Motion to approve Change Order No. 3 to the construction contract with Progressive Construction Co., LLC, for the Red River Levee Recertification, Aloha Rigolette North Bank Project, 40 PARA 3301, for an increase of $15,953.02 adjusting final contract quantities, upgraded securit y fencing and additional components at the Bayou Darrow Flow Control Structure, as recommended by Meyer, Meyer, LaCroix & Hixson, Engineers and approved by the State of Louisiana Office of Community Development and authorize the President to sign same. The increase will be paid with grant funds. The final contract price is $16,014.28 less than the original bid amount. (Workforce 9/6)

Motion to authorize the Rapides Parish Police Jury to continue the a nnual lease agreement with Human Learning Systems, formally Shreveport Job Corps, for 211 square feet of office space in the Rapides American Job Center at a rate of $18.8945 per square foot ($332.23 per month) with proceeds appropriated to the Office of Economic and Workforce Development and authorize the President to sign the lease. (This is a current lease that has been in existence since 2013 under Shreveport Job Corp, which has been bought out by Human Learning Systems.) (Workforce 9/6)

The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, September 12, 2022, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Craig Smith, President, Oliver “Ollie” Overton, Jr., Vice President and Police Jurors: Joe Bishop, Davron “Bubba” Moreau, Theodore Fountaine, III, Rusty Wilder, Sean McGlothlin, David Johnson and Jay Scott.

Also present were Theresa Pacholik, Treasurer; Shane Trapp, Courthouse Building Superintendent; Donna Andries, Sales and Use Tax Director; Cory Ashmore, Public Works Director; Elaine Morace, WIA Operations Director; Linda Sanders, Civil Service Director; Greg Jones, Legal Counsel and Laurel Smith, Secretary.

The invocation was given by Mr. Oliver “Ollie” Overton.

The Pledge of Allegiance was led by Mr. Greg Jones.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any public comment on any agenda item, t o which there was no response.

The first item on the agenda was to recognize Shalon Latour, Candidate for Public Service Commissioner for District No. 4.

Mr. Shalon Latour gave a brief statement of his candidacy for Public Service Commission in District No. 4 and asked the Jury for their support.

The next item was to recognize Mr. Chris Roy, President of Red River, Atchafalaya & Bayou Boeuf to give an update on the Red River, Atchafalaya & Bayou Boeuf Levee District Board.

Mr. Chris Roy, President of Red River Atchafalaya & Bayou Boeuf introduced Mr. Ryan Ingalls, Executive Director. Mr. Roy gave a brief overview of the creation and responsibilities of RRABB to operate and maintain flood protection levees within its jurisdictional boundaries. Mr. Roy spoke of the numerous jobs that are being done by RRABB in Avoyelles Parish and about the difference in Tax Revenue St. Landry, Avoyelles and Rapides Parish contribute. Mr. Roy passed out a resolution he would like for the Jurors to seek support from their representatives to increase the number of commissioners on the board at RRABB and to include Grant Parish in the boundary.

WHEREAS, the Code of Federal regulations as enacted by the United States REGULAR MEETING SEPTEMBER 12, 2022

Congress mandates that all structures defined as bridges located on all public roads shall be inspected, rated for safe load capacity and posted in accordance with the National Bridge Inspection Standards and that an inventory of these bridges be maintained by each State; and,

WHEREAS, the responsibility to inspect, rate and load post those bridges under the authority of Rapides Parish in accordance with those Standards is delegated by the Louisiana Department of Transportation and Development to Rapides Parish.

THEREFORE, BE IT RESOLVED by the governing authority of Rapides Parish (herein referred to as the Parish) that the Parish in regular meeting assembled does hereby certify to the Louisiana Department of Transportation and Development (herein referred to as the DOTD) that for the period October 1, 2021 through September 30, 2022:

1. The Parish has performed all interim inspections on all Parish owned or maintained bridges in accordance with the National Bridge Inspection Standards.
2. All bridges owned or maintained by the Parish have been structurally analyzed and rated by the Parish as to the safe load capacity in accordance with AASHTO Manual for Maintenance Inspection of Bridges. The load posting information that has been determined by the LA DOTD for all bridges where the maximum legal load under Louisiana State law exceeds the load permitted under the operating rating as determined above has been critically reviewed by the Parish. Load posting information has been updated by the Parish to reflect all structural changes, any obsolete structural ratings or any missing structural ratings.
3. All Parish owned or maintained bridges which require load posting or closing are load posted or closed in accordance with the table in the DOTD Engineering Directives and Standards Manual Directive No. 1.1.1.8. All DOTD supplied load posting information concerning a bridge has been critically reviewed by the Parish Engineer prior to load posting.
4. All bridges owned or maintained by the Parish are shown on the attached list in the format specified by the DOTD. Corrections to data supplied to the Parish by the LA DOTD are noted.

