Motion to enter into an Intergovernmental Agreement with the Town of Cheneyville for the Rapides Parish Highway Department to furnish labor and equipment, for approximately twenty (20) hours of patching potholes on various roads, as requested by the Mayor of Cheneyville, to be paid out of Road District No. 3A Maintenance Funds, the Town’s portion and authorize the President to sign same. (Workforce 5/7)
  2. Motion to authorize the President to sign an Intergovernmental Agreement with the Rapides Parish School Board, for the purpose of engaging out of school youth. The Rapides Parish School Board experiences a large number of students who drop out of high school each year. The Rapides Workforce Development Board and the Rapides Parish School Board are collaborating to remain connected with these youth and provide services.

As a drop out, these former students are automatically eligible for services through the Workforce Innovation and Opportunities Act (WIOA) which may help them return to school, obtain a HiSET (secondary diploma of equivalency), gain employment, join the military, or a combination thereof. Once the student has expressed desire to leave school, a pre-counseling session can be arranged by the School Board liaison to inform the student and his/her parents of the services that can be provided to the student after the student exits the school system. Once the former student is enrolled for services, the staff will provide case management to ensure the participant’s success. There is no anticipated expense to Rapides Parish Police Jury through this collaboration. (Workforce 5/7)

  1. Motion to approve the creation of a Workforce Professional I position to meet the needs of the WIOA grant. (Workforce 5/7)
  2. Motion to approve the hiring of one (1) part-time, temporary Workforce Specialist to assist with the provision of WIOA services until a Workforce Professional I can be hired. (Workforce 5/7)
  3. Motion to ratify authorization of the submission of a Capacity Building federal grant application, for the USDA’s Farmers Market Promotion Program (FMPP) and authorize the President to sign any necessary documents. The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, May 18, 2018, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Davron “Bubba” Moreau, President, Richard Vanderlick, Vice President, and Police Jurors: Joe Bishop, Craig Smith, Theodore Fountaine, Jr., Oliver “Ollie” Overton, Jr., Sean McGlothlin, Richard Billings and Scott Perry, Jr.

Also present were Mr. Bruce Kelly, Treasurer; Mr. Dennis Woodward, Public Works Director; Mr. Shane Trapp, Courthouse Building Superintendent; Ms. Donna Andries, Sales & Use Tax Administrator; Chief Randy McCain, Fire District No. 2; Ms. Elaine Morace, WIA Operations Director; Ms. Linda Stewart, Registrar of Voters; Mr. Greg Jones, Legal Counsel and Ms. Laurel Smith, Secretary.

The invocation was given by Mr. Dennis Woodward.

The Pledge of Allegiance was led by Mr. Theodore Fountaine.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Davron “Bubba” Moreau, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any public comment on any agenda item, to which there was no response.

On motion by Mr. Ollie Overton, seconded by Mr. Scott Perry, to adopt the minutes of the Rapides Parish Police Jury held in Special Session March 26, 2018, Regular Session on April 9, 2018, Special Session April 18, 2018 and Special Session May 3, 2018 as published in the Official Journal. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Richard Vanderlick, that approved bills be paid. On vote the motion carried.

On motion by Mr. Richard Vanderlick, seconded by Mr. Scott Perry, to accept the Treasurer’s Report. On vote the motion carried.

The next item on the agenda was to recognize and present plaques to the Pineville Lady Rebels for winning 2018 LHSAA State Championship and National Championship in Powerlifting.

Mr. Joe Bishop and Coach Matthew Carmouche presented plaques to the Pineville Lady Rebels for winning 2018 LHSAA State Championship and National Championship in Powerlifting. The next item on the agenda was to recognize and present plaques to the Rapides Parish 2018 Nachman Fitness Team and 2018 Louisiana State Fitness Champions.

Mr. Sean McGlothlin, Ms. Margaret Laborde and Ms. Rebecca Cook presented plaques to the Rapides Parish 2018 Nachman Fitness Team and 2018 Louisiana State Fitness Champions.

The following appointments were announced to be made at the next meeting: **Mr. Walter Warwick on the AICUZ Appeal Board for a three (3) year term. Term will expire June 8, 2018. **Mr. Tommy Milo on the AICUZ Appeal Board for a three (3) year term. Term will expire June 14, 2018.

On motion by Mr. Richard Billings, seconded by Mr. Joe Bishop, the following resolution was presented and unanimously adopted:

RESOLUTION

A resolution providing for canvassing the returns and declaring the result of the special election held in Fire Protection Sales Tax District No. 18 of the Parish of Rapides, State of Louisiana, on Saturday, April 28, 2018, to authorize the levy of a sales and use tax therein.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Fire Protection Sales Tax District No. 18 of the Parish of Rapides, State of Louisiana (the “District”), that: SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the District on SATURDAY, APRIL 28, 2018, to authorize the levy of a sales and use tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election. SECTION 2. Procès Verbal. A Procès Verbal of the c anvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority. SECTION 3. Promulgation of Election Result. The result of said election shall be promulgated by publication in the manner provided by law. BE IT KNOWN AND REMEMBERED that on Monday, May 14, 2018, at three o'clock (3:00) p.m., at its regular meeting place, the Rapides Parish Courthouse. 2nd Floor, 701 Murray Street, Alexandria, Louisiana, the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Fire Protection Sales Tax District No. 18 of the Parish of Rapides, State of Louisiana (the "District"), and being the authority ordering the special election held therein on Saturday, April 28, 2018, with the following members present:

Joe Bishop, Craig Smith, Theodore Fountaine, Jr., Oliver “Ollie” Overton, Jr., Sean McGlothlin, Richard Billings, Scott Perry, Jr., Richard Vanderlick and Davron Moreau;

did, in open and public session, examine the official certified tabulations of votes cast at the said election, and did examine and canvass the returns of the said election, there having been submitted at said election the following proposition, to wit: PROPOSITION (SALES TAX)

Shall Fire Protection Sales Tax District No. 18 of the Parish of Rapides, State of Louisiana (the “District”), be authorized to levy and collect a tax of one-half of one percent (½%) (the “Tax”) upon the sale at retail, the use, the lease or rental, the consumption and the storage for use or consumption, of tangible personal property and on sales of services in the District, all as defined by law (an estimated $90,000 reasonably expected at this time to be collected from the levy of the tax for an entire year), in perpetuity, commencing July 1, 2018, with the avails and proceeds of the Tax (after paying reasonable and necessary costs and expenses of collecting and administering the Tax) to be dedicated and used for the purpose of acquiring, constructing, maintaining and/or operating fire protection and emergency medical service facilities, vehicles and equipment, including both movable and immovable property, and including paying the cost of obtaining water for fire protection purposes and further, shall the District be authorized to fund proceeds of the Tax into bonds?

There was found by said count and canvass that there was a total of 375 votes cast IN FAVOR OF the Proposition and a total of 189 votes cast AGAINST the Proposition, as hereinabove set forth, and that there was a majority of 186 votes cast IN FAVOR OF the Proposition as hereinabove set forth.

Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that the Proposition as hereinabove set forth was duly CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in the District on Saturday, April 28, 2018.

Exhibit "A" attached hereto and made a part of this Procès Verbal is a copy of the Notice of Special Election and proof of publication thereof.

If at the end of such period of time the accumulation of filthy or offensive matter has not been removed and/ or the weeds or other growths have not been cut or removed, any interested person is authorized to file criminal charges against the owner, occupant, or possessor or any agent of the above mentioned as a violation of section 13-3 and the penalty provisions therein.

Chapter 18. MOTOR VEHICLES AND TRAFFIC

Section 18-4.2. Speed limits designated on certain streets:

  • (i) Fifteen miles per hour. It shall be unlawful for any person to drive or operate a vehicle upon the following parish road in Rapides Parish in excess of fifteen (15) miles per hour.

(l). Whoever violates the provisions of this section shall be punished by a fine not to exceed one hundred dollars ($100.00), or imprisoned in the Rapides Parish Jail for a period not to exceed thirty (30) days, or both.

