The Police Jury of the Parish of Rapides, State of Louisi ana, met in Regular Session at its regular meeting place, the Police Jury Room of Monday, May 14, 2012, at three (3:00) o’clock p.m. (Central Standard Time)

There were present: Honorable Oliver Overton, President; Richard Vanderlick, Vice President; and Police Jurors Joe Bishop; Scott Perry, Jr.; Theodore Fountaine, Jr.; Davron “Bubba” Moreau; Craig Smith; Richard Billings; and Sean McGlothlin.

Also present w ere Mr. Tim Ware, Treasurer; Mr. Dennis Woodward, Public Works Director; Ms. Donna Andries, Sales Tax Administrator; Mr. Shane Trapp, Courthouse and Jail Building Superintendent; Chief Randy McCain, Fire District No. 2; Mr. Thomas O. Wells, Legal Counsel; and Ms. Angela T. Voss, Parish Secretary.

The invocation was given by Mr. Bubba Moreau.

The Pledge of Allegiance was led by Mr. Theodore Fountaine.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Oliver Overton, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

The President asked if there was any Public Comment on any Agenda Item, to which there was no response.

On motion by Mr. Richard Vanderlick, seconded by Mr. Scott Perry, to adopt the minutes of Rapides Parish Police Jury held in Regular Session on April 9, 2012, as published in the Official Journal. On vote the motion carried.

On m otion by Mr. Joe Bishop, seconded by Mr. Craig Smith, that approved bills be paid. On vote the motion carried.

Mr. Oliver Overton and Mr. Scott Perry r ecognized and presented plaques on behalf of the Police Jury to the Peabody Magnet High School Power Lifting Team 2012 Varsity and Junior Varsity National Champions.

Mr. Oliver Overton and Mr. Richard Billings presented plaques on behalf of the Police Jury to Rapides Parish Fire Districts #2, 3, 4, 5, 7 & 11 in recognition of exemplary dedication to workplace sa fety and placing in the LWCC top 70 for 2011. ADOPT MINUTES

WHEREAS John Lance Harris and Leetha Stokes Harris, referred to individually, collectively and interchangeably as "the Harrises," are the owners of the following described property:

A certain piece, parcel or tract of land, together with all buildings and improvements located thereon and all rights, ways and servitudes thereto appertaining, and all prescriptions and possessions being, lying and situated in Section 18, T4N, R1E, Pineville, Rapides Parish, Louisiana, containing 0.99 acres and being shown on a Certificate of Survey prepared by Jessie P. Lachney dated December 13, 2005, a copy of which is filed and recorded in Conveyance Book 1741 at Page 253 of the Rapides Parish records, and being more particularly described as follows:

WHEREAS the Rapides Parish Police Jury by Dee d dated March 21, 1921, filed and recorded on May 21, 1921, under Registry Number 73,098, recorded in Conveyance Book 109 at Page 77 and following of the Rapides Parish records acquired from Louisiana Railroad and REGULAR MEETING MAY 14, 2012

Navigation Company for the construction of a parish road a strip of land being shown by red ink on a blueprint plat or map attached to the act of Sale which strip of land varied in width between 100 feet to 200 feet as shown by deeds duly recorded.

WHEREAS the Rapides Parish Police Jury by Dee d dated July 25, 1961, under Registry Number 356,010, recorded in Conveyance Book 419 at Page 216 of the Rapides Parish records conveyed a right of way to the Department of Highways for the State of Louisiana and being that portion lying 65 feet on the nor therly side of the centerline from highway survey station 70+100 to 82+100 and decreasing to 60 feet at highway survey station 83+100 to highway survey station 104+32.2 being known as State Project Number 142-107-07, Pineville-Kolin Highway.

WHEREAS the Rapides Parish Police Jury by ordinance offered and adopted at its regular meeting on September 20, 1965 did revoke in favor of Estelle Craig that portion of the property acquired from Louisiana Railroad and Navigation Company lying on the northerly side of a line located 65 feet from the centerline of the right of way granted to the Department of Highways for the State of Louisiana filed and recorded in Conveyance Book 409 at Page 216 of the Rapides Parish records.

WHEREAS it has come to the attention of the Rapides Parish Police Jury that the Department of Highways for the State of Louisiana, now known as the Louisiana Department of Transportation and Development, has abandoned all of that portion of the right of way granted by the Rapides Parish Police Jury to the Louisiana Department of Highways for the State of Louisiana recorded in Conveyance Book 419 at Page 216 of the Rapides Parish records lying 45 feet on the north side of the centerline from highway survey station 70+100 to 82+100 for the Pineville-Kolin Highway.

WHEREAS, the portion of the right of way granted by the Rapides Parish Police Jury to the Department of Highways for the State of Louisiana lying 45 feet north of the centerline from highway survey station 70+100 to 82+100 which was aba ndoned by the Department of Transportation and Development created an unused and not needed portion of the strip of land acquired by the Rapides Parish Police Jury from Louisiana Railroad and Navigation Company for the construction of a parish road which property is described as

Tract."

WHEREAS the Harrises have requested and desire to acquire by direct revoca tion from the Rapides Parish Police Jury the 0.08 acre tract which is no longer needed by the Rapides Parish Police Jury for a parish road nor is used by the Department of Highways for the State of Louisiana now known as the Louisiana Department of Transportation and Development.

WHEREAS the Harrises, in accordance with the provisions of Section 22 -140 of the Rapides Parish Code of Ordinances, submitted their Application For Revocation to the Rapides Area Planning Commission for revocation of the 0.08 A c. Tract and the Rapides Area Planning Commission has recommended the revocation of the 0.08 Ac. Tract as not needed by the Rapides Parish Police Jury for any purpose.

WHEREAS, the Rapides Area Planning Commission submitted the Harrises' Application For Revocation to the Public Works Director who has recommended the revocation of the 0.08 Ac. Tract as not needed by the Rapides Parish Police Jury.

WHEREAS the Rapides Parish Police Jury has the power and authority under the provisions of La. R.S. 48:701 t o revoke and set aside any dedication, deed or conveyance where the right of way is not needed and it appears to be in the best interest of the Rapides Parish Police Jury to revoke and set aside any dedication of the 0.08 Ac. Tract 5.

THEREFORE, BE IT ORDAINED by the Rapides Parish Police Jury that the 0.08 Ac. Tract is hereby declared as being abandoned and no longer needed for highway or road use and, insofar as the 0.08 Ac. Tract is concerned, the 0.08 Ac. Tract is revoked to and in favor of the Harrises and the Harris Property subject to the condition that this revocation is made subject to and in favor of any entity that is providing or will provide electricity, water, gas, sewer, drainage, television, telephone or similar utility services and the r evocation includes a reservation by the Rapides Parish Police Jury in favor of such entities to continue to repair, replace and maintain any facilities providing any utility service located within or under the 0.08 Ac. Tract.

BE IT FURTHER ORDAINED by th e Rapides Parish Police Jury that the 30 day public review period is waived as unnecessary and that no notice was required to be given by the Rapides Area Planning Commission to adjoining property owners by certified mail because the adjoining property owners are the Harrises and the Rapides Parish Police Jury.

BE IT FURTHER ORDAINED by the Rapides Parish Police Jury that the 0.08 Ac. Tract shall revert to the contiguous property owners, the Harrises, as provided by law.

THUS DONE AND SIGNED on this 14th day of May 2012. On motion by Mr. Joe Bishop, seconded by Mr. Richard Vanderlick, to enter into a financing agreement with Red River Bank for the lease -purchase of a 2012 Ford F -550 Regular Cab (4X2) (purchased under the City of Alexandria Bid No. 1859) in the amount $37,619.00 to be purchased from Hixson Autoplex with terms and conditions to be five (5) annual payments at an interest rate of 2.45 %, as recommended by the Ruby-Kolin Volunteer Fire Association Board of Directors, Treasurer and Purchasing Agent, to be paid from Fire District No. 7 Funds as budgeted. RESOLUTION

Whereas, Rapides Parish Police Jury (the "Purchaser"), a body politic and corporate duly organized and existing as a political subdivision of the State of Louisiana (the "State"), is authorized by the laws of the State to purchase and acquire movable property for the benefit of the Purchaser and its citizens and to enter into contracts with respect thereto; and

Whereas, the Purchaser desires to purchase and acquire certain equipment constituting movable property necessary for the Purchaser to perform essential governmental functions; and

Whereas, in order to acquire such equipment, the Purchaser proposes to enter into that certain Equipment Installment Purchase Agreement (the "Agreement") with Red River Bank (the "Bank"), the form of which has been presented to the governing body of the Purchaser at this meeting; and

Whereas, the governing body of the Purchaser deems it beneficial to the Purchaser and for the efficient and effect administration thereof to enter into the Agreement for the financing of the purchase and acquisition of the equipment therein described on the terms and conditions therein provided;

NOW, THEREFORE, BE IT RESOLVED:

Section 1. Approval of Documents.

The form, terms and provisions of the Agreement are hereby approved in substantially the form presented at this meeting, with such insertions, omissions and changes as shall be approved by the counsel of the Purchaser or other members of the governing body of the Purchaser executing the same, the execution of such documents being conclusive evidence of such approval; and the President of the Purchaser is hereby authorized and directed to execute, and the Treasurer of the Purchasers is hereby authorized and directed to attest and countersign, the Agreement and any related exhibits attached thereto, and the Secretary of the Purchaser is hereby authorized to affix the seal of the Purchaser to such documents.

Section 2. Other Actions Authorized.

The officers and employees of the Purchaser shall take all action necessary or reasonably required by the parties to the Agreement to carry out, give effect to and consummate the transactions contemplated thereby and to take all action necessary in conformity therewi th, including, without limitation, the execution and delivery of any closing and other documents required to be delivered in connection with the Agreement.

Section 3. No General Liability.

Nothing contained in this Resolution, the Agreement nor any ot her instrument shall be construed with respect to the Purchaser as incurring a pecuniary liability or charge upon the general credit of the Purchaser or against its taxing power, nor shall the breach of any agreement contained in this Resolution, the Agree ment or any other instrument or document executed in connection therewith impose any pecuniary liability upon the Purchaser or any charge upon its general credit or against its taxing power, except to the extent that the Installment Payments payable under the Agreement are special limited obligations of the Purchaser as provided in the Agreement.

Section 4. Severability.

If any section, paragraph, clause or provision of this Resolution shall for any reason be held to be invalid or unenforceable, the i nvalidity or unenforceability of such section, paragraph, clause or provision shall not affect any of the remaining provisions of this Resolution.

Section 5. Repealer.

All bylaws, orders and resolutions or parts thereof, inconsistent herewith, are her eby repealed to the extent only of such inconsistency. This repealer shall not be construed as reviving any bylaw, order, resolution or ordinance of part thereof.

Section 6. Effective Date.

This Resolution shall be effectively immediately upon its approval and adoption.

Section 7. Section 265(b)(3) Designation.

Purchaser hereby designates the Agreement as a "qualified tax -exempt obligation" for the purposes and within the meaning of Section 265(b)(3) of the Internal Revenue Code of 1986, as amended. Purchaser further represents that Purchaser reasonably anticipates that Purchaser and other entities issuing obligations on behalf of Purchaser will not issue tax -exempt obligations (including the Agreement) that exceed the aggregate principal amo unt of $10,000,000 during the calendar year in which the Agreement is executed and delivered.

A RESOLUTION SUPPORTING THE REVISION OF STATE LAW R.S. 8:2212 A(1)(f)(i) WHICH REQUIRES PUBLIC ENTITIES TO PROVIDE CONTRACTORS THE OPTION TO SUBMIT BIDS FOR PUBLIC CONTRACTS THROUGH AN ELECRONIC FORMAT AND REQUESTING SUPPORT FROM THE LOUISIANA LEGISLATIVE DELEGATION AND OTHER GOVERNMENTAL ENTITIES TO RIVISE SAID LAW.

WHEREAS, Louisiana Revised Statutes state that contractors shall be provided the option to submit bids for public contracts through a uniform and secure electronic interactive system,

WHEREAS, public entities may incur expenses associated with this requirement,

WHEREAS, there are additional man hours required to provide the bid in an electronic format and to monitor the bid submissions,

WHEREAS, contractors wishing to submit bids for public contracts are required to pay annual and/or per bid costs to submit bids in this manner,

WHEREAS, problems with the submission of bids electronically sometimes arise due to computer malfunctions, loss of internet access, and errors in keying in these electronic bids, along with other issues.

WHEREAS, other public entities have expressed interest in having this law revised and/or removed, REGULAR MEETING MAY 14, 2012

WHEREAS, the Rapides Parish Police Jury has only had one bid that was submitted electronically in the past two years and four months since this law took effect,

WHEREAS, the one bid submitted to the Rapides Parish Police Jury was not the lowest bidder and was not awarded the bid, now therefore,

BE IT RESOLVED, by the Rapides Parish Police Jury, in legal session convened, that the Jury hereby supports the revision of State Bid Law R.S. 38:2212 A(1)(f)(i) from making it mandatory that public entities provide a means of allowing electronic submittal of bids to making it optional at the prerogative of the public entity.

THUS PASSED, APPROVED AND ADOPTED on this 14th day of May, 2012.

Section 2. The acquiring person shall certify, in writing, to the Purchasing Department that he/she or his/her agent has searched for all names and last known addresses of all owners, mortgages, and any other person(s) who may have a vested or contingent interest in the property, or who have filed a request for notice as indicated in those records and has so examined:

-the mortgage and conveyance records of Rapides Parish, -the current telephone book, -any other examination resources, including Internet search engines, if any, the records of the Louisiana Secretary of State and the Secretary of States set forth by the names of identified entities

Section 3. The acquiring person shall submit the required notifications (R.S. 47:2206 A and

  • B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. *Copies of the "green and white receipts" should be maintained by the purchaser as indicia of compliance with the notice requirements;

Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or otherwise challenge in a court of competent jurisdiction the potential sale or donation: REGULAR MEETING MAY 14, 2012

  • (a) Sixty days from the date of the notice provided in this Subsection, if five years have elapsed from the filing of the tax sale certificate (formerly "proces verbal"), or six months after the date of the notice provided for in this Subsection, if five years have not elapsed since the filing of the tax sale certificate (formerly "proces verbal");
  • (b) The filing of the sale or donation transferring the property.
  • (c) The written notice required by this Section shall be that which is included in R.S. 47:

Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:

  • (a) Sixty days, for property on which a tax sale certificate (formerly "proces verbal") was filed over five years previous of the first publication, or six month if the tax sale certificate (formerly "proces verbal") was filed less than five years before the first publication of the notice provided for in this Subsection.
  • (b) The filing of the sale or donation transferring the property.
  • (c) The publication required by this Section shall be that which is included in R.S. 47: 2206 B.

Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.

Section 7. At any time after the expiration of the sixty-day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney's office has certified in writing to the President, that purchaser or donee has complied with the mandates of this Ordinance. The sale price shall be paid by cashier's check or money order at the time of the sale.

NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.

NOTE: The City of Alexandria and/or the City of Pineville and/or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface lights of the said property.

Section 8. The acquiring person shall be responsible for filing the sale or donation and payment of all filing fees.

Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.

  • (a) All sales and donations shall be without warranty, either expressed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against REGULAR MEETING MAY 14, 2012

redhibitory defects or vices and the warranty that the thing sole is reasonable fit for its ordinary purpose or the acquiring person's intended or particular purpose.

  • (b) These waivers or exclusions of warranties shall be self-operative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardless of whether they are brought to the attention of the acquiring person. This provision supersedes the requirements of any other law.
  • (c) The writing constituting the sale shall be in the form as provided in R.S. 47: 2207 B. and the writing constituting the donation shall be that which is included in R.S. 47: 2207 C.

Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.

Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.

Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors, or assigns, may file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors, or assigns, intends to be terminated were identified, how the address of each tax sale party was obtained, how the written notice was sent, the results of sending the written notice, and the dates of publication.

  • (a) The affidavit may also contain a statement of the interest to which the purchaser or donee takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debtor, as mortgagors.
  • (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47: 2208.
  • (c) With respect to a sale, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
  • (d) With respect to a donation, the filing of the affidavit provided herein shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governmental liens, and of all interests, liens, mortgages, privileges, and other encumbrances recorded against the property sold and listed in the affidavit.
  • (e) Upon filing of the affidavit, the recorder of mortgages or the recorder of conveyances shall treat as canceled, terminated, released, or erased, all those liens, privileges, mortgages or other encumbrances canceled, terminated, released or erased under subsections (c) or (d) of this Section, only insofar as they affect the property.
  • (f) The owner filing the affidavit shall be liable to and indemnify the recorder of mortgages, the recorder of conveyances, and any other person relying on the cancellation, termination, release, or erasure by affidavit for any dames that they may suffer as a consequence of such reliance if the recorded affidavit contains materially false or incorrect statements that cause the recorder to incorrectly cancel, terminate, release, or erase any interest listed in the affidavit. The recorder of mortgages and the recorder of conveyances shall not be liable for any damages resulting to any person or entity as a consequence of the cancellation, termination, release or erasure of any interest in compliance with this Section.

Section 2. The acquiring person shall certify, in writing, to the Purchasing Department that he/she or his/her agent has searched for all names and last known addresses of all owners, mortgages, and any other person(s) who may have a vested or contingent interest in the property, or who have filed a request for notice as indicated in those records and has so examined:

-the mortgage and conveyance records of Rapides Parish, -the current telephone book, -any other examination resources, including Internet search engines, if any, the records of the Louisiana Secretary of State and the Secretary of States set forth by the names of identified entities

Section 3. The acquiring person shall submit the required notifications (R.S. 47:2206 A and

  • B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publication and/or service of process. *Copies of the "green and white receipts" should be maintained by the purchaser as indicia of compliance with the notice requirements;

Section 4. The acquiring person shall send a written notice notifying any tax sale party whose interest the successful bidder or donee intends to be terminated that the party has until the later of the following to redeem the property or otherwise challenge in a court of competent jurisdiction the potential sale or donation:

  • (a) Sixty days from the date of the notice provided in this Subsection, if five years have elapsed from the filing of the tax sale certificate (formerly "proces verbal"), or six months after the date of the notice provided for in this Subsection, if five years have not elapsed since the filing of the tax sale certificate (formerly "proces verbal");
  • (b) The filing of the sale or donation transferring the property.
  • (c) The written notice required by this Section shall be that which is included in R.S. 47:

Section 5. The acquiring person shall cause to be published in the official journal of this parish (currently the Town Talk) a notice that any tax sale party whose interest the successful bidder or donee intends to be terminated has, to redeem the property, until the later of:

  • (a) Sixty days, for property on which a tax sale certificate (formerly "proces verbal") was filed over five years previous of the first publication, or six month if the tax sale certificate (formerly "proces verbal") was filed less than five years before the first publication of the notice provided for in this Subsection.
  • (b) The filing of the sale or donation transferring the property.
  • (c) The publication required by this Section shall be that which is included in R.S. 47: 2206 B.

Section 6. The acquiring person may file with the recorder of mortgages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege, or other encumbrance filed after the filing of the notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the request of the acquiring person.

Section 7. At any time after the expiration of the sixty-day or six-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notice requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not execute the act of cash sale or act of donation until the District Attorney's office has certified in writing to the President, that purchaser or donee has complied with the mandates of this REGULAR MEETING MAY 14, 2012

Ordinance. The sale price shall be paid by cashier's check or money order at the time of the sale.

NOTE: The initial application fee of $75.00 and any other costs incurred by the purchaser shall not be applied to the purchase price and shall not be refundable if the purchaser elects not to complete the process.

NOTE: The City of Alexandria and/or the City of Pineville and/or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed, but shall convey the surface lights of the said property.

Section 8. The acquiring person shall be responsible for filing the sale or donation and payment of all filing fees.

Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.

  • (a) All sales and donations shall be without warranty, either expressed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against redhibitory defects or vices and the warranty that the thing sole is reasonable fit for its ordinary purpose or the acquiring person's intended or particular purpose.
  • (b) These waivers or exclusions of warranties shall be self-operative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardless of whether they are brought to the attention of the acquiring person. This provision supersedes the requirements of any other law.
  • (c) The writing constituting the sale shall be in the form as provided in R.S. 47: 2207 B. and the writing constituting the donation shall be that which is included in R.S. 47: 2207 C.

Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.

Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation and the validity of the sale or donation.

Section 12. BE IT RESOLVED by the Police Jury of the Parish of Rapides, State of Louisiana (the "Governing Authority"), acting as the governing authority of Fire Protection District No. 2 of Rapides Parish, Louisiana (the "District"), that:

SECTION 1. Election Call. Subject to the approval of the State Bond Commission, and under the authority conferred by Article VI, Sections 30 and 32 of the Constitution of the State of Louisiana of 1974, the applicable provisions of Chapter 5 and Chapter 6 -A of the Louisiana Election Code, and other constitutional and statutory authority, a special election is hereby called and ordered to be held in the District on TUESDAY, NOVEMBER 6, 2012 , between the hours of six o'clock (6:00) a.m., and e ight o'clock (8:00) p.m., in accordance with the provisions of La. R.S. 18:541, and at the said election there shall be submitted to all registered voters qualified and entitled to vote at the said election under the Constitution and laws of this State and the Constitution of the United States, the following proposition, to-wit:

FIRE PROTECTION DISTRICT NO. 2

REDEDICATION PROPOSITION

Summary: Authority for Fire Protection District No. 2 to authorize the levy of a 15.52 mills property tax through the year 2021 with the proceeds to be rededicated for the purposes of acquiring, constructing, improving, maintaining or operating fire protection and emergency medical service facilities, vehicles and equipment, said tax to be levied in lieu of the current tax being levied for fire purposes and further authority to rededicate the proceeds of the current tax to include medical purposes.

Shall Fire Protection District No. 2 of Rapides Parish, Louisiana (the "Di strict"), levy and collect a special ad valorem tax of fifteen and fifty -two hundredths (15.52) mills (the "Tax") on all the property subject to taxation within the confines of the District (an estimated $3,900,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), beginning with the year 2012 and ending with the year 2021, to be used for the purposes of acquiring, constructing, improving, maintaining or operating fire protection and emergency medical service fa cilities, vehicles and equipment, including both movable and immovable property, that are to be used to provide fire protection and medical services in the District, the Tax to be levied in lieu of a fifteen and fifty -two hundredths (15.52) mills fire tax authorized to be levied through the year 2021 pursuant to an election held on October 2, 2010 (the "2010 REGULAR MEETING MAY 14, 2012

Tax"), with the proceeds collected under the 2010 Tax being hereby rededicated for the purposes set forth above?

SECTION 2. Publication of Notice of Election. A Notice of Special Election shall be published in the Alexandria Daily Town Talk, a daily newspaper of general circulation within the District, published in Alexandria, Louisiana, and being the official journal of the District, once a week for four consecutive weeks, with the first publication to be made not less than forty - five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as "Exhibit A" and incorpora ted herein by reference the same as if it were set forth herein in full.

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Rapides Parish Courthouse, 701 Murray Street, 2nd Floor, Alexandria, Louisiana, on MONDAY, DECEMBER 10, 2012 , at THREE O'CLOCK (3:00) P.M. , and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.

SECTION 4. Polling Places. The polling places se t forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.

SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners -in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with L a. R.S. 18:1287, shall hold the said special election as herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Monday, December 10, 2012, as provided in Section 3 hereof. All registered voter s in the District will be entitled to vote at the special election, and voting machines shall be used.

SECTION 6. Authorization of Officers . The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furn ish to said election officers in ample time for the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.

SECTION 7. Furnishing Election Call to Election Officials . Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Rapides Parish and the Registrar of Voters of Rapides Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.

SECTION 8. Application to State Bond Commi ssion. Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to rededicate the special tax provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application. Shall Fire Protection District No. 2 of Rapides Parish, Louisiana (the "District"), levy and collect a special tax of sixteen and thirty -one hundredths (16.31) mills (the "T ax") on all the property subject to taxation within the confines of Service Area No. 1 of the District (an estimated $350,000 reasonably expected at this time to be collected from the levy of the Tax for an entire year), beginning with the year 2012 and en ding with the year 2020, to be used for the purposes of acquiring, constructing, improving, maintaining and operating fire protection and emergency medical service facilities and other fire fighting or emergency medical service equipment, the Tax to be levied in lieu of a sixteen and thirty-one hundredths (16.31) mills fire tax authorized to be levied through the year 2020 pursuant to an election held on May 2, 2009 (the "2009 Tax"), with the proceeds collected under the 2009 Tax being hereby rededicated f or the purposes set forth above?

SECTION 2. Publication of Notice of Election . A Notice of Special Election shall be published in the Alexandria Daily Town Talk, a daily newspaper of general circulation within the said service area, published in Alexan dria, Louisiana, and being the official journal of the said service area, once a week for four consecutive weeks, with the first publication to be made not less than forty-five (45) days nor more than ninety (90) days prior to the date of the election, which Notice shall be substantially in the form attached hereto as "Exhibit A" and incorporated herein by reference the same as if it were set forth herein in full.

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the R apides Parish Courthouse, 701 Murray Street, 2nd Floor, Alexandria, Louisiana, on MONDAY, DECEMBER 10, 2012 , at THREE O'CLOCK (3:00) P.M. , and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special election.

SECTION 4. Polling Places. The polling places set forth in the aforesaid Notice of Special Election are hereby designated as the polling places at which to hold the said election, and the Commissioners-in-Charge and Commissioners, respectively, will be the same persons as those designated in accordance with law.

SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners -in-Charge and Commissioners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special election a s herein provided, and shall make due returns of said election for the meeting of the Governing Authority to be held on Monday, December 10, 2012, as provided in Section 3 hereof. All registered voters in the said service area will be entitled to vote at the special election, and voting machines shall be used.

SECTION 6. Authorization of Officers . The Secretary of the Governing Authority is hereby empowered, authorized and directed to arrange for and to furnish to said election officers in ample time fo r the holding of said election, the necessary equipment, forms and other paraphernalia essential to the proper holding of said election and the President and/or Secretary of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the election, including but not limited to, appropriate submission to the Federal Department of Justice under Section 5 of the Federal Voting Rights Act of 1965, as amended.

SECTION 7. Furnishing Election Call to Election Officials . Certified copies of this resolution shall be forwarded to the Secretary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Rapides Parish and the Registrar of Voters of Rapides Parish, as notification of the special election, in order that each may prepare for said election and perform their respective functions as required by law.

SECTION 8. Application to State Bond Commission . Application is made to the State Bond Commission for consent and authority to hold the special election as herein provided, and in the event said election carries for further consent and authority to rededicate the special tax provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter requesting the prompt consideration and approval of this application.

It is anticipated that approximately ten (10) to eleven (11) three year awards will be made under this solicitation. A RESOLUTION AUTHORIZING THE RAPIDES PARISH POLICE JURY TO SOLICIT“REQUEST FOR PROPOSALS” FOR AN ADMINISTRATIVE/PROJECT MANAGER FOR THE GREENWAY PARK SUBDIVISION ACQUISITION PROJECT

WHEREAS, the Federal Emergency Management Agency has made funds available to the State of Louisiana under the Hazard Mitigation Grant Program (HMGP) CFDA#97.039, and,

WHEREAS, the use of these funds are being made available to the Rapides Parish Police Jury to acquire 60 properties located in t he Greenway Park Subdivision Acquisition Project, Alexandria, Louisiana

WHEREAS, this allocation being referred to as the Greenway Park Subdivision, Rapides Parish's allocation for $6,083,370; $4,562,528 (Federal Share); and $1,520,842 (St ate Share), and

WHEREAS, as authorized under Section 404 of the Robert T. Stafford Disaster Relief and Emergency Assistance Act, HMGP Funds may be used to fund projects that will reduce or eliminate the losses from future disasters. Projects must conform to the State and Local Hazard Mitigation Plan and provide a long -term solution to a problem. In addition a project's potential savings must be more than the cost of implementing the project. Funds may be used to protect either public or private property that has been subjected to or is in danger of repetitive damage. The eligible types of projects are: Acquisition, Pilot Reconstruction, Elevation, Retrofit, Minor structural flood control projects, Floodwall systems to protect critical f acilities, Vegetative management soil stabilization, infrastructure protection measures, post -disaster code enforcement activities and Hazard Mitigation Planning; and,

NOW, THEREFORE, BE IT RESOLVED by the Rapides Parish Police Jury, Stat e of Louisiana, in regular session convened on this 14th day of May, 2012, that the Rapides Parish Police Jury does hereby authorize the Solicitation of Qualification Statements for an administrative/project management consulting firm for the purpose of as sisting the Parish in meeting its obligations and all program requirements; and,

BE IT FURTHER RESOLVED the Rapides Parish Police Jury does hereby adopt the following administrative/project Management criteria for the Hazard Mitigation Gr ant Program (HMGP) Project No. CFDA #97.039:

WHEREAS, Section 742.2 of Title 39 of the Louisiana Revised Statutes of 1950, as amended, authorizes Road District No. 2C of Rapides Parish, State of Louisiana (the "Issuer") to borrow money in anticipation of revenues to be realized from a special fifty -three and thirty - nine hundredths (53.39) mills tax, authorized at an election held in the Issuer on July 15, 2006 (the "Tax") to be used only for the purpose for which the Tax is authorized; and

WHEREAS, except for the Certificates, the Issuer has no other indebtedness payable from the Tax; and

WHEREAS, it is anticipated that the net revenues from the Tax will amount to the sum of $1,459,000 and the annual debt service on the proposed Certificates at the maximum rate of 6% per annum will not exceed seventy -five percent (75%) of the estimated income to be realized from the levy and collection of said special Tax during the period said Certificates are outstanding;

NOW, THEREFORE, BE IT RESOLVED by the Police Jury of Rapides Parish, Louisiana, acting as th e governing authority of Road District No. 2C of Rapides Parish, State of Louisiana, that:

SECTION 1. Application be and the same is hereby formally made to the State Bond Commission for consent and authority for Road District No. 2C of Rapides Parish, S tate of Louisiana (the "Issuer"), to issue, sell and deliver an amount not exceeding $1,300,000 of Limited Tax Certificates of Indebtedness, Series 2012 (the "Certificates"), to bear interest at a rate or rates not exceeding six percent (6%) per annum, to mature over a period not exceeding six

  • (6) years, and to be sold at not less than 97% of the par value thereof, all in the manner provided for by R.S. 39:742.2 et seq. and other constitutional and statutory authority supplemental thereto, and shall be used for the purpose of constructing, maintaining, draining and keeping in repair the public roads, highway and bridges within said District and paying the costs of issuance. Said Certificates shall be secured by and payable solely from the fifty -three and th irty-nine hundredths (53.39) mills tax, authorized at an election held on July 15, 2006.

SECTION 2. A certified copy of this resolution shall be forwarded to said State Bond Commission by the District's bond counsel, together with a letter requesting the prompt consideration and approval of this ap plication. By virtue of applicant/issuer ?s application for acceptance and utilization of the benefits of the Louisiana State Bond Commission ?s approval resolved and set forth herein, it resolves that it understands and agrees that such approval is expressly conditioned upon, and it further resolves that it understands, agrees and binds itself, its successors and as signs to, full and continuing compliance with the ?State Bond Commission Policy on Approval of Proposed Use of Swaps, or other forms of Derivative Products Hedges, Etc.?, adopted by the Commission on July 20, 2006, as to the borrowing and other matter subject to the approval, including subsequent application and approval under said Policy of the implementation or use of any swap or other product or enhancement covered thereby.

SECTION 3. Prior to the delivery of the Certificates, the Issuer antici pates that it may pay a portion of the costs of the project from the General Fund or other moneys available to REGULAR MEETING MAY 14, 2012

the Issuer. Upon the issuance of the Certificates, the Issuer re asonably expects to reimburse any such expenditures of other available funds from a portion of the proceeds of the Certificates. Any such allocation of proceeds of the Certificates for reimbursement will be with respect to capital expenditures (as defined in Reg. 1.150 -1[b]) and will be made upon the delivery of the Certificates and not later than one year after the later of (i) the date such expenditure was paid or (ii) the date on which the Project was placed in service. This Section is intended to be a declaration of official intent within the meaning of Reg. 1.150-2.

SECTION 4. The Issuer finds and determines that a real necessity exists for the employment of special bond counsel in connection with the issuance of the Certificates, and accordingly t he law firm of Foley & Judell, L.L.P., of New Orleans, Louisiana, is hereby employed as special bond counsel to the Issuer to do and perform comprehensive legal and co - ordinate professional work with respect to the issuance and sale of the Certificates. S aid Bond Counsel shall prepare and submit to this governing authority for adoption all of the proceedings incidental to the authorization, issuance, sale and delivery of the Certificates, shall counsel and advise this governing authority as to the issuance and sale thereof, and shall furnish their opinion covering the legality of the issuance thereof. The fee of Bond Counsel in connection with the issuance of the Certificates is hereby fixed at a sum not to exceed the fee provided by the Attorney General's Guidelines for Fees and Services of Bond Attorneys for comprehensive legal and coordinate professional work in the issuance of revenue bonds, said fee to be payable solely out of funds derived from the sale of the Certificates and to be contingent upon the issuance, sale and delivery thereof. A certified copy of this resolution shall be forwarded to the Attorney General of the State of Louisiana for his written approval of said employment and of the fees herein designated, and the Secre tary-Treasurer of this governing authority is hereby empowered and directed to issue vouchers to said special counsel in payment of the fees herein provided for under the conditions herein enumerated.
