The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, on Tuesday , November 12 , 2024, at three (3:00) o'clock p.m. (Central Standard Time).
There were present: Sean McGlothlin , Presiden t and Police Jurors: Davron “Bubba” Moreau, Daniel Lonsberry, Craig Smith, Ernest Nelson, Danny Bordelon, Oliver “Ollie” Overton, Jr., Parrish Giles and Jay Scott.
Absent: None

The invocation was given by Mr. Ollie Overton.
The Pledge of Allegiance was led by Mr. Jay Scott.
The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened at 3:00 p.m. as the governing authority of said Parish by Hon. Sean McGlothlin , President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.
President McGlothlin asked for the Jurors to review the proposed 2025 meeting dates and the proposed 2025 holiday schedule placed at their seat. A vote will be taken on each item at the December meeting.
Mr. Jay Scott presented a plaque to Mr. Donald “Buffy” Normand and Mr. Kevin Jones, employees of the Rapides Parish Public Works Department, in recognition of outstanding leadership and dedication during the recent rainstorm.
On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on October 14, 2024, as published in the Official Journal. On vote the motion carried.
On motion by Mr. Craig Smith, seconded by Mr. Parrish Giles that approved bills be paid. On vote the motion carried.

- (30) day announcement rule and reappoint Mr. Rick Reno to the Alexandria/Pineville Convention and Visitors Bureau for a one (1) year term. New term will expire December 31, 2025. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith to approve the Treasurer’s report to approve the Treasurer’s report as presented in the Committee Meeting on November 4, 2024. The report contained budget to actual revenue and expenses for all funds and status of audit findings. On vote the motion carried.
On motion by Mr. Parrish Giles, seconded by Mr. Craig Smith, the following resolution was unanimously adopted:

WHEREAS, the Rapides Parish Police Jury received the following bids on Thursday, October 17, 2024 for the Courthouse Annex (Former Gravel Law Office) Building Renovation and Miscellaneous Site Improvements, 711 Washington Street; and,
CONTRACTOR BASE BID
- Pat Williams Construction, LLC $1,399,000.00
- Tudor, Inc. $1,443,000.00
- DSW Construction, LLC $1,559,119.00
WHEREAS, the bids have been checked and tabulated by Pan American Engineers, LLC, with a recommendation of award being made to the low bidder;
NOW, THEREFORE BE IT RESOLVED, that the contract for said construction project is hereby awarded to the low bidder, Pat Williams Construction, LLC for the base bid of $1,399,000.00.
- The successful bidder must have an active Unique Entity ID (UEI) and be registered with the Federal System of Award (SAM) Registration Program prior to award of contract.
BE IT FURTHER RESOLVED, that the President is hereby authorized to execute contracts, change orders and other documents related to the project between the Rapides Parish Police Jury and the successful bidder.

