Motion to hold a public hearing September 11, 2017, on proposed condemnation of the following property in accordance with the Rapides Parish Code of Ordinances Section 8-1/4, as authorized by the Rapides Parish Police Jury. OWNER LOCATION, DESCRIPTION & SERVICE REPORT Mr. Jimmie F. Price Unsafe, unsanitary and dilapidated structure (Mr. Perry)
  2. Motion to declare the following structure to be in violation of Flood Damage Prevention, Section 10-1/2 - 17 of the Rapides Parish Code of Ordinances, which is a violation of Flood Damage Prevention which is intended to discourage or otherwise restrict land development or occupancy in flood prone areas and the Rapides Parish Police Jury, therefore, requests that FEMA deny the availability of flood insurance coverage to this structure pursuant to the provisions of Section 1316 of the National Flood Insurance Act of 1968, as amended, subject to approval of Legal Counsel: 1038 Palmer Chapel Rd., Pineville, Rapides Parish, LA, Parcel ID #3-10-4600519; Residence in “Zone A”. The enclosure below the main floor of the structure was either built or converted to livable space below the base flood elevation, with construction materials that are not flood resistant, and electrical, heating, plumbing, and air-conditioning equipment below the base flood elevation. The base flood elevation is 83.0 and the lowest floor elevation, per the elevation certificate is 77.8’ and although modifications were made to try to correct the compliance issues, the violations were not remedied. As part of this Motion, the Rapides Parish Police Jury further declares that with the issuance of a Chapter 1316 Declaration by FEMA any further enforcement actions, with respect to these violations on this structure located at 1038 Palmer Chapel Road, Pineville, Rapides Parish, LA, shall be precluded.   3. Motion to acknowledge the election of Mr. Ernest Klock, representing employee elect, to the Rapides Parish Fire District No. 3 Civil Service Board, to fill an expiring term of Mr. John Cummings. Term will be for three (3) years, to expire October 10, 2017. (Mr. Moreau)

The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, August 14, 2017, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Craig Smith, President, Scott Perry, Jr., Vice President, and Police Jurors; Davron “Bubba” Moreau, Joe Bishop, Richard Vanderlick, Oliver “Ollie” Overton, Jr., Sean McGlothlin and Richard Billings.

Absent was: Theodore Fountaine, Jr.

Also present were Mr. Bruce Kelly, Treasurer; Mr. Dennis Woodward, Public Works Director; Mr. Shane Trapp, Courthouse Building Superintendent; Ms. Donna Andries, Sales & Use Tax Administrator; Chief Randy McCain, Fire District No. 2; Ms. Linda Sanders, Civil Service Director; Mr. Thomas O. Wells, Legal Counsel; Mr. Phillip Terrell, District Attorney and Ms. Laurel Smith, Secretary.

The invocation was given by Pastor Mike Evans.

The Pledge of Allegiance was led by Mr. Richard Vanderlick.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any public comment on any agenda item or Juror comments, to which there was no response.

On motion by Mr. Bubba Moreau, seconded by Mr. Joe Bishop, to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on July 10, 2017 and Special Session July 19, 2017 as published in the Official Journal. On vote the motion carried.

On motion by Mr. Richard Billings, seconded by Mr. Joe Bishop, that approved bills be paid. On vote the motion carried. Mr. Craig Smith recused himself.

On motion by Mr. Richard Vanderlick, seconded by Mr. Scott Perry, to accept the Treasurer’s Report. On vote the motion carried.

The next item on the agenda was to recognize Payne, Moore & Herrington, CPA Firm to present the 2016 Audit report. REGULAR MEETING AUGUST 14, 2017

Ms. Deborah Dunn, Payne, Moore & Herrington and Mr. James Ballard were present to give a brief update on the findings of the 2016 audit. Ms. Dunn shared some highlights of the audit report. They performed the audit on the financial statements, of the primary government, of the Police Jury, for the years ending December 31, 2016. Ms. Dunn further stated they did issue a clean or unqualified, unmodified audit. This is basically saying, based on their audit, the financial statements are materially correct. Ms. Dunn went over some of the findings from the audit. They all have been addressed or been resolved or in the process of being resolved.

RESOLUTION

A resolution of intention of the Police Jury of the Parish of Rapides, State of Louisiana, to reduce Fire Protection District No. 18 of the Parish of Rapides, State of Louisiana, describing the boundaries thereof, ordering and directing the President to give due notice of the proposed reduction of said fire protection district and providing for the hearing of any and all objections to the reduction or boundaries thereof.

WHEREAS, the Police Jury, acting upon its own initiative, desires to issue notice of its intention to reduce Fire Protection District No. 18 of the Parish of Rapides, State of Louisiana (the “District”) in the hereinafter described territory of the Parish of Rapides, State of Louisiana, in the manner provided by Part 1, Chapter 7, Title 40 of the Louisiana Revised Statutes of 1950, and other constitutional and statutory authority supplemental thereto:

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana, acting as governing authority of said Parish:

statutory authority supplemental thereto, it is the intention of this Police Jury to reduce the District within the Parish of Rapides, State of Louisiana, which District shall thereafter comprise and embrace all of that territory within the following described boundaries, or such part thereof as may be determined upon, to-wit:

FIRE PROTECTION DISTRICT NO. 18

BEGINNING at a point in Indian Creek Reservoir along the southern line of Ward 2 where said line intersects the southern point common to Sections 33 and 35 at the range line separating Township 1 North Range 1 West from Township 2 North Range 1 West; thence northeasterly to the northwestern corner of Section 36 Township 2 North Range 1 West; thence along the line common to Sections 36 and 79 to the center of Interstate 49; thence southerly along the center of Interstate 49 to a point west of the southern terminus of that northern most four (4) linear miles of Chickamaw Road which meanders Bayou Boeuf; thence east to the center of Chickamaw Road; thence northeasterly to a point on a line offset 1320 feet perpendicular from the southern terminus of that northern most (4) linear miles of Chickamaw Road which meanders Bayou Boeuf; thence northerly along said offset line to a point perpendicular to the northern most terminus of that aforementioned segment of Chickamaw Road; thence southeasterly to a point being the intersection of the line thence northwesterly to the intersection of the line common to Sections 78 and 79 Township 2 North Rage 1 West with the center of Bayou Clear; Thence upstream Bayou Clear to the intersection of Robinson Bridge Road; thence easterly along Robinson Bridge road to the intersection of La. BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Road District No. 5A of Rapides Parish, State of Louisiana (the "District"), that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Sections 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5 and Chapter 6-A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the District on SATURDAY, NOVEMBER 18, 2017, between the hours of seven o'clock (7:00) a.m. and eight o'clock (8:00) p.m., in accordance with the provisions of La. On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, to approve the hiring of one (1) part-time, temporary Youth Specialist to assist with the provision of youth services under the Workforce Innovation and Opportunity Act (WIOA), to be paid out of WIOA funds, and to authorize the Treasurer to amend the budget as necessary. On vote the motion carried.

On motion by Mr. Richard Billings, seconded by Mr. Ollie Overton, to hold a public hearing September 11, 2017, on proposed condemnation of the following property in accordance with the Rapides Parish Code of Ordinances Section 8-1/4, as authorized by the Rapides Parish Police Jury. OWNER LOCATION, DESCRIPTION & SERVICE REPORT Mr. Jimmie F. Price Unsafe, unsanitary and dilapidated structure On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, to declare the following structure to be in violation of Flood Damage Prevention, Section 10-1/2

    • 17 of the Rapides Parish Code of Ordinances, which is a violation of Flood Damage Prevention, which is intended to discourage or otherwise restrict land development or occupancy in flood prone areas and the Rapides Parish Police Jury, therefore, requests that FEMA deny the availability of flood insurance coverage to this structure pursuant to the provisions of Section 1316 of the National Flood Insurance Act of 1968, as amended, subject to approval of Legal Counsel: 1038 Palmer Chapel Rd., Pineville, Rapides Parish, LA, Parcel ID #3-10-46005-19; Residence in “Zone A”. The enclosure below the main floor of the structure was either built or converted to livable space below the base flood elevation, with construction materials that are not flood resistant, and electrical, heating, plumbing, and air-conditioning equipment below the base flood elevation. The base flood elevation is 83.0 and the lowest floor elevation, per the elevation certificate is 77.8’ and although modifications were made to try to correct the compliance issues, the violations were not remedied. As part of this Motion, the Rapides Parish Police Jury further declares that with the issuance of a Chapter 1316 Declaration by FEMA, any further enforcement actions, with respect to these violations on this structure located at 1038 Palmer Chapel Road, Pineville, Rapides Parish, LA, shall be precluded. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Joe Bishop, to acknowledge the election of Mr. Ernest Klock, representing employee elect, to the Rapides Parish Fire District No. 3 Civil Service Board, to fill an expiring term of Mr. John Cummings. Term will be for three (3) years, to expire October 10, 2020. On vote the motion carried.

On motion by Mr. Richard Billings, seconded by Mr. Joe Bishop, to add the following motions to the agenda, received after the Jury Meeting agenda was posted in compliance with the Public Meetings Law and are now confirmed as having been added to the agenda by unanimous vote:

On motion by Mr. Richard Billings, seconded by Mr. Scott Perry, to authorize the President to sign a letter of support for the Louisiana Department of Agriculture and Forestry, (LDAF), to apply for a grant, for constructing a new public fishing pier, cleaning station and appropriate boat dock area, at the Indian Creek Recreation Area, to also be ADA complaint, providing fishing access for hundreds of individuals with disabilities, as requested by the Louisiana Department of Agriculture and Forestry and the Park Manager at the Indian Creek Recreation Area. On vote the motion carried.

On motion by Mr. Richard Billings, seconded by Mr. Ollie Overton, there being no further business, the meeting was adjourned at 3:30 pm.
