NOTICE OF SPECIAL POLICE JURY MEETING

  1. To adopt an amended reapportionment plan for the Rapides Parish Police Jury.
  2. Any other business that may properly come before the Police Jury.

BY ORDER OF THE PRESIDENT

There were present: Richard W. Billings, President, and Police Jurors John "Buck" Lincecum, Joe Bishop, Theodore Fountaine Jr., Ri chard Vanderlick, Oliver "Ollie" Overton Jr., Steve Coco and Scott Perry Jr.

Absent was Vice President Jamie L. Floyd.

Also present were Mr. Tim Ware, Treasurer; Ms. Elaine Morace, WOD Director; Mr. Shannon Trapp, Courthouse and Jail Building Superinte ndent; Chief Randy McCain, Fire District No. 2; Ms. Linda Sanders, Civil Service Director; Mr. Thomas O. Wells, Legal Counsel; and Ms. Angie Richmond, Secretary.

The invocation was given by Mr. Theodore Fountaine.

The Pledge of Allegiance was led by Mr. Tim Ware.

The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Richard W. Billings, President, who welcomed all present and then stated that the Police Jury was ready for the transaction of business.

The President asked if there was any public comment on any agenda item, to which there was no response.

On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to add the following items to the agenda.

A roll call vote was called and was as follows: YES NO ABSENT Richard Billings Jamie Floyd Buck Lincecum Joe Bishop Theodore Fountaine Richard Vanderlick Ollie Overton Steve Coco Scott Perry On roll call vote the motion carried 8-0.

On motion by Mr. Theodore Fountaine, seconded by Mr. Buck Lincecum, the following resolution was presented, to adopt a resolution to name the following polling places for the new created subdivided precincts, as recommended by the Registrar of Voters, and on vote unanimously adopted:

Resolution BE IT RESOLVED the Rapides Parish Police Jury does hereby select and designate the following polling places for the newly created subdivided precincts, as follows:

BE IT FURTHER RESOLVED that a copy of this resolution be submitted to the U.S. Department of Justice for preclearance. THUS PASSED AND APPROVED on this 25th day of May, 2011.

On motion by Mr. Joe Bishop, seconded by Mr. Buck Lincecum, the following ordinance was presented, an ordinance establishing an alphabetical division by voter surname in the following precincts, no change in geographical location, as recommended by the Registrar of Voters, and on vote unanimously adopted:

Ordinance AN ORDINANCE TO ESTABLISH AN ALPHABETICAL SPLIT IN CERTAIN VOTING PRECINCTS

SECTION I

WHEREAS, it has been b rought to the attention of the Rapides Parish Police Jury that there is over 1,600 registered voters in certain voting precincts; WHEREAS, the Registrar of Voters has reviewed the matter and recommended an alphabetical division; and, WHEREAS, an alphabetical division by voter surname is to be made in the following precincts, with no change in the geographical territory or polling place location, NOW, THEREFORE, BE IT RESOLVED that the Rapides Parish Police Jury does hereby establish the following precincts with an alphabetical division:

SECTION II

BE IT FURTHER ORDAINED that a certified copy of this ordinance, together with other showings required by Section 5 of the Voting Rights Act of 1965 and Regulations pertaining thereto (29 C.F.R. 51.22) and in accordance with LARS 18: 1941, be submitted to the United States Attorney General for approval in compliance with the said Voting Rights Act.

BE IT FURTHER ORDAINED that certified copies of this ordinance be sent to the Secretary of State, the Secretary of the Senate and the Cl erk of the House of Representatives with a request for their consideration and approval.

BE IT FURTHER ORDAINED that this ordinance shall be effective August 29, 2011, contingent upon receipt of required approvals or no objections, as appropriate.

This Ordinance, having been presented, and having been submitted to a vote, the vote thereon was as follows: YEAS: Richard W. Billings, John "Buck" Lincecum, Joe Bishop, Theodore Fountaine Jr., Richard Vanderlick, Oliver "Ollie" Overton Jr., Steve Coco and Scott Perry Jr. NAYS: None. ABSENT AND NOT VOTING: Jamie L. Floyd. And the Ordinance was declared adopted on this 25th day of May, 2011.

Motion by Mr. Buck Lincecum, seconded by Mr. Ollie Overton, to adopt an amended reapportionment plan for the Rapides Parish Police Jury.

Mr. John Miller, Executive Director of the Rapides Area Planning Commission, explained it was discovered after the public hearing that Precinct C11 was inadvertently split in reapportionment but was not readily apparent becaus e of the overlay of the precinct line and the US 71/167 map feature. The split only affected 700 to 800 in population and the reapportionment criteria was at least 600 in population for sufficient registered voters for a precinct split. Thus, the change i n population data was minor. Other very minor corrections were also made on the map.

Discussion ensued.

Mr. Lincecum called for the question.

On motion restated by Mr. Buck Lincecum, seconded by Mr. Ollie Overton, the following ordinance was presented, to adopt an amended reapportionment plan for the Rapides Parish Police Jury, that represents the precinct split of C11 affecting Districts D and I, the alphabetical precinct splits and other minor changes:

ORDINANCE

AN ORDINANCE TO REDISTRICT RA PIDES PARISH INTO NINE POLICE JURY DISTRICTS, TO DEFINE THE BOUNDARIES THEREOF, TO PROVIDE THE EFFECTIVE DATE FOR SAID REAPPORTIONMENT; AND TO AMEND THE VISIBLE PRECINCT BOUNDARIES TO ACCOMMODATE REAPPORTIONMENT.

WHEREAS, Revised Statute Title 33 Sectio n 1411 of the State of Louisiana requires all parish governing authorities to determine whether there exists substantial variation in the representation of the election districts within six months after the official release of every decennial census; and, WHEREAS, the present apportionment plan of the Parish has been examined as a committee as a whole; and, WHEREAS, the Rapides Parish Police Jury has determined its existing apportionment is not equitable and, in accordance with the law, a new apportionm ent plan must be drawn, which plan shall be effective at the end of the term of the incumbent Police Jurors; and WHEREAS, it has been further determined that certain subdivisions of precinct boundaries will be required for the Rapides Parish Police Jury to create its reapportionment plan to meet applicable state and federal guidelines and hereby acts under the provisions of Louisiana Revised Statutes 18:532.1.D;

NOW, THEREFORE, BE IT ENACTED BY THE RAPIDES PARISH POLICE JURY:

SECTION 1. Rapides Parish is hereby redistricted into nine (9) Police Jury Districts, whose boundaries are described as follows, to be composed of the following precincts of Rapides Parish:

DISTRICT A

Precincts N6, N14A, N15, N16, N17, N18(A-K), N18(L-Z), N19(A-K), N19(L-Z), N20(A-K), N20(L-Z), N21.

DISTRICT B

Precincts N1, N2, N4, N5, N7, N8(A-K), N8(L-Z), N9, N10(A-K), N10(L-Z), N11, N13B, N29.

DISTRICT C

Precincts N12, N13A, N14B, N22, N23, N24(A-K), N24(L-Z), N25, N26(A-K), N26(L-Z), N27, N28.

DISTRICT D

Precincts N3, C1, C2, C3, C4(A-K), C4(L-Z), C7, C10, C11B, C15, C18.

DISTRICT E

Precincts C22, C23, C37(A-K), C37(L-Z), C38A, S1, S2, S4, S5, S6A, S7, S8, S9, S11, S14.

DISTRICT F

Precincts C5, C6, C8, C9, C20, C21(A-K), C21(L-Z), C24, C25, S15, S20.

DISTRICT G

Precincts C26, C30, C31, C32, C33, C34, C35, C36(A-K), C36(L-Z), C41, C42.

DISTRICT H

Precincts S10(A-K), S10(L-Z), S13, S16, S17, S18, S19, S21, S22, S23, S24, S25, S26, S27, S28, S29.

DISTRICT I

Precincts C11A, C13(A-K), C13(L-Z), C14, C17, C19, C27, C28, C38B, C39, C40, S6B.

All of the above -described districts are particularly shown on the map of Rapides Parish, which is marked "Exhibit A" and paraphed "Ne Varietur" as identification with this resolution.

SECTION 2. The Rapides Parish Police Jury shall be composed of nine (9) members with one (1) member being elected from each of the above described districts.

SECTION 3. This reapportionment and redistricting shall become effective at the end of the term of the incumbent officials, the first election under this Ordinance shall be at the next general election.

SECTION 4. This redistricting and reapportionment shall not affect existing tax or bonding districts, which tax and bond districts shall remain in full force and effect as otherwise provided by law.

BE IT FURTHER ORDAINED that the ordinances of the Rapides Parish Police Jury adopted on the 13th day of April, 1998, and as amended, are hereby amended and re -enacted to include the following five (5) additional precinct boundaries and to change or redefine the boundary description of certain precincts subdivided to accommodate reapportionment, as follows:

SECTION 1. In accordance with the provisions of the Louisiana Election Code, and in particular with Louisiana Revi sed Statutes Title 18 Section 532.1.D, the Police Jury of the Parish of Rapides does hereby amend, re -enact, establish and define or redefine the territorial limits of certain precincts within the Parish of Rapides, State of Louisiana, all boundaries being clearly observable and coinciding with visible features readily distinguishable on the ground as follows:

Rapides Parish Additional or Changed (Redefined) Precinct Boundaries Descriptions

All boundary lines follow the center line of said physical featu re, be it man -made or natural, unless otherwise stated.

Boundary directions follow the center line of the last said feature until the intersection of the center line of the next stated feature unless otherwise specified.

Precinct N13A (change)

Commence with the intersection of the west tributary of Bayou Maria and Donahue Ferry Road, northeast on Donahue Ferry Road to Fox Chase Drive, south to Holly Moore Drive, west to Sweetwater Rim, south to Susek Drive, west to Edgewood Drive, northwest to Iris Park Drive, west to the western tributary of Bayou Maria, north to Donahue Ferry Road which is the point of beginning.

Precinct N13B (additional)

Commence with the intersection of Pinehurst Drive and Susek Drive, west on Susek Drive to Sweetwater Rim, north to Holly Moore Drive, east to Fox Chase Drive, north to Donahue Ferry Road, east to Pinehurst Drive, southeast to Susek Drive which is the point of beginning.

Precinct N14A (change)

Commence with the intersection of US Hwy 165 and LA Hwy 116 (Esler Field Road), east on LA Hwy 116 (Esler Field Road) to a powerline right -of-way near the rear of the Walmart Super Center, southwest (and parallel to Lorelei Street) to Pinecrest Drive, east approximately 83 feet to an unimproved right -of-way, south to a minor d rainage feature, southeast to the eastern tributary of Bayou Maria, southeast to Donahue Ferry Road, southwest to Cottingham Expressway, north to US Hwy 165, northeast to LA Hwy 116 (Esler Field Road) which is the point of beginning.

Commence with the intersection of LA Hwy 116 (Esler Field Road) and Donahue Ferry Road, south on Donahue Ferry Road to the eastern tributary of Bayou Maria near Leonard Drive, northwest to a minor drainage feature near Ann Street, northwest to an un improved right-of-way, north to Pinecrest Drive, west approximately 83 feet to a powerline right-of-way, northeast (and parallel to Lorelei Street) to LA Hwy 116 (Esler Field Road), east to Donahue Ferry Road which is the point of beginning.