On motion by Mr. Ollie Overton, seconded by Mr. Bubba Moreau to call for a Public Hearing on December 9, 2024, at 3:00 p.m. to discuss the 2025 proposed budget. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Ernest Nelson to contract with Fontenot & Associates, LLC for engineering services for design and plans for a new Fire Station for Rapides Parish Fire District No. 15 – Taylor Hill VFD. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Bubba Moreau to award Construction Contract No. 3314 for Rapides Parish Fire District No. 5 to Artech Construction for the base bid amount of $770,000.00, contingent upon a contemporaneously negotiated deductive Change Order, to deduct certain work to budget within the funds that are available, as recommended by the Engineer, Board Members, Chief and authorize the President to sign any necessary documents. On vote the motion carried.
On motion by Mr. Craig Smith, seconded by Mr. Danny Bordelon to receive price quotes and award to the lowest bidder for asphalt overlay on a portion of Azalea Lane, Ward 11, District C, Lake Hills Subdivision. Project to be funded by Road District 2B-1. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton to enter into an Intergovernmental Agreement with the City of Pineville for repairs to Levee Road, reimbursement to the City of Pineville not to exceed $10,500.00, to be paid of Reseal Funds, District B and authorize the President to sign any necessary documents. On vote the motion carried.
On motion by Mr. Danny Bordelon, seconded by Mr. Ollie Overton to authorize Pan American Engineers, LLC. to advertise and receive bids for the Downs Lane Overlay project. The estimated construction cost of the project is $198,500.00. Project is to be paid from Police Jury District E – Road District 36A funds. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith to authorize the President to 1) sign nomination form for the Rapides Workforce Development for Lafe Jones, COO and Executive Vice President for Louisiana Central to fill the previously vacant but required Economic Development Representative Position and
- to sign a letter addressed to the Louisiana Workforce Commission concerning new member. Members (New Appointments) Initial Term Dates Lafe Jones 11/1/2024-11/1/2026 On vote the motion carried.
On m otion by Mr. Danny Bordelon to adopt a resolution to enter into an Intergovernmental Agreement with LDOTD for the England Airpark Roadway Improvements and authorize the Parish President to sign all necessary documents. Project to be fund through LDOTD using federal funds and matching funds provided by the England Authority. Motion died for lack of a second.
On motion by Mr. Ollie Overton, seconded by Mr. Bubba Moreau the following resolution was unanimously adopted:

WHEREAS, the Rapides Parish Police Jury requires professional engineering services to implement the five year Capital Improvement Program for the Esler Regional Airport; and,
WHEREAS, the Rapides Parish Police Jury solicited Qualification Statements from firms interested in providing said services for a three (3) year term with options to extend two (2) one-year terms and two (2) firms submitted Qualification Statements in response to the solicitation; and,
WHEREAS, the evaluation committee, using methods and criteria mandated by the State of Louisiana, rated and ranked the Qualification Statements; and,
WHEREAS, the Qualification Statement submitted was reviewed by the evaluation committee and found to be reasonable and acceptable; and,
WHEREAS, Pan American Engineers, LLC was ranked in the first position and is invited to submit a proposed Master Engineering Services Agreement and fee schedule;
NOW THEREFORE BE IT RESOLVED that the President is hereby authorized to enter into a Master Engineering Services Agreement with Pan American Engineers, LLC; and,
BE IT FURTHER RESOLVED that the President is hereby authorized to enter into Supplemental Engineering Services Agreements for individual Capital Improvement Program projects during the term of the Master Engineering Services Agreement.
Passed, approved and adopted this 12th day of November, 2024.
On motion by Mr. Craig Smith, seconded by Mr. Parrish Giles to allow Boy Scout Troop 66 to place a Book Box at the Deville Veteran’s Park. On vote the motion carried.
Mr. Shane Trapp, Building Superintendent, provided an update on the current projects at the Rapides Parish Courthouse and Rapides Parish Coliseum.
On motion by Mr. Craig Smith, seconded by Mr. Parrish Giles to authorize the President to execute Change Order No. 2 for the Exhibition Hall Renovation project with Tudor Construction Company in the amount totaling $53,673.00 to change electrical service to pad mount transformer in lieu of pole assembly to accommodate grounding requirements to meet code; resulting in a contract amount as revised of $874,647.00, as recommended by Ballard, CLC. Discussion ensued.
Mr. Rhett Desselle stated due to the current electrical code requirements a request of an additional $11,387.00 has been submitted for approval. He recommends the Jury approve the additional funds.
On amended motion by Mr. Craig Smith, seconded by Mr. Bubba Moreau to authorize the President to execute Change Order No. 2 for the Exhibition Hall Renovation project with Tudor Construction Company in the amount totaling $65,060.00 to change electrical service to pad mount transformer in lieu of pole assembly to accommodate grounding requirements to meet code; resulting in a contract amount as revised of $886,034.00, as recommended by Ballard, CLC. On vote the amended motion carried.
On motion by Mr. Craig Smith, seconded by Mr. Parrish Giles to appoint Chief John Dauzat, nominee of Louisiana Christian University to the Fire District No. 4 Civil Service Board for a three (3) year term to fill the expiring term of Ms. Gayle Murrell. Term will expire November 12, 2027. On vote the motion carried.
On motion by Mr. Parrish Giles, seconded by Mr. Ollie Overton to appoint Dexter Guins to fill the unexpired term of Harold Elliott on the Rapides Housing Authority Board. Term is for five (5) years, expiring on July 14, 2027. On vote the motion carried.
On motion by Mr. Danny Bordelon, seconded by Mr. Craig Smith to approve the following pay increases for current employees at Fire District No. 8 as recommended by the Cotile Volunteer Fire Department Board of Directors, two (2) part time firefighters and increase of $1.65 per hour, one (1) part time firefighter and the fire chief a ten percent (10%) increase, to be effective 10/27/2024. On vote the motion carried.
On motion by Mr. Danny Bordelon, seconded by Mr. Ollie Overton to approve the appointment of Mr. Roger Ramos as Interim Fire Chief for Rapides Parish Fire District No. 15, hourly rate of $20.00 per hour, not to exceed thirty-four (34) hours per week. On vote the motion carried.
On m otion by Mr. Parrish Giles, seconded by Mr. Ernest Neslon to receive the required report from Acadian Ambulance under the Contract for September 2024:

On motion by Mr. Parrish Giles, seconded by Mr. Ollie Overton to accept the donation of two (2) 10R 22.5 tires and the cost of mounting, valued at $500.00, from Phillips Logging to Rapides Fire District No. 14, as recommended by the Fire Chief. A letter be sent to Phillips Logging for their donation. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Parrish Giles to renew the FY 2025 Group Health Insurance with Blue Cross Blue Shield of LA and maintain the current plan offered to active employees and retirees with cost sharing of 88%/12% for active employees and 90%/10% cost sharing for retirees. On vote the motion carried.
On m otion by Mr. Ollie Overton, seconded by Mr. Parrish Giles to renew the Humana Insurance Plan for Medicare Primary Retirees for 2025 and authorize the President to sign. Rate increase from $385.09 in 2024 to $400.21 per month in 2025. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith the following item(s) were placed on the Jury but were posted on the agenda after the Committee Meeting in compliance with the public meetings law and are confirmed as having been added to the agenda by unanimous vote:

Ms. Betty Jo Bourgeois, Sales Tax Administrator, provided an update on the current proposed tax bills.
On motion by Mr. Parrish Giles, seconded by Mr. Bubba Moreau, the following resolution was unanimously adopted:

THE RAPIDES PARISH POLICE JURY
WHEREAS, Brudd Construction Co., LLC, the Contractor for State Project No. H.014261, F.A.P. No. H014261, Doshie Road Bridge Over Cherry Winche Creek Tributary has “Substantially Completed” the work under the Contract, as recommended by the Engineer.
NOW THEREFORE BE IT RESOLVED, that the construction project with Brudd Construction Co., LLC, the Contractor, for said work is hereby accepted as “Substantially Complete”;
BE IT FURTHER RESOLVED, that the signing and filing with the Clerk of Court of this Resolution by the Rapides Parish Police Jury is hereby authorized; and
BE IT FURTHER RESOLVED, that the President is authorized to sign this resolution to approve and accept that the Doshie Road Bridge Over Cherry Winche Creek Tributary as Complete.
Passed, approved, and adopted on this 12 th day of November, 2024.
On motion by Mr. Craig Smith, seconded by Mr. Bubba Moreau to appoint Laurie Meche, nominee of Louisiana Christian University to the Fire District No. 3 Civil Service Board for a three (3) year term to fill the un expired term of Ms. Beverly Ingram. Term will expire October 10, 2025. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Ernest Nelson to receive a report from the Parish Engineer on the following condemnations per Jury Meeting held on August 12 and September 10, 2024:

Mr. Rhett Desselle stated based off the findings of the report, it is his recommendation to proceed with the condemnations of the three (3) properties. He stated the owner of the property listed at 1411 Singer Drive, Pineville, LA 71360 is out of town and the Jury would need to appoint an attorney to represent the absentee.

NOW, THEREFORE BE IT RESOLVED, that the contract for said construction project is hereby awarded to the low bidder, Pat Williams Construction, LLC for the base bid of $1,096,600.00, contingent upon the following:

On motion by Mr. Ollie Overton, seconded by Mr. Bubba Moreau to open public hearing is to obtain views on the housing and community development needs of Rapides Parish and to discuss the submission of an application for funding under the State of Louisiana FY 2025 Community Development Block Grant (LCDBG) Clearance Program. Discussion ensued.
Mr. Thomas Magee stated LCDBG has opened the application process and is due by December 16, 2024. The grant can be 100% funded by LCDBG, however, an entity may receive additional points for providing matching funds. He asked if there were any questions or comments by those in attendance, which there were none. He asked for each Ju ror to submit a list of eight (8) to ten (10) addresses in their respective districts that may qualify under the clearance program. He stated the structures must be vacant to qualify.
On motion by Mr. Craig Smith, seconded by Mr. Parrish Giles the public hearing was closed. On vote the motion carried.
On motion by Mr. Craig Smith, seconded by Mr. Jay Scott to submit an application under the State of Louisiana FY 2025 Community Development Block Grant (LCDBG) Clearance Program. On vote the motion carried.
On motion by Mr. Craig Smith, seconded by Mr. Parrish Giles to adopt the following resolution;

WHEREAS, Gregory L. Jones is in need of the expertise of Gold Weems Bruser Sues & Rundell, APLC , in the area of USDC Western District of Alexandria Division; and
WHEREAS, a Civil Suit has been filed, McKenzie v. City of Alexandria: Civil Action 1:24-cv-01289, USDC Western District of Alexandria Division, against the Rapides Parish Police Jury; and
WHEREAS, Gold Weems Bruser Sues & Rundell, APLC, has represented others in Civil Actions and the employment of private counsel will greatly assist the Police Jury in this defense; and
WHEREAS, Gold Weems Bruser Sues & Rundell, APLC, be hereby retained as cocounsel for the Rapides Parish Police Jury; at the compensation schedule published and approved by the attorney general not to exceed $225.00 per hour together with incurred expenses for court cost advances, subpoena and deposition fees, and other like out-of-pocket expenditures, subject however to the approval of the Louisiana Attorney General pursuant to R.S. 42:263; and
WHEREAS, Gold Weems Bruser Sues & Rundell, APLC, is hereby retained for a term of one (1) year beginning November 1 , 2024 and ending November 1, 2025 ; and
WHEREAS, in the event of claims brought in federal court seeking equitable relief, these claims may implicate the interests of the State of Louisiana, and so the Rapides Parish Police Jury agrees to provide advance written notice to the Louisiana Attorney General ten (10) business days before the next meeting and an opportunity for the Attorney General to express concerns directly to the Board in writing or in executive session before the Board:
- (1) proposes a settlement, accepts a proposed settlement, agrees to a consent decree, or enters any other agreement with any party in any federal action for declaratory or injunctive relief that is going to be or has been filed; or
- (2) files any document in any federal case in which(a) declaratory or injunctive relief has been granted against the Board, (b) final judgement dismissing the case has not been entered, and (c) at least 3 years have passed since any party seeking relief, including the USDOJ in an amicus capacity, filed any document in the case.
Accordingly, the Rapides Parish Police Jury authorizes and directs Gold Weems Bruser Sues & Rundell, APLC , to provide the required notice to the Attorney General, release such information and documentation as the Attorney General may request in response to the notice, and generally cooperate with the Attorney General in regard to the notice.
WHEREAS, this resolution shall take effect immediately; and
THEREFORE, BE IT RESOLVED, that the Rapides Parish Police Jury, pursuant to La. R.S. 42:262, does hereby retain and Gold Weems Bruser Sues & Rundell, APLC, as special counsel; and
BE IT FURTHER RESOLVED, that this Resolution and proposed contract described herein be submitted to the Attorney General for the State of Louisiana for approval.
The resolution having been submitted to a vote; the vote thereon was as follows:

Whereupon the Resolution was declared adopted by the Rapides Parish Police Jury on the 12 th day of November, 2024.
On motion by Mr. Parrish Giles, seconded by Mr. Danny Bordelon, the following resolution was unanimously adopted:
RESOLUTION
A resolution providing for canvassing the returns and declaring the results of the special election held in Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana, on Tuesday, November 5, 2024, to authorize the levy of a sales and use tax therein.
BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana (the "District"), that:
SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana, on Tuesday, November 5, 2024, to authorize the levy of a sales and use tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.
SECTION 2. Election Results. According to the official certified tabulation of votes cast at said Election, there was a total of 921 votes cast IN FAVOR OF the Proposition and a total of 1,612 votes cast AGAINST the Proposition, resulting in a majority of 691 votes cast AGAINST Proposition. The Proposition was therefore duly DEFEATED by a majority of the votes cast by the qualified electors voting at the Election.
SECTION 3. Promulgation of Election Result. The results of said election shall be promulgated by publication in the manner provided by law, after receipt from the Secretary of State’s office of the actual costs of the election, as required by §18:1292 of the Louisiana Revised Statutes of 1950, as amended.
SECTION 4. Declaration. The foregoing results of the Election are hereby declared by this Governing Authority and shall be published as required by law.
SECTION 5. Procès Verbal. A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in her office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.
This resolution having been submitted to a vote, the vote thereon was as follows:

BE IT KNOWN AND REMEMBERED that on Tuesday, November 12, 2024, at 3:00 p.m., at its regular meeting place, the Police Jury Room of the Rapides nd Floor, Alexandria, Louisiana, the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana (the "District"), and being the authority ordering the special election held therein on Tuesday, November 5, 2024, with a quorum being present, did examine the official certified tabulations of votes cast at the said election, and did examine and canvass the returns of said election, there having been submitted at said election the following proposition to wit:

Shall Road District No. 5A Sales Tax District of the Parish of Rapides, State of Louisiana (the "District"), be authorized to levy and collect a tax of 2% (the "Tax") in accordance with Louisiana law (an estimated $376,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), in perpetuity, commencing January 1, 2025, with the avails and proceeds of the Tax (after paying reasonable and necessary costs and expenses of collecting and administering the Tax) to be dedica ted and used for the purpose of constructing, improving, maintaining and keeping in repair the public roads, highways, bridges and related drainage facilities in the District?
There was found by said count and canvass that there was a total of 921 votes cast IN FAVOR OF the Proposition and a total of 1,612 votes cast AGAINST the Proposition, as hereinabove set forth, and it was further found and determined that there was a majority of 691 votes cast AGAINST the Proposition as hereinabove set forth.
Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that the Proposition as hereinabove set forth was duly DEFEATED by a majority of the votes cast by the qualified electors voting at the said special election.

REGULAR MEETING
NOVEMBER 12, 2024
On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith to receive an update from the Storage Building Negotiation Committee. Discussion ensued.
Mr. Brian Thompson stated he met with the property owner to negotiate a sale price for the building located at 1293 Murray Street, Alexandria, LA. Mr. Thompson stated the sale price of three hundred twelve thousand five hundred dollars and no cents ($312,500.00) was agreed upon by both parties. Mr. Thompson stated the sale price was within appraisal range and if the Jury wanted to proceed he would need a deposit of one thousand dollars and no cents. Mr. McGlothlin expressed his concerns of being in the same vicinity of our current storage building and having the same issues.
Roll call vote as follows to proceed with the purchase of the building:
