- Motion to approve the revocation of a portion of Flaggon St, in Libuse Townsite, Louisiana Investment and Securities Subdivision, Section 49, T4N-R1E, Rapides Parish, approximately 250’ in length and 84’ in width, subject to and in favor of any existing or future utility servitudes, as recommended by the Rapides Area Planning Commission and the Public Works Director. - Motion to approve the revocation of the alleyway between lots 3,4,5,6, and lots 7, 8, 9, 10, in Libuse Townsite, Louisiana Investment and Securities Subdivision, Section 49, T4N-R1E, Rapides Parish, approximately 200’ in length and 20’ in width, subject to and in favor of any existing or future utility servitudes, as recommended by the Rapides Area Planning Commission and the Public Works Director. - Motion to ratify approval of Amendment No.1 to both WIOA PY15/FY16 and PY16/FY17 contracts to remove contractual obligations and certifications that do not apply to local grant recipients, to update discrimination clause language, and to correct an error in the explanation of paying for infrastructure cost when the State’s infrastructure funding mechanism applies and to authorize the President to sign both contract amendments. - Motion to authorize the Rapides Workforce Development Board, to issue a Request for Proposal (RFP), for the One-Stop Operator, as required by WIOA, upon completion of the RFP, authorize the President to sign a contract with the selected Contractor for the One-Stop Operator beginning July 1, 2017 and ending on June 30, 2018, with option to renew for three
- (3) years, and have Treasurer to amend the budget accordingly. The contract will be funded through the WIOA grant funds.
In order to comply with the Workforce Innovation and Opportunity Act (WIOA) Sec. 121(d)(2)(A) which states “an entity shall be designated or certified as a one-stop operator through a competitive process;” and further defined in the Final Regulations at §678.605 on pages 55892 – 55896 of the Federal Register effective October 18, 2016, the Rapides Workforce Development Board is to follow local / state procurement policies, and/or Uniform Guidance at 2 CFR 200.318 – 200.326 to procure a One-Stop Operator for the Rapides One-Stop Center. The selected Contractor must be in place no later than July 1, 2017. (WORKFORCE 12/5)
- Motion to accept the Construction Contract with Cecil D. Gassiott, LLC, Rapides Parish Gustav/Ike CDBG Location No. 1-City of Pineville, Wastewater Treatment Plant Outfall/New Treated Effluent Pump Station and Primary Outfall, Project No. 40PARA3304, as substantially complete as recommended by the Project Engineer, Pan American Engineers and authorize the President to sign all necessary documents. (GRANTS 12/5)
- Motion to adopt the following resolution as requested by Pan American Engineers, LLC, Project Engineers:
WHEREAS, the Drawing and Specifications for the Rapides Parish Gustav/Ike CDBG Disaster Recovery Program, Rapides Parish Police Jury for the Red River, Atchafalaya and Bayou Boeuf Levee District, Location 9B – Spanish Bayou – Drainage Pump Station Rehabilitation, have been completed and submittals to applicable reviewing agencies are being made. The Engineer reports that the project is now ready for advertisement of bids; pending final approval of applicable reviewing agencies.
NOW THEREFORE BE IT RESOLVED, that the President is hereby authorized to advertise for bids and sign any necessary documents for the project; pending final approval of applicable reviewing agencies. (GRANTS 12/5)

- Motion to adopt a resolution thanking the Greater Alexandria Economic Development Association (GAEDA) for their donation/contribution to the Rapides Parish Police Jury for the Coliseum. (GRANTS 12/5)
- Motion to ratify authorization for the Rapides Senior Citizens Center to hold a Public Hearing for a grant to operate and assist to provide Rural Public Transportation of a non-emergency, ambulatory nature for the FY 2017-2018 program year and authorize the President to sign any necessary documents. - Motion to authorize the Rapides Parish Police Jury to pursue flood mitigation measures for either infrastructure improvements or individual mitigation measures as eligible using Hazard Mitigation Grant Program funds to be allocated by GOHSEP and FEMA. (GRANTS 12/5)

The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, on Monday, December 12, 2016, at three (3:00) o'clock p.m. (Central Standard Time).
There were present: Craig Smith, Scott Perry, Jr., Davron Bubba” Moreau, Joe Bishop, Theodore Fountaine, Jr., Richard Vanderlick, Oliver “Ollie” Overton Jr., Sean McGlothlin and Richard Billings,
Also present were Mr. Bruce Kelly, Treasurer; Dennis Woodward, Public Works Director; Sonya Wiley-Gremillion, OHSEP Director; Shane Trapp, Courthouse Building Superintendent; Donna Andries, Sales & Use Tax Administrator; Linda Sanders, Civil Service Director; Phillip Terrell, District Attorney; Thomas O. Wells, Legal Counsel and Ms. Laurel Smith, Secretary.
The invocation was given by Mr. Scott Perry.
The Pledge of Allegiance was led by Mr. Richard Vanderlick.
The Police Jury of the Parish of Rapides , State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.
The President asked if there was any Public Comment on any Agenda Item, to which there was no response.
On motion by Mr. Richard Vanderlick, seconded by Mr. Scott Perry, to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on November 14, 2016 as published in the Official Journal. On vote the motion carried.
On motion by Ollie Overton, seconded by Mr. Richard Vanderlick, that approved bills be paid. On vote the motion carried.

The next item on the agenda was to adopt an “In Memoriam” for the late Mr. Charlie Stewart, former Police Juror, of the Rapides Parish Police Jury, as presented at the December 5, 2016 Committee Meeting.
IN MEMORIAM
WHEREAS, Mr. Charles “Charlie” W. Stewart was called by his Creator on Monday, October 3, 2016; and
WHEREAS, Mr. Stewart was born in Houston, Texas and lived most of his life in Central Louisiana; and

WHEREAS, Mr. Stewart attended New Hope Baptist Church and was a Mason and a member of the Forest Hill Masonic Lodge No. 254; and
WHEREAS, Mr. Stewart is survived by his loving wife, Linda Dyess Stewart; sons, Kerry Stewart, Kevin Stewart, Michael Stewart and Chad Robinson; and
WHEREAS, Mr. Stewart served two (2) terms in the U.S. Army, serving in the 101st Airborne and Infantry and he was a member of the U.S. Army Boxing Team; and
WHEREAS, Mr. Stewart served on the Rapides Parish Police Jury, District A from June 5, 1972 to December 10, 1974; and
WHEREAS, Mr. Stewart was a former member of the Home Builder’s Association, the CENLA Community Action Committee (CCAC), Legislative Aide in the Louisiana State Senate, and a Commissioner of the England Airp ort Authority and Rapides Parish Sewer Board; and
WHEREAS, the Rapides Paris h Police Jury does hereby recognize Mr. Charles “Charlie” W. Stewart for his dedication and hard work in serving the citizens of Rapides Parish; and
NOW, THEREFORE, BE IT RESOL VED that the Rapides Parish Police Jury does hereby order that this formal expression of honor for the late Charles “Charlie” W. Stewart, and sympathy for his family be spread upon the minutes of this meeting

The acquiring person shall submit the required notifications (R.S. 47:2206 A and B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. *Copies of the “green and white receipts” should be maintained by the purchaser as indicia of compliance with the notice requirements;
Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or otherwise challenge in a court of competent jurisdiction the potential sale or donation:

Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:
- (a) Sixty days, for property on which a tax sale certificate (formerly “proces verbal”) was filed over five years previous of the first publication, or six month if the tax sale certificate (formerly “proces verbal”) was filed less than five years before the first publication of the notice provided for in this Subsection.
- (b) The filing of the sale or donation transferring the property.
- (c) The publication required by this Section shall be that which is included in R.S. 47:2206 B. (2).
Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.
Section 7. At any time after the expiration of the sixty-day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney’s office has certified in writing to the President, that purchaser or donee has complied with the mandates of this Ordinance. The sale price shall be paid by cashier’s check or money order at the time of the sale.
NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.

of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.
Section 8. The acquiring person shall be responsible for filing the sale or donation and payment of all filing fees.
Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.
- (a) All sales and donations shall be without warranty, either expressed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against redhibitory defects or vices and the warranty that the thing sole is reasonable fit for its ordinary purpose or the acquiring person’s intended or particular purpose.
- (b) These waivers or exclusions of warranties shall be self-operative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardless of whether they are brought to the attention of the acquiring person. This provision supersedes the requirements of any other law.
- (c) The writing constituting the sale shall be in the form as provided in R.S. 47:2207 B. and the writing constituting the donation shall be that which is included in R.S. 47:2207 C.
Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.
Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.
Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.
- (a) The affidavit may also contain a statement of the interest to which the purchaser or donee takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debtor, as mortgagors.
- (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47:2208.
- (c) With respect to a sale, the filing of the affidavit provided herein shall operate REGULAR MEETING DECEMBER 12, 2016
as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
- (d) With respect to a donation, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
- (e) Upon filing of the affidavit, the recorder of mortgages or the recorder of conveyances shall treat as canceled, terminated, released, or erased, all those liens, privileges, mortgages or other encumbrances canceled, terminated, released or erased under subsections (c) or (d) of this Section, only insofar as they affect the property.
- (f) The owner filing the affidavit shall be liable to and indemnify the recorder of mortgages, the recorder of conveyances, and any other person relying on the cancellation, termination, release, or erasure by affidavit for any dames that they may suffer as a consequence of such reliance if the recorded affidavit contains materially false or incorrect statements that cause the recorder to incorrectly cancel, terminate, release, or erase any interest listed in the affidavit. The recorder of mortgages and the recorder of conveyances shall not be liable for any damages resulting to any person or entity as a consequence of the cancellation, termination, release or erasure of any interest in compliance with this Section.

Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.
Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.
- (a) The affidavit may also contain a statement of the interest to which the purchaser or donee takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debtor, as mortgagors.
- (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47:2208.
- (c) With respect to a sale, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.

Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.
Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.
Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.

On motion by Mr. Joe Bishop, seconded by Mr. Richard Vanderlick, to authorize the Rapides Workforce Development Board, to issue a Request for Proposal (RFP), for the One-Stop Operator, as required by WIOA, upon completion of the RFP, authorize the President to sign a contract with the selected Contractor for the One-Stop Operator beginning July 1, 2017 and ending on June 30, 2018, with option to renew for three (3) years, and have Treasurer to amend the budget accordingly. The contract will be funded through the WIOA grant funds.
In order to comply with the Workforce Innovation and Opportunity Act (WIOA) Sec. 121(d)(2)(A) which states “an entity shall be designated or certified as a onestop operator through a competitive process;” and further defined in the Final Regulations at §678.605 on pages 55892 – 55896 of the Federal Register effective October 18, 2016, the Rapides Workforce Development Board is to follow local / state procurement policies, and/or Uniform Guidance at 2 CFR 200.318 – 200.326 to procure a One-Stop Operator for the Rapides One-Stop Center. The selected Contractor must be in place no later than July 1, 2017. On vote the motion carried.

WHEREAS, Cecil D. Gassiott, LLC, the Contractor for the project entitled Rapides Parish Gustav/Ike CDBG Location No. 1-City of Pineville, Louisiana, wastewater treatment plant outfall, new treated effluent pump station and primary outfall, has “Substantially Completed” the work under the Contract as recommended by the Engineer;
NOW THEREFORE BE IT RESOLVED, that the Contract of Cecil D. Gassiott, LLC, the Contractor, for said work, is hereby accepted as “Substantially Complete” with the understanding that the final payment will be made upon satisfactory completion of any Punch List items and presentation of the Clear Lien Certificate as required by law; and,
It is HEREBY FURTHER RESOLVED that the signed and filing with the Clerk of Court of this Resolution of Contract Acceptance by the President is hereby authorized.

19-21.1 – CONCEALED AND OPEN CARRY WEAPONS
NOW, THEREFORE BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session, convened on this 12th day of December, 2016, that Section 1921 and Section 19-21.1 of the Rapides Parish Code of Ordinances, is hereby created as follows:
Chapter 19-21 – PUBLIC BUILDINGS DEFINED
- (a) For the purpose of this article, the term “public building” shall include, but not be limited to any building, structure or other construction thereon, owned, leased or possessed by the Rapides Parish Police Jury for a public purpose.
Chapter 19-21.1 – WEAPONS AND FIREARMS PROHIBITED; PENALTY
- (a) Possessing a firearm or dangerous weapon as defined by R.S. 14.2, by anyone not exempted in subsection (b) hereof, in a public building is unlawful.
- (b) The provisions of this Section shall not apply to a Federal Law Enforcement Officer or a Louisiana Commissioned State or Local Post Certified Enforcement Officer who is authorized to carry a firearm. The Rapides Parish Coliseum and Exhibition Hall is also exempt from this ordinance.
- (c) Whoever commits the crime of carrying a firearm or a dangerous weapon as defined in R.S. 14.2, in a public building shall be subject to prosecution as a misdemeanor punishable by a fine not to exceed five hundred dollars ($500.00) or incarceration of not more than sixty (60) days or both.
BE IT FURTHER ORDAINED that this ordinance is to be effective immediately.

An ordinance creating the Tioga Heritage Museum District of the Parish of Rapides, State of Louisiana, fixing the boundaries thereof, appointing one (1) commissioner therefor, designating the domicile and providing for the organization thereof and other matters in connection therewith.
WHEREAS, Section 4571, et seq. of Title 33 of the Louisiana Revised Statutes of 1950 (the “Act”) provides that the governing authority of any parish in the state is authorized and empowered, upon its own initiative, to form and create a special district or districts for the preservation and development of recreational facilities, historic sites or areas, tourist attractions and central business district areas; and
WHEREAS, any such special district created under the Act shall constitute a body corporate in law, with all the powers of a corporation, and with all the powers and rights of a political subdivision of the state as provided by the laws of the state relating to the incurring of debt and the issuing of bonds therefor; and
WHEREAS, this Police Jury, acting on its own initiative, desires to create a museum district in the manner provided by the Act; and
WHEREAS, the lands in the museum district herein created comprise less than the whole territory of the Parish of Rapides, State of Louisiana; and
NOW, THEREFORE, BE IT ORDAINED, by the Police Jury of the Parish of Rapides, State of Louisiana, acting as the governing authority of said Parish, that:
SECTION 1. Acting under the authority of Section 4571 of Title 33 of the Louisiana Revised Statutes of 1950 and other constitutional and statutory authority supplemental thereto, there is hereby created a museum district within the Parish of Rapides, State of Louisiana, for the purpose of preserving and developing historic sites or areas and tourist attractions within the district, and the boundaries of which shall be coextensive with the boundaries of Police Jury District A, as such boundaries are presently constituted.
SECTION 2. The said museum district hereby created shall be known and is hereby designated as "Tioga Heritage Museum District of the Parish of Rapides, State of Louisiana" (the “District”), and as thus created, shall constitute a body corporate in law and a political subdivision of the State of Louisiana, and as such, shall have all the rights, powers and privileges granted and conferred by the Constitution and Statutes of the State of Louisiana, including the authority to incur debt, to issue bonds and to levy taxes.
SECTION 3. In accordance with the provisions of Section 4572 of Title 33 of the Louisiana Revised Statutes of 1950 (La. R.S. 33:4572), the following one (1) individual is hereby appointed by the Police Jury to serve as a Commissioner of the first Board of Commissioners (the “Board”) of the District: NAME ADDRESS TERM OF APPOINTMENT TBD By Lot REGULAR MEETING DECEMBER 12, 2016
The above appointed Commissioner is a qualified voter and resident of the District. The remaining four (4) members of the Board shall be appointed as prescribed by La. R.S. 33:4572.
SECTION 4. Each member of the Board shall receive a per diem in the amount of $___ (up to $50)] for each meeting they attend, but shall not be paid for more than twelve meetings in a year. Such per diems shall be paid out of the funds of the District. Notwithstanding the foregoing, in no event shall the members of the Board receive more than the maximum per diem then prescribed by law.
SECTION 5. The domicile of the District is hereby designated as _________.
SECTION 6. The Police Jury hereby requests that the Town of Ball appoint one (1) member of the Board and the legislative delegation representing the representative and senatorial districts of the District appoint three (3) members of the Board, all in accordance with the Act.
SECTION 7. This ordinance shall be in full force and effect immediately upon its adoption.
SECTION 8. Any and all ordinances and resolutions or provisions thereof, in conflict herewith are hereby repealed to the extent of such conflict.

The next item on the agenda was to discuss the 9th Judicial District Court, Courthouse and Rapides Parish Detention Center report that was performed by Barron, Heinberg & Brocato in 2009 and also recognize Mr. Joey Bollinger with the Chamber of Commerce Public Safety Committee.
Mr. Joey Bollinger was not present.
Mr. Sean McGlothlin stated the Chamber of Commerce appointed him to the Public Safety Committee. Judge Yeager has a copy of the study and he also furnished a copy to the Chamber. He further stated that in 2017, it will be discussed at the Chamber of Commerce on how crime is affecting them and the level of business that is coming into Rapides Parish.
The President recognized Mr. Joe Brocato and Mr. Marion Cheney from Barron, Heinberg & Brocato, which had conducted the study the first time it was brought up in 2009.

Funding. The public is upset with the crime on the street. The Police Jury is responsible for a holding facility. We need to generate some funds for Rapides Parish to build a new facility to house the criminals that are committing the crimes. It comes to a point that if someone is arrested for murder and you have inmates that are housed for shoplifting or something, you have to bond them out to make room for the stronger crimes committed in our Parish. It is a problem. Maybe the District Attorney’s Office, the Sheriff’s Office and the Police Jury could come together next year to look for some type of funding to increase the capacity of our jail.
Mr. Sean McGlothlin stated the Chamber of Commerce would like to be a participant in the discussion, because it does affect new and existing businesses.
Mr. Bishop stated we want to work with every civic organization. Everybody is going to have to step up to the plate. Municipalities are warehousing their prisoners here. We are going to have to work together.
Mr. Phillip Terrell, District Attorney, stated Sheriff Hilton, Mr. Bishop, Mr. Smith and himself had a discussion of various options and combinations of different things we could do to get funds for the jail space. Certainly it is an issue when somebody has been arrested thirty-five times and they get out because there is not enough jail space. Mr. Terrell stated his office was available for any discussions to help with this problem.
Mr. Richard Billings stated the Police Jury could build the building, but the Sheriff is going to have to step up to the plate, cause that is going to take a lot of funds just to man the building. Everybody has to be involved in this so called scenario.

On motion by Mr. Bubba Moreau, seconded by Mr. Richard Billings, to accept the Right-of-way dedication from the Rapides Parish School Board for the Laura Lane Extension Project (District A). On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Billings, the following resolution was presented and unanimously adopted:

Resolution authorizing the filing of an application with the Louisiana Department of Transportation and Development for a grant under 49 CFR 5311, NonUrbanized Area Formula Program and/or 49 CFR 5309, Discretionary Capital Program.
WHEREAS, the Secretary of Transportation and Development is authorized to make grants for mass transportation projects;
WHEREAS, the contract for financial assistance will impose certain obligations upon the applicant, including the provisions by it of the local share of project costs;

NOW, THEREFORE, BE IT RESOLVED by Rapides Parish Police Jury:
- That the President Craig Smith is authorized to execute and file an application on behalf of Rapides Parish Police Jury with the Louisiana Department of Transportation and Development, to aid in the financing of operating and/or capital assistance projects pursuant to the Rural Public Transit Program, 49 CFR 5311 and/or the Discretionary Capital Program, 49 CFR 5309.
- That the President Craig Smith is authorized to execute and file with such applications an assurance or any other document required by the Louisiana Department of Transportation and Development effectuating the purposes of Title VI of the Civil Rights Act of 1964, as amended.
- That the President Craig Smith is authorized to furnish such additional information as the Louisiana Department of Transportation and Development may require in connection with the application or the project.
- That the President Craig Smith is authorized to set and execute affirmative minority business policies in connection with the project's procurement needs.
- That the President Craig Smith is authorized to execute grant contract agreements on behalf of Rapides Parish Police Jury with the Louisiana Department of Transportation and Development for aid in the financing of the operating or capital assistance projects.
- This resolution is applicable for a period of one year unless revoked by the governing body and copy of such revocation shall be furnished to the DOTD.

Resolution authorizing the Rapides Senior Citizens’ Centers, Inc. (RSCC) to be the designated contractor to operate for Rural Transportation. To also prepare grant application with the Louisiana Department of Transportation and Development for a grant under 49 CFR 5311, Non-Urbanized Area Formula Program and/or 49 CFR 5309, Discretionary Capital Program and provide complete information on all actions involving this grant to the Rapides Parish Police Jury.
WHEREAS, the contract for financial assistance will impose certain obligations upon Rapides Senior Citizens’ Center, Inc. as the Contractor and Administration Contractor, including the provisions by it of the local share of project costs; which Rapides Senior Citizens’ Centers, Inc. agrees to assume full responsibility for all operating costs utilizing Rapides Parish Senior Tax funds for this grant.

Mr. Theodore Fountaine questioned if the two motions needed to be swapped due to the conflict of interest between the two entities, to which Ms. Laurel Smith, Secretary stated that Alliance Design was awarded Architect. When they opened the bids Friday, Alliance Design had to back out due to his brother, Tudor Construction being the lowest bidder on the project, so they withdrew from this point forward.
On motion by Mr. Joe Bishop, seconded by Mr. Richard Billings, to award the Construction Contract for the new Libuse Branch Library, to the lowest responsible bidder, Tudor, Inc., as recommended by the Architect, Alliance Design, LLC, in the amount of $1,019,900.00, and authorize the President to sign any necessary documents. On vote the motion carried.
On motion by Mr. Joe Bishop, seconded by Mr. Richard Vanderlick, to accept the request of Alliance Design, LLC, to withdraw their Professional Services Agreement, from this point forward, for the architectural work associated with the new Libuse Branch Library, due to the conflict of interest in awarding of the Construction Contract to Tudor, Inc.
Mr. Tom Wells, Legal Counsel stated he had a conversation with Mr. Craig Smith and a Representative from Alliance Design and suggested they write for an advisory opinion from the Ethics Commission.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Billings, there being no further business, the meeting was adjourned at 3:55.
