The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 70 1 Murray Street, Alexandria, Louisiana, on Monday, June 10, 2024, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Joseph “Joe” Bishop , President and Police Jurors: Davron “Bubba” Moreau, Craig Smith, Danny Bordelon, Oliver “Ollie” Overton, Jr., Sean McGlothlin, Parrish Giles and Jay Scott.

Absent: Ernest Nelson

Also present were: Ms. Theresa Pacholik, Secretary/Treasurer; Mr. Cory Ashmore, Public Works Director; Mr. Shane Trapp, Building Superintendent; Chief David Corley, FD#3; Ms. Sharon Neal, WOD/OEWD Executive Director; Ms. Betty Jo Bourgeois, Sales Tax Administrator; Ms. Linda Sanders, Civil Service Director; Hon. Greg Beard; Mr. Rhett Desselle, Pan American Engineers ; Mr. Matt Johns, RAPC Executive Director; Ms. Marla West, Purchasing Agent; and Mr. Greg Jones, Legal Counsel.

The invocation was given by Mr. Ollie Overton.

The Pledge of Allegiance was led by Mr. Craig Smith.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened a s the governing authority of said Parish by Hon. Joe Bishop, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

President Bishop asked if there were any Juror comments to which Mr. Craig Smith stated he has been researching the purchase or lease of a grapple truck for the Public Works Department. The quote for a two (2) year lease of a grapple truck is estimated at $6,500.00 per month, to purchase a used grapple truck will range from $145,000.00 - $160,000.00 and to purchase a new grapple truck will range from $230,000.00 - $275,000.00. Mr. Smith asked for the Jurors to state which option they would like to pursue. Discussion ensued. The consensus was to advertise and receive bids for two (2) used grapple trucks.

President Bishop presented plaques to Xtreme Athletics team, Mini Militia, for winning the Prep Grand Nationals Championship in Orlando, Florida.

On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on May 13, 2024, and Special Session on June 6, 2024, as published in the Official Journal. On vote the motion carried. Mr. Jay Scott voted nay.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith that approved bills be paid. On vote the motion carried.

Ms. Allison Elnaggar gave the annual report for the LSU Ag Center.

On motion by Mr. Bubba Moreau, seconded by Mr. Sean McGlothlin to open the Public Hearing for the Front Sight Shooting Range. Mr. Matt Johns stated they went REGULAR MEETING JUNE 10, 2024

through the same procedures for the public hearing as they would for proposed subdivisions. They sent out the proper notices to surrounding landowners and to the individual submitting the application. Mr. Jones recommended if approved the permit should only be issued to the individual who submits the application and Gravity Drainage District No. 2 and Mr. Jay Scott have identified some drainage issues that will need to be addressed. Mr. Bishop asked if there were any objections and to which there were non e. Mr. Bishop asked if the landowner was present, to which there was no reply.

On motion by Mr. Joe Bishop, seconded by Mr. Craig Smith to close the Public Hearing. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Ollie Overton to waive the thirty (30) day announcement rule and reappoint Mr. Mark Winegeart on the Rapides Parish Fire District No. 2 Civil Service Board for a three (3) year term, new term will begin on July 30, 2024. On vote the motion carried.

BE IT FURTHER RESOLVED that the proper administrative officials of the Parish of Rapides, State of Louisiana, be and they are hereby empowered, authorized, and directed to spread said taxes, as hereinabove set forth, upon the assessment roll of said Parish for the year 2024, and to make the collection of the taxes imposed for and on behalf of the taxing authority, according to law, and that the taxes herein levied shall become a permanent lien an d privilege on all property subject to taxation as herein set forth, and collection thereof shall be enforceable in the manner provided by law.

The foregoing resolution was read in full, the roll was called on the adoption thereof, and the resolution was adopted by the following votes:

BE IT FURTHER RESOLVED, that the President is hereby authorized to execute contracts, change orders and other documents related to the project between the Rapides Parish Police Jury and the successful Bidder.

ORDINANCE

AN ORDINANCE TO AMEND AND REENACT SECTION 18 -4.2

• (I) SPEED LIMITS SO AS TO SET A 15 MPH SPEED LIMIT ON ED PERKINS ROAD, WARD 6, DISTRICT H

BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 10th day of June, 2024, that Section 18-4.2 (i) of the Rapides Parish Code of Ordinances is hereby amended and reenacted to set a 15 mph speed limit on the following road 5 as follows:

Chapter 18. MOTOR VEHICLES AND TRAFFIC

Section 18-4.2. Speed limits designated on certain streets:

• (i) Fifteen miles per hour. It shall be unlawful for any person to drive or operate a vehicle upon the following parish road in Rapides Parish in excess of fifteen (15) miles per hour.

