The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 70 1 Murray Street, Alexandria, Louisiana, on Monday, December 11 , 2023, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Joseph “Joe” Bishop, President, Sean McGlothlin, Vice President and Police Jurors: Davron “Bubba” Moreau, Craig Smith, Ernest Nelson, Rusty Wilder, Oliver “Ollie” Overton, Jr., David Johnson and Jay Scott.

Absent: None

The invocation was given by Mr. David Johnson.

The Pledge of Allegiance was led by Mr. Bubba Moreau.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened a s the governing authority of said Parish by Hon. Joe Bishop, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

On motion by Mr. Bubba Moreau, seconded by Mr. David Johnson to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on November 13, 2023 and Special Session on November 28, 2023, as published in the Official Journal. On vote the motion carried.

On motion by Mr. Jay Scott, seconded by Mr. Bubba Moreau that approved bills be paid. On vote the motion carried.

Hon. Phillip Terrell provided an update on the State of Louisiana Clemency Hearings held in November in Baton Rouge.

On motion by Mr. Jay Scott, seconded by Mr. Sean McGlothlin to hold a public hearing on the proposed 202 4 Rapides Parish Police Jury Budget. Ms. Theresa Pacholik, Secretary/Treasurer allowed the public to comment and ther e were no comments from the public. Discussion ensued.

On motion by Mr. Sean McGlothlin, seconded by Mr. Rusty Wilder the hearing was declared closed. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Ollie Overton the following ordinance was presented for the operating budget and revenues and expenditures for funds for the fiscal year beginning January 1, 2024, and ending with December 31, 2024, in accordance with LA R.S. 39:1309 -1310, and authorize the Treasurer to amend budget as necessary:

ORDINANCE

AN ORDINANCE ADOPTING THE OPERATING BUDGET AND REVENUES AND EXPENDITURES FOR CERTAIN FUNDS FOR THE FISCAL YEAR BEGINNING JANUARY 1, 2024, AND ENDING DECEMBER 31, 2024, IN ACCORDANCE WITH LA R.S. 39:1309-1310.

BE IT ORDAINED by the Police Jury of Rapides Parish, in regular session convened that:

SECTION 1. The following estimate of revenues for certain funds for the fiscal year beginning January 1, 2024, and ending December 31, 2024, be and the same is hereby adopted to serve as an operating budget of Revenues for these funds for the Police Jury of Rapides Parish, during the same period.

SECTION 2. The attached estimates of expenditures for certain funds are hereby adopted to serve as a budget of expenditures for these funds for the Police Jury of Rapides Parish during the same period.

SECTION 3. The adoption of this operating budget of expenditures be and the same is hereby declared to operate as an appropriation of the amount therein set forth within the terms of the budget classification.

SECTION 4. Amounts are available for expenditure only to the extent included within the 2023 budget.

SECTION 5. The Treasurer shall have the authority to make any changes and amendments to any agencies, departments, functions, characters and funds within the adopted budget as she deems necessary provided that the provisions of LA R.S. 39:1310 (A) are followed.

On motion by Mr. David Johnson, seconded by Mr. Rusty Wilder, the following ordinance was presented, to set a 25 mph speed limit on Johnson Road, Ward 4, District H, and authorize the Parish Highway Department to erect speed limit signs, and on vote unanimously adopted:

AN ORDINANCE TO AMEND AND REENACT SECTIONS 18 -4.2 (G) SPEED 4, DISTRICT H

BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 11th day of December, 2023, that Section 18-4.2 (g) of the Rapides Parish Code of Ordinances is hereby amended and reenacted to include a 25 mph speed limit on Johnson Road, Ward 4, District H, as follows:

Chapter 18. MOTOR VEHICLES AND TRAFFIC

Section 18-4.2. Speed limits designated on certain streets:

• (g) Twenty-five miles per hour. It shall be unlawful for any person to drive or operate a vehicle upon the following parish roads in Rapides Parish in excess of twenty-five
• (25) miles per hour: ... Johnson Road, Ward 4, District H ...

(l). Whoever violates the provisions of this section shall be punished by a fine not to exceed one hundred dollars ($100.00), or imprisoned in the Rapides Parish Jail for a period not to exceed thirty (30) days, or both.

BE IT FURTHER ORDAINED that this ordinance is to be effective immediately. BE IT FURTHER ORDAINED in all other respects Section 18 -4.2 of the Rapides Parish Code of Ordinances shall remain unchanged. BE IT FURTHER ORDAINED that the Parish Highway Department is hereby authorized to erect the speed limit signs on the Road. THUS DONE AND SIGNED on this 11th day of December, 2023.

On motion by Mr. Craig Smith, seconded by Mr. Bubba Moreau to authorize acceptance of the completion of Bethel Road Bridge over Slash Bayou Tributary under State Project No. H.013120 and to authorize the President to execute any necessary documents of such completion. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Sean McGlothlin to ratify authorization of said motion passed on November 13, 2023, to reimburse Town of Woodworth for various road improvements on Lamothe Lane and Wesley Circle, not to exceed $159,000.00, to be paid out Road District 2C-District H funds, to also include various other roads within the Town. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Bubba Moreau to grant approval of Teekell Ridge Subdivision, as recommended by the Rapides Area Planning Commission and authorize signing of the plat upon Legal Counsel review and approval. On vote the motion carried. REGULAR MEETING DECEMBER 11, 2023

On motion by Mr. Jay Scott, seconded by Mr. Bubba Moreau to authorize the Parish President to sign a six (6) month extension for a Professional Service s Contract for Monitoring Services for the WIOA programs. The contract extension will be for the period of January 1, 2024 – June 30, 2024. This contract for monitoring will supplement current internal program monitoring in order to comply with LWC regulations. Contract will be paid out of WIOA funds. Contract extensio n contingent on approval from Rapides Parish Civil Service . On vote the motion carried.

On motion by Mr. Rusty Wilder, seconded by Mr. David Johnson to authorize CLEAN to host an event with Southern 3 Cylinder Outlaw Drag Club to hold a Boat Racing Events in 2024 on Cotile Lake, tentative dates: May 4-5, June 1-2, July 2021, August 24-25, boat landing within the park to be closed on event dates, pending legal counsel approval. Discussion ensued.

Mr. Cory Ashmore recommended that we add a clause in the agreement to not allow spectators to sit on the levee and watch the event. Mr. Jones stated the contracts have not been submitted yet for review, but he will definitely take note of Mr. Ashmore’s request. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Rusty Wilder, the confirming the following proclamation and unanimously adopted: PROCLAMATION PURSUANT TO LSA-R.S. 18:602 ORDERING A SPECIAL ELECTION TO FILL THE VACANCY IN THE OFFICE OF POLICE JURY, DISTRICT D, OF RAPIDES PARISH

WHEREAS, on November 13, 2023, the honorable THEODORE FOUNTAINE, III, duly elected Police Juror for Rapides Parish, District D, whose term of office will begin on January 1, 202 4 for a term of four years, passed away in Alexandria, Louisiana, creating a vacancy in the office of the Police Juror for District D of Rapides Parish, and the Louisiana Secretary of State notified the Police Jury th at said vacancy must be filled by appointment on or before December 4, 2023, and a special election shall be set to fill the unexpired term;

WHEREAS, the Rapides Parish Police Jury at a duly noticed and posted Special Meeting held on November 28, 2023, with a legal quorum present, have appointed Ernest Nelson to fill the vacancy pending the special election to fill the unexpired term, pursuant to LSA-R.S. 18:602; and

WHEREAS, the death of Police Juror Theodore Fountaine, III, has caused a vacancy in his elected office as Police Juror for District d of Rapides Parish, and pursuant to LSA-R.S. 18:602, an election must be ordered and called to fill the unexpired term of office which exceeds 18 months; and

NOW THEREFORE, BE IT HEREBY PROCLAIMED that the Rapides Parish Police Jury does hereby order and call a Special Election to fill the unexpired term of Police Juror for District D, Rapides Parish, Louisiana, as follows:

• (1) the Qualifying Dates : July 17, 18, & 19, 2024;
• (1) the Primary Election Date: November 5, 2024; REGULAR MEETING DECEMBER 11, 2023
• (2) the General Election Date: December 7, 2024; and that certified copies of the Proclamation shall be sent to the Louisiana Secretary of State; This Proclamation introduced at a properly posted and held Special Meeting, after a proper motion, and second, and received majority vote of approval on the 4th day of December, 2023.

Thus confirmed and approved on this 11th day of December, 2023.

On motion by Mr. David Johnson, seconded by Mr. Jay Scott to increase the starting base pay for Rapides Parish Fire District No. 7 Civil Service Firefighters, from $10.50 per hour to $12.00 per hour, and for the increase to be allocated for all classified positions according to the salary plan, effective December 31 , 2023, as recommended by the Fire Chief and Ruby Kolin Fire Department Board. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. David Johnson to increase the starting base pay for Rapides Parish Fire District No. 7 Secretary, from $8.25 per hour to $9.50 per hour, with an increase to $10.00 per hour upon one (1) year confirmation, effective December 31, 2023, as recommended by the Fire Chief and Ruby Kolin Fire Department Board. On vote the motion carried.

On motion by Mr. David Johnson, seconded by Mr. Rusty Wilder to receive the required report from Acadian Ambulance under the Contract for October, 2023:

On motion by Mr. Ollie Overton, seconded by Mr. Jay Scott to renew the ten (10) year Intergovernmental Agreement with the Town of Boyce to provide fire protection services for the Alfalfa District and Fire Protection District No. 16. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. David Johnson to authorize to renew the Worker’s Compensation Policy for Rapides Parish Fire District No. 2, 3, 4, 5, 6, 7, 8, 9, 10, 11, 14, 15, 16, and 18 for Policy Period beginning January 1, 2024 and ending December 31, 2024, as recommended by the Purchasing Agen t and Treasurer. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. David Johnson to authorize the renewal of the Rapides Parish Police Jury Worker’s Compensation Insurance for 2024 with PGRMA/CCMSI for $209,864 and authorize the President to sign the same. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith, that the following item(s) were posted to the Jury meeting after the agenda was posted and added to REGULAR MEETING DECEMBER 11, 2023

A resolution providing for canvassing the returns and declaring the results of the special election held in the Parish of Rapides, State of Louisiana, on Saturday, November 18, 2023, to authorize the levy of a special tax therein.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority o f the Parish of Rapides, State of Louisiana (the "Parish"), that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Parish of Rapides, State of Louisiana, on Saturday, November 18, 2023, to authorize the levy of a special tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.

SECTION 2. Election Results. According to the official certified tabulation of votes cast at said Election, there was a total of 4,222 votes cast IN FAVOR OF Proposition and a total of 10,510 votes cast AGAINST Proposition, resulting in a majority of 6,288 votes cast AGAINST Proposition. Mr. Rusty Wilder stated it is important for the Jury to acknowledge and make no te of the word renewal in the tax call to clear any misconceptions or confusion from the general public. This proposed tax call to be placed on the ballot will not be the same one as the one on the ballot in the November 2023 election. This will be strictly a renewal of the current millage rate for the Renai ssance Tax. Mr. Bishop stated it will be a renewal proposition and contains the same exact terms as the current taxes collected. No additional verbiage has been added. The Police Jury approves for the tax call to be placed on the ballot. All funds collected are distributed to the Renaissance Home. On vote motion carried.

APPROVING THE INDUSTRIAL TAX

EXEMPTION APPLICATION FOR PLASTIPAK PACKAGING, INC.

REGULAR MEETING

DECEMBER 11, 2023

WHEREAS, Article 7, Section 21(F) of the Louisiana Constitution authorizes the Board of Commerce and Industry ("BCI”), with the approval of the Go vernor, to approve contracts under the Industrial Tax Exemption Program ("ITEP"), through which applicants seeking to construct a new manufacturing establishment or install an addition to a manufacturing establishment are awarded an exemption for such facilities from local ad valorem taxes; and

WHEREAS, Through Executive Orders JBE 16-26 and 16-73, Governor John Bel Edwards set forth conditions for approval of exemptions under ITEP contracts including the creation or retention of jobs and payroll and, among other things, review and approval by th e local governing authority in which the exemption is contemplated, the parish POLICE JURY, the municipality (if applicable) and the sheriff; and

WHEREAS, Plastipak Packaging, Inc. (“Plastipak") submitted an ITEP application to the Louisiana Department of Economic Development for the addition of 7 new production lines to fulfill demand for plastic containers. The equipment added will consist of new blow molding machines, conveyors, quality equipment, air compressors and other equipment used in the production process. This will benefit the facility by increasing sales and the hiring of additional employ ees. This project is planned for the facility at 4101 Pardue Rd in Pineville, LA and includes a commitment of adding 10 jobs and $400,000 in payroll; and

WHEREAS, The ITEP application was approved by the BCI on April 28, 2021 for an 100% exemption for 5 years and an option to renew the exemption at 80% for an additional 3 years; and

WHEREAS, the Rapides Parish Police Jury passed a resolution approving Plastipak’s ITEP participation for the project as further detailed in Application 20170399; and

WHEREAS, Plastipak has completed its project and exceeded its commitments by creating # 48 of new jobs and $818,244.31 of new payroll; and

WHEREAS, Plastipak worked with Louisiana Department of Economic Development to complete its ITEP application; and

WHEREAS, Plastipak is currently experiencing challenges with implementing its ITEP exemption with the Louisiana Department of Economic Development;

WHEREAS, the Louisiana Department of Economic Development is now advising Plastipak that it should have filed for additional ITEP applications even though Plastipak only has one (1) project.

WHEREAS, Plastipak is requesting the Rapides Parish Police Jury to notify the Louisiana Department of Economic Development and the Louisiana Board of Commerce and Industry to reaffirm its support for Plastipak to receive all of the ITEP exemptions original ly contemplated and associated with Plastipak’s project, without further delay or penalty.

NOW, THEREFORE BE IT DULY RESOLVED by the Rapides Parish Police Jurt in regular session duly convened that: REGULAR MEETING DECEMBER 11, 2023

SECTION I. The Rapides Parish Police Jury reaffirms its support for Plastipak’s participation in the Louisiana Industrial Property Tax Exemption Program and specifically requests that:

• a) The Louisiana Department of Economic Development and the Louisiana Board of Commerce and Industry also support Plastipak’s participation in the Louisiana Industrial Property Tax Exemption Program; and
• b) The Louisiana Department of Economic Development and the Louisiana Board of Commerce and Industry allow Plastipak to file the requisite forms, reports, and applications needed for Plastipak to receive the ITEP exemption benefits originally contemplated for the project; and
• c) The Louisiana Department of Economic Development and the Louisiana Board of Commerce and Industry, upon review and proper consideration, approve subsequent Plastipak ITEP applications and renewal applications related to the project, so that Plastipak may r eceive all ITEP exemption benefits originally contemplated for the project; and
• d) The Louisiana Department of Economic Development and the Louisiana Board of Commerce and Industry forgo the assignment of any penalties associated with Plastipak’s efforts to receive all the ITEP exemption benefits originally contemplated for the project, including the aforementioned subsequent Plastipak ITEP applications and renewal applications.

Determination of Need. The Governing Authority has determined that a true and very real need exists for the acquisition of One (1) 2024 Kenworth US Fire Pumper Truck (the "Equipment") for the District.

SECTION 2. Approval and Authorization. The Governing Authority has determined that the Government Obligation Contract (the "Contract"), substantially in the form presented at this meeting, is in the best interests of the District for the acquisition of such Equipment, and the Governing Authority hereby approves the entering into of the Contract by the District and hereby designates and authorizes the following person(s) to execute and deliver the Contract on the District’s behalf with such changes theret o as such person(s) deem(s) appropriate, and any related documents, including any Escrow Agreement, necessary to the consummation of the transaction contemplated by the Contract.

SECTION 3. Employment of Counsel. The fee to be paid said specia l counsel shall be an amount computed at hourly rates based on the Attorney General’s then current Maximum Hourly Fee Schedule, together with reimbursement of out -of-pocket expenses. The Secretary-Treasurer is hereby authorized and directed to execute, and this Governing Authority hereby agrees to and accepts the terms of, the engagement letter of said special counsel which is on fi le with the Governing Authority. The Secretary-Treasurer is hereby empowered and directed to provide for payment of the work herein specified upon completion thereof and under the conditions herein enumerated without further approval of the Governing Authority.
