The Police Jury of the Parish of Rapides, State of Louisiana, met i n Special Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, on Wednesday, Fe bruary 22, 2023, at one (1:00) o'clock p.m. (Central Standard Time).

There were present: Joseph “Joe” Bishop , President, Sean McGlothlin, Vice President and Police Jurors: Craig Smith, Theodore Fountaine, III, Oliver “Ollie” Overton, Jr., David Johnson and Jay Scott.

Absent: Davron “Bubba” Moreau and Rusty Wilder

Also present were: Ms. Theresa Pacholik, Secretary/Treasurer; Mr. Shane Trapp , Courthouse Building Superintendent; Greg Jones, Legal Counsel

The invocation was given by Mr. Ollie Overton.

The Pledge of Allegiance was led by Mr. Theodore Fountaine, III

The Police Jury of the Parish of Rapides, State of Louisiana, was duly con vened as the governing authority of said Parish by Hon. Joe Bishop, Presid ent, who welcomed all present and then stated that the Police Jury was read y for the first item of business.

On motion by Mr. Sean McGlothlin, seconded by Mr. Craig Smith to open a public hearing on appropriation of ARPA funds to close purchase of property located at 711 Washington Street, Alexandria, Louisiana, for Parish agencies office annex. Discussion ensued.

Mr. Greg Jones, Legal Counsel, stated the appraisal, review of the appraisal and engineer inspection of the property was completed. President Bishop stated all tenants were aware of the purchase and their deadline to vacate the premises.

On motion by Mr. Sean McGlothlin, seconded by Mr. Ollie Overton to close the public hearing. On vote the motion carried.

SPECIAL JURY MEETING

FEBRUARY 22, 2023 On motion by Mr. Sean McGlothlin, seconded by Mr. Craig Smith for FINAL APPROVAL AND AUTHORIZATION TO PURCHASE THE IMMOVABLE PROPERTY and building at 711 Washington Street, Alexandria, Louisiana, AND

AUTHORIZE the payment of $875,000.00 to be paid from ARPA funds, to finalize the purchase of the immovable property and building office space located at 711 Washington Street, Alexandria, Louisiana, to consolidate General government administration, staff and administrative facilities (and install COVID prevention HVAC systems), for the Registrar of Voters, the 9th JDC Juvenile Probation Offices, the Parish Veterans Affairs Offices, the Parish Civil Service Offices, the Parish District Attorney Juvenile Offices, and necessary Parish Records Storage; AND

The Parish President and/or Treasurer, are hereby authorized as necessary and appropriate, to execute any documents in connection with the above approval, and do hereby order and instruct the Parish Treasurer to provide the appropriate distributions and line item credits under the CSLFRF Final Rules;

Retain and authorize real estate Attorney Brian Thompson to handle all issues related to the buy-sell agreement, title, and closing for the purchase of said property.

On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Craig Smith the following resolution was adopted:

RESOLUTION

AUTHORIZING EXPENDITURE

OF AMERICAN RESCUE ACT PLAN FUNDS UNDER

U.S. DEPARTMENT OF THE TREASURY

Coronavirus State & Local Fiscal Recovery Funds Final Rules

WHEREAS, the COVID-19 Pandemic began in early 2020 and continued unabated through December 2021, with hundreds of deaths and thousands of hospitalizations here in Rapides Parish, while the Parish and its statutory agencies were required to continue to provide day-to-day operations and public SPECIAL JURY MEETING FEBRUARY 22, 2023 services and responses for public safety and public health & welfare during the pandemic;

AND WHEREAS, The Parish of Rapides has been allocated a total of $25,182,604.00 in funds under the ARPA. The "Coronavirus State & Local Fiscal Recovery Funds Final Rules" issued by the U.S. Department of the Treasury (CSLFRF Final Rules) in January, 2022, and effective on April 1, 2022;

AND WHEREAS, the "Coronavirus State & Local Fiscal Recovery Funds Final Rules'' (CSLFRF Final Rules) issued by the U.S. Department of the Treasury and effective on April 1, 2022, (U.S. 31 CFR Sec. 35-35.12,Dept of the Treasury) provide for the guidelines for the COVID-19 Pandemic replacement of governmental loss of revenues, expenditures, and construction of capital improvements, and water and sewer infrastructure improvements, and specifically include and provide, but are not limited to the following provisions:

SPENDING ON GOVERNMENT SERVICES: Recipients can use SLFRF funds on government services up to the standard allowance revenue loss amount ($10,000,000.00}. Government Services generally include ANY SERVICE provided by a government, unless Treasury has stated otherwise - some common examples are (this list is not exhaustive): Health Services; General Government, Administration, Staff, and Administrative Facilities; Provision for Police, Fire, and other Public Safety Services;"

GOVERNMENTAL SERVICES

& CAPITAL IMPROVEMENTS

• (a) SPENDING ON GOVERNMENT SERVICES 11 Recipients can use SLFR FUNDS on government services up to the revenue loss amount, whether that be the standard allowance or the calculated using the above approach. Government services generally include any service traditionally provided by a government, unless Treasury has stated otherwise. Some common examples are: Health Services; General government administration, staff and administrative facilities; Provision for police, fire, and other public safety services; Road building and maintenance, and other infrastructure;
• (b) RESPONDING TO THE PUBLIC HEALTH EMERGENCY COVID-19 Mitigation and Prevention. The pandemic has broadly impacted SPECIAL JURY MEETING FEBRUARY 22, 2023 Americans and recipients can provide services to prevent and mitigate COV/019 to the general public or to small businesses, nonprofits, and impacted industries in general. Enumerated eligible uses include: *Ventilation system installation and improvement

AND WHEREAS, the CSLFRF Final Rules specifically provided:

11 Recipients may determine their revenue loss by choosing between two options:

• • A standard allowance of up to $10 million in aggregate, not to exceed their award amount, during the program."

AND WHEREAS. after several meetings and preparation, on March 14, 2022, the Rapides Parish Police Jury formally passed, at a regular public meeting, a RESOLUTION selecting and adopting the "standard allowance" of up to $10,000,000.00 for the Pandemic replacement of governmental loss of revenues, expenditures, and construction of capital improvements, and water and sewer infrastructure improvements, including a "Final Rule Funding Proposed Plan" which identified a formal listing of 13 categories for expenditures that are within compliance with the "Coronavirus State & Local Fiscal Recovery Funds Final Rules" (CSLFRF Final Rules) issued by the U.S. Department of the Treasury and effective on April 1, 2022, (U.S. 31 CFR Sec. 35-35.12, Dept of the Treasury;

AND WHEREAS said Rapides Parish Police Jury itemized "Final Rule Funding Proposed Plan" adopted on March 14, 2022, by formal Resolution (see attached "EXHIBIT A"), specifically included the categories and projects listed below herein under this Resolution;

AND WHEREAS

said Rapides Parish Police Jury did approve at a public meeting held on December12, 2022, a buy-sell agreement for the purchase of immovable property and building office space located at 711 Washington Street, Alexandria, Louisiana, to consolidate General government administration staff and administrative facilities (and install improve COVID prevention HVAC systems), for the Registrar of Voters, the 9th JDC Juvenile Probation Offices, the Parish Veterans Affairs Offices, SPECIAL JURY MEETING FEBRUARY 22, 2023 the Parish Civil Service Offices, the Parish District Attorney Ju venile Offices, and necessary Parish Records Storage; AND that all regulations, conditions, and terms required for said sale have now been complied with;

NOW THEREFORE BE IT RESOLVED THAT BY THE POLICY JURY OF THE PARISH OF RAPIDES, pursuant to the "Coronavirus State & Local Fiscal Recovery Funds Final Rules'' issued by the U.S. Department of the Treasury (CSLFRF Final Rules), effective on April 1, 2022, does hereby approve and adopt and authorize the following:

1. the payment of $875,000.000 to be paid from Parish ARPA funds, to finalize the purchase of the immovable property and building office

consolidate General government administration, staff and administrative facilities (and install COVID prevention HVAC systems), for the Registrar of Voters, the 9th JDC Juvenile Probation Offices, the Parish Veterans Affairs Offices, the Parish Civil Service Offices, the Parish District Attorney Juvenile Offices, and necessary Parish Records Storage; AND

2. The Parish President and/or Treasurer, are hereby authorized as necessary and appropriate, to execute any documents in connection with the above approval, and do hereby order and instruct the Parish Treasurer to provide the appropriate distributions and line item credits under the CSLFRF Final Rules.

THIS RESOLUTION PASSED, ADOPTED, AND APPROVED ON THIS THE 22nd DAY OF FEBRUARY, 2023,