Precinct C38A (change)

Commence with the intersection of Vandenburg Drive and Bayou Rapides Road, east on Bayou Rapides Road to Ball Lane, southwest to Cloverleaf Boulevard, south to Coliseum Boulevard, west to Vandenburg Drive, north to Bayou Rapides Road which is the point of beginning.

Precinct C38B (additional)

Commence with the intersection of Coliseum Boulevard and Cloverleaf Boulevard, north on Cloverleaf Boulevard to Ball Lane, northeast to Bayou Rapides Road, north to Vandenburg Drive, north to Bayou Rapides , east to MacArthur Drive, south to Coliseum Boulevard, west to Cloverleaf Boulevard which is the point of beginning.

Precinct S6A (change)

Commence with the intersection of Saline Bayou and I -49, east on I -49 to Rapides Station Road, south to LA Hwy 1, east to Moss Point Drive, south to Christine Drive, west to Moss Point Drive, east to Jimmy Brown Road, south to Bayou Rapides, south to LA Hwy 496, west to LA Hwy 1202, north to Saline Bayou, north to I - 49 which is the point of beginning.

Precinct S6B (additional)

Commence with the headwater of Saline Bayou and Red River, east Red River to unnamed levee road splitting Section 16 and 17, T5NR2W, south to Old Boyce Road, east to Big Bayou, south to Jimmy Brown Road, north to Moss Point Drive, west to Chris tine Drive, north to Moss Point Drive, north to LA Hwy 1, west to Rapides Station Road, north to I -49, west to the headwater of Saline Bayou, north to the Red River which is the point of beginning.

Precinct C11A (change)

Commence with the intersection of Bayou Rapides and Bolton Avenue, northwest on Bolton Avenue to Industrial Park Site Road, north approximately 1300 feet to an unnamed road, northwest to the Red River, east to US Hwy 71/165, west to the Missouri Pacific Railroad, southeast to Bayou Rapide s, southwest to Bolton Avenue which is the point of beginning.

Precinct C11B (additional)

Commence with the intersection of Bolton Avenue and Bayou Rapides, northeast on Bayou Rapides to the Missouri Pacific Railroad, southeast to Park Avenue, southwest to Bolton Avenue, northwest to Bayou Rapides which is the point of beginning.

SECTION 2. In all other respects the precinct boundaries descriptions previously established shall remain unchanged.

SECTION 3. The precincts established by this ordinance shall be effective for the following purposes at the following times:

  • (1) on or after August 29, 2011 for the purpose of apportionment of elected officials and governing bodies.
  • (2) not later than December 31, 2011 for all purposes, subject to precl earance by the U.S. Department of Justice.

SECTION 4. This reapportionment of the Rapides Parish Police Jury shall be effective at the end of the term of the incumbent Police Jurors.

SECTION 5. That a certified copy of this resolution, together with other showings required by Section 5 of the Voting Rights Act of 1965 and Regulations pertaining thereto (29 C.F.R. 51.22) be submitted to the United States Attorney General for approval in compliance with the said Voting Rights Act.

SECTION 6. A certified copy of this ordinance for a reapportionment plan shall be sent to the Secretary of State, the Commissioner of Elections, the Secretary of the Senate, the Clerk of the House of Representatives and the Registrar of Voters in accordance with LARS 18:532.1.D(2)(c).

This Ordinance, having been presented, and having been submitted to a vote, the vote thereon was as follows: YEAS: Richard W. Billings, John "Buck" Lincecum, Joe Bishop, Theodore Fountaine Jr., Richard Vanderlick, Oliver "Ollie" Overton Jr., Steve Coco and Scott Perry Jr. NAYS: None. ABSENT AND NOT VOTING: Jamie L. Floyd. And the ordinance was declared adopted on this 13th day of May, 2011 and amended on this 25th day of May, 2011.

On motion by Mr. Joe Bishop, seconded by Mr. Buck Lincecum, that there being no further business, the meeting be declared adjourned. On vote the motion carried at 10:00 a.m
