority business enterpri se be utilized to the fullest extent possible in connection with this project, and that definitive procedures shall be established and administered to ensure that minorit y businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment, or consultant and other services:
