Motion to enter into a Cooperative Endeavor Agreement with the Rapides Senior Citizen Centers, Inc., to be the Administrator of a Rural Transportation Grant with the Louisiana Department of Transportation and Development and authorize the President to sign same. This grant is to provide transportation to Senior Citizens in the non-urbanized areas where existing services are either insufficient, unavailable or inappropriate or not able to drive. The Rapides Senior Citizens Centers, Inc. will be the provider of all services and is responsible to ensure all requirements are fulfilled. (Grants 12/7)

The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, December 14, 2015, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Richard Billings, President, Craig Smith, Vice President, and Police Jurors; Davron “Bubba” Moreau, Joe Bishop, Theodore Fountaine, Jr., Richard Vanderlick, Oliver “Ollie” Overton, Jr., Sean McGlothlin and Scott Perry, Jr.

Also present were Mr. Bruce Kelly, Treasurer; Mr. Dennis Woodward, Public Works Director; Ms. Sonya Wiley-Gremillion, OHSEP Director; Ms. Elaine Morace, WIA Operations Director; Mr. Shane Trapp, Courthouse Building Superintendent; Ms. Donna Andries, Sales & Use Tax Administrator; Ms. Linda Sanders, Civil Service Director; Mr. Thomas O. Wells, Legal Counsel and Ms. Laurel Smith, Secretary.

The invocation was given by Mr. Scott Perry.

The Pledge of Allegiance was led by Mr. Craig Smith.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Richard Billings, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any public comment on any agenda item, to which there was no response.

Mr. Richard Billings wished everyone in Rapides Parish a Very Merry Christmas and a Happy New Year.

On motion by Mr. Joe Bishop, seconded by Mr. Richard Vanderlick, to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on November 9, 2015, as published in the Official Journal. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton, that approved bills be paid. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, to accept the Treasurer’s Report. On vote the motion carried.

The next item on the agenda was to recognize the Alexandria/Pineville Area Convention and Visitors Bureau for a presentation.

Ms. Sherri Ellington, Executive Director, Ms. Kelly West, Mr. Sam Dangerfield and Ms. Tammy Carpenter gave a brief update on the responsibilities of the staff members, events and functions that are taken place in Rapides Parish.

On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, the following ordinance was presented and on vote unanimously adopted:

ORDINANCE

AN ORDINANCE ADOPTING THE OPERATING BUDGET AND

REVENUES AND EXPENDITURES FOR CERTAIN FUNDS FOR

THE FISCAL YEAR BEGINNING JANUARY 1, 2016, AND ENDING DECEMBER 31, 2016, IN ACCORDANCE WITH LA R.S. 39:1309-1310.

BE IT ORDAINED by the Police Jury of Rapides Parish, in regular session convened that:

SECTION 1. The following estimate of revenues for certain funds for the fiscal year beginning January 1, 2016, and ending December 31, 2016, be and the same is hereby adopted to serve as an Operating budget of Revenues for these funds for the Police Jury of Rapides Parish, during the same period.

SECTION 2. The attached estimates of expenditures for certain funds is hereby adopted to serve as a budget of expenditures for these funds for the Police Jury of Rapides Parish during the same period.

SECTION 3. The adoption of this operating budget of expenditures be and the same is hereby declared to operate as an appropriation of the amount therein set forth within the terms of the budget classification.

SECTION 4. Amounts are available for expenditure only to the extent included within the 2016 budget. REGULAR JURY MEETING December 14, 2015

SECTION 5. The Treasurer shall have the authority to make any changes and amendments to any agencies, departments, functions, characters and funds within the adopted budget as he deems necessary provided that the provisions of LA R.S. 39:1310 (A) are followed.

AUTHORIZING THE RAPIDES PARISH POLICE JURY TO SELL

FOR THE

CONSIDERATION OF $562.07 CASH

WHEREAS, the City of Alexandria and/or the City of Pineville and/or Parish of Rapides owns property described as

said property having been adjudicated to either of aforementioned Cities and/or the Parish for unpaid property taxes; and

WHEREAS, a request has been received from ANGELO D’ANGELO, III, to purchase said property for the consideration of $562.07 cash, at the time of sale, said consideration representing the total of the statutory impositions, governmental liens, and costs of sale or two-thirds (2/3) of the appraised value of the property; and,

WHEREAS, this Jury is of the opinion that it would be in the public interest to convey the above-mentioned property to ANGELO D’ANGELO, III, for the offered consideration.

NOW, THEREFORE, BE IT ORDAINED by the Rapides Parish Police Jury that:

Section 1. A certain piece, parcel, or tract of land together with all buildings and improvements located thereon, and all rights, ways and privileges thereunto appertaining, being, lying and situated in the Parish of Rapides, State of Louisiana, and being more particularly described as follows, to-wit:

Lot Seven (7) of Square Two (2) of Sunset Addition, as per plat thereof recorded in Conveyance Book Y, page 432, records of Rapides Parish, Louisiana.

Rapides Parish, Louisiana, should be re-entered into the stream of commerce thereby serving the public interest.

Section 2. The acquiring person shall certify, in writing, to the Purchasing Department that he/she or his/her agent has searched for all names and last known addresses of all owners, mortgages, and any other person(s) who may have a vested or contingent interest in the property, or who have filed a request for notice as indicated in those records and has so examined:

  • • the mortgage and conveyance records of Rapides Parish,
  • • the current telephone book,
  • • any other examination resources, including Internet search engines, if any, the records of the Louisiana Secretary of State and the Secretary of States set forth by the names of identified entities

Section 3. The acquiring person shall submit the required notifications (R.S. 47:2206 A and B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. *Copies of the “green and white receipts” should be maintained by the purchaser as indicia of compliance with the notice requirements;

Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or otherwise challenge in a court of competent jurisdiction the potential sale or donation:

  • (a) Sixty days from the date of the notice provided in this Subsection, if five years have elapsed from the filing of the tax sale certificate (formerly “proces verbal”), or six months after the date of the notice provided for in this Subsection, if five years have not elapsed since the filing of the tax sale certificate (formerly “proces verbal”);

  • (c) The written notice required by this Section shall be that which is included in R.S. 47:2206 A. (2).

Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:

  • (a) Sixty days, for property on which a tax sale certificate (formerly “proces verbal”) was filed over five years previous of the first publication, or six month if the tax sale certificate (formerly “proces verbal”) was filed less than five years before the first publication of the notice provided for in this Subsection.
  • (b) The filing of the sale or donation transferring the property.
  • (c) The publication required by this Section shall be that which is included in R.S. 47:2206 B. (2).

Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.

Section 7. At any time after the expiration of the sixty-day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney’s office has certified in writing to the President, that purchaser or donee has complied with the mandates of this Ordinance. The sale price shall be paid by cashier’s check or money order at the time of the sale.

NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.

NOTE: The City of Alexandria and/or the City of Pineville and/or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.

Section 8. The acquiring person shall be responsible for filing the sale or donation and payment of all filing fees.

Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.

  • (a) All sales and donations shall be without warranty, either expressed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against redhibitory defects or vices and the warranty that the thing sole is reasonable fit for its ordinary purpose or the acquiring person’s intended or particular purpose.
  • (b) These waivers or exclusions of warranties shall be self-operative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardless of whether they are brought to the attention of the acquiring person. This provision supersedes the requirements of any other law.
  • (c) The writing constituting the sale shall be in the form as provided in R.S. 47:2207 B. and the writing constituting the donation shall be that which is included in R.S. 47:2207 C.

Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.

Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.

Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.

  • (a) The affidavit may also contain a statement of the interest to which the purchaser or donee takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debtor, as mortgagors.
  • (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47:2208.
  • (c) With respect to a sale, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.

  • (d) With respect to a donation, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
  • (e) Upon filing of the affidavit, the recorder of mortgages or the recorder of conveyances shall treat as canceled, terminated, released, or erased, all those liens, privileges, mortgages or other encumbrances canceled, terminated, released or erased under subsections (c) or (d) of this Section, only insofar as they affect the property.
  • (f) The owner filing the affidavit shall be liable to and indemnify the recorder of mortgages, the recorder of conveyances, and any other person relying on the cancellation, termination, release, or erasure by affidavit for any dames that they may suffer as a consequence of such reliance if the recorded affidavit contains materially false or incorrect statements that cause the recorder to incorrectly cancel, terminate, release, or erase any interest listed in the affidavit. The recorder of mortgages and the recorder of conveyances shall not be liable for any damages resulting to any person or entity as a consequence of the cancellation, termination, release or erasure of any interest in compliance with this Section.

WHEREAS, a request has been received from JANICE AND BOOKER T. JOHNSON, JR., to purchase said property for the consideration of $2,666.67 cash, at the time of sale, said consideration representing the total of the statutory impositions, governmental liens, and costs of sale or two-thirds (2/3) of the appraised value of the property; and,

WHEREAS, this Jury is of the opinion that it would be in the public interest to convey the above-mentioned property to JANICE AND BOOKER T. JOHNSON, JR., for the offered consideration.

NOW, THEREFORE, BE IT ORDAINED by the Rapides Parish Police Jury that:

Section 1. Lot Nine (9) of Square Three (3) of HOMEWOOD PLACE Section “C” as per plat thereof recorded in Plat Book 7, Page 148, of the records of Rapides Parish, Louisiana; subject to restrictions, rights-of-way and outstanding mineral rights of record affecting the property.

Rapides Parish, Louisiana, should be re-entered into the stream of commerce thereby serving the public interest.

Section 2. The acquiring person shall certify, in writing, to the Purchasing Department that he/she or his/her agent has searched for all names and last known addresses of all owners, mortgages, and any other person(s) who may have a vested or contingent interest in the property, or who have filed a request for notice as indicated in those records and has so examined:

  • • the mortgage and conveyance records of Rapides Parish,
  • • the current telephone book,
  • • any other examination resources, including Internet search engines, if any, the records of the Louisiana Secretary of State and the Secretary of States set forth by the names of identified entities

Section 3. The acquiring person shall submit the required notifications (R.S. 47:2206 A and B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. *Copies of the “green and white receipts” should be maintained by the purchaser as indicia of compliance with the notice requirements;

Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or otherwise challenge in a court of competent jurisdiction the potential sale or donation:

  • (a) Sixty days from the date of the notice provided in this Subsection, if five years have elapsed from the filing of the tax sale certificate (formerly “proces verbal”), or six months after the date of the notice provided for in this Subsection, REGULAR JURY MEETING December 14, 2015

if five years have not elapsed since the filing of the tax sale certificate (formerly “proces verbal”);

  • (b) The filing of the sale or donation transferring the property.
  • (c) The written notice required by this Section shall be that which is included in R.S. 47:2206 A. (2).

Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:

  • (a) Sixty days, for property on which a tax sale certificate (formerly “proces verbal”) was filed over five years previous of the first publication, or six month if the tax sale certificate (formerly “proces verbal”) was filed less than five years before the first publication of the notice provided for in this Subsection.
  • (b) The filing of the sale or donation transferring the property.
  • (c) The publication required by this Section shall be that which is included in R.S. 47:2206 B. (2).

Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.

Section 7. At any time after the expiration of the sixty-day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney’s office has certified in writing to the President, that purchaser or donee has complied with the mandates of this Ordinance. The sale price shall be paid by cashier’s check or money order at the time of the sale.

NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.

NOTE: The City of Alexandria and/or the City of Pineville and/or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.

On motion by Mr. Joe Bishop, seconded by Mr. Bubba Moreau, to enter into a contract with Charlie Carlisle, L.L.C. to remove and dispose of the remaining concrete slab, footings and debris from the Pole Barn behind the Coliseum for the amount of $31,000.00 and authorize the President to sign all necessary documents. On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith, to authorize the expenses of the Public Works Director and any interested Jurors to attend the National Association of County Engineers Conference to be held on April 23-28, 2016 in Tacoma, WA. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith, to waive the insurance requirements for a Sewage Effluent Discharge Permit at 175 Washboard Rd., Pineville, LA and approval to discharge sewage effluent to the road side ditch in the public right-of-way for Kastle Properties, LLC, as approved by the Public Works Director and Health Department. On vote the motion carried.

On motion by Mr. Craig Smith, seconded by Mr. Richard Vanderlick, to authorize Mr. Clifford Cole, 10936 Highway 28 West, Boyce, LA 71409, as a Hardship Case. (Proper certification received 11/23). On vote the motion carried.