On motion by Mr. Richard Billings, seconded by Mr. Ollie Overton, to enter into an Intergovernmental Agreement with the Town of Cheneyville for the Rapides Parish Highway Department to furnish labor and equipment, for approximately twenty (20) hours of patching potholes on various roads, as requested by the Mayor of Cheneyville, to be paid out of Road District No. 3A Maintenance Funds, the Town’s portion and authorize the President to sign same. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Craig Smith, to authorize the President to sign an Intergovernmental Agreement with the Rapides Parish School Board, for the purpose of engaging out of school youth. The Rapides Parish School Board experiences a large number of students who drop out of high school each year. The Rapides Workforce Development Board and the Rapides Parish School Board are collaborating to remain connected with these youth and provide services.

As a drop out, these former students are automatically eligible for services through the Workforce Innovation and Opportunities Act (WIOA) which may help them return to school, obtain a HiSET (secondary diploma of equivalency), gain employment, join the military, or a combination thereof. Once the student has expressed desire to leave school, a pre-counseling session can be arranged by the School Board liaison to inform the student and his/her parents of the services that can be provided to the student after the student exits the school system. Once the former student is enrolled for services, the staff will provide case management to ensure the participant’s success. There is no anticipated expense to Rapides Parish Police Jury through this collaboration. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Scott Perry, to approve the creation of a Workforce Professional I position to meet the needs of the WIOA grant. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Craig Smith, to approve the hiring of one (1) part-time, temporary Workforce Specialist to assist with the provision of WIOA services until a Workforce Professional I can be hired. On vote the motion carried.

On motion by Mr. Sean McGlothlin, seconded by Mr. Richard Billings, to ratify authorization of the submission of a Capacity Building federal grant application, for the USDA’s Farmers Market Promotion Program (FMPP) and authorize the President to sign any necessary documents. The funds from this grant will be used for a Farmers Market in Rapides Parish, located at the Buckeye Recreation District. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith, to enter into an Intergovernmental Agreement with the Rapides Parish Sheriff’s Office for an inmate labor crew, to be used for janitorial services at the Rapides Parish Courthouse, pending Legal Counsel’s review and authorize the President to sign same. A resolution of intention of the Police Jury of the Parish of Rapides, No. 2B (Ward 11) of the Parish of Rapides, State of Louisiana, and Parish of Rapides, State of Louisiana, describing the boundaries thereof, ordering and directing the President to give due notice of the proposed creation of said sub-road districts and providing for the hearing of any and all objections to the creation or boundaries thereof.

WHEREAS, this Police Jury, acting upon its own initiative, desires to issue notice of its intention to create two sub-road districts in the hereinafter described territory of Road District No. 2B (Ward 11) of the Parish of Rapides, State of Louisiana, in the manner provided by Part II, Chapter 2, Title 48 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority supplemental thereto:

On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, to accept a permanent drainage servitude at 516 Bayou Marie Road, to relocate a culvert to avoid a conflict with structure (Ward 9, District D) and authorize the President to sign all the necessary documents. On vote the motion carried.

On motion by Mr. Richard Billings, seconded by Mr. Joe Bishop, to authorize to purchase for Rapides Parish Fire District No. 9, a F-550 truck, off State Contract No. 4400010201 for the amount of $47,041.00, as requested by the Fire Chief and Echo/Poland Volunteer Fire Department Board, to be paid out of Fire District No. 9 funds. On vote the motio n carried.

The next item on the agenda was to receive an update from Ms. Lin Stewart, Registrar of Voters, on the Gravity Drainage District #2 election results and status.

Ms. Lin Stewart, Registrar of Voters, stated during the process of creating Gravity Drainage District #2, the voters that lived on the streets that were in the boundary lines of the District were entered into the Elections Registration and Information Network. The ERIN system is used throughout the Secretary of State’s Office and all the Registrar of Voter’s Offices. Anything to do with voter’s registration and elections, goes through this system. In our Parish, we have a lot of Districts and Precincts that are split. Therefore , not all voters have the same ballot at the poles every time you go vote. In Precincts 41 and 42, our office entered all the addresses into the new District. That is all the streets that were going to be in Gravity Drainage District No. 2. We had some problems from the beginning of this, several different reasons. Everyone that was in this District, when it was created, had been entered into the District properly. The poll books, from the Secretary of State’s Office, came in and we put them into the black binders for Election Day at the polls. In Precincts 41 and 42, on April 28th, some of the voter’s ballots should have reflected they could only vote for City Marshal, other people should have been able to vote for City Marshall and the Gravity Drainage District No. 2. The majority of those people were in the Precinct 42 portion, which is the Landmark and Tennyson Oaks Subdivisions. In Precinct 41 there are 1360 registered voters. 934 were eligible to vote for or against the GDD#2. 171 of the 1360 registered voters in Precinct 41 voted. Of the 171 voter s that actually did cast a ballot, 161 of those people should have been able to vote on GDD#2. They were able to vote for City Marshall, but unable to vote for or against GDD#2. In Precinct 42, there are 1412 voters, 587 were eligible to vote for the GDD#2. 255 people actually voted that day. 123 should have been able to vote for GDD#2. They were able to vote for the City Marshall, but unable to in the GDD#2 election. Ms. Lin Stewart stated she met with the GDD#2 Board after the election and informed them of the status of what happened. From the date of the promulgation of the election results, there is a period of sixty days for the election results to be challenged. If the election is challenged, the outcome for that challenge has to come pursuant to a court judgement. In other words, someone will have to file a challenge to the election within sixty days. The Judge will review that and decide whether there is a reason to challenge. Other than that, she stated she had been advised by the Secretary of State’s Office and the Attorney General’s Office that she is not an Attorney and could not give any legal opinions.

Mr. Sean McGlothlin stated he had gotten several phone calls and some people in the audience have some questions.

Ms. Lin Stewart stated that on the Election Day, there were over 3,000 registered voters that went to those two precincts that were eligible to vote on GDD#2 and her office did not receive one call wanting to know why they couldn’t vote. When you have a problem on Election Day you need to call her office immediately.

Mr. Scott Perry questioned what the status of the election was, to which Ms. Lin Stewart said they are waiting for someone to challenge the election. They have sixty days.

Mr. Chris Chelette, who lives on the back side of West Point, stated that he was not able to vote for the GDD#2 tax. When he showed up to cast his vote for City Marshall, he was told he didn’t live in the GDD#2 and then to find out that I am, it is a little discouraging and disheartening for the citizens of this community. How do we go to officially protest this? You said that no one has protested yet. I am here to protest it. I am about to be charged with another tax, that I didn’t get to vote on. It is my American right that I get to choose whether I want to be taxed or not. Taxation without representation is not right. I am here to protest that I didn’t get to vote. The only fair thing to do is to have the re -vote.

Discussion, questions and answers ensued.

The next item on the agenda was to receive an update from Mr. Jimmy Faircloth, Legal Counsel, on the meeting with the District Attorney concerning the budget.

Mr. Greg Jones stated if there were no objections, he would like to leave the room because of the discussion.

Mr. Jimmy Faircloth stated there was no reason for Mr. Jones to leave, he was not going to say anything that is privilege communications.

Mr. Joe Bishop stated the reason he put Mr. Faircloth on the agenda was because Mr. Faircloth, Mr. Bubba Moreau and Mr. Bruce Kelly were supposed to meet and later on he was told Mr. Overton was supposed to meet too and he was wondering how the meeting went with the District Attorney’s Office concerning the budget.

Mr. Faircloth stated there was no meeting. Because it’ s an open meeting, I have been asked several times by members to explain, the lawsuit and the budget issue. It’s best to cover in an open meeting to let the public hear this as well. The lawsuit concerns the conflict issue and it concerns the PTI Program. The budget issue appears to be separate and it’s not. It’s not the subject of the litigation right now, there is no lawsuit involving the funding the budget. If you go back to, when Mr. Holland came back on either March 4th or 5th and he made the presentation to you that you should fund the remainder, the difference, they were arguing about, on the DA’s budget. If you remember correctly, he said that if he files a suit over the budget, he would ask that you not only fund that gap, but that you fund, I think it was 2 million dollars or 2.2 million dollars, it would essentially be the entire self-funded piece. Well, that is the PTI Program. The reason that it’s important to understand the relationship here, is that your obligation to fund the DA’s Office, is to fund the reasonable expenses of the District Attorney’s Office. If it’s ultimately determined, that the PTI Program proceeds, cannot be used to fund the District Attorney’s Office and that doesn’t mean the District Attorney can’t have a PTI Program. The District Attorney is running a program and we had challenged the authority and the scope of the authority, to spend those fees generated by that program. It is impossible to just say we are going to talk about the budget not the lawsuit. Having said that, after the hearing, at your request, I did reach out to Counsel of the District Attorney, in response to him asking me, could we have a meeting? He thought it would be a good idea to meet. Certainly no harm in that, I told you that. I receive d a response the latter part of last week and the response, I would politely describe as negative in turns of a meeting, if the intention was for you to continue to challenge the authority of the PTI Program. So, you are basically reduced to saying, yes we will pay this amount of money without any real understanding of why. I don’t think that is appropriate, you don’t think that’s appropriate, that’s what the litigation is about, I will continue to make every effort I can to try to figure out a way and that is what our petition last week was about. What I’m trying to do, is to come up with a way to construct it under the criminal court fund so it could be administered and the fees are under the criminal court fund statute. This would allow you to do your budget. So that didn’t happen, I think ultimately this case is going to move up very quickly on appeal. I think it is going to be addressed by the Court of Appeals and I do think that it will be treated differently in the District Attorney’s Office after that. But until that happens, unless there is some conversation with the District Attorney about how he runs the program, I can’t tell you what your obligations are. That’s kind of the best explanation I can give you.

Mr. Ollie Overton stated one, thing this Jury is having a lot of miscommunication between the parties. We need to figure this thing out, because right now, everybody is sitting, picking out which way to go and how to approach this thing and it’s costing the Jury in the long run. How m uch money are we going to spend on fighting this case? That’s my question to my colleagues. We need to maybe put a cap on how much we are going to spend, because we are going to be out of a whole lot of money.

Mr. Theodore Fountaine stated this has been going on over several years. This didn’t just come up. But we’ve accepted whatever they have said to us that they needed. I’m talking about the District Attorney’s Office. Whatever they told us they needed, we said ok. We need to find out what we can and what we can’t do. From the beginning, I stated that we will pay reasonable expenses. There are times that you go in almost any office, that there are things come up that we don’t need to be paying. My thrust, and I hope this thrust is ours, is that we finally come up with a basic system that we are in charge and their budget needs to be what we can afford for them.

Discussion ensued.

Mr. Bruce Kelly stated the problem, for the past several years is that the DA’s Office has been diverting court funds and court costs and it has gone to his own funds upstairs.

Mr. Perry stated that the Jury can’t keep going like this. The DA’s Office is family to the Rapides Parish Police Jury. They are our legal advisor and we are fighting amongst ourselves. It seems like to me it should be very simple though. Somebody needs to sit down and see if this issue can be taken care of.

Mr. Faircloth stated that lawsuits are frustrating and they do sometimes take time. There were two issues when we started. One was the conflict issue. I thought that was going to be the problem. I never thought we would have a hearing on that issue. We had a trial last week and the Judge entered an order enjoining the District Attorney by taking action in conflict with this. The Judge referred to the conflict, Authority, by citing basic law. Not just in this state but everywhere. So, if we couldn’t come to an agreement to avoid that injunction, I don’t know how we are going to solve the more complicated problem of the budget. I will tell you this, there’s a Court of Appeals system and I think this issue will work itself through very, very quickly. This issue is a very prominent issue in this state right now. The Supreme Court has asked the District Attorney’s in this State to start talking about their PTI Programs

Mr. Fountaine questioned Mr. Bruce Kelly where the budget stands now.

Mr. Bruce Kelly stated since we are in a half years appropriation, showing June 30th, General Fund and Criminal Court Fund will run out of funding.

Mr. Fountaine stated that at the rate we are moving, I don’t think this will be settled by June 30th.

Mr. Faircloth stated that you are going to have to make decisions on how you spend the resources that you have. You got mandated expenses, you g ot discretionary expenses. You lack the funds that state all the mandated expense. When you get to that point, you are going to have to make some hard decisions about which mandated expenses you are going to pay.
