Motion to rescind a certain motion of September 13, 2021, to approve Rapides Parish Fire District No. 8 soliciting bids for the purchase of a van (Type II) style ambulance to replace Rescue/EMS van, as recommended by the Board of Directors and the Fire Chief, to be paid for with Fire District No. 8 funds. The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, October 11, 2021, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Craig Smith, President, Oliver “Ollie” Overton, Jr., Vice President and Police Jurors: Davron “Bubba” Moreau, Joe Bishop, Rusty Wilder, Sean McGlothlin and Doris Perry.

Jurors absent: Theodore Fountaine, Jr. and David Johnson

Also present: Theresa Pacholik, Treasurer; Shane Trapp, Courthouse Building Superintendent; Donna Andries, Sales & Use Tax Administrator; Elaine Morace, WIA Operations Director; Linda Sanders, Civil Service Director; Greg Jones, Legal Counsel and Laurel Smith, Secretary.

The invocation was given by Mr. Ollie Overton.

The Pledge of Allegiance was led by Mr. Sean McGlothlin.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any public comment on any agenda item, to which there was no response.

The first item on the agenda was a special presentation in recognition of Mr. Morris Taft Thomas.

Mr. Ollie Overton and Mr. Craig Smith presented Mr. Morris Taft Thomas with a Certificate of Recognition.

On motion by Mr. Craig Smith, seconded by Mr. Ollie Overton, the following Memoriam was presented to the family of the late Mr. Richard Vanderlick, Past Rapides Parish Police Juror, District E:

IN MEMORIAM

WHEREAS, Mr. Richard Vanderlick was called by his Creator on Monday, July 26, 2021; and

WHEREAS, Mr. Vanderlick was a native and lifetime resident of Rapides Parish growing up on the bank of Bayou Rapides and graduate of Holy Savior Menard High School in 1957; and

WHEREAS, Mr. Vanderlick leaves behind his loving wife of 63 years, Mrs. REGULAR MEETING OCTOBER 11, 2021

Joan Feazell Vanderlick and three children; Joan Denise, Richard Kevin and Stephanie Lynn; and

WHEREAS, Mr. Vanderlick began work in December 1957 at Central Louisiana Electric Company (CLECO), where he retired after 40 years in 1998 and also proudly served his country in the U.S. Army Reserves; and

WHEREAS, Mr. Vanderlick served on the Board of the Rapides Island Water Association after his retirement; and

WHEREAS, Mr. Vanderlick in 2007 began his journey with the Rapides Parish Police Jury representing District E, were he completed 12 years of service and served as Vice-President, and was a member of several committees including Chair of the Public Works, Watershed and Agricultural Committee, Member of the Finance Committee and Ambulance, Fire and Homeland Security Committee; and

WHEREAS, Mr. Vanderlick was a member of the National Association of County Officials (NACO) and served on the Human Services and Education Steering Committee; and

WHEREAS, the Rapides Parish Police Jury does hereby recognize Mr. Richard Vanderlick for his dedication and hard work in serving the citizens of Rapides Parish; and

NOW, THEREFORE, BE IT RESOLVED, that the Rapides Parish Police Jury does hereby order that this formal expression of honor for the late Mr. Richard Vanderlick and sympathy for his family be spread upon the minutes of this meeting.

WHEREAS, Title 2 of the Louisiana Revised Statutes of 1950 provides that cities, towns, parishes, and other political subdivisions of this State may separately or jointly acquire, establish, construct, expand, own, lease, control, equip, improve, maintain, operate, regulate, and police airports and landing fields for the use of aircraft; and,

WHEREAS, the State of Louisiana, Department of Transportation and Development, Division of Aviation (formerly the LA DOTD-OAPT) is charged by Title 2 with the responsibility for the development of aviation facilities within the State to foster air commerce and to safeguard the interests of those engaged in all phases of the aviation industry and of the general public; and,

WHEREAS, the Rapides Parish Police Jury hereinafter referred to as “Sponsor”, has completed an FAA and DOTD approved Master Plan, Action Plan, and/or Airport Layout Plan which outlines the specific future development of the Esler Regional Airport; and, the Sponsor is desirous of implementing a portion of the approved Plan recommendations which provide for the critically needed improvements as stated below to substantially improve the safety and usability of the Airport, but does not have sufficient funds of its own required for completing the needed improvements; and,

WHEREAS, the LA DOTD, Division of Aviation is authorized by Title 2 to expend funds for the construction or enlargement of airports for the safety and advancement of aeronautics;

NOW, THEREFORE, BE IT RESOLVED:

SECTION I

That the Sponsor does hereby formally request that the LA DOTD, Division of Aviation provide funds required to complete the airport improvements at the Esler Regional Airport specifically as described in the Capital Improvement Program Application for State Financial Assistance to be dated October 2021.

SECTION II

That the said LA DOTD, Division of Aviation be and is hereby assured that all necessary servitudes, rights-of-way, rights of ingress and egress and means thereof will be furnished by the Sponsor and the titles thereto will be valid and indefeasible, and that the Sponsor will assume ownership, financial reporting, and complete responsibility for the maintenance and upkeep of the airport after completion of said improvement.

SECTION III

That the Sponsor will save and hold the said LA DOTD, Division of Aviation, its officers, agents, and employees harmless from any liability or claim for damages arising out of the project, including death or injuries to third parties including, but not limited to, liability or claim for damages out of the negligence of said LA DOTD, Division of Aviation, its officers, agents, or employees, and expressly REGULAR MEETING OCTOBER 11, 2021

agrees to defend any suit of any nature brought against the LA DOTD, Division of Aviation as a result of this project.

SECTION IV

That the President of the Sponsor be and is hereby authorized and directed to evidence this agreement by affixing his signature at the place provided therefore on this resolution and on subsequent related documents/agreements as required by the rules and regulations of the Federal Aviation Administration and the State of Louisiana and the Clerk is hereby authorized to attest said execution.

SECTION V

That this resolution shall be in full force and effect from and after its adoption.

On motion by Mr. Rusty Wilder, seconded by Mr. Joe Bishop, to approve Change Order No. 2 for the construction contract with M.D. Descant, LLC, for Rapides Parish Alfred Wettermark Boyce Library Branch (sewer treatment plant) for an additional amount of $18,066.00 and an increase of 110 days, as recommended by Alliance Design Group, Project Engineer and authorize the President to sign same. On motion Mr. Joe Bishop, seconded by Mr. Ollie Overton, to ratify the renewal of the annual General Liability Insurance with Risk Services, to be paid from various fund accounts and authorize the President or Treasurer to sign all necessary documents. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton, to hire Engineer to come up with a set of plans to complete Station No. 4 alternate items and other items value engineered out of Bid #2544 – Construction of Fire Station No. 4 – Fire District No. 3, as recommended by Alpine Volunteer Fire Department Board of Directors. On motion by Mr. Rusty Wilder, seconded by Mr. Ollie Overton, that leased Duck Blinds on Indian Creek for 2021, already paid for, be allowed to carry their leases over to 2022, due to the drawdown on the lake. On vote the motion carried.

WHEREAS, the Secretary of Transportation and Development is authorized to make grants for mass transportation projects;

WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provisions by it of the local share of project costs;

WHEREAS, it is required by the Louisiana Department of Transportation and Development in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and

WHEREAS, it is the goal of the Applicant that minority business enterprise be utilized to the fullest extent possible in connection with this project, and that definitive procedures shall be established and administered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment, or consultant and other services:

The next item on the agenda was to recognize Mr. Matt Johns, Director, Rapides Area Planning Commission, for a presentation on reapportionment/redistricting. REGULAR MEETING OCTOBER 11, 2021

Mr. Matt Johns, Director of Rapides Area Planning Commission gave a brief presentation of how the proposed boundaries were going to change. Only three (3) districts are proposed to be changed. District B, C and D. Redistricting is based on populations. You divide the population of the Parish as evenly as possible between the nine districts. There will be about 14,677 people living inside your district. Mr. Johns further stated some of the laws and procedures.

Discussion ensued.

On motion by Mr. Joe Bishop, seconded by Mr. Rusty Wilder, to accept a Volunteer Fire Assistance grant administered by the Louisiana Department of Agriculture and Forestry for $9,916.28 for Rapides Parish Fire District No. 14. The purpose of the U. S. Forest Service grant is to assist rural fire departments in their building of firefighter capacities. On vote the motion carried.

On motion by Mr. Rusty Wilder, seconded by Mr. Ollie Overton, to grant a new overhead primary electric line right-of-way to Cleco Power, LLC, for an electrical service line to the Cotile Recreation Park and authorize the President to sign necessary paperwork. On vote the motion carried.

On motion by Mr. Rusty Wilder, seconded by Mr. Ollie Overton, to rescind a certain motion of September 13, 2021, to approve Rapides Parish Fire District No. 8 soliciting bids for the purchase of a van (Type II) style ambulance to replace Rescue/EMS van, as recommended by the Board of Directors and the Fire Chief, to be paid for with Fire District No. 8 funds. Fire Department decided to purchase other equipment. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Joe Bishop, to authorize the Parish President to execute an agreement with Merrick, LLC, to repair slope failure along Lone Pine Road and authorize the President to sign all necessary documents related thereto. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Bubba Moreau, to receive an update from Linda Sanders, Civil Service Director, regarding the Rapides Parish Civil Service Employee Survey on earning compensatory time versus being paid for regular overtime hours, as requested by the Personnel Committee.

Ms. Linda Sanders, Civil Service Director stated she surveyed seventy-three employees and of the seventy-three, forty-five wanted to continue to receive the compensatory time. Twenty-seven wanted to discontinue compensatory time and receive overtime pay.

On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, to approve a Cooperative Endeavor Agreement with Rapides Parish Sheriff’s Office for RPSO to assist with disposal of fallen and leaning trees and debris within Parish Road servitudes, reducing the eliminating Parish cost of debris disposal and authorize the President to sign same, subject to Legal Counsel approval.
