The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, July 12, 2021, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Oliver “Ollie” Overton, Jr., Vice President, presiding as President Pro Tem and Police Jurors: Davron “Bubba” Moreau, Joe Bishop, Theodore Fountaine, Jr., Rusty Wilder, Sean McGlothlin, David Johnson, and Doris Perry.

Juror absent was Craig Smith, President.

Also present were Theresa Pacholik, Treasurer; Shane Trapp, Courthouse Building Superintendent; Donna Andries, Sales & Use Tax Administrator; Elaine Morace, WIA Operations Director; Cory Ashmore, Public Works Director, Greg Jones, Legal Counsel and Lawanda Stewart, Assistant Secretary.

The invocation was given by Reverend Joseph Franklin.

The Pledge of Allegiance was led by Mr. Joe Bishop.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Oliver “Ollie” Overton, President Pro Tem, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President Pro Tem asked if there was any public comment on any agenda item, to which there was no response.

The first item on the agenda was to recognize Dr. David Holcombe, Director of the Rapides Parish Health Unit, for an update on public health, Covid-19 Delta Variant.

Dr. David Holcombe stated they had finally achieved 27% of vaccinations in Central Louisiana. Rapides Parish is a little higher at 30% and the state at large is 40%. There are about 60% of older people vaccinated. Dr. Holcombe stated the Delta Variant started at 3% in Louisiana and jumped to 30% and is now 60%. It is more transmissible and every single parish throughout the state has rising rates. Dr. Holcombe stressed everyone needed to get the vaccination.

Discussion ensued.

Mr. Ollie Overton, President Pro Tem, recognized Sheriff Mark Wood from the Rapides Parish Sheriff’s Department. Sheriff Wood stated for the last year and a half, they have done a really good job of keeping the COVID out of the Corrections. DC 1 there are cases, they are in the process of testing guards and inmates. Three went to the hospital, they came right back. They have already started litigation of isolating, testing and such. They have talked to Dr Holcombe’s Office about the rapid test. He further stated he talked to Judge Doggett and told REGULAR MEETING JULY 12, 2021

them they were not sending any inmates out this week. Sheriff Wood stated he felt they had a handle on the situation.

The next item on the agenda was to recognize Ms. Kelia Bingham, LWI Region 5 Watershed Coordinator, for a brief update on the work/progress made to date in Region 5. Ms. Rachel Godeaux spoke first.

Ms. Rachel Godeaux, Acadiana Planning Commission, Community & Economic Development Director, gave a brief overview of the Acadiana Planning Commission.

Ms. Kelia Bingham, LWI Region 5 Watershed Coordinator, gave a brief update on the work/progress made to date in Region 5. The Louisiana Watershed Initiative began in 2016, by Governor Edwards Office, introducing watershed-based approaches to reducing flood risk regionally. Funds are allocated for local watershed projects and state programs, projects and watershed modeling.

Discussion ensued.

Ms. Godeaux stated there were already nearly 190 applications that were submitted on behalf of the entire state and about 20% were awarded in the initial Round 1. The projects awarded are the ones that were most ready and a lot of areas were left behind because they did not have the necessary technical capacity to apply for the grant or maybe they didn’t have the necessary funds to develop the applications. Round 2 there will be a more even playing field to allow those entities to be able to seek out funds. Round 1 in Region 5, Alexandria actually had two projects that were submitted and awarded for Round 1 funds. Congratulations to Rapides.

The next item was to recognize Mr. Jay Huner concerning Cotile Lake.

Mr. Jay Huner stated he was under the understanding that Cotile Lake was going to be lowered. He thought it was on the agenda, but it is not.

Mr. Rusty Wilder stated the Jury did go by the recommendation of Louisiana Wildlife & Fisheries who suggested that we do Indian Creek this year and we had tried to do Kincaid last year, but unfortunately Mother Nature did not allow us to. We are trying to follow up with that as well. If all that goes as according to plan, he would be happy to look at doing Cotile Lake next year.

Mr. Huner stated even a partial draw down would help a lot of people.

On motion by Mr. David Johnson, seconded by Mr. Rusty Wilder, to authorize to purchase two (2) Fire Engines for Rapides Parish Fire District No. 5 off the Lamas State Contract, not to exceed $800,000.00, secure financing and authorize the President to sign any necessary documentation, as requested by the Fire District No. 5 Board of Directors. An ordinance creating Road District No. 2B (Ward 11) Sales Tax District of the Parish of Rapides, State of Louisiana; and providing for other matters in connection therewith.

WHEREAS, Section 338.54 of Title 47 of the Louisiana Revised Statutes of 1950, as amended, authorizes the Police Jury of the Parish of Rapides, State of Louisiana (the "Police Jury"), to create a sales tax district within the Parish of Rapides, State of Louisiana (the "Parish"); and

WHEREAS, it is now the desire of the Police Jury to create a sales tax district in the Parish containing all of the territory described in Section 1 of this Ordinance, all for the purpose of submitting to the electorate of said sales tax district the question of the imposition of a sales and use tax in said sales tax district in the manner provided by the aforesaid statutory provision and Article VI, Section 30 of the Constitution of the State of Louisiana of 1974;

NOW, THEREFORE, BE IT ORDAINED by the Police Jury, acting as the governing authority of the Parish, that: REGULAR MEETING JULY 12, 2021

SECTION 1. In accordance with the provisions of Section 338.54 of Title 47 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority supplemental thereto, there is hereby created a sales tax district in the Parish, which sales tax district shall comprise all the territory within the boundaries of Road District No. 2B (Ward 11) of the Parish of Rapides, State of Louisiana, as such boundaries presently exist.

SECTION 2. The sales tax district hereby created shall be known and designated as "Road District No. 2B (Ward 11) Sales Tax District of the Parish of Rapides, State of Louisiana" (the "District"); and the seal of the Parish is hereby adopted as the seal of the District. The governing authority of the District shall be the Police Jury, the domicile shall be the regular meeting place of the Police Jury and the officers of the Police Jury shall be the officers of the District.

SECTION 3. The District shall have all powers granted to it under Louisiana law, including the power to levy a sales and use tax in accordance with Section 338.54 of Title 47 of the Louisiana Revised Statutes of 1950, as amended, and Article VI, Section 30 of the Constitution of the State of Louisiana of 1974, and to fund the proceeds thereof into bonds for the purposes for which the sales and use tax is authorized to be used.

SECTION 4. In case any one or more of the provisions of this ordinance shall for any reason be held to be illegal or invalid, such illegality or invalidity shall not affect any other provisions of this ordinance, but the same shall be construed and enforced as if such illegal or invalid provisions had not been contained herein. Any constitutional or statutory provisions enacted after the date of this ordinance which validate or make legal any provisions thereof shall be deemed to apply hereto.

SECTION 5. This Ordinance shall become effectively immediately upon adoption.

WHEREAS, Mr. Smith is currently serving his third term as Police Juror of the Rapides Parish Police Jury representing District C, which includes all of Ward 11 and parts 9 and 10; and

WHEREAS, Mr. Smith is currently serving as President of the Rapides Parish Police Jury and has also served as President in 2016, 2017 and 2020 and Vice-President in 2015; and

WHEREAS, Mr. Smith, as President of the Police Jury, he serves on the Rapides Area Planning Commission, Chamber of Commerce, Regional Infrastructure Beltway Committee, and Metropolitan Planning Organization (MPO) Transportation Policy Committee; and

WHEREAS, Mr. Smith was the Chairman of the Workforce Development and Municipal Liaison Committee for 2019 and has served as a member of the Finance Committee; Public Works, Watershed and Agricultural Affairs Committee; Coliseum Liaison Committee; Grants, Economic Planning and Development Committee; Courthouse and Tourism Committee; Parochial Board Liaison and Legal Committee; Personnel, Elections and Health Committee and Insurance, Ambulance, Fire and Homeland Security Committee of the Rapides Parish Police Jury; and

WHEREAS, Mr. Smith is a member of the National Association of County Officials, where he currently serves on the Community, Economic and Workforce Development Steering Committee; and
