PUBLIC GATHERINGS LIMITED
Public gatherings are restricted to 75% of the total occupancy of the State Fire Marshal, and requires a six (6) foot minimum of social distancing, limiting the public seating area for the Rapides Parish Police Jury on a first come basis, in accordance with Phase III restrictions.
WRITTEN CERTIFICATION
The Rapides Parish Police Jury consists of 9 elected Jurors, and essential staff for Police Jury meetings. The Police Jury would be unable to operate and hold its public meeting due to quorum requirements unless said Police Jury meeting is conducted pursuant to the authorization provided by the Governor’s Proclamations and LSA-R.S. 42:17.1, a political subdivision may provide for the attendance at essential governmental meetings via teleconference or video conference and a Rapides Parish Police Juror may participate in this meeting via teleconference.
PUBLIC OBSERVATION AND COMMENTS

This request is from the Chief of Rapides Parish Fire District No. 5, to be paid out of Fire District No. 5 funds. (Mr. Johnson)
- Motion to authorize the Rapides Workforce Development Board to issue a Request for Proposal (RFP) for the One-Stop Operator as required by WIOA beginning January 1, 2021 and ending on December 31, 2021 with option to renew for three (3) years, and have Treasurer to amend the budget accordingly. The contract will be funded through the WIOA grant funds.
Per the approval of Rapides Workforce Development Board (WBD) One Stop Committee on August 20, 2020, and In order to comply with the Workforce Innovation and Opportunity Act (WIOA) Sec. 121(d)(2)(A) which states “an entity shall be designated or certified as a one-stop operator through a competitive process;” and further defined in the Final Regulations at §678.605 on pages 55892 – 55896 of the Federal Register effective October 18, 2016, the Rapides Workforce Development Board is to follow local / state procurement policies, and/or Uniform Guidance at 2 CFR 200.318 – 200.326 to procure a One-Stop Operator for the Rapides One-Stop Center. The selected Contractor must be in place no later than January 1, 2021. (Mr. Overton)
- Motion to approve a contract with FEMA for use of the Coliseum meeting rooms for Citizen Assistance at no charge. (Mr. Smith)
- Motion to amend the Ordinance/permit application regarding utility pipeline in rights-of-ways in the Parish. (Mr. Smith)
- Motion to approve participation and authorize OHSEP Director to administer, designate project Director and sign related documents for the 2020 State Homeland Security Grant Program (EMW-2020-SS-00011-S01, CFDA #97.067). - Motion to accept a Volunteer Fire Assistance grant administered by the Louisiana Department of Agriculture and Forestry for $5,320.82 for Rapides Parish Fire District No. 16. The purpose of this U.S. Forestry Service grant is to assist rural fire departments in building their firefighting capacities. (Mr. Wilder)
- Motion that leased Duck Blinds on Kincaid Lake for 2020, already paid for, be allowed to carry their leases over to 2021, due to the drawdown on the lake. (Mr. Wilder)

The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, on Monday, September 14, 2020, at three (3:00) o'clock p.m. (Central Standard Time).
There were present: Craig Smith, President, Oliver “Ollie” Overton, Jr., Vice President and Police Jurors: Davron “Bubba” Moreau, Joe Bishop, Theodore Fountaine, Jr., Rusty Wilder, Sean McGlothlin, David Johnson and Scott Perry, Jr.(via phone)
Also present were: Theresa Pacholik, Treasurer; Shane Trapp, Courthouse Building Superintendent; Donna Andries, Sales & Use Tax Administrator; Sonya Wiley-Gremillion, OHSEP Director; Elaine Morace, WIA Operations Director; Cory Ashmore, Public Works Director; Linda Sanders, Civil Service Director; Greg Jones, Legal Counsel and Laurel Smith, Secretary.
The invocation was given by Mr. Ollie Overton.
The Pledge of Allegiance was led by Mr. Bubba Moreau.
The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.
The President asked if there was any public comment on any agenda item, to which there was no response.
The first item on the agenda was to recognize Judge Shannon Gremillion, Candidate for Louisiana Supreme Court, 4th District.
Judge Shannon Gremillion gave a brief update of his candidacy for Louisiana Supreme Court, 4th District.
On motion by Mr. Bubba Moreau, seconded by Mr. Scott Perry, to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on August 10, 2020 as published in the Official Journal. On vote the motion carried.
On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, that approved bills be paid. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Joe Bishop, the following resolution was presented and unanimously adopted:

BE IT RESOLVED, by the Police Jury of the Parish of Rapides, Louisiana, in a public meeting held on September 14, 2020, which meeting was conducted in accordance with the Open Meetings Law and the additional requirements of Article VII, Section 23(C) of the Louisiana Constitution and R.S. 47:1705(B), that the following adjusted millage rates be and they are hereby levied upon the dollar of the assessed valuation of all property subject to ad valorem taxation within said Parish for the year 2020, for the purpose of raising revenue:

BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, shall extend upon the assessment roll for the year 2020 the taxes herein levied, and the tax collector of said Parish shall collect and remit the same to said taxing authority in accordance with law.
The foregoing resolution was read in full, the roll was called on the adoption thereof, and the resolution was adopted by the following votes:

BE IT RESOLVED, by the Police Jury of the Parish of Rapides, Louisiana, in a public meeting held on September 14, 2020, which meeting was conducted in accordance with the Open Meetings Law and the additional requirements of Article VII, Section 23(C) of the Louisiana Constitution and R.S. 47:1705(B), that the taxing district voted to increase the millage rate(s), but not in excess of the prior year’s maximum rate(s), on all taxable property shown on the official assessment roll for the year 2020, and when collected, the revenues from said taxes shall be used only for the specific purposes for which said taxes have been levied. WHEREAS, bids have been received for the Ball Lane – Bayou Rapides Road Intersection Improvements (and Related Drainage Improvements) project and have been previously received and read aloud;
WHEREAS, the Rapides Parish Police Jury has received a recommendation from the Engineer for the project that the contract be awarded to the lowest responsible bidder,
THEREFORE, BE IT RESOLVED, by the Rapides Parish Police Jury, that the contract be awarded to the responsible low bidder, as follows, subject to the satisfactory receipt of all forms and information required under the contract provisions, subject to funding from District I Road Maintenance Funds.

Mr. Sean McGlothlin questioned Mr. Greg Jones, Legal Counsel, on whether Rapides Parish had been moved to 90/10 yet, to which Mr. Jones stated they had not. Rapides was 6A Category approved, which means that the debris removal contract will be reimbursable. The Parish is doing their own and assisting municipalities in doing their own.
Mr. Craig Smith, President stated we are at a 75/25, to which Mr. Jones stated that our Congressional Delegation has put in a request that it be moved to 90/10.
Mr. Joe Bishop stated he appreciated Mr. Tom David, Pan American Engineers, doing the leg work to make sure we get reimbursed on this. Mr. Bishop also requested the President to write letters to our Congressional Delegates to request the move to 90/10.

RESOLUTION TO SUBMIT FY 2021-2026 CAPITAL IMPROVEMENTS PROGRAM APPLICATION FOR THE ESLER REGIONAL AIRPORT BY THE RAPIDES PARISH POLICE JURY
WHEREAS, Title 2 of the Louisiana Revised Statutes of 1950 provides that cities, towns, parishes, and other political subdivisions of this State may separately or jointly acquire, establish, construct, expand, own, lease, control, equip, improve, maintain, operate, regulate, and police airports and landing fields for the use of aircraft; and,
WHEREAS, the State of Louisiana, Department of Transportation and Development, Division of Aviation (formerly the LA DOTD-OAPT) is charged by Title 2 with the responsibility for the development of aviation facilities within the State to foster air commerce and to safeguard the interests of those engaged in all phases of the aviation industry and of the general public; and,
WHEREAS, the Rapides Parish Police Jury hereinafter referred to as “Sponsor”, has completed an FAA and DOTD approved Master Plan, Action Plan, and/or Airport Layout Plan which outlines the specific future development of the Esler Regional Airport; and, the Sponsor is desirous of implementing a portion of the approved Plan recommendations which provide for the critically needed improvements as stated below to substantially improve the safety and usability of the Airport, but does not have sufficient funds of its own required for completing the needed improvements; and,
WHEREAS, the LA DOTD, Division of Aviation is authorized by Title 2 to expend funds for the construction or enlargement of airports for the safety and advancement of aeronautics;
NOW, THEREFORE, BE IT RESOLVED:
SECTION I
That the Sponsor does hereby formally request that the LA DOTD, Division of Aviation provide funds required to complete the airport improvements at the Esler Regional Airport specifically as described in the Capital Improvement Program Application for State Financial Assistance to be dated October 2020.
SECTION II
That the said LA DOTD, Division of Aviation be and is hereby assured that all necessary servitudes, rights-of-way, rights of ingress and egress and means thereof will be furnished by the Sponsor and the titles thereto will be valid and indefeasible, and that the Sponsor will assume ownership, financial reporting, and complete responsibility for the maintenance and upkeep of the airport after completion of said improvement.
SECTION III
That the Sponsor will save and hold the said LA DOTD, Division of Aviation, its officers, agents, and employees harmless from any liability or claim for damages arising out of the project, including death or injuries to third parties including, but not limited to, liability or claim for damages out of the negligence of said LA DOTD, Division of Aviation, its officers, agents, or employees, and expressly agrees to defend any suit of any nature brought against the LA DOTD, Division of Aviation as a result of this project.
SECTION IV
That the President of the Sponsor be and is hereby authorized and directed to evidence this agreement by affixing his signature at the place provided therefore on this resolution and on subsequent related documents/agreements as required by the rules and regulations of the Federal Aviation Administration and the State of Louisiana and the Clerk is hereby authorized to attest said execution.
SECTION V
That this resolution shall be in full force and effect from and after its adoption.

WHEREAS, the Board of Commissioners of Waterworks District No. 3 of Rapides Parish, Louisiana, acting as the governing authority of Waterworks District No. 3 of Rapides Parish, Louisiana (the "Issuer"), by resolution adopted on September 8, 2020, has authorized the issuance of not exceeding Six Million Five Hundred Thousand Dollars ($6,500,000) of Water Revenue Refunding Bonds (the "Bonds") for the purpose of refunding all or a portion of the Issuer’s outstanding Water Revenue Refunding Bonds, Series 2015, and Taxable Water Revenue Bonds, Series 2015, and paying the costs of issuance thereof, pursuant to Part II of Chapter 4 of Subtitle II of Title 39 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, said Bonds to be secured by the income and revenues derived or to be derived from the operation of the Issuer’s waterworks system on a parity with the Issuer's unrefunded Water Revenue Refunding Bonds, Series 2015, and Taxable Water Revenue Bonds, Series 2015, if any; and
WHEREAS, it is now the desire of the Police Jury of the Parish of Rapides, State of Louisiana, to approve the issuance of the Bonds;
NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana, acting as the governing authority of the Parish of Rapides, State of Louisiana, that:
SECTION 1. In compliance with the provisions of Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of the Issuer, this Police Jury hereby approves the issuance and sale of not exceeding $6,500,000 of Water Revenue Refunding Bonds of Waterworks District No. 3 of Rapides Parish, Louisiana, said Bonds to be issued under the authority, for the purposes and to be payable from the sources stated in the preamble hereto. BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Service Area No. 1 of Fire Protection District No. 2 of Rapides Parish, Louisiana (the "District"), that:
SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in Service Area No. 1 of Fire Protection District No. 2 of Rapides Parish, Louisiana, on SATURDAY, AUGUST 15, 2020 (the “Election”), to authorize the renewal of a special tax therein pursuant to the following proposition (the “Proposition”):

Shall Fire Protection District No. 2 of Rapides Parish, Louisiana (the "District"), continue to levy and collect a special tax of sixteen and thirty-one hundredths (16.31) mills on all the property subject to taxation within the confines of Service Area No. 1 of the District for a period of ten years, beginning with the year 2021 and ending with the year 2030 (an estimated $640,000 reasonably expected at this time to be collected from the levy of the tax for an entire year) for the purpose of acquiring, constructing, improving, maintaining and operating fire protection and emergency medical service facilities and other firefighting or emergency medical service equipment?
This Governing Authority does further proceed to examine and canvass the returns of the Election thereof.
SECTION 2. Election Results. According to the official certified tabulation of votes cast at said Election, there was a total of 307 votes cast IN FAVOR OF the Proposition and a total of 33 votes cast AGAINST the Proposition, resulting in a majority of 274 votes cast IN FAVOR OF the Proposition. The Proposition was therefore duly CARRIED by a majority of the votes cast by the qualified electors voting at the Election.
SECTION 3. Promulgation of Election Result. The results of said election shall be promulgated by publication in the manner provided by law, after receipt from the Secretary of State’s office of the actual costs of the election, as required by Act 205 of the Regular Session of the Legislature of Louisiana for the year 2019.
SECTION 4. Declaration. The foregoing results of the Election are hereby declared by this Governing Authority and shall be published as required by law.
SECTION 5. Procès Verbal. A Procès Verbal of the canvass of the returns of the Election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority. BE IT KNOWN AND REMEMBERED that on Monday, September 14, 2020, at 3:00 p.m., at its regular meeting place, the Rapides Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Service Area No. 1 of Fire Protection District No. 2 of Rapides Parish, Louisiana (the "District"), and being the authority ordering the special election held therein on Saturday, August 15, 2020, with the following members present:

Shall Fire Protection District No. 2 of Rapides Parish, Louisiana (the "District"), continue to levy and collect a special tax of sixteen and thirty-one hundredths (16.31) mills on all the property subject to taxation within the confines of Service Area No. 1 of the District for a period of ten years, beginning with the year 2021 and ending with the year 2030 (an estimated $640,000 reasonably expected at this time to be collected from the levy of the tax for an entire year) for the purpose of acquiring, constructing, improving, maintaining and operating fire protection and emergency medical service facilities and other firefighting or emergency medical service equipment?
There was found by said count and canvass that there was a total of 307 votes cast IN FAVOR OF the Proposition and a total of 33 votes cast AGAINST the Proposition, as hereinabove set forth, and that there was a majority of 274 votes cast IN FAVOR OF the Proposition as hereinabove set forth.
Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that the Proposition as hereinabove set forth was duly CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in the District on Saturday, August 15, 2020.

This request is from the Chief of Rapides Parish Fire District No. 5, to be paid out of Fire District No. 5 funds. On vote the motion carried.
The next item on the agenda was to authorize the Rapides Workforce Development Board to issue a Request for Proposal (RFP) for the One-Stop Operator as required by WIOA beginning January 1, 2021 and ending on December 31, 2021 with option to renew for three (3) years, and have Treasurer to amend the budget accordingly. The contract will be funded through the WIOA grant funds.
Per the approval of Rapides Workforce Development Board (WBD) One- Stop Committee on August 20, 2020, and in order to comply with the Workforce Innovation and Opportunity Act (WIOA) Sec. 121(d)(2)(A) which states “an entity shall be designated or certified as a one-stop operator through a competitive process;” and further defined in the Final Regulations at §678.605 on pages 55892 – 55896 of the Federal Register effective October 18, 2016, the Rapides Workforce Development Board is to follow local / state procurement policies, and/or Uniform Guidance at 2 CFR 200.318 – 200.326 to procure a One-Stop Operator for the Rapides One-Stop Center. The selected Contractor must be in place no later than January 1, 2021.
On motion by Mr. Ollie Overton, seconded by Mr. David Johnson, that this item be tabled until Mr. Greg Jones, Mr. Craig Smith and myself could look over the terms. Mr. Jones stated he had not had a chance to review this. Mr. Overton stated it is very lengthy and complex and the Jury had just gotten through with the problems we had of hiring people.
Ms. Elaine Morace, OEWD Director explained that his is done every four years. The law states you have to put out bids for a One-Stop-Operator. The previous One-Stop-Operator was LSUA and it has ended. By law we have to announce it and go through the process. If we table it till November, we will have to get the State approval. The entity has to be in place before January 2021. No vote was taken on this motion.
Mr. Jones stated the previous motion stated that the Jury would grant approval and then put it out for an RFP, which is backwards of the way it should be.

On motion by Mr. Sean McGlothlin, seconded by Mr. David Johnson, to approve a contract with FEMA for use of the Coliseum meeting rooms for Citiz en Assistance, at no charge.
Mr. Greg Jones, Legal Counsel, stated this was discussed last week and pursuant to the contract with the Jury, the Jury will receive $50,000 in compensation, for the use of the Coliseum by GOSHEP. FEMA did a walk through with Ms. Sonya Wiley and they are going to use two conference rooms. This is to provide a central location for all of the citizens that do not have internet service or telephone services will be able to go sign up for the IA, the Individual FEMA Assistance.
Mr. Sean McGlothlin questioned if this check would go into the Coliseum funds, to which Mr. Jones stated it will be deposited into the Jury account and you can assess it to your line item of the Coliseum. The Coliseum money you have is basically a line item.
Ms. Theresa Pacholik, Treasurer, stated this is at no charge. The $50,000 will come to us and then the Jury will discuss which account it will go in.

On motion by Mr. Rusty Wilder, seconded by Mr. David Johnson, to accept a Volunteer Fire Assistance grant administered by the Louisiana Department of Agriculture and Forestry for $5,320.82 for Rapides Parish Fire District No. 16. The purpose of this U.S. Forestry Service grant is to assist rural fire departments in building their firefighting capacities. On vote the motion carried.

WHEREAS, the potential to exhaust local resources exists due to already saturated grounds, unstable structures and trees/debris that remain from Hurricane Laura, along with the potential for Sheltering of those Parishes who may seek refuge from the coastal areas;
THEREFORE, I, Craig Smith, President of the Rapides Parish Police Jury by authority vested in me by the Parish Charter and the Louisiana Disaster Act of 1993, do hereby proclaim;
A State of Emergency exists within the Parish of Rapides and that all Emergency Preparedness Plans and the Parish All Hazard Emergency Operations Plan be activated, if necessary.
