The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, September 13, 2021, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Craig Smith, President, Oliver “Ollie” Overton, Jr., Vice President and Police Jurors: Davron “Bubba” Moreau, Joe Bishop, Rusty Wilder, Sean McGlothlin, David Johnson and Doris Perry.

Absent: Theodore Fountaine, Jr.

Also present: Theresa Pacholik, Treasurer; Shane Trapp, Courthouse Building Superintendent; Donna Andries, Sales & Use Tax Administrator; Sonya Wiley-Gremillion, OHSEP Director; Elaine Morace, WIA Operations Director; Linda Sanders, Civil Service Director; Greg Jones, Legal Counsel and Laurel Smith, Secretary.

The invocation was given by Reverend Joseph Franklin.

The Pledge of Allegiance was led by Mr. Bubba Moreau.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any public comment on any agenda item, to which there was no response.

On motion by Mr. Ollie Overton, seconded by Mr. Joe Bishop, to open a public hearing and to sit as a Board of Review for hearing complaints on property assessments, as advertised. On vote the motion carried.

RESOLUTION

WHEREAS, the Code of Federal regulations as enacted by the United States Congress mandates that all structures defined as bridges located on all public roads shall be inspected, rated for safe load capacity and posted in accordance with the National Bridge Inspection Standards and that an inventory of these bridges be maintained by each State; and,

WHEREAS, the responsibility to inspect, rate and load post those bridges under the authority of Rapides Parish in accordance with those Standards is delegated by the Louisiana Department of Transportation and Development to Rapides Parish.

THEREFORE, BE IT RESOLVED by the governing authority of Rapides Parish (herein referred to as the Parish) that the Parish in regular meeting assembled does hereby certify to the Louisiana Department of Transportation and Development (herein referred to as the DOTD) that for the period October 1, 2020 through September 30, 2021:

  1. The Parish has performed all interim inspections on all Parish owned or maintained bridges in accordance with the National Bridge Inspection Standards.
  2. All bridges owned or maintained by the Parish have been structurally analyzed and rated by the Parish as to the safe load capacity in accordance with AASHTO Manual for Maintenance Inspection of Bridges. The load posting information that has been determined by the LA DOTD for all bridges where the maximum legal load under Louisiana State law exceeds the load permitted under the operating rating as determined above has been critically reviewed by the Parish. Load posting information has been updated by the Parish to reflect all structural changes, any obsolete structural ratings or any missing structural ratings.
  3. All Parish owned or maintained bridges which require load posting or closing are load posted or closed in accordance with the table in the DOTD REGULAR MEETING SEPTEMBER 13, 2021

Engineering Directives and Standards Manual Directive No. 1.1.1.8. All DOTD supplied load posting information concerning a bridge has been critically reviewed by the Parish Engineer prior to load posting.

  1. All bridges owned or maintained by the Parish are shown on the attached list in the format specified by the DOTD. Corrections to data supplied to the Parish by the LA DOTD are noted.

These stipulations are prerequisites to participation by the Parish in the Off-System Bridge Replacement Program.

On motion by Mr. Ollie Overton, seconded by Mr. Joe Bishop, to approve PY21/FY22 WIOA budget transfer of $129,600.00 from FY22 Dislocated Worker Program Funds to FY22 Adult Program Funds and to authorize the President to sign the amendment and the Treasurer to amend the budget. The Workforce Development Board approved the transfer of $129,600.00 at the meeting held on Thursday, August 19, 2021, contingent upon approval by Louisiana Workforce Commission (LWC). On motion by Mr. Ollie Overton, seconded by Mr. Joe Bishop, to enter into a three (3) year contract with the Louisiana Department of Health, Central Louisiana Human Services District (CLHSD), beginning July 1, 2021 and ending June 30, 2024 , for the Ninth Judicial District Court to provide Behavioral Health Court services, for up to 2400 participants for FY 22 and up to 2400 participants for FY 23 with a contract amount of $540,000.00 for each year, and 2100 participants for FY24 with a contract amount of $472,500.00, with no cost to the Police Jury and authorize the President to sign the necessary documents. On motion by Mr. Joe Bishop, seconded by Mr. Bubba Moreau, for authorization to enter into a Cooperative Endeavor Agreement between the Rapides Parish Police Jury and the Louisiana Department of Veterans Affairs for the period of January 1, 2022, to December 31, 2022, to provide support to the local Veterans’ Service Office, cost of $28,790.00 annually, in monthly payments of $2,399.00 as recommended by the Treasurer, pending Legal Counsel approval and authorize the President to sign same. A resolution approving the holding of an election in Kolin-Ruby Wise Waterworks District No. 11A of the Parish of Rapides, State of REGULAR MEETING SEPTEMBER 13, 2021

Louisiana, on Saturday, November 13, 2021, to authorize the renewal of a special tax therein.

WHEREAS, the Board of Commissioners of Kolin-Ruby Wise Waterworks District No. 11A of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Kolin-Ruby Wise Waterworks District No. 11A of the Parish of Rapides, State of Louisiana (the "District"), adopted a resolution on August 26, 2021, calling a special election in the District on Saturday, November 13, 2021, to authorize the renewal of a special tax therein; and

WHEREAS, the Governing Authority has requested that this Police Jury, acting as the governing authority of the Parish of Rapides, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries, to continue to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to give its consent and authority of the District to hold the said election, and in the event that the election carries, to continue to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Kolin-Ruby Wise Waterworks District No. 11A of the Parish of Rapides, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, November 13, 2021, at which election there will be submitted the following proposition, to-wit:

Tropical Storm and/or Hurricane force winds could reach as far inland as Central Louisiana, impacting Rapides Parish

WHEREAS, a definite threat to property and lives, for the Citizens of Rapides Parish exists due to the potential for torrential rains, damaging winds and widespread power outages

WHEREAS, the potential to exhaust local resources exists due to flash flooding which could cause damage to roadways and property limiting Emergency Response access to the Citizens of Rapides Parish; This event could also cause the inundation of floodwaters into homes and businesses, resulting in severe threat to private property, public facilities and the safety and security of the citizens of Rapides as well as those of other Parishes who may seek refuge from the coastal areas;

THEREFORE, I, Craig Smith, President of the Rapides Parish Police Jury by authority vested in me by the Parish Charter and the Louisiana Disaster Act of 1993, do hereby proclaim;

A State of Emergency exists within the Parish of Rapides and that all Emergency Preparedness Plans and the Parish All Hazard Emergency Operations Plan be activated, if necessary.

A resolution canceling an election called by a resolution adopted on August 9, 2021, to authorize the levy of a special tax in Sub-Road Rapides, State of Louisiana; and providing for other matters in connection therewith.

WHEREAS, this Police Jury of the Parish of Rapides, State of Louisiana, adopted a resolution on August 9, 2021, ordering and calling a special election to be held in Sub-Road District No. 1 of Road District No. 2B (Ward 11) of the Parish of Rapides, State of Louisiana (the “District”), on November 13, 2021, to authorize the levy of a special tax therein (the “Election Resolution”); and

WHEREAS, it is the desire of this Police Jury to cancel the election to be held in the District on said date;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana, acting as the governing authority of the District, that: REGULAR MEETING SEPTEMBER 13, 2021

WHEREAS, acting through the United States Constitution, the people of this Country created a government to be their agent in the exercise of a few defined powers, while reserving to the citizens the right to decide on matters which concern their lives, liberty and property in the ordinary course of affairs;

WHEREAS, the Second Amendment of the Constitution of the United States of America states, “A well-regulated Militia being necessary to the security of a free State, the right of the People to keep and bear arms, shall not be infringed;”

WHEREAS, the right of the people to keep and bear arms is further protected from infringement by the State and Local Governments under the Ninth, Tenth and Fourteenth Amendments to the Constitution of the United States of America.

WHEREAS, the Supreme Court of the United States of America in the District of Columbia v. Heller, 554 U.S. 570(2008), recognized the individual’s right to keep and bears arms, as protected by the Second Amendment of the Constitution of the United States of America, Justice Antonin Scalia’s prevailing opinion in that case stated that Second Amendment protects the individual’s right to possess a firearm unconnected with service in a militia, and the right to use that firearm for traditionally lawful purposes, such as self-defense within the home;

WHEREAS, Section 1 of the Fourteenth Amendment to the Constitution of the United States of America states, “No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty or property, without due process of law; nor deny to any person within jurisdiction the equal protection of laws”;

WHEREAS, the Supreme Court of the United States recognized in McDonald v. City of Chicago, 561 U.S. (2010) declared the Second Amendment to the Constitution was incorporated by the Fourteenth Amendment and thereby made REGULAR MEETING SEPTEMBER 13, 2021

applicable to the States;

WHEREAS, the right to be free from the commandeering hand of the government has been recognized by the United States Supreme Court in Printz v. United States, 521 U.S. 898 (1997), the Court held: “The Federal Government may neither issue directives requiring the States to address particular problems, nor command the States’ officers, or those of their political subdivisions, to administer or enforce a federal regulatory program.”

NOW, THEREFORE, BE IT RESOLVED THAT, the Rapides Parish Police Jury does determine that the legal, historic and patriotic words of the Second Amendment of the United States Constitution: “A well-regulated Militia being necessary to the security of a free state, the right of the People to keep and bear arms, shall not be infringed” is hereby declared to be the public policy of the Rapides Parish Police Jury and that Rapides Parish is hereby declared to be a Second Amendment Sanctuary Parish.
