Motion to adopt the criteria for hiring a Project Manager for administrative services for the Masonic Drive Drainage Improvement Project (Project #1786-0790002) (CFDA #97.039). Phase 1 of this project was approved under the Hazard Mitigation Grant Program (HMGP) by GOHSEP and FEMA for the completion of engineering and surveying for a total of $216,406.00. The 25% match is being provided by the Gravity Drainage District #1 of Rapides Parish as follows. On vote the motion carried.

  11. Motion to authorize Change Order No. 1, with Don M. Barron Contractor, Inc. on the Gustav/Ike CDBG Project, Location 7-City of Pineville, Abandoned Outfall Plugging and Sealing at Rembert Street, to provide a contract time extension of 46 days and a net credit in the amount of $9,478.78, which results from additional work performed as a result of unforeseeable conditions and a recap of current bid item quantities for a total construction amount of $128,221.22, as recommended by Pan American Engineers, Project Engineer and Treasurer, and authorize the President to sign same. The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, June 9, 2014, at three (3:00) o'clock p.m. (Central Standard Time).

There were present: Joe Bishop, President, Davron “Bubba” Moreau, Vice President, and Police Jurors Craig Smith, Theodore Fountaine, Jr., Richard Vanderlick, Oliver “Ollie” Overton, Jr., Sean McGlothlin, Richard Billings and Scott Perry, Jr.

Also present were Mr. Tim Ware, Treasurer; Mr. Dennis Woodward, Public Works Director; Ms. Sonya Wiley -Gremillion, OHSEP Director; Ms. Elaine Morace, WIA Operations Director; Mr. Shane Trapp, Courthouse Building Superintendent; Ms. Donna Andries, Sales & Use Tax Administrator; Ms. Linda Sanders, Civil Service Director; Mr. Thomas O. Wells, Legal Counsel and Ms. Laurel Smith, Secretary.

The invocation was given by Mr. Ollie Overton.

The Pledge of Allegiance and the State and American Flags were presented by the Boy Scout Troop 626-Deville Kolin.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Joe Bishop, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any Public Comment on any Agenda Item, to which there was no response.

Mr. Joe Bishop, President, recognized Ms. Sherri Ellington with the Alexandria/Pineville Convention & Visitors Bureau.

Ms. Ellington thanked the Police Jury for all their support and gave a brief update on upcoming events and tourism in Rapides Parish.

The next item on the agenda was to recognize Ms. Lynn Stewart, Registrar of Voters, to discuss Early Voting Satellite Office. REGULAR SESSION JUNE 9, 2014

Ms. Stewart explained the early voting and how this has grown o ver the years due to people being able to vote when they will not be present for the voting day. Ms. Stewart explained about the Early Voting Satellite locations that are currently in other Parishes. Packets were passed out to the Jurors. Their goal is to one day, if the Early Voting Satellite is feasible on the Northside of the River, to also one the Southside of the Parish in the Forest Hill, Lecompte and Woodworth area. Ms. Stewart stated she had talked to the administration in Pineville and any place that they own in Pineville, they would be more than glad to extend this to the Jury, at no charge, to help accomplish this . The Secretary of State’s Office would pay for any Security during the early voting and pay the Commissioners. There would be one or two personnel sent from the Registrar of Voter’s Office, depending on how big the election is, to handle the voters for that day, which is also paid for by the Secretary o f State’s Office. One of the big things that Secretary of State, Tom Schedler is always trying to promote getting people out to vote. Ms. Stewart also stated if the Police Jury wanted, she could have someone from the Secretary of State’s Office come talk about the Early Voting Satellite Office.

Mr. Joe Bishop stated he had talked to Mayor Clarence Fields in Pineville and he suggested the Kees Park area because it has a large parking area, it’s a voting precinct already, right next to the Pineville Expres sway, convenient to the people in the Ball, Pineville and Deville areas. It already has handicapped parking also.

The next item on the agenda was to r ecognize and present a plaque to Mr. Larry Spottsville, Director of Juvenile Services, for being selected by the Attorney General’s Office, to receive the 2014 Faith Based Grass Roots Community Service Award.

Mr. Richard Billings and Mr. Ollie Overton presented Mr. Larry Spottsville a plaque and commended him on his services to the Juvenile Services and being selected by the Attorney General’s Office in receiving the 2014 Faith Based Grass Roots Community Service Award.

The next item on the agenda was to recognize Ms. Melissa Becker for an update on the building codes.

Ms. Carrie Robinette from the Rapides Area Planning Commission gave a brief update on the building codes in Ms. Melissa Becker’s absence.

Section 2. The acquiring p erson shall certify, in writing, to the Purchasing Department that he/she or his/her agent has searched for all names and last known addresses of all owners, mortgages, and any other person(s) who may have a vested or contingent interest in the property, o r who have filed a request for notice as indicated in those records and has so examined:

  • • the mortgage and conveyance records of Rapides Parish,
  • • the current telephone book,
  • • any other examination resources, including Internet search engines, if any, the records of the Louisiana Secretary of State and the Secretary of States set forth by the names of identified entities

Section 3. The acquiring person shall submit the required notifications (R.S. 47:2206 A and B) to the Civil Sheriff for his/her sign ature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. *Copies of the “green and white receipts” should be maintained by the purchaser as indicia of compliance with the notice requirements;

Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or otherwise challenge in a court of competent jurisdiction the potential sale or donation:

  • (a) Sixty days from the date of the notice provided in this Subsection, if five years have elapsed from the filing of the tax sale certificate (formerly “proces verbal”), or six mon ths after the date of the notice provided for in this Subsection, if five years have not elapsed since the filing of the tax sale certificate (formerly “proces verbal”);
  • (b) The filing of the sale or donation transferring the property.
  • (c) The written notice required by this Section shall be that which is included in R.S. 47: 2206 A. (2).

Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:

  • (a) Sixty days, for property on which a tax sale certificate (formerly “proces verbal”) was filed over five years previous of the first publication, or six month if REGULAR SESSION JUNE 9, 2014

the tax sale certificate (formerly “proces verbal”) was filed less than five years before the first publication of the notice provided for in this Subsection.

  • (b) The filing of the sale or donation transferring the property.
  • (c) The publication required by this Section shall be that which is included in R.S. 47: 2206 B. (2).

Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices t hat was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.

Section 7. At any time after the expiration of the sixty -day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as prac tical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney’s office has certified in writing to the President, that purchaser or donee has complied with the mandates of this Ordinance. The sale pr ice shall be paid by cashier’s check or money order at the time of the sale.

NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.

NOTE: The City of Alexandria and/or the City of Pineville and/or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.

Section 8. The acquiring person shall be responsible for filing the sale or donation and payment of all filing fees.

Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against ev iction resulting from a prior alienation by the political subdivision or the municipality.

  • (a) All sales and donations shall be without warranty, either expressed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against redhibitory defects or vices and the warranty that the thing sole is reasonable fit for its ordinary purpose or the acquiring person’s intended or particular purpose.
  • (b) These waivers or exclusions of warranties shall be self -operative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardless of REGULAR SESSION JUNE 9, 2014

whether they are brought to the attention of the acquiring person. This pro vision supersedes the requirements of any other law.

  • (c) The writing constituting the sale shall be in the form as provided in R.S. 47: 2207 B. and the writing constituting the donation shall be that which is included in R.S. 47: 2207 C.

Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.

Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.

Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interes t the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.

  • (a) The affidavit may also contain a statement of the interest to which the purchaser or donee takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debtor, as mortgagors.
  • (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47: 2208.
  • (c) With respect to a sale, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of re cord of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
  • (d) With respect to a donation, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
  • (e) Upon filing of the affidavit, the recorder of mortgages or the recorder of conveyances shall treat as canceled, ter minated, released, or erased, all those liens, privileges, mortgages or other encumbrances canceled, terminated, released or erased under subsections (c) or (d) of this Section, only insofar as they affect the property.

This agreement was for the term of July 1, 2013 through June 30, REGULAR SESSION JUNE 9, 2014

2014 with possible extension of up to three years. This renewal will change the expiration date to June 30, 2017. On vote the motion carried.

A resolution providing for canvassing the returns and declaring the result of the special election held in the Parish of Rapides, State of Louisiana, on Saturday, May 3, 2014, to authorize the continuation of a special tax therein.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of the Parish of Rapides, State of Louisiana, that:

SECTION 1. Canvass. This Governing Authority does now proceed in open and public session to examine the official tabulations of votes cast at the special election held in the Parish of Rapides, State of Louisiana, on SATURDA Y, MAY 3, 2014, to authorize the continuation of a special tax therein, and said Governing Authority does further proceed to examine and canvass the returns and declare the result of the special election.

SECTION 2. Procès Verbal. A Procès Verbal of the canvass of the returns of said election shall be made and a certified copy thereof shall be forwarded to the Secretary of State, Baton Rouge, Louisiana, who shall record the same in his office; another certified copy thereof shall be forwarded to the Cle rk of Court and Ex-Officio Recorder of Mortgages in and for the Parish of Rapides, who shall record the same in the Mortgage Records of said Parish; and another copy thereof shall be retained in the archives of this Governing Authority.

SECTION 3. Promulgation of Election Result. The result of said election shall be promulgated by publication in the manner provided by law.

An ordinance creating a sales tax district within the Parish of Rapides, State of Louisiana, and defining and describing the boundaries thereof.

WHEREAS, no industrial area is located within the proposed boundaries of the District;

WHEREAS, the Police Jury has determined that the creation of said sales tax district would benefit and is to the best interests of the Parish and the inhabitants of the area affected; and

WHEREAS, the total rate of all sales and use taxes levied within the proposed sales tax district, exclusive of state and law enforcement district sales and use taxes, is less than five percent (5%);

NOW, THEREFORE, BE IT ORDAINED, by the Police Jury of the Parish of Rapides, State of Louisiana (the “Police Jury”), acting as the governing authority of the Parish of Rapides, State of Louisiana (the “Parish”), that:

SECTION 1. By virtue of the authority conferred by Section 338.54 of Title 47 of the Louisiana Revised Statutes of 1950, as amended (the “Act”), and other constitutional and statutory authority, a sales tax district is hereby created within the Parish, which sales tax district shall comprise and embrace all of that territory within the following described boundaries: REGULAR SESSION JUNE 9, 2014

BOUNDARY DESCRIPTION

Begin at a point in Township One South, Range One East (T1S R1E), where the Ward 3 and Ward 4 boundary lines meet in Cocodrie Lake. Follow the Ward 4 boundary line northwesterly and westerly to the northwest corner of Section 25, R1N-R1W; thence along a hypothetical line due north, passing along the west boundary line of Section 24, T1N-R1W, to its intersection with Beaver Creek; thence northwesterly and upstream Beaver Creek to its intersection with LA 112; thence west along LA 112 to its intersection with Ward 4 boundary; thence northerly and westerly along said Ward boundary line until it intersects with the northwestern corner of Section 4, T1NR2W; thence south along the section lines of Sections 9, 16, 21, 28 and 33, T1N-R2W, to its intersection with Spring Creek; thence southeasterly and downstream Spring Creek along the meanders of the Rapides Parish Boundary Line northward and eastward to the point of the beginning.

SECTION 2. The sales tax district hereby created shall be known and designated as "Fire Protection Sales Tax District No. 17 of the Parish of Rapides, State of Louisiana" (the “District”), and as thus created constitutes a public corporation and political subdivision of the State of Louisiana, and has all rights, powers and privileges granted by and conferred by the Constitution and Statutes of the State of Louisiana to such corporations, including the authority to incur debt, issue bonds and levy sales and use taxes.

SECTION 3. The Rapides Parish Police Jury shall serve as the governing authority of the District and its officers shall be the officers of the District.

SECTION 4. The domicile of the District is hereby designated as the Rapides Parish Police Jury Office, Rapides Parish Courthouse, 701 Murray Street, Alexandria, Louisiana.

SECTION 5. That the official journal of the District shall be the official journal of the Parish and the Police Jury’s seal shall be the seal of the District.

SECTION 6. This ordinance shall become effective immediately.

Barron, Contractor for the Gustav/Ike CDBG Project, Location 7 -City of Pineville, Abandoned Outfall Plu gging and Sealing at Rembert Street, as substantially complete, as recommended by Pan American Engineers, Project Engineer and Treasurer, and authorize the President to sign same.

WHEREAS, Don M. Barron Contractor, Inc., the Contractor for the project entitled RAPIDES PARISH GUSTAV/IKE CDBG, LOCATION 7 – CITY OF PINEVILLE, LOUISIANA ABANDONED OUTFALL PLUGGING AND SEALING AT REMBERT STREET, has “Substantially Completed” the work under the Contract as recommended by the Engineer; NOW THEREFOR E BE IT RESOLVED that the Contract of Don M. On motion by Mr. Richard Billings, seconded by Mr. Sean McGlothin, to approve an intergovernmental agreement between Rapides Parish Fire District No. 2 and the Rapides Parish Communication District (911) for the temporary rental of the former communication facility (4220 Ellis St., Alexandria) to FD2 subject to approval by the Communication Board of Directors. Amount to be $300.00 monthly, to be paid from FD2 funds as recommended by the Fire Chief. On vote the motion carried.

ORDINANCE

AN ORDINANCE TO AMEND AND REENACT SECTION 18 -4.2

  • (F) SPEED LIMITS SO AS TO ESTABLISH A 30 MPH SPEED LIMIT ON CARLOS WRIGHT ROAD, WARD 5, DISTRICT H.

NOW, THEREFORE, BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 9th day of June, 2014, that Section 18 -4.2 (f) of the Rapides Parish Code of Ordinances is hereby amended and reenacted to include the following road, as follows:

Chapter 18. MOTOR VEHICLES AND TRAFFIC Section 18-4.2. Speed limits designated on certain streets: ...

  • (f) Thirty miles per hour. It shall be unlawful for any person to drive or operate a vehicle upon the following parish roads in Rapides Pari sh in excess of thirty (30) miles per hour. ... Carlos Wright Road, Ward 5, District H ...

(l). Whoever violates the provisions of this section shall be punished by a fine not to exceed one hundred dollars ($100.00), or imprisoned in the Rapides Parish Jail for a period not to exceed thirty (30) days, or both.

BE IT FURTHER ORDAINED that this ordinance is to be effective immediately. BE IT FURTHER ORDAINED in all other respects Section 18 of the Rapides Parish Code of Ordinances shall remain unchanged. BE IT FURTHER ORDAINED that the Parish Highway Department is hereby authorized to erect speed limit signs on the road. THUS DONE AND SIGNED on this 9th day of June, 2014.

On motion by Mr. Sean McGlothlin, seconded by Mr. Richard Vanderlick, to clean property on 7011 Isabella Drive, Penny Acres, to be paid out of District G reseal funds.

Mr. Tom Wells requested that the motion be amended to reflect that this is property that the owner was sent two separate notices to clean the property and the inspector reported that this has not been done as of yet. Mr. Wells also stated that we don’t clean up private property normally, but this was done by proper procedures, done correctly and need the motion to reflect this and also that the cost be filed as a lien like we normally do.

On motion by Mr. Scott Perry, seco nded by Mr. Sean McGlothlin, to reject all bids received for the Airbase Road Phase II Sewer System Improvements –FY 2013 LCDBG Program No. 724753 construction project, bids received were in excess of the L CDBG construction funds available and authorize to re-advertise the project at a later date, as recommended by the Treasurer, Meyer, Meyer, LaCroix and Hixson, Project Engineer and Frye Magee, Project Manager. On vote the motion carried.
