The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room Louisiana, on Monday, January 13, 2014, at three (3:00) o'clock p.m. (Central Standard Time).
There were present: Joe Bishop, President, Davron “Bubba” Moreau, Vice President, and Police Jurors Richard Billings, Richard Vanderlick, Oliver “Ollie” Overton, Jr., Theodore Fountaine Jr., Mr. Scott Perry, Jr., Craig Smith and Sean McGlothlin.
Also present were Mr. Tim Ware, Treasurer; Mr. Dennis Woodward, Public Works Director; Ms. Sonya Wiley-Gremillion, OHSEP Director; Ms. Elaine Morace, WIA Operations Director; Mr. Shane Trapp, Courthouse Building Superintendent; Ms. Donna Andries, Sales & Use Tax Administrator; Ms. Linda Sanders, Civil Service Director; Mr. Thomas O. Wells, Legal Counsel and Ms. Laurel Smith, Secretary.
The invocation was given by Chief Randy McCain, Fire District No. 2.
The Pledge of Allegiance was led by the Honorable Judge Ross Foote.
The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Joe Bishop, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.
Mr. Joe Bishop questioned if there was any public comment on any agenda item to which there was no response.
The first item on the agenda was the election of President.
Mr. Tom Wells, Legal Counsel opened the floor for nominations of President of the Rapides Parish Police Jury.
On motion by Mr. Craig Smith, seconded by Mr. Richard Billings, to nominate Mr. Joe Bishop as President.
There being no further nominations, Mr. Joe Bishop was appointed President by acclamation.
On motion by Mr. Richard Billings, seconded by Mr. Craig Smith that Mr. Bubba Moreau be nominated for Vice President.
There being no other nominations, Mr. Bubba Moreau was appointed Vice President by acclamation.
On motion by Mr. Bubba Moreau, seconded by Mr. Scott Perry, to appoint Mr. Tim Ware as Parish Treasurer. On vote the motion carried.
On motion by Mr. Richard Billings, seconded by Mr. Bubba Moreau, that Ms. Laurel Smith be appointed Parish Secretary. On vote the motion carried.
Mr. Joe Bishop recognized Dr. David Holcombe with the Rapides Parish Health Unit. Dr. Holcombe encouraged everyone to get their flu shots. He stated there had already been twenty deaths due to the flu statewide and it was mainly young adults and children. He further stated that the season for flu usually starts around October and doesn’t end until February or March.
On motion by Mr. Richard Vanderlick, seconded by Mr. Craig Smith, to layover the adoption of the minutes of the Rapides Parish Police Jury held in Regular Session on December 9, 2013, as not yet published in the Official Journal. On vote the motion carried.
On motion by Mr. Richard Vanderlick, seconded by Mr. Craig Smith, to adopt the minutes of the Special Session held on December 17, 2013 as published in the Official Journal. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Sean McGlothlin, that approved bills be paid. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith, to accept the Treasurer’s Report. On vote the motion carried.
On motion by Mr. Richard Billings, seconded by Mr. Richard Vanderlick, the following ordinance was presented and on vote unanimously adopted:
ORDINANCE
AUTHORIZING THE RAPIDES PARISH POLICE JURY
TO SELL
Sale of Adjudicated Property
Lot Five (5), Ashton Acres Subdivision, a subdivision of Rapides Parish, Louisiana, as per plat thereof recorded in Conveyance Book 21, Page 68 and 69 of the records of Rapides Parish, Louisiana.
Municipal Address of the Property: Not Applicable
Married to and living in community with Carol LaCombe
FOR THE
CONSIDERATION OF $3,750.88 CASH
WHEREAS, the City of Alexandria and/or the City of Pineville and/or Parish of Rapides owns property described as
Lot Five (5), Ashton Acres Subdivision, a subdivision of Rapides Parish, Louisiana, as per plat thereof recorded in Conveyance Book 21, Page 68 and 69 of the records of Rapides Parish, Louisiana.
Municipal Address of the Property: Not Applicable
said property having been adjudicated to either of aforementioned Cities and/or the Parish for unpaid property taxes; and
WHEREAS, a request has been received from Darrell LaCombe married to and living in community with Carol LaCombe, to purchase said property for the consideration of $3,750.88 cash, at the time of sale, said consideration representing the total of the statutory impositions, governmental liens, and costs of sale or two-thirds (2/3) of the appraised value of the property; and,
WHEREAS, this Jury is of the opinion that it would be in the public interest to convey the above-mentioned property to Darrell LaCombe, married to and living in community with Carol LaCombe, for the offered consideration.
NOW, THEREFORE, BE IT ORDAINED by the Rapides Parish Police Jury that:
Section 1. Lot Five (5), Ashton Acres Subdivision, a subdivision of Rapides Parish, Louisiana, as per plat thereof recorded in Conveyance Book 21, Page 68 and 69 of the records of Rapides Parish, Louisiana.
Municipal Address of the Property: Not Applicable
Rapides Parish, Louisiana, should be re-entered into the stream of commerce thereby serving the public interest.
Section 2. The acquiring person shall certify, in writing, to the Purchasing Department that he/she or his/her agent has searched for all names and last known addresses of all owners, mortgages, and any other person(s) who may have a vested or contingent interest in the property, or who have filed a request for notice as indicated in those records and has so examined:
- • the mortgage and conveyance records of Rapides Parish,
- • the current telephone book,
- • any other examination resources, including Internet search engines, if any, the records of the Louisiana Secretary of State and the Secretary of States set forth by the names of identified entities
Section 3. The acquiring person shall submit the required notifications (R.S. 47:2206 A and B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. *Copies of the “green and white receipts” should be maintained by the purchaser as indicia of compliance with the notice requirements;
Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or
otherwise challenge in a court of competent jurisdiction the potential sale or donation:
- (a) Sixty days from the date of the notice provided in this Subsection, if five years have elapsed from the filing of the tax sale certificate (formerly “proces verbal”), or six months after the date of the notice provided for in this Subsection, if five years have not elapsed since the filing of the tax sale certificate (formerly “proces verbal”);
- (b) The filing of the sale or donation transferring the property.
- (c) The written notice required by this Section shall be that which is included in R.S. 47: 2206 A. (2).
Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:
- (a) Sixty days, for property on which a tax sale certificate (formerly “proces verbal”) was filed over five years previous of the first publication, or six month if the tax sale certificate (formerly “proces verbal”) was filed less than five years before the first publication of the notice provided for in this Subsection.
- (b) The filing of the sale or donation transferring the property.
- (c) The publication required by this Section shall be that which is included in R.S. 47: 2206 B. (2).
Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.
Section 7. At any time after the expiration of the six ty-day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney’s office has certified in writing to the President, that purchaser or donee has complied with the mandates of this Ordinance. The sale price shall be paid by cashier’s check or money order at the time of the sale.
NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.
NOTE: The City of Alexandria and/or the City of Pineville and/or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface rights of the said property.
Section 8. The acquiring person shall be responsible for filing the sale or donation and payment of all filing fees.
Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.
- (a) All sales and donations shall be without warranty, either expressed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against redhibitory defects or vices and the warranty that the thing sole is reasonable fit for its ordinary purpose or the acquiring person’s intended or particular purpose.
- (b) These waivers or exclusions of warranties shall be self-operative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardless of whether they are brought to the attention of the acquiring person. This provision supersedes the requirem ents of any other law.
- (c) The writing constituting the sale shall be in the form as provided in R.S. 47: 2207 B. and the writing constituting the donation shall be that which is included in R.S. 47: 2207 C.
Section 10. The provisions of R.S. 41:13 38 shall not apply to the property being sold or donated in accordance with this Ordinance.
Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.
Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.
- (a) The affidavit may also contain a statement of the interest to which the purchaser or donee takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debtor, as mortgagors.
- (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47: 2208.
- (c) With respect to a sale, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
- (d) With respect to a donation, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all
statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
- (e) Upon filing of the affidavit, the recorder of mortgages or the recorder of conveyances shall treat as canceled, terminated, released, or erased, all those liens, privileges, mortgages or other encumbrances canceled, terminated, released or erased under subsections (c) or (d) of this Section, only insofar as they affect the property.
- (f) The owner filing the affidavit shall be liable to and indemnify the recorder of mortgages, the recorder of conveyances, and any other person relying on the cancellation, termination, release, or erasure by affidavit for any damages that they may suffer as a consequence of such reliance if the recorded affidavit contains materially false or incorrect statements that cause the recorder to incorrectly cancel, terminate, release, or erase any interest listed in the affidavit. The recorder of mortgages and the recorder of conveyances shall not be liable for any damages resulting to any person or entity as a consequence of the cancellation, termination, release or erasure of any interest in compliance with this Section.

Beginning at the corner of Lot 8 of Square 4 of the Roberts Addition to the City of Alexandria, Rapides Parish, Louisiana, where it intersects Mary Street and from this point run Northwest along Mary Street a distance of 48 feet 10 inches, thence back away from Mary Street parallel with Northwest side of Lot 8 of Square 4 a distance of 125 feet, thence Southeast to the rear corner of Lot 8 of Square 4, thence run toward Mary Street along the Northwest side of Lot 8 of Square 4 of Roberts Addition a distance of 125 feet to the point of beginning, the property herein described having a front of 48 feet 10 inches on Mary Street or the continuation thereof, and running back between parallel lines a distance of 125 feet, being alongside of and adjoining Lot 8 of Square 4 of said Roberts Addition, said property being that shown on Plat recorded at Plat Book 4, page 121, records of Rapides Parish, Louisiana, as Lot 1 Square 1 of the Adams Addition.

On motion by Mr. Ollie Overton, seconded by Mr. Sean McGlothlin, to authorize the expenses of interested Police Jurors, Employees and Legal Counsel to attend the NACo Annual Conference in New Orleans LA., to be held on July 11-14, 2014. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith, to adopt a Notice of Intent of Sale through the Abandoned/Adjudicated Property procedures on the property listed below:
Tax Debtor Description Bearing the municipal address of: On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton, to approve Amendment #1 on the Professional Services Agreement with Frye/Magee, LLC, dated May 19, 2010, which did not reflect the 5 Red River Levee Recertification Projects and the Overall Administration of the Gustav/Ike Grant of up to $78,665 in addition to the original contract amount of $654,494.16, which increases the total amount not to exceed $733,159.16. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith, to authorize the President to sign certificates to the Legislative Auditor certifying on behalf of the Governing Body that funds made available during the year from January 1, 2013 thru December 31, 2013 pursuant to LSA-R.S. 48-751-760 have been expended in accordance with the provisions of those statues and other standards established by law. On vote the motion carried.
On motion by Mr. Bubba Moreau, seconded by Mr. Craig Smith, to amend the 2014 Budgets to reflect the actual beginning balances. O n vote the motion carried.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of the Parish of Rapides, State of Louisiana (the "Parish"), that:
SECTION 1. Election Call. Subject to the app roval of the State Bond Commission, and under the authority conferred by Article VI, Sections 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5 and Chapter 6-A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the Parish on SATURDAY, MAY 3, 2014, between the hours of seven o'clock (7:00) a.m., and eight o'clock (8:00) p.m., in accordance with the provisions of La. SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the Alexandria Daily Town Talk, a newspaper of general circulation within the Parish, published in Alexandria, Louisiana, and being the official journal of the Parish, once a week for four consecutive weeks, with the first publication to be made not less than forty-five
- (45) days nor more than ninety (90) days prior to the date of the election, which

SECTION 3. Canvass. SECTION 4. Polling Places. SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Monday, June 9, 2014, as provided in Section 3 hereof. SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Rapides Parish and the Registrar of Voters of Rapides Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.
SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to continue to levy and collect the special tax provided for therein. A certi fied copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.
SECTION 9. Additional Notice Requirement. Th is Governing Authority made the announcement with respect to the adoption of this resolution required by La. R.S. 42:19.1, at its public meeting on Monday, December 9, 2013 and published said announcement in the Official Journal on Friday, December 13, 2013.

Shall Road District Number 7A of Rapides Parish, State of
Louisiana (the “District”), continue to levy a special tax of five and fifty-six hundredths (5.56) mills on all the property subject to taxation in said District (an estimated $203,000 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2016 and ending with the year 2025, for the purpose of constructing, maintaining and keeping in repair the public roads, highways and bridges within said District, said millage to represent a sixteen hundredths of a mill (.16) increase over the 5.40 mills tax authorized to be levied through the year 2015 pursuant to an election held on January 17, 2004?
The said special election will be held at the following polling places situated within the District, which polls will open at seven o'clock (7:00) a.m., and close at eight o'clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, to-wit:

The said special election will be held in accordance with the applicable provisions of Chapter 5 and Chapter 6-A of Title 18 of the Louisiana Revised Statutes of 1950, as amended, and other constitutional and statutory authority, and the officers appointed to hold the said election, as provided in this Notice of Special Election, or such substitutes therefor as may be selected and designated in accordance with La. A resolution ordering and calling a special election to be held in Road District No. 10A of the Parish of Rapides, State of Louisiana, to authorize the renewal of a special tax therein; making application to the State Bond Commission in connection therewith; and providing for other matters in connection therewith.
BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Road District No. 10A of the Parish of Rapides, State of Louisiana (the "District"), that:
SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Sections 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5 and Chapter 6-A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the District on SATURDAY, MAY 3, 2014, between the hours of seven o'clock (7:00) a.m., and eight o'clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

Shall Road District No. 10A of the Parish of Rapides, State of Louisiana (the “District”), continue to levy a special tax of ten and four hundredths (10.04) mills on all the property subject to taxation in said District (an estimated $990,000 reasonably expected at this time to be collected from the levy of the tax for an entire year), for a period of ten (10) years, beginning with the year 2016 and ending with the year 2025, for the purpose of constructing, maintaining and keeping in repair the public roads, highways and bridges within said District?
SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the Alexandria Daily Town Talk, a newspaper of general circulation within the District, published in Alexandria, Louisiana, and being the official journal of the District, once a week for four consecutive weeks, with the first publication to be made not less than forty-five
- (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as "Exhibit A" and incorporated herein by reference the same as if it were set forth herein in full.
SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Rapides Parish Courthouse, 701 Murray Street, 2nd Floor, Alexandria, Louisiana, on MONDAY, JUNE 9, 2014, at THREE O'CLOCK (3:00) P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.
SECTION 4. Polling Places. The pollin g places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.
SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Monday, June 9, 2014, as provided in Section 3 hereof. All registered voters in the District will be entitled to vote at the special election, and voting machines shall be used.
SECTION 6. Authorization of Officers. The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election.
SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Rapides Parish and the Registrar of Voters of Rapides Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.
SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to continue to levy and collect the special tax provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.
SECTION 9. This Governing Authority made the announcement with respect to the adoption of this resolution required by La. R.S. 42:19.1, at its public meeting on Monday, December 9, 2013 and published said announcement in the Official Journal on Friday, December 13, 2013.

On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, to request the State Bond Commissions approval to issue up to $700,000 in Certificates of indebtedness for Fire District #15 to use Foley and Judell as Bond Council. (Funds will be used to build a station and buy equipment, trucks, etc.) On vote the motion carried.
On motion by Mr. Richard Billings, seconded by Mr. Sean McGlothlin, to adopt an ordinance to amend Section 18-4.4 (Through Truck Traffic) to include West River Road, Ward 6, District H.
ORDINANCE
AN ORDINANCE TO AMEND AND REENACT SECTION 18-4.4
THROUGH TRUCK TRAFFIC SO AS TO PROHIBIT THROUGH TRUCK ON WEST RIVER ROAD, WARD 6, DISTRICT H.
BE IT ORDAINED by the Rapides Parish Police Jury in Regular Session convened on this 13th day of January, 2014, that Section 18-4.4 of the Rapides Parish Code of Ordinances is hereby amended and reenacted to include the following restriction on West River Road as follows:
Chapter 18. MOTOR VEHICLES AND TRAFFIC
Section 18-4.4. Through truck traffic.
- (a) Prohibited Through truck traffic is prohibited on the following streets and public ways:
… West River Road, Ward 6, District H …
Penalty. Whoever violates the provisions of this section shall be punished by a fine not to exceed one hundred dollars ($100.00), or imprisoned in the Rapides Parish Jail for a period not to exceed thirty (30) days, or both.
BE IT FURTHER ORDAINED that this ordinance is to be effective immediately.
BE IT FURTHER ORDAINED in all other respects Section 18 4.4 of the Rapides Parish Code of Ordinances shall remain unchanged.
BE IT FURTHER ORDAINED that the Parish Highway Department is hereby authorized to erect through truck signs on the road.

Motion by Mr. Craig Smith, seconded by Mr. Richard Vanderlick, to appoint and request Special Counsel, Steve Crews, to file suit against Baron, Heinberg & Brocato to recover funds in the amount of $600,000 and to adopt a resolution to hire Steve Crews as Special Counsel, representing the Rapides Parish Police Jury in the litigation, at the rate approved by the Attorney General.
RESOLUTION OF THE
WHEREAS, the District Attorney for the Rapides Parish, and particularly Assistant D.A., Thomas O. Wells, provides legal representation to the Rapides Parish Police Jury and
WHEREAS, this matter involves a dispute between the Rapides Parish Police Jury and the architectural firm of Barron, Heinberg and Brocato regarding the renovation of the Rapides Parish Coliseum. Thomas O. Wells provided legal advice regarding this matter and may become a witness regarding factual events leading up to the termination of the contract between the Rapides Parish Police Jury and the architectural firm of Barron, Heinberg and Brocato
WHEREAS, Rule 3.7 of the Louisiana Rules of Professional Conduct prohibits a lawyer from representation in a case where the lawyer may be called as a witness; and
WHEREAS, Mr. Steve Crews an attorney practicing in Natchitoches, Louisiana, has often represented public bodies including the Rapides Parish Police Jury in matters of this nature and therefore possesses the specialized knowledge and skill for the representation of the Rapides Parish Police Jury in this matter;
WHEREAS, the employment of private counsel will eliminate any issues of legal ethics which would arise in the event it is necessary in the prosecution of these matters for the Jury’s general counsel to testify as a witness;
NOW, THEREFORE, BE IT RESOLVED that Mr. Steve Crews and the Firm of Corkern and Crews, Attorneys at Law, is hereby engaged as counsel for the Rapides Parish Police Jury; at the compensation schedule published and approved by the attorney general not to exceed $175.00 per hour together with incurred expenses for court cost advances, subpoena and deposition fees, and other like out-of-pocket expenditures, subject however to the approval of the Louisiana Attorney General pursuant to R.S. 42:263
BE IT FURTHER RESOLVED that a certified copy of this resolution and attachments be forwarded to the Honorable Buddy Caldwell, Attorney General of Louisiana, for his review and approval, all pursuant to R.S. 42-263.
