- Motion to enter into an Intergovernmental Agreement with the Town of Glenmora for the Rapides Parish Highway Department to level and repair certain roads in the Town of Glenmora, so that they may be chip sealed by the Parish Crews or micro-surfaced by a contractor, to be paid out of Town’s portion of Road District No. 1A Funds and authorize the President to sign. Roads are as follows: 7th Street and 12th Street 7th Avenue and 9th Avenue (Public Works 8/6)
- Motion to approve Change Order No. 1 to the construction contract with Gilchrist Construction Company, Bid No. 2651 to delete the Calvin Merchant Road and Lotts Road (District H, Ward 5) and the Blue Lake Road (Forest Hill) (District H, Ward 4), at a decreased cost of approximately $140,137.00 and authorize the President to sign all the necessary paperwork, as recommended by the Public Works Director. - Motion to approve Change Order No. 3 for the Masonic Drive Drainage Improvement Project, Project No. 1786-079-0002, for a decreased amount of $6,097.40, for a total contract amount of $1,854,983.23, to address completed unit price changes and miscellaneous items not anticipated or covered in the original contract but were required to complete the project, as recommended by Ballard CLC, Inc. Engineers and also to extend contract time from 280 days to 406 days and authorize the President to sign same. (Grants 8/6)
- Motion to authorize/ratify the Declaration of Public Emergency under LSA R.S. 38:2211, et seq, by the Rapides Parish Police Jury through its President, on July 25, 2018, regarding the failure of old cooling Tower No. 2 at the Rapides Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, and the need to immediately contract to replace same, in accordance with the provisions of LSA R.S. 38:2212, and declaration that such structural damage and extreme heat conditions warrant the Rapides Parish Police Jury to take immediate action to repair the damages without compliance with the provisions of LSA R.S. 38:2211 et seq. - Motion to authorize/ratify the President of the Rapides Parish Police Jury to enter into a Public Emergency contract under the July 25, 2018, Declaration of Public Emergency under LSA R.S. 38:2212(P), for the immediate replacement of old cooling Tower No. 2 at the Rapides Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, and such structural damage and extreme heat conditions warrant the contract without compliance with the provisions of LSA R.S. 38:2211 et seq. - Motion for the Rapides Parish Police Jury to enter into a ten (10) year lease agreement, with the Rapides Area Planning Commission, to lease the Lawyers (Munsterman) Building for $4,200.00 a month and authorize the President to sign same. (Parochial 8/6)
Amend motion to approve an Intergovernmental Agreement and Lease Agreement with Rapides Parish Area Planning Commission, for renovations to and lease of 701 Johnston Street, Alexandria, Louisiana building (old Gist Lawyers Building), and ordinance authorizing same, and authorizing any technical language changes necessary for execution of agreement upon approval of legal counsel and Jury President and authorize President to sign same.

The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, August 13, 2018, at three (3:00) o'clock p.m. (Central Standard Time).
There were present: Davron “Bubba” Moreau, President, Richard Vanderlick, Vice President, and Police Jurors: Joe Bishop, Craig Smith, Theodore Fountaine, Jr., Oliver “Ollie” Overton, Jr., Sean McGlothlin and Scott Perry, Jr.
Members absent were: Richard Billings.
Also present were Mr. Bruce Kelly, Treasurer; Ms. Donna Andries, Sales & Use Tax Administrator; Chief Randy McCain, Fire District No. 2; Ms. Elaine Morace, WIA Operations Director; Mr. Shane Trapp, Courthouse Building Superintendent; Ms. Linda Sanders, Civil Service Director; Ms. Lin Stewart, Registrar of Voters; Mr. Greg Jones, Legal Counsel and Ms. Laurel Smith, Secretary.
The invocation was given by Mr. Theodore Fountaine.
The Pledge of Allegiance was led by Mr. Ollie Overton.
The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Davron “Bubba” Moreau, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.
The President asked if there was any public comment on any agenda item, to which there was no response.
On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on July 9, 2018 and Special Session July 30, 2018, as published in the Official Journal. On vote the motion carried.
On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, that approved bills be paid. On vote the motion.
On motion by Mr. Richard Vanderlick, seconded by Mr. Craig Smith, to accept the Treasurer’s Report. On vote the motion carried.
The next item on the agenda was to recognize Ms. Deborah Dunn of Payne, Moore & Harrington for an update on the Police Jury audit.
Ms. Deborah Dunn, Payne, Moore & Harrington, presented a brief update on the audit for the year ending December 31, 2017 and also for the Rapides Parish Coliseum Authority from September 1, 2017 through December 31, 2017. Ms. Dunn highlighted the financial statements and various funds. Some of the findings REGULAR MEETING AUGUST 13, 2018
were records keeping, verification of payroll sheets, processing payrolls, purchase orders, ethics, budget preparation, payroll theft and misuse of public funds, as related to Fire District No. 7. Ms. Dunn stated they have included with their findings, a recommendation to management to address these issues, which some have already been addressed. The final piece of information, which they call a stats 114 letter, is a communication that their professional standards require them to share with those parts of governance, which is the Jury and it basically just highlights the experience.
Discussion ensued.
On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith, to adopt a proclamation proclaiming the month of October, 2018 as Dysautonomia Awareness Month. PROCLAMATION WHEREAS, dysautonomia is a group of medical conditions that result in a malfunction of the autonomic nervous system, which is responsible for “automatic” bodily functions such as respiration, heart rate, blood pressure, digestion, temperature control and more;
WHEREAS, some forms of dysautonomia are considered rare diseases, such as Multiple System Atrophy and Pure Autonomic Failure, while other forms of dysautonomia are common, impacting millions of people in the US and around the world, such as Diabetic Autonomic Neuropathy, Neurocardiogenic Syncope and Postural Orthostatic Tachycardia Syndrome;
WHEREAS, dysautonomia impacts people of any age, gender, race or background, including many individuals living in Rapides Parish;
WHEREAS, some forms of dysautonomia can be very disabling and this disability can result in social isolation, stress on the families of those impacted, and financial hardship;
WHEREAS, some forms of dysautonomia can result in death, causing tremendous pain and suffering for those impacted and their loved ones;
WHEREAS, increased awareness about dysautonomia will help patients get diagnosed and treated earlier, save lives, and foster support for individuals and families coping with dysautonomia in our community;
WHEREAS, The Dysautonomia International-Louisiana Support Group is an organization that advocates on behalf of patients living with dysautonomia, encourages communities to celebrate Dysautonomia Awareness Month each October around the world;
WHEREAS, we seek to recognize the contributions of the professional medical community, patients and family members who are working to educate our citizenry about dysautonomia in Rapides Parish.
NOW, THEREFORE, I, Davron “Bubba” Moreau, President of the Rapides Parish Police Jury, do hereby proclaim the month of October as,

A resolution ordering and calling a special election to be held in Fire Protection District No. 10 of the Parish of Rapides, State of Louisiana, to authorize the continuation and rededication of a special tax therein; making application to the State Bond Commission in connection therewith; and providing for other matters in connection therewith.
BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Fire Protection District No. 10 of the Parish of Rapides, State of Louisiana (the "District"), that:
SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Sections 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5 and Chapter 6-A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the District on SATURDAY, DECEMBER 8, 2018, between the hours of seven o'clock (7:00) a.m. and eight o'clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.
SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Monday, January 14, 2019, as provided in Section 3 hereof. All registered voters in the District will be entitled to vote at the special election, and voting machines shall be used.
SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election.
SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Rapides Parish and the Registrar of Voters of Rapides Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.
SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to levy and collect the special tax provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt REGULAR MEETING AUGUST 13, 2018

On motion by Mr. Ollie Overton, to approve Change Order No. 3 for the Masonic Drive Drainage Improvement Project, Project No. 1786-079-0002, for a decreased amount of $6,097.40, for a total contract amount of $1,854,983.23, to address completed unit price changes and miscellaneous items not anticipated or covered in the original contract but were required to complete the project, as recommended by Ballard CLC, Inc. Engineers and also to extend contract time from 280 days to 406 days and authorize the President to sign same.

On motion by Mr. Sean McGlothlin, seconded by Mr. Joe Bishop, to authorize/ratify the Declaration of Public Emergency under LSA R.S. 38:2211, et seq, by the Rapides Parish Police Jury through its President, on July 25, 2018, regarding the failure of old cooling Tower No. 2 at the Rapides Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, and the need to immediately contract to replace same, in accordance with the provisions of LSA R.S. 38:2212, and declaration that such structural damage and extreme heat conditions warrant the Rapides Parish Police Jury to take immediate action to repair the damages without compliance with the provisions of LSA R.S. 38:2211 et seq. On vote the motion carried.

The next motion was to adopt a resolution authorizing the President to sign a Capital Outlay request for the renovation of the elevators at the Rapides Parish Courthouse, to the State of Louisiana, Division of Administration, Office of Facility Planning and Control, FP&C Project No. 50-J40-17-01. Copy of resolution to be sent to our Louisiana Legislative Delegation.
Mr. Sean McGlothlin stated he wanted to clarify, this wasn’t Capital Outlay money. This was money that Senator Luneau and Governor John Bel Edwards dedicated to this project to repair these elevators. We are having to send parts to REGULAR MEETING AUGUST 13, 2018
the fabricator to get the elevator fixed. If this motion passes, he would like to see the Jury send a letter to the Governor and Senator Jay Luneau thanking them for this expropriation of cash money for the dire need we have.
Mr. Greg Jones stated this did not come through the general appropriation procedures, it was expedited by the Governor and Senator Luneau so that we could get those elevators fixed.

On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith, to approve an Intergovernmental Agreement between RPPJ & Rapides Parish Fire Districts #15, #16, #14 & # 8 and CLECO, to provide backup/supplemental fire protection and emergency services to the Brame Energy Center (Rodemacher Plant) and ordinance authorizing same, and authorizing any technical language changes necessary for execution of agreement upon approval of legal counsel and Jury President; and authorize the President to sign any necessary documents.
Mr. Greg Jones, Legal Counsel, stated that the Jury had worked with Cleco towards this agreement to provide primary first responder service at the Rodemacher Plant, however, they want to do a Cooperative Endeavor agreement to contract with the Jury and Fire Districts #15, #14, #16 and #8, which are adjacent to the Rodemacher Plant, for supplemental backup fire protection. Cleco being a good community partner, over the next five years through this Cooperative Endeavor Agreement will be providing $1,100,000 in financial aid, that will be directed to those fire districts in that area. This will greatly enhance their equipment, their training and their readiness of the four districts to respond to fire protection and emergency services.

On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, to discuss the 2019 budget.
Mr. Joe Bishop stated he wanted the Department Heads and anybody getting any kind of funding out of the General Funds, to submit a written formal budget to each Juror to evaluate and make sure that according to our budget, we can approve it this year, for 2019.
On motion by Mr. Joe Bishop, seconded by Mr. Sean McGlothlin, that it is required for anyone receiving any kind of funding out of the General Fund budget for 2019, submit in writing, a formal budget to each of the Police Juror’s to evaluate and make sure according to the budget that it can be approved for the 2019 budget.

Mr. Bruce Kelly, Treasurer, stated that in the past, the Treasurer’s Office has put together all the budgets for all the departments and just met with them on a gentleman’s agreement. Now they’re going to have to justify what they need the money out of General Funds for.

DISASTER RELIEF AND EMERGENCY ASSISTANCE ACT,
AND THAT SAID LANGUAGE BE TETROACTIVE TO THE 2016 FLOOD EVENTS, AND ACTION BE TAKEN TO ASSIST BOSSIER PARISH IN RESOLVING THIS ISSUE, AND OTHERWISE PROVIDING WITH RESPECT THERETO
WHEREAS, Bossier Parish experienced a 1,000 year flood event in March of 2016; and WHEREAS, the Bossier Parish Police Jury contracted CB & I Environmental & Infrastructure, Inc., (now APTIM Environmental & Infrastructure, Inc.) in June of 2016, to perform damage assessment on all paved roads inundated as a result of the 2016 flood event; and WHEREAS, on June 27, 2018, the Bossier Parish Police Jury submitted CB&I REGULAR MEETING AUGUST 13, 2018
Environmental & Infrastructure, Inc.’s (now APTIM Environmental & Infrastructure, Inc.) request to the Federal Emergency Management Agency for $25,072,336.00, Project Worksheet (PW) BPA001C, for permanent repairs to 52 inundated roadways in Bossier Parish; and WHEREAS, Bossier Parish roadways are typically constructed with flexible asphalt pavement over rigid soil cement bases or gravel bases; and WHEREAS, the flexible asphalt pavement typically experience pavement cracking due to temperature differentials, but the cracks are not alligator cracking; and WHEREAS, on July 2, 2018, FEMA denied Bossier Parish’s request for Public Assistance stating that Bossier Parish did not provide documentation which proved that the damage to the 52 inundated roadways in Bossier Parish were a result of the declared flood event; and WHEREAS, Bossier Parish provided core samples to FEMA of four roads which were inundated and a core sample of a road that has never flooded for comparison; and WHEREAS, the Bossier Parish Police Jury experienced a flood event in October of 2009 (Flood Event No. 1863) where roads were inundated during the flood event; and WHEREAS, FEMA participated in 2009 for repairs to the inundated roads paying seventy-five percent (75%); and WHEREAS, FEMA has approved and participated in similar events after Hurricane Katrina and funded $1.2 billion in repairs to eight parishes around New Orleans, Louisiana; and WHEREAS, FEMA has approved and participated in infrastructure repairs after Hurricane Sandy; and WHEREAS, an appeal must be submitted to the Governor’s Office of Homeland Security and Emergency Preparedness within 60 days of receipt of the FEMA determination letter; and NOW THEREFORE, BE IT RESOLVED, by the Bossier Parish Police Jury in due, regular and legal session convened, that it does hereby requests that arbitration language be included in a bill that would allow applicants to request the use of binding arbitration by a panel to resolve disputes arising under the Robert T. Stafford Disaster Relief and Emergency Assistance Act, and that said language be retroactive to the 2016 flood events, and action be taken to assist Bossier Parish in resolving this issue; and BE IT FURTHER RESOLVED, that the Bossier Parish Police Jury requests support of the Congressional Delegation of Bossier Parish’s claim to FEMA for $25, 072,336.00 to repair flood damaged roads in Bossier Parish, Louisiana, due to the 1,000 year flood event in 2016 in Bossier Parish; and THUS DONE AND ADOPTED THIS 13TH DAY OF AUGUST, 2018.