On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, to accept the Construction Contract with Turner & Turner Contracting, LLC (Contractor) for Bid No. 2365 – Timberlake Subdivision Street Repair as substantially complete, as recommended by the Engineer and authorize the President to sign same. On motion by Mr. Richard Vanderlick, seconded by Mr. Craig Smith, to authorize Ms. Cathy Pearson, 315 McNary Cutoff Road, Glenmora, LA 71433, as a Hardship Case. (Proper certification received 11/10). On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Bubba Moreau, to ratify approval of a contract between the Rapides Parish Police Jury and the Louisiana Workforce Commission for the LAJET Program in the amount of $239,685.00 for the fiscal year October 1, 2015 through September 30, 2016, and authorize the President to sign the contract and the Treasurer to amend the budget as necessary. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to enter into a Cooperative Endeavor Agreement with the Rapides Senior Citizen Centers, Inc., to be the Administrator of a Rural Transportation Grant with the Louisiana Department of Transportation and Development and authorize the President to sign same. This grant is to provide transportation to Senior Citizens in the non-urbanized areas where existing services are either insufficient, unavailable or inappropriate or not able to drive. be the provider of all services and is responsible to ensure all requirements are fulfilled. The following resolution was unanimously adopted:

RESOLUTION AUTHORIZING

Rapides Senior Citizens’ Centers, Inc. the official Rural Transportation Contractor for Rapides Parish.

Resolution authorizing the Rapides Senior Citizens’ Centers, Inc. (RSCC) to be the designated contractor to operate the Rural Transportation grant. To also prepare grant application with the Louisiana Department of Transportation and Development for a grant under 49 CFR 5311, Non-Urbanized Area Formula Program and/or 49 CFR 5309, Discretionary Capital Program and provide complete information on all actions involving this grant to the Rapides Parish Police Jury.

WHEREAS, the contract for financial assistance will impose certain obligations upon Rapides Senior Citizens’ Center, Inc. as the Contractor and administration contractor, including the provisions by it of the local share of project costs; which Rapides Senior Citizens’ Centers, Inc. agrees to assume full responsibility for all operating costs utilizing Rapides Parish Senior Tax funds for this grant.

WHEREAS, it is required by the Louisiana Department of Transportation and Development in accord with the provisions of Title VI of the Civil Rights Act of 1964, that in connection with the filing of an application for assistance that it will comply with Title VI of the Civil Rights Act of 1964 and the U.S. Department of Transportation requirements thereunder; and

WHEREAS, it is the goal of the Applicant that minority business enterprise be utilized to the fullest extent possible in connection with this project, and that definitive procedures shall be established and administered to ensure that minority businesses shall have the maximum feasible opportunity to compete for contracts when procuring construction contracts, supplies, equipment, or consultant and other services:

NOW, THEREFORE, BE IT RESOLVED by Rapides Parish Police Jury, applicant, hereby designates the Rapides Senior Citizens’ Centers as the contractor to prepare the grant; ensure that RSCC has the adequate matching funds for capital funding (van purchases); operational funding and the management funding of the grant

  1. That the Rapides Senior Citizens’ Center, Inc. is authorized to execute and sign a contract the Rapides Parish Police Jury to administer the grant with the Louisiana Department of Transportation and Development, to aid in the financing of operating and/or capital assistance projects pursuant to the Rural Public Transit Program, 49 CFR 5311 and/or the Discretionary Capital Program, 49 CFR 5309.
  2. That the Rapides Senior Citizens’ Centers, Inc. is authorized to furnish such additional information as the Louisiana Department of Transportation and Development may require in connection with the application or the project and prepare such information for review by the Rapides Parish Police Jury. On motion by Mr. Ollie Overton, seconded by Mr. Bubba Moreau, to hire the firm of Meyer, Meyer, LaCroix & Hixson as the Project Engineer for the development of the Rapides Parish Resiliency Plan as recommended by the Comprehensive Resiliency Plan Engineering Selection Committee. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Craig Smith, for the President to sign and submit a request to extend the period of performance for the CDBG-DR grant provided by the Office of Community Development that is for the development of the Rapides Parish Comprehensive Resiliency Plan as recommended by the Rapides Area Planning Commission. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Ollie Overton, that the Rapides Parish Police Jury goes on record that conditioned upon the approval of the necessary parties, the Police Jury is willing to utilize up to $566,600.00 of Gustav/Ike CDBG-DRU funds for the replacement of the two pumps and ancillary improvements at the Spanish Bayou Pump Station, Project No. 40PARA3305. On vote the motion carried.

On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, to authorize to renew the lease for the Boyce Library with Mr. Clarence Dabney, Jr. for a ten (10) year period, January 1, 2016 to December 31, 2025, at the rate of $750 for the first year, and with a 1.5% increase annually afterwards, to be paid out of Library funds, as recommended by the Library Board of Control, and authorize the President to sign same. On vote the motion carried.

On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith, to approve Change Order No. 1 for the Robertson Library Addition, ADG Job No. 14022, for an increase amount of $7,085.00, as recommended by Alliance Design Group Project Architect. On vote the motion carried.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of the Parish of Rapides, State of Louisiana, that:

This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Parish of Rapides, State of Louisiana, on SATURDAY, NOVEMBER 21, 2015, to authorize the continuation of a special tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.

SECTION 2. Procès Verbal. A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

Shall the Parish of Rapides, State of Louisiana, continue to levy and collect a special ad valorem tax of one and six-hundredths (1.06) mills on each dollar of assessed valuation on all the property subject to taxation in said Parish (an estimated $170,000 reasonably expected at the time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2017 and ending with the year 2026, for the purpose of providing funds to match Federal and State funds allocated to Rapides Parish for services to the elderly, including the establishment and maintenance of centers for senior citizens, a work of public improvement for the parish, said millage to represent a three hundredths of a mill (.03) increase over the 1.03 mills tax authorized to be levied through the year 2016 pursuant to an election held on July 16, 2005?

RESOLUTION

A resolution providing for canvassing the returns and declaring the result of the special election held in Road District No. 3-A Maintenance of the Parish of Rapides, State of Louisiana, on November 21, 2015, to authorize the continuation of a special tax therein.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Road District No. 3-A Maintenance of the Parish of Rapides, State of Louisiana, that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in Road District No. 3-A Maintenance of the Parish of Rapides, State of Louisiana, on NOVEMBER 21, 2015, to authorize the continuation of a special tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.

SECTION 2. Procès Verbal. A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Clerk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

SECTION 3. Promulgation of Election Result. The result of said election shall be promulgated by publication in the manner provided by law.

This resolution having been submitted to a vote, the vote thereon was as follows:

Shall Road District No. 3-A Maintenance of the Parish of Rapides, State of Louisiana (the “District”), continue to levy and collect a tax of thirty-two (32.00) mills on all the property subject to taxation in the District (an estimated $1,120,000 reasonably expected at the time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2017 and ending with the year 2026, for the purpose of constructing, maintaining, and keeping in repair the public roads, highways, and bridges within said District, said millage to represent a three and eighty-one hundredths (3.81) mill increase over the 28.91 mills tax authorized to be levied through the year 2016 pursuant to an election held on July 16, 2005?

The polling places above specified being the only polling places designated at which to hold the said election, it was therefore shown that there was a total of 323 votes cast IN FAVOR OF the Proposition and a total of 217 votes cast AGAINST the Proposition, as hereinabove set forth, and that there was a majority of 106 votes cast IN FAVOR OF the Proposition as hereinabove set forth.

Therefore, the Governing Authority did declare and proclaim and does hereby declare and proclaim in open and public session that the Proposition as hereinabove set forth was duly CARRIED by a majority of the votes cast by the qualified electors voting at the said special election held in the District on November 21, 2015.

Exhibit "A" attached hereto and made a part of this Procès Verbal is a copy of the Notice of Special Election and proof of publication thereof.

Shall Road District No. 3-A Maintenance of the Parish of Rapides, State of Louisiana (the “District”), continue to levy and collect a tax of thirty-two (32.00) mills on all the property subject to taxation in the District (an estimated $1,120,000 reasonably expected at the time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2017 and ending with the year 2026, for the purpose of constructing, maintaining, and keeping in repair the public roads, highways, and bridges within said District, said millage to represent a three and eighty-one hundredths (3.81) mill increase over the 28.91 mills tax authorized to be levied through the year 2016 pursuant to an election held on July 16, 2005?

The said special election will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said election, as provided in this Notice of Special Election, or such substitutes therefor as may be selected and designated in accordance with La. PROCLAMATION

On motion by Mr. Theodore Fountaine, seconded by Mr. Ollie Overton, to have the Department Heads and Director of each Department to give a written report to the Rapides Parish Police Jurors on a quarterly basis. (Beginning 2016/March, June, September and December) On vote the motion carried. Mr. Joe Bishop voted nay.

On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, to waive the thirty day announcement rule and reappoint Mr. Chesten Felsher for a two (2) year term on the Fire Protection District No. 12 Board. Term will expire December 31, 2017. On vote the motion carried.

REGULAR JURY MEETING

On motion by Mr. Joe Bishop, seconded by Mr. Bubba Moreau, to create a Daily Supervisor position, with proper job description and salary, effective January 1, 2016, for Fire Protection District No. 4 and to amend the Organizational Chart, as recommended by the Holiday Village Volunteer Fire Department Board of Directors, to be paid out of Fire District No. 4 Funds. On vote the motion carried.

On motion by Mr. Scott Perry, seconded by Mr. Ollie Overton, to waive the thirty day announcement rule and reappoint Mr. Grady Blackwell to the Coliseum Authority for a five (5) year term representing District I. Term expire July 16, 2020. On vote the motion carried.

On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, to waive the thirty day announcement rule and reappoint Mr. Jimbo Thiels to the Coliseum Authority for a five (5) year term representing District E. Term will expire December 13, 2020. On vote the motion carried.

On motion by Mr. Joe Bishop, seconded by Mr. Craig Smith, to receive the required report from Acadian Ambulance under the Contract for October, 2015:

On motion by Mr. Joe Bishop, seconded by Mr. Craig Smith, to authorize the President and Legal Counsel to settle the lawsuit of Rapides Parish Police Jury vs. BobCat Logging, Inc. and Mark Chenevert, Civil Suit No. 254,436 and to sign all necessary documents and to dismiss the suit with prejudice, with defendants paying the sum of $3,970.00 to the Rapides Parish Police Jury, Road District 1A. On vote the motion carried.

On moti on by Mr. Bubba Moreau , seconded by Mr. Craig Smith, the following resolution was presented, as requested by the North Criminalistics Laboratory and recommended by the Treasurer, and on vote unanimously adopted:

BE IT RESOLVED by this Polic e Jury in Regular Session duly convened and assembled, a quorum being present, that it does hereby approve the original 2016 budget and the amended budget for the calendar year 201 5, duly adopted by the North Louisiana Criminalistics Laboratory Commission, the same having been furnished to this Police Jury by said Commission and being on file in the office of the Secretary hereof. A resolution approving the holding of an election in Fire Protection District No. 12 of the Parish of Rapides, State of Louisiana, on Saturday, April 9, 2016, to authorize the levy of a special tax therein.

WHEREAS, the Board of Commissioners of Fire Protection District No. 12 of the Parish of Rapides, State of Louisiana, acting as the governing authority of Fire Protection District No. 12 of the Parish of Rapides, State of Louisiana (the REGULAR JURY MEETING December 14, 2015

"District"), adopted a resolution on December 7, 2015, calling a special election in the District on Saturday, April 9, 2016, to authorize the levy of a special tax therein; and

WHEREAS, the governing authority of the District has requested that this Police Jury, acting as the governing authority of the Parish of Rapides, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and

WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Police Jury to approve the holding of said election and in the event that the election carries, to levy and collect the special tax provided for therein;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana, acting as the governing authority of said Parish, that:

SECTION 1. In compliance with the provisions of Article VI, Section 15 of the constitution of the State of Louisiana of 1974, and in accordance with the request of the Board of Commissioners of Fire Protection District No. 12 of the Parish of Rapides, State of Louisiana, this Police Jury hereby approves the holding of an election in the District, on Saturday, April 9, 2016, at which election there will be submitted the following proposition, to-wit:

Shall Fire Protection District No. 12 of the Parish of Rapides, State of Louisiana (the "District"), levy an eleven and ninety-six hundredths (11.96) mills tax on all the property subject to taxation in the District for a period of ten (10) years, beginning with the year 2018 and ending with the year 2027 (an estimated $310,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), for the purpose of acquiring, constructing, improving, operating and maintaining fire protection facilities and equipment in and for the District, including paying the cost of obtaining water for fire protection purposes?

SECTION 2. In the event the election carries, this Police Jury does hereby further consent to and authorize the District to levy and collect the special tax provided for therein. This resolution having been submitted to a vote, the vote thereon was as follows:
