The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, September 11, 2017, at three (3:00) o'clock p.m. (Central Standard Time).
There were present: Craig Smith, President, Scott Perry, Jr., Vice President, and Police Jurors; Davron “Bubba” Moreau, Joe Bishop, Theodore Fountaine, Jr., Richard Vanderlick, Oliver “Ollie” Overton, Jr., Sean McGlothlin and Richard Billings.
Also present were Mr. Bruce Kelly, Treasurer; Mr. Dennis Woodward, Public Works Director; Mr. Shane Trapp, Courthouse Building Superintendent; Ms. Donna Andries, Sales & Use Tax Administrator; Chief Randy McCain, Fire District No. 2; Ms. Sonya Wiley-Gremillion, OHSEP Director; Ms. Linda Sanders, Civil Service Director; Mr. Thomas O. Wells, Legal Counsel; Mr. Phillip Terrell, District Attorney and Ms. Laurel Smith, Secretary.
The invocation was given by Mr. Richard Billings.
The Pledge of Allegiance was led by Mr. Bruce Kelly.
The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.
The President asked if there was any public comment on any agenda item, to which there was no response.
The President asked if there was any Juror comments to which the re was no response.
On motion by Mr. Joe Bishop, seconded by Mr. Sean McGlothlin, to adopt the minutes of the Rapides Parish Police Jury held in Special Session August 1, 2017, August 11, 2017 and Regular Session on August 14, 2017, as published in the Official Journal. On vote the motion carried.
On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, that approved bills be paid. On vote the motion carried. Mr. Craig Smith abstained.
On motion by Mr. Richard Vanderlick, seconded by Mr. Scott Perry, to accept the Treasurer’s Report. On vote the motion carried.
The next item on the agenda was to r ecognize and present plaques to the Rapides Parish Coliseum Authority members.
Mr. Craig Smith and Mr. Joe Bishop presented plaques to the Rapides Parish Coliseum Authority members that were present and thanked them for their service REGULAR MEETING SEPTEMBER 11, 2017

The next item on the agenda was to recognize Mr. Sam Voisin, SMG, for an update on the Coliseum.
Mr. Sam Voisin, SMG also thanked the Coliseum Authority for their years of dedication and hard work. Mr. Voisin gave a brief update on the Coliseum. He also introduced the new General Manager, Mr. Charlton Arlington for the Coliseum.
Mr. Arlington gave a brief statement of his background information.
On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton, to open a public hearing on the proposed condemnation of the following property in accordance with the Rapides Parish Code of Ordinances Section 8-1/4, as authorized by the Rapides Parish Police Jury. Ms. Carolyn Hines, Curator for the Rapides Parish Police Jury, stated the condemnation was originally set for September 12, 2016 and wanted to take notice of the file being started previously. The certified letter that was sent was never signed for. Returned “No such address, no such number.” She stated she took out a public ad in August and she has not received any calls on the ad. Ms. Hines respectfully asked that this notice of evidence be filed into the record and she be discharged and relieved from further responding and that all fees and charges be assessed to the property.
Mr. Tom Wells stated for the record he would like for the inspection report to be filed in the records and call for Mr. Jimmie Price’s property to be condemned.
On motion by Mr. Sean McGlothlin, seconded by Mr. Richard Vanderlick, the public hearing be closed. On vote the motion carried.
On motion by Mr. Scott Perry, seconded by Mr. Sean McGlothlin, the following ordinance was presented and unanimously adopted:
ORDINANCE
WHEREAS, the hearing having been held on the structure being considered for condemnation and it is the opinion of the Rapides Parish Police Jury that the facts justify the condemnation of the property of Mr. Jimmie F. Price located at 1719 Ulster Street, Alexandria, Section 76, T4N-R1W, Ward 8, Rapides Parish;

hereby enter an order condemning the following property:

and order it be demolished and/or removed in accordance with the Rapides Parish Code of Ordinances, Chapter 8-1/4 Condemnation of Buildings.
THUS PASSED AND APPROVED on this 11th day of September, 2017.

AUTHORIZING THE RAPIDES PARISH POLICE JURY TO SELL
Married to and living in community with RUFUS WRIGHT
FOR THE
CONSIDERATION OF $4,887.40 CASH
WHEREAS, the City of Alexandria and/or the City of Pineville and/or Parish of Rapides owns property described as
Lots Eight (8) and Nine (9), Square 14, New Enterprise Addition, as per plat thereof recorded in Plat Book 4, page 50, of the records of Rapides Parish, Louisiana.
WHEREAS, a request has been received from DEBRA WRIGHT, married to and living in community with Rufus Wright, to purchase said property for the consideration of $4,887.40 cash, at the time of sale, said consideration representing the total of the statutory impositions, governmental liens, and costs of sale or twothirds (2/3) of the appraised value of the property; and,
WHEREAS, this Jury is of the opinion that it would be in the public interest to convey the above-mentioned property to DEBRA WRIGHT, married to and living in the community with Rufus Wright, for the offered consideration.
NOW, THEREFORE, BE IT ORDAINED by the Rapides Parish Police Jury that:
Section 1. Lots Eight (8) and Nine (9), Square 14, New Enterprise Addition, as per plat thereof recorded in Plat Book 4, page 50, of the records of Rapides Parish, Louisiana.

Rapides Parish, Louisiana, should be re-entered into the stream of commerce thereby serving the public interest.
Section 2. The acquiring person shall certify, in writing, to the Purchasing Department that he/she or his/her agent has searched for all names and last known addresses of all owners, mortgages, and any other person(s) who may have a vested or contingent interest in the property, or who have filed a request for notice as indicated in those records and has so examined:
- • the mortgage and conveyance records of Rapides Parish,
- • the current telephone book,
- • any other examination resources, including Internet search engines, if any, the records of the Louisiana Secretary of State and the Secretary of States set forth by the names of identified entities
Section 3. The acquiring person shall submit the required notifications (R.S. 47:2206 A and B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. *Copies of the “green and white receipts” should be maintained by the purchaser as indicia of compliance with the notice requirements;
Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or otherwise challenge in a court of competent jurisdiction the potential sale or donation:
- (a) Sixty days from the date of the notice provided in this Subsection, if five years have elapsed from the filing of the tax sale certificate (formerly “proces verbal”), or six months after the date of the notice provided for in this Subsection, if five years have not elapsed since the filing of the tax sale certificate (formerly “proces verbal”);
- (b) The filing of the sale or donation transferring the property.
- (c) The written notice required by this Section shall be that which is included in R.S. 47:2206 A. (2).
Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:
- (a) Sixty days, for property on which a tax sale certificate (formerly “proces verbal”) was filed over five years previous of the first publication, or six month if the tax sale certificate (formerly “proces verbal”) was filed less than five years before the first publication of the notice provided for in this Subsection.

- (b) The filing of the sale or donation transferring the property.
- (c) The publication required by this Section shall be that which is included in R.S. 47:2206 B. (2).
Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.
Section 7. At any time after the expiration of the sixty-day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney’s office has certified in writing to the President, that purchaser or donee has complied with the mandates of this Ordinance. The sale price shall be paid by cashier’s check or money order at the time of the sale.
NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.
NOTE: The City of Alexandria and/or the City of Pineville and/or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.
Section 8. The acquiring person shall be responsible for filing the sale or donation and payment of all filing fees.
Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.
- (a) All sales and donations shall be without warranty, either expressed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against redhibitory defects or vices and the warranty that the thing sole is reasonable fit for its ordinary purpose or the acquiring person’s intended or particular purpose.
- (b) These waivers or exclusions of warranties shall be self-operative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardless of whether they are brought to the attention of the acquiring person. - (c) The writing constituting the sale shall be in the form as provided in R.S. 47:2207 B. and the writing constituting the donation shall be that which is included in R.S. 47:2207 C.
Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.
Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.
Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.
- (a) The affidavit may also contain a statement of the interest to which the purchaser or donee takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debtor, as mortgagors.
- (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47:2208.
- (c) With respect to a sale, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
- (d) With respect to a donation, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
- (e) Upon filing of the affidavit, the recorder of mortgages or the recorder of conveyances shall treat as canceled, terminated, released, or erased, all those liens, privileges, mortgages or other encumbrances canceled, terminated, released or erased under subsections (c) or (d) of this Section, only insofar as they affect the property.
- (f) The owner filing the affidavit shall be liable to and indemnify the recorder of mortgages, the recorder of conveyances, and any other person relying on the cancellation, termination, release, or erasure by affidavit for any dames that they REGULAR MEETING SEPTEMBER 11, 2017

may suffer as a consequence of such reliance if the recorded affidavit contains materially false or incorrect statements that cause the recorder to incorrectly cancel, terminate, release, or erase any interest listed in the affidavit. The recorder of mortgages and the recorder of conveyances shall not be liable for any damages resulting to any person or entity as a consequence of the cancellation, termination, release or erasure of any interest in compliance with this Section.

WHEREAS, Section 338.54 of Title 47 of the Louisiana Revised Statutes of 1950, as amended, authorizes the Police Jury of the Parish of Rapides, State of Louisiana (the "Police Jury"), to create a sales tax district within the Parish of Rapides, State of Louisiana (the "Parish"); and
WHEREAS, the Police Jury adopted an ordinance on May 8, 2017 (the “Prior Ordinance”), creating Fire Protection Sales Tax District No. 18 of the Parish of Rapides, State of Louisiana (“Sales Tax District 18”); and
WHEREAS, pursuant to the Prior Ordinance, the District comprises all that territory within the boundaries of Fire Protection District No. 18 of the Parish of Rapides, State of Louisiana (“Fire District 18”), as such boundaries existed on May 8, 2017; and
WHEREAS, the Police Jury adopted a resolution on September 11, 2017 (the “Resolution”), reducing the boundaries of Fire District 18; and
WHEREAS, the Police Jury now desires to amend the Prior Ordinance to reflect the amended boundaries of Fire District 18 set forth in the Resolution;
NOW, THEREFORE, BE IT ORDAINED by the Police Jury, acting as the governing authority of the Parish, that:

A RESOLUTION OF THE RAPIDES PARISH POLICE JURY
APPROVING PLASTIPAK FOR PARTICIPATION IN THE
INDUSTRIAL TAX EXEMPTION PROGRAM AT PARDUE
ROAD IN PINEVILLE, LA
WHEREAS, Article 7, Section 21 (F) of the Louisiana Constitution provides for the Board of Commerce and Industry (“BCI”), with the approval of the Governor, to approve contracts for the exemption of ad valorem taxes f a new manufacturing establishment or an addition to an existing manufacturing establishment, on such terms and conditions as the board, with the approval of the Governor, deems in the best interest of the State; and
WHEREAS, PLASTIPAK has applied for an Industrial Tax Exemption (“ITE”) and seeks approval of the BCI and the Governor for a contract granting that exemption; and
WHEREAS, Executive Order JBE-16-26 has provided standards upon which the Governor will approve contracts for the exemption as being in the best interest of the State. To that end, the Executive Order sets forth parameters for approval that include job creation, percentage of the exemption granted and the term of the exemption and provides for the guidance of the Louisiana Department of Economic Development in addressing these issues. It further provides for local review and approval by the relevant parish and / or municipal council, police jury and sheriff; and
WHEREAS, Executive Order JBE-16-26 mandates that each exemption contract approved by the Governor shall include as Exhibit “A”, a Cooperative Endeavor Agreement between the State of Louisiana and the Department of Economic Development and the applicant, to the ITE contact between the BCI and the applicant, which provides for the creation or retention of jobs and provides for the exercise of the option in the Louisiana Constitution for the term or percentage of the Parish ad valorem tax exemption granted in the contract, and provides for the reduction or loss of the exemption based upon the applicant’s compliance with the contract.
WHEREAS, Executive Order JBE-16-26 further requires that this board, together with the other required local governmental entities signify consent to the terms of the exemption by resolution and the Sheriff of this Parish shall signify consent to the terms of the exemption by letter. Executive Order JBE-16-26 further provides that the resolutions of approval shall be attached as Exhibit “B” to the ITE contract REGULAR MEETING SEPTEMBER 11, 2017

between the BCI and PLASTIPAK; and
WHEREAS, PLASTIPAK and the Louisiana Department of Economic Development have advised that certain terms and conditions forming Exhibit “A” to the ITE contract pending approval before the Louisiana BCI have been reached and have conveyed the same to this board, and thus this matter is now ready for a determination of approval of this board as required by Executive Order JBE-16-26,
THEREFORE, BE IT RESOLVED, upon consideration of the foregoing and the public discussion held this day, that this board approves the terms of the ITE contract based on the inclusion of the following terms and conditions into Exhibit “A” (the Cooperative Endeavor Agreement between the State of Louisiana, the Department of Economic Development, and PLASTIPAK) to the ITE contract between the BCI and PLASTIPAK with respect to its manufacturing facility located in Pineville, Rapides Parish, Louisiana:
- a. Total capital investment by PLASTIPAK in Pineville, LA of at least $15.0 million by December 31, 2017.
- b. The retention of existing jobs (estimated at 236 jobs) through 2027, along with retention of associated annual payroll (estimated at $14.2 million, exclusive of benefits and contract labor) to be increased at a minimum of 2% annually.
- c. New jobs and new annual payroll (excluding benefits and contract labor) at the Pineville facility at the following levels: 10 net new jobs with an annual average payroll of $40,000.00.
In the event PLASTIPAK fails to complete its project, or fails to timely meet its performance objectives and/or job creation requirements, including but not limited to the retention or creation of the number of jobs or the achieving or maintaining of the payroll amounts within the time and for the term agreed, as specified in its award agreement; if PLASTIPAK ceases its operations, reduces its employment numbers or payroll amounts to less than 90% of the required amounts; any one of those events or circumstances shall constitute a default under the award agreement, and the Rapides Parish Police Jury shall have at its option and sole discretion to recover from PLASTIPAK all previously exempted taxes that but for this agreement would have been due during the period of default and/or to withdraw or modify the exemption for future years. If PLASTIPAK ceases operation at its Pineville, LA facility during the term of this agreement the Rapides Parish Police Jury shall have at its option and sole discretion to recover from PLASTIPAK all previously exempted taxes that but for this agreement would have been due during the period of this agreement.
The Rapides Parish Police Jury further authorizes the Louisiana Department of Economic Development, on behalf of the BCI, to include this resolution in Exhibit “B” to the ITE contact between the BCI and Plastipak.

The next item on the agenda was to recognize Sheriff William Hilton to give an update on the Jail Overcrowding.
Sheriff William Hilton stated he would be talking about DC-1, the jail here in the Courthouse. The jail was built in 1974 and had a capacity at that time of 236 inmates. Over the period of time it has increased to 348. Sheriff Hilton stated he had Mr. Daniel Broussard as Legal Counsel, representing him as they work through this situation. This morning at 6:00 a.m., there were 395 inmates in the jail. Since Judge Tom Yeager has moved to the criminal side, he and Judge Doggett have changed the bonding process. The jail is overcrowded and the liability is falling back on the Jurors to find some place to put the excess inmates. Most of the jails in the state right now are full, so it’s not going to be easy to find a place for these inmates. He stated he had talked to Mr. Phillip Terrell and Mr. Tom Wells about the situation. He had a meeting with Judge Doggett, Judge Beard and Judge Koch.
Mr. Dan Broussard stated in the past, when he represented Sheriff Grady Kelley, they went before a Judge and the Sheriff was told that for every inmate he was over the capacity, the Sheriff was going to be fined $50.00, per day personally, over the capacity. It doesn't matter if you say you don't have the money. The Jury has the sole responsibility of housing the prisoners, taking care of them, medical care, transportation, etc. The law is very serious about that.
Sheriff Hilton stated Friday, the State Fire Marshall did an inspection and they were about 30 or 40 inmates above capacity. He served notice on the Sheriff at 4:00 p.m. and this afternoon if they didn't have the jail count back down to 348, he was going to issue him a summons.
Mr. Craig Smith stated he had Mr. Bruce Kelly pass out copies of the General Fund Budget for the Jurors to take home and look over. He further stated that in the next few days there would be a special meeting to address this situation. The Jury is strapped for money right now. We are all looking for options, working with the District Attorney's Office, Judges and the Sheriff.
Discussion ensued.
Mr. Phillip Terrell stated that there were over 12, 000 arrests in Rapides Parish Jails last year. The Judges and the DA’s Office are moving cases as quickly as they can.
Sheriff Hilton stated crime is rampant and increasing all over the United States, primarily behind narcotics. Drugs are coming across the Mexican border by the tons.

bonds for felonies was not to hold people in jail, it was so the Judges could take a look at the situation. There is a Judge on every single day reading affidavits and setting bonds. The preset bond means that it is preset, so when you are arrested, you are automatically given an opportunity to bond that amount. An example would be possession of intent to distribute heroin. On the preset bonds your bond is $10,000. Two months later they are arrested for possession of intent to distribute heroin, $10,000 preset bond and they walk out. Two months later, possession of intent to distribute heroin. $10,000 preset bond and walk out. It doesn’t make sense. What we wanted to do was on a temporary basis, remove preset bonds and look at each bond separately. When I go to the jail on the weekends, I pull up the criminal history. If this person is on bond and it’s his third, fourth, fifth burglary that person needs a high bond. There is a new law that said if you’re on bond for possession with intent, and you fail to show up for your court date, you are not given another bond. That is what the jail did the other day. He enforced that law. He would not give that person a bond and it raised some flags. That’s the law. We are trying to comply with the law. All we want to do is start looking at these bonds and lowering ones that need lowering and raising the ones of the people who just don’t want to follow the law. We are slowly putting preset bonds back in. We want to clear the jail of people who don’t’ need to be there. We want to get a hand on the ones that are in the revolving door system.
