The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, on Monday, March 13, 2023, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Joseph “Joe” Bishop , President, Sean McGlothlin, Vice President and Police Jurors: Davron “Bubba” Moreau, Craig Smith, Theodore Fountaine, III, Oliver “Ollie” Overton, Jr., David Johnson and Jay Scott.

Absent: Rusty Wilder

Also present were: Ms. Theresa Pacholik, Secretary/Treasurer; Mr. Shane Trapp, Courthouse Building Superintendent; Ms. Donna Andries, Sa les & Use Tax Administrator; Ms. Sharon Neal, Interim WOD Director; Chief Jody Glorioso, Fire District No. 2; Sheriff Mark Wood; Chief Deputy Mike Jones; Asst. Chief Deputy Robert Beauregard and Greg Jones, Legal Counsel.

The invocation was given by Mr. David Johnson.

The Pledge of Allegiance was led by Mr. Craig Smith.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Joe Bishop , President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

President Joe Bishop asked if there were any public comments on any agenda items, to which there was no response.

Mr. David Johnson congratulated Mr. Craig Smith on winning the election for 3 rd Vice President of the Police Jury Association. Mr. Craig Smith thanked all Jurors for their support and assistance at the Police Jury Association Conference.

On motion by Mr. Ollie Overton, seconded by Mr. Jay Scott , to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on February 13, 2023 and Special Session on February 22, 2023, as published in the Official Journal. On vote the motion carried.

On motion by Mr. David Johnson, seconded by Mr. Jay Scott, that approved bills be paid. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Sean McGlothlin, to waive the thirty (30) day announcement rule and reappoint Mr. Matt Johns to the Rapides Parish Area Planning Commission for a five (5) year term. Term will expire April 8, 2028. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton to open a Public Hearing to discuss and take action to accept or deny the Industrial Tax Exemption Appl ication: PQ, LLC. Industrial Tax Exemption application #20220369-ITE. On vote the motion carried.

REGULAR MEETING

MARCH 13, 2023

Mr. Joe Bishop recognized Mr. Ken Bunting, representative for PQ, LLC.

Mr. Bunting stated the plant is located on Pardue Road behind Proctor & Gamble. He spoke briefly on the nature of business conducted at PQ, LLC and stated the average salary of an employee is $84,000.00 . The expansion will cost approximately four million dollars ($4,000,000.00) and will add at least two (2) new positions to their workforce.

On motion by Mr. Ollie Overton, seconded by Mr. Jay Scott to close the Public Hearing. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Joe Bishop the following resolution was presented and unanimously adopted:

NOTICE

Rapides Parish Police Jury conducted a public meeting on Industrial Tax Exemption Application No. 20220396-ITE and voted to APPROVE the application of PQ, LLC.

Thus, signed and unanimously adopted this 13th day of March, 2023.

On motion by Mr. David Johnson, seconded by Mr. Craig Smith to authorize the transfer of funds generated from the sale of timber at the Hester Landing Road Debris Burn Site from Public Works Contingencies to the Reseal Account for Ward 4. Funds will be used to repair damage caused by logging equipment. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith to award Request for Proposal No. 3076 (Contract Hauling Various Road Materials – Annual Bid) to Tommy Russell Enterprises, LLC beginning on April 1, 2023 and ending March 31, 2024 with the option to renew up to thirty-six (36) months total, as recommended by the Purchasing Agent and the Public Works Director. The rates awarded: 0 to 10 Mile Haul 0.70 per yard mile 11 to 20 Mile Haul 0.55 per yard mile 21 and over Mile Haul 0.45 per yard mile Truck Owned – 2 Trucks Hired: 4 On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. David Johnson to award Bid No. 3075 (Various Bituminous Road Materials – Hot & Cold Mix) to Diamond B. Construction beginning April 1, 2023 and ending September 30, 2023 with the option to renew up to thirty-six (36) months total, as recommended by the Purchasing Agent and the Public Works Director.

On motion by Mr. Jay Scott, seconded by Mr. David Johnson to delete from the Rapides Parish Fire District No. 7 Asset/Inventory program the following equipment as it is not suitable for the needs of the Fire District. This equipment will be sold in a sealed bid process to the highest bidder with a minimum bid amount of $250,000.00, as requested by the Ruby-Kolin Fire Department Board. ASSET NO. On motion by Mr. Jay Scott, seconded by Mr. Bubba Moreau to approve the extension of Bid No. 3028 (MC-30), as requested by the Purchasing Agent and approved by the participating vendor. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Ollie Overton to approve the extension of Bid No. 3029 (CRS-2), as requested by the Purchasing Agent and approved by the participating vendor. On vote the motion carried.

On motion by Mr. Jay Scott, seconded by Mr. David Johnson to authorize Hardship Case, pending proper certification. On vote the motion carried.

On motion by Mr. David Johnson, seconded by Mr. Bubba Moreau, the following ordinance was presented and on vote unanimously adopted:

ORDINANCE

AN ORDINANCE TO AMEND AND REENACT SECTION 20-

7(B)(1) HARDSHIP CASES SO AS TO INCREASE THE

MAXIMUM MONTHLY INCOME OF HOME OWNERS WHO

QUALIFY FROM $1,300 PER MONTH TO $1,500 PER MONTH

BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 13th day of March, 2023, that Section 20-7(b)(1) of the Rapides Parish Code of Ordinances is hereby amended and reenacted so as to increase the maximum monthly income of home owners who qualify for a hardship case for all weather access to a public road from $1,300 per month from all sources to $1,500 REGULAR MEETING MARCH 13, 2023

Chapter 20. ROADS AND DRAINAGE Article I. In General Section 20-7. Hardship Cases.

• (b) Administration. These funds shall be administered under the following rules:
• (1) Persons who qualify. In order to qualify for assistance under this section, a person must execute an application under oath stating he or she is the owner of a home without reasonable all-weather access to a public road and is unable to provide funds of their own to obtain reasonable access; that their monthly income does not exceed one thousand five hundred ($1,500.00) dollars from all sources, that they are needy and that without assistance they will be unable to reach a public road in all weather; that they have resided in such home for six (6) months or more.

BE IT FURTHER ORDAINED that this ordinance is to be effective immediately. BE IT FURTHER ORDAINED in all other respects Section 20-7 of the Rapides Parish Code of Ordinances shall remain unchanged. THUS DONE AND SIGNED on this 13th day of March, 2023.

On motion by Mr. Bubba Moreau, seconded by Mr. David Johnson to enter into an Intergovernmental Agreement with Ward 10 Recreation District for the Public Works Department to provide labor and equipment to perform approximately ten (10) hours of hauling and spreading of 610 base, to be paid out of Ward 10 Maintenance Funds and authorize the President to sign all necessary documents. On vote the motion carried.

Recognize and present plaques to the Northwood Girls Basketball Team for winning the Louisiana High School Athletic Association (LHSAA) Class 1A State Championship.

Mr. Ollie Overton and Mr. Jay Scott presented plaques to the Northwood Girls Basketball Team for winning the Louisiana High School Athletic Association (LHSAA) Class 1A State Championship.

On motion by Mr. David Johnson, seconded by Mr. Jay Scott, the following ordinance was presented, to set a 25 mph speed limit on Satcher Road, Ward 2, District F, and authorize the Parish Highway Department to erect speed limit signs, and on vote unanimously adopted:

AN ORDINANCE TO AMEND AND REENACT SECTIONS 18-4.2 (G) SPEED WARD 2, DISTRICT F

BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 13th day of March, 2023, that Section 18-4.2 (g) of the Rapides Parish Code of Ordinances is hereby amended and reenacted to include a 25 mph speed limit on Satcher Road, Ward 2, District F, as follows:

Chapter 18. MOTOR VEHICLES AND TRAFFIC

Section 18-4.2. Speed limits designated on certain streets:

• (g) Twenty-five miles per hour. It shall be unlawful for any person to drive or operate a vehicle upon the following parish roads in Rapides Parish in excess of twenty-five (25) miles per hour: ... Satcher Road, Ward 2, District F ...

(l). Whoever violates the provisions of this section shall be punished by a fine not to exceed one hundred dollars ($100.00), or imprisoned in the Rapides Parish Jail for a period not to exceed thirty (30) days, or both.

BE IT FURTHER ORDAINED that this ordinance is to be effective immediately. BE IT FURTHER ORDAINED in all other respects Section 18-4.2 of the Rapides Parish Code of Ordinances shall remain unchanged. BE IT FURTHER ORDAINED that the Parish Highway Department is hereby authorized to erect the speed limit signs on the Road. THUS DONE AND SIGNED on this 13th day of March, 2023.

On motion by Mr. Jay Scott, seconded by Mr. David Johnson to award and authorize the President to sign the proposal from ACA, LLC for $76,500.00 to install a Potable Water Booster Pump for the Rapides Parish Courthouse and Jail. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Ollie Overton to amend the term of Mr. Rick Reno to the Alexandria/Pineville Area Convention & Visitor’s Bureau. Amended term will expire December 31, 2024. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. David Johnson to waive the thirty (30) day rule and appoint Mr. Stan Miller, nominee of Louisiana Christian University, to the Rapides Parish Civil Service Board for a three (3) year term. Term will expire April 14, 2026. On vote the motion carried.

On motion by Mr. David Johnson, seconded by Mr. Ollie Overton to receive the required report from Acadian Ambulance under the contract for January, 2023:

On motion by Mr. David Johnson, seconded by Mr. Jay Scott, the following Proclamation was unanimously adopted:

PROCLAMATION

National 9-1-1 Telecommunicator Week April 9-15, 2023

WHEREAS, 9-1-1 is nationally recognized as the number to call in an emergency to receive immediate help from police, fire, emergency medical services, or other appropriate emergency response entities; and

WHEREAS, 9-1-1 was designated by Congress as the national emergency call number under the Wireless Communications and Public Safety Act of 1999 (Public Law 106-81); and

WHEREAS, the ENHANCE 9-1-1 Act of 2004 (Public Law 108-494) established enhanced 9-1-1 as a high national priority as part of our Nation’s homeland security and public safety: and

WHEREAS, people of all ages use 9-1-1, and it is critical to educate the public of all ages on the proper use of 9-1-1; and

WHEREAS, a growing segment of the population, including the deaf, hard of hearing, deaf-blind, and individuals with speech disabilities increasingly communicate with nontraditional text, video and instant messaging communications services and anticipate that these services will be able to connect directly to 9-1-1; and

WHEREAS, thousands of 9-1-1 calls are made every year by children properly trained on the use of 9-1-1, resulting in lives saved which underscores the critical importance of training children early in life about 9-1-1; and

WHEREAS, there is widespread misuse of the 9-1-1 system, including prank and non-emergency calls, which can result in costly and inefficient use of 9-1-1 and emergency response resources.

NOW, THEREFORE, I, Joe Bishop, President of Rapides Parish Police Jury, do hereby proclaim April 9-15, 2023 as National 9-1-1 Education Month. I call upon all government officials, parents, teachers, school administrators, caregivers, businesses, leaders, non-profit organizations, and the people of the United States to observe this month with training, events, and activities to educate the public on 91-1 and its services.

On motion by Mr. Jay Scott, seconded by Mr. Joe Bishop to appoint Ms. Sharon Neal as OEWD/LWDA 61 WOD Executive Director with a salary of $65,000.00 plus standard benefit package. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Bubba Moreau to increase the starting base pay for Rapides Parish Fire District No. 4 Civil Service Firefighters, from $1,033.85 per pay period to $1,085.54 per pay period, Chief of Administration from $1,536.72 per pay period to $1,648.00 per pay period, effective February 26, 2023, as recommended by the Fire Chief and Holiday Village Fire Department Board. On motion by Mr. Ollie Overton, seconded by Mr. David Johnson to enter into an Intergovernmental Agreement with the Town of Glenmora, for the Rapides Parish Highway Department, to provide labor and equipment, to perform fifty (50) hours of pot hole patching on various roads, as requested by the Town of Glenmora, to be paid out of Town’s portion of Road District 1A Maintenance Funds and authorize the President to sign. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. David Johnson to authorize the Rapides Parish Police Jury to execute an Engineering Agreement with Pan American Engineers, LLC. to develop bidding documents for the Hoyt Road Improvements Project and authorize Pan American Engineers, LLC. to advertise and receive bids for the same. The estimated cost of the project is $315,000. On vote the motion carried.

Mr. Jay Scott inquired on start date for seasonal employees at the Public Works Department. Mr. Craig Smith stated the workers will start April 1, 2023. The new tractors should arrive in May and June.

There being no further business, motion by Mr. Ollie Overton, seconded by Mr. Jay Scott the meeting was adjourned at 3:27 p.m.