These stipulations are prerequisites to participation by the Parish in the Off-System Bridge Replacement Program.

RESOLUTION TO SUBMIT FY 2023-2027 CAPITAL IMPROVEMENTS PROGRAM APPLICATION FOR THE ESLER REGIONAL AIRPORT BY THE RAPIDES PARISH POLICE JURY

WHEREAS, Title 2 of the Louisiana Revised Statutes of 1950 provides that cities, REGULAR MEETING SEPTEMBER 12, 2022

towns, parishes, and other political subdivisions of this State may separately or jointly acquire, establish, construct, expand, own, lease, control, equip, improve, maintain, operate, regulate, and police airports and landing fields for the use of aircraft; and,

WHEREAS, the State of Louisiana, Department of Transportation and Development, Division of Aviation (formerly the LA DOTD-OAPT) is charged by Title 2 with the responsibility for the development of aviation facilities within the State to foster air commerce and to safeguard the interests of those engaged in all phases of the aviation industry and of the general public; and,

WHEREAS, the Rapides Parish Police Jury hereinafter referred to as “Sponsor”, has completed an FAA and DOTD approved Master Plan, Action Plan, and/or Airport Layout Plan which outlines the specific future development of the Esler Regional Airport; and, the Sponsor is desirous of implementing a portion of the approved Plan recommendations which provide for the critically needed improvements as stated below to substantially improve the safety and usability of the Airport, but does not have sufficient funds of its own required for completing the needed improvements; and,

WHEREAS, the LA DOTD, Division of Aviation is authorized by Title 2 to expend funds for the construction or enlargement of airports for the safety and advancement of aeronautics;

NOW, THEREFORE, BE IT RESOLVED:

SECTION I

That the Sponsor does hereby formally request that the LA DOTD, Division of Aviation provide funds required to complete the airport improvements at the Esler Regional Airport specifically as described in the Capital Improvement Program Application for State Financial Assistance to be dated September 2022.

SECTION II

That the said LA DOTD, Division of Aviation be and is hereby assured that all necessary servitudes, rights-of-way, rights of ingress and egress and means thereof will be furnished by the Sponsor and the titles thereto will be valid and indefeasible, and that the Sponsor will assume ownership, financial reporting, and complete responsibility for the maintenance and upkeep of the airport after completion of said improvement.

SECTION III

That the Sponsor will save and hold the said LA DOTD, Division of Aviation, its officers, agents, and employees harmless from any liability or claim for damages arising out of the project, including death or injuries to third parties including, but not limited to, liability or claim for damages out of the negligence of said LA DOTD, Division of Aviation, its officers, agents, or employees, and expressly agrees to defend any suit of any nature brought against the LA DOTD, Division of Aviation as a result of this project.

Mr. Rusty Wilder stated as the Rapides Parish Police Jury is the owner of the Cotile Recreation Park, if the Jury is not going to take care of it, who is. The Jury is the owners and it’s up to us to take care of it.

WHEREAS, the Rapides Parish Police Jury intends to submit a FY 2023 Application for funding under the LCDBG Program for Street Improvements; and,

WHEREAS, the LCDBG regulations provide that two (2) additional ranking points can be secured if an applicant agrees to pay for all related non-construction fees; including topographical surveys, geotechnical investigations, engineering services, observation of construction, etc.; and,

WHEREAS, because of the competitive nature of the LCDBG Program, it is believed that as a strategy to improve the Police Jury’s rating for grant funds it is advisable to make the financial commitment to locally provide the funds for these costs and thereby utilizing LCDBG grant funds, if awarded, only for construction costs; and,

WHEREAS, it is estimated that the expenses that are non-construction and related to the technical services required for a LCDBG grant would total approximately 15% of the amount of grant funds awarded; excluding grant administration and technical assistance services, which are considered as a separate category in the LCDBG Program.

NOW THEREFORE BE IT RESOLVED, that the Police Jury hereby obligates and commits, as part of the LCDBG application process, to pay for engineering, observation of construction, topographic survey, geotechnical investigations, and miscellaneous related costs all in an effort to raise the competitiveness of the Police Jury’s LCDBG application by securing two (2) additional points in the rating process; and,

BE IT FURTHER RESOLVED, that Pan American Engineers, LLC is hereby selected to provide the required engineering services for fees in accordance with LCDBG guidelines; and,

BE IT FURTHER RESOLVED, that the Parish President is hereby directed to include a copy of this resolution in the project file related to the LCDBG application to serve as documentation as to the Police Jury’s commitment to obligate itself to pay for all related non-construction fees; including topographical surveys, geotechnical investigations, engineering services, observation of construction, etc. utilizing local funds, when and if the LCDBG Grant Application is awarded.

A resolution canceling an election called by a resolution adopted on May 9, 2022, to authorize the levy of a special tax in Road District No. 5A of Rapides Parish, State of Louisiana, and providing for other matters in connection therewith.

WHEREAS, the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), adopted a resolution on May 9, 2022 ordering and calling a special election to be held in Road District No. 5A of Rapides Parish, State of Louisiana (the “District”), on Tuesday, November 8, 2022 to authorize the levy of a special tax therein (the “Election Resolution”); and

WHEREAS, it is now the desire of the Governing Authority to cancel the election to be held in the District on said date;

NOW, THEREFORE, BE IT RESOLVED by the Governing Authority, acting as the governing authority of the District, that:

SECTION 1. The election to be held in Road District No. 5A of Rapides Parish, State of Louisiana, on November 8, 2022 for the purpose set forth above is hereby canceled.

On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton, to accept Task Order A-7-2022 – District A – District Wide Asphalt Roadway Improvements 2022 as “Substantially Complete”, and authorize the Parish President to sign and record the “Substantial Completion” certificate, and authorize the Parish President to sign a Final Recap Task Order Change Order adjusting the final contract quantities and time period as necessary, as recommended by the Parish Engineer, Pan American Engineers, LLC. THE PRESIDENT AND POLICE JURORS

WHEREAS, it is the intention of the Rapides Parish Police Jury (RPPJ) to continue participating in the Transportation Planning Process though the local Metropolitan Planning Organization (MPO); and

WHEREAS, multiple governmental jurisdictions and various, diverse public and private groups share an interest in preservation of the non-interstate national highway system; and

WHEREAS, the Rapides Parish Police Jury recognizes that the requirements to obtain Surface Transportation Program (STP50-200K) funds from the Louisiana Department of Transportation and Development include a local non-federal match of 20%; and

WHEREAS, the Rapides Parish Police Jury intends to serve as a conduit for local non-federal matching funds that will be provided by the England Authority to secure Surface Transportation Program (STP50-200K) funding; and

WHEREAS, the Jury has the authority by State statute to enter into intergovernmental agreements; and

NOW THEREFORE BE IT RESOLVED THAT the Rapides Parish Police Jury hereby authorizes the Jury President to enter into an Inter-governmental Agreement with the England Authority for their commitment of the twenty percent (20%) local non-federal match under the Surface Transportation Program 50-200K to construct the Vandenburg Drive Overlay Project.

Passed and adopted by the President and Police Jurors of the Rapides Parish Police Jury, State of Louisiana, on this 12th day of September, 2022.

On motion by Mr. Rusty Wilder, seconded by Mr. Ollie Overton, that l eased duck blinds on Cotile Lake for 2021 that are already paid for, be allowed to carry their leases over to 2022, due to the drawdown on the lake.

Mr. Joe Bishop questioned if this was for 2021, to which Mr. Rusty Wilder stated yes, they had already paid for this year and we will allow them to carry it over due to the drawdown on the lake.

Discussion ensued.

Amended motion by Mr. Sean McGlothlin, seconded by Mr. Rusty Wilder, that there will be no duck blind hunting allowed on Cotile Lake this year and leased duck blinds for 2022 hunting season, already paid, be allowed to carry over their lease payments for the 2022/2023 hunting season, due to the drawdown being done this year. On vote the amended motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Joe Bishop, to authorize to advertise for repairs to the Coliseum, Exhibition Hall, and Sales Tax Office as recommended by Pan American Engineering and Ballard CLC, Inc. On vote the motion carried.

On motion by Joe Bishop, seconded by Mr. Bubba Moreau, to authorize the issuance of a quietus on the part of the Rapides Parish Police Jury in favor of the Sheriff and Tax Collector, and against any claim on the part of the Rapides Parish Police Jury for the ad valorem taxes of the year 2021, and authorize Theresa Pacholik, Treasurer, to issue said quietus.