… (l). Whoever violates the provisions of this section shall be punished by a fine not to exceed one hundred dollars ($100.00), or imprisoned in the Rapides Parish Jail for a period not to exceed thirty (30) days, or both.

BE IT FURTHER ORDAINED that this ordinance is to be effective immediately.

BE IT FURTHER ORDAINED in all other respects Section 18 -4.2 of the Rapides Parish Code of Ordinances shall remain unchanged.

BE IT FURTHER ORDAINED that the Parish Highway Department is hereby authorized to erect the speed limit signs on the Road and a copy of this ordinance sent to the Rapides Parish Sheriff Office.

WHEREAS, Gregory L. Jones is in need of the expertise of The Law Office of McCoy Roberts & Begnaud, LTD and attorney Mark A. Begnaud in the area of U.S. Bankruptcy Court; and

WHEREAS, a Civil Suit has been filed, Case No. 24-80189, U.S. Bankruptcy Court, Western District of Louisiana Division, against the Rapides Parish Police Jury; and

WHEREAS, Mark A. Begnaud, t he Law Office of McCoy Roberts & Begnaud, LTD, of Natchitoches, Louisiana, has represented others in Bankruptcy Court and the employment of private counsel will greatly assist the Police Jury in this defense; and

WHEREAS, Mark A. Begnaud, t he Law Office of McCoy Roberts & Begnaud, LTD, be hereby retained as co -counsel for the Rapides Parish Police Jury; at the compensation schedule published and approved by the attorney general not to exceed $275.00 per hour together with incurred expenses for court cost advances, subpoena and deposition fees, and other like out -of-pocket expenditures, subject however to the approval of the Louisiana Attorney General pursuant to R.S. 42:263; and

WHEREAS, Mark A. Begnaud, t he Law Office of McCoy Roberts & Begnaud, LTD, is hereby retained for a term of one (1) year beginning July 1, 2024 and ending June 30, 2025; and

WHEREAS, in the event of claims brought in federal court seeking equitable relief, these claims may implicate the interests of the State of Louisiana, and so the Rapides Parish Police Jury agrees to provide advance written notice to the Louisiana Attorney General ten (10) business days before the next meeting and an opportunity for the Attorney General to express concerns directly to the Board in writing or in executive session before the Board:

• (1) proposes a settlement, accepts a proposed settlement, agrees to a consent decree, or enters any other agreement with any party in any federal action for declaratory or injunctive relief that is going to be or has been filed; or
• (2) files any document in any federal case in which(a) declaratory or injunctive relief has been granted against the Board, (b) final judgement dismissing the case has not been entered, and (c) at least 3 years have passed since any party seeking relief, including the USDOJ in an amicus capacity, filed any document in the case.

Accordingly, the Rapides Parish Police Jury authorizes and directs Mark A. Begnaud, t he Law Office of McCoy Roberts & Begnaud, LTD , to provide the required notice to the Attorney General, release such information and documentation as the Attorney General may request in response to the notice, and generally cooperate with the Attorney General in regard to the notice

WHEREAS, this resolution shall take effect immediately; and

THEREFORE, BE IT RESOLVED, that the Rapides Parish Police Jury, pursuant to La. R.S. 42:262, does hereby retain and employee Mark A. Begnaud, the Law Office of McCoy Roberts & Begnaud, LTD, as special counsel; and

BE IT FURTHER RESOLVED, that this Resolution and proposed contract described herein be submitted to the Attorney General for the State of Louisiana for approval.

The resolution having been submitted to a vote; the vote thereon was as follows:

Whereupon the Resolution was declared adopted by the Rapides Parish Police Jury on the 10th day of June, 2024.

On motion by Mr. Sean McGlothlin, seconded by Mr. Craig Smith to discuss the creation of a policy that anyone entering the first floor of the R apides Parish Courthouse, including employees, shall be required to go thru the metal detectors that are monitored by the Rapides Parish Sheriff’s Office. Discussion ensued.

On m otion by Mr. Sean McGlothlin, seconded by Mr. Ollie Overton to approve entering into an Intergovernmental Government Agreement with Louisiana State Police for eight (8) hours training on Coliseum property and authorize the Parish President to sign all necessary documents. Discussion ensued.

On amended motion by Mr. Sean McGlothlin, seconded by Mr. Joe Bishop to approve entering into an annual Intergovernmental Government Agreement with all local, parish and state law enforcement entities for eight (8) hours training on Coliseum property and for the scheduling of the training to be approved by ASM Global and authorize the Parish President to sign all necessary documents. On vote the motion carried.

On m otion by Mr. Ollie Overton, seconded by Mr. Bubba Moreau to renew the Cooperative Endeavor Agreement with the LSU AgCenter to support and administer Louisiana Cooperative Units Off Campus for a three (3) year period beginning July 1, 2024 to June 30, 2027, in the amount of $54,502.00, add a non -appropriation clause and authorize the President to sign. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Craig Smith to nominate and appoint Erin Guin to represent Louisiana Christian University on the Rapides Parish REGULAR MEETING JUNE 10, 2024

Civil Service Board to fill the unexpired three (3) year term of Mr. Stan Miller. Term will expire April 14, 2026. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Parrish Giles to increase Fire Protection District No. 3 Part Time Firefighters starting pay rate from $12 per hour to $14 per hour effective July 28, 2024, as recommended by Alpine Voluntee r Fire Department Board of Directors, to be paid out of Fire Protection Distric t No. 3 Funds. On vote the motion carried.

On m otion by Mr. Bubba Moreau, seconded by Mr. Craig Smith to increase all current Fire Protection District No. 3 Part Time Firefighters, a $2 per ho ur raise effective July 28, 2024, as recommended by Alpine Volunteer Fire Department Board of Directors, to be paid out of Fire Protection District No. 3 Funds. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Sean McGlothlin to amend Fire Protection District No. 3 Part Time Firefighter pay plan adopted on 06/08/2015, to include, any employee that works over 1,000 hours in a calendar year will receive a $1 per hour raise to be effective in January the following year, as recomm ended by Alpine Volunteer Fire Department Board of Directors, to be paid out of Fire Protection District No. 3 Funds. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith to grant 4% annual longevity pay increase for Rapides Parish Fire Protection District No. 3 Fire Chie f, Training Officer and Records Clerk, in addition to any mandated raises, effective July 28, 2024, as recommended by Alpine Volunteer Fire Department Boar d of Directors, to be paid out of Fire Protection District No. 3 Funds. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Bubba Moreau to grant 2% annual longevity pay increase mandated by the State for eligible Rapides Parish Fire Protection District No. 7 employees effective July 28, 2024, as recommended by Ruby Kolin Volunteer Fire Department Board of Directors, to be paid out of Fire Protection District No. 7 funds. On vote the motion carried.

On motion by Mr. Parrish Giles, seconded by Mr. Craig Smith to receive the required report from Acadian Ambulance under the Contract for April 2024:

Mr. Bishop stated the committee met and reviewed the three (3) proposals received and the committee recommends awarding RFP#3281 Engineer/Architectural Services for Hometown Revitalization and Resilient Communities Infrastructure Program to Pan American Engineers.

On motion by Mr. Sean McGlothlin, seconded by Mr. Bubba Moreau to awardRFP#3281 Engineer/Architectural Services for Hometown Revitalization and Resilient Communities Infrastructure Program to Pan American Engineers as recommended by the Selection Committee. On vote motion the carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Jay Scott to authorize the payment for two (2) Rapides Parish Sheriff’s deputies for security detail at Co tile Lake Recreation for Juneteenth celebrations, June 15 th, June 16th and June 19th and July 4th holiday weekend, Thursday, July 4 th thru Sunday, July 7 th, for the hours of 12:00 p.m. to 8:00 pm each day. On vote the motion carried.

On m otion by Mr. Ollie Overton, seconded by Mr. Sean McGlothlin to declare Wednesday, June 19 th, 2024, as a parish holiday, in observance of Juneteenth, in accordance with Proclamation 29 JML 2024 issued by Governor Jeff Landry on May 28, 2024. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Sean McGlothlin to approve the extension for the paid Auditor internship(s) at the Rapides Parish Sales & Use Tax Department, not to exceed forty (40) hours per week, beginning in June and ending in May. Position was unable to be filled during the school year. On vote the motion carried.

On motion by Mr. Danny Bordelon, seconded by Mr. Craig Smith to discuss and authorize the creation of a policy to allow food and non -alcoholic drink truck vendors to conduct sales within Cotile Recreation Park on the weekends and holidays. Discussion ensued.

On motion by Mr. Parrish Giles, seconded by Mr. Ollie Overton to authorize asphalt overlay on various roads within the Town of Cheneyville, not to exceed $60,000.00, project to be funded Road District 3A, District H. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Bubba Moreau to award RFP No.3262 – Substance Abuse Testing/Physicals to Louisiana Occupational Health Services (LOHS) for a one (1) year term, with the option to extend for an additional two (2) years beginning July 1, 2024, as recommended by the Purchasing Agent. On vote the motion carried.
