The Police Jury of the Parish of Rapides, State of Louisiana, met in Regular Session at its regular meeting place, the Police Jury Room of the Parish Courthouse, 701 Murray Street, Alexandria, Louisiana, on Monday, May 9, 2011, at three (3:00) o'clock p.m. (Central Standard Time).
and Police Jurors John "Buck" Lincecum, Joe Bishop, Richard Gerald Vanderlick, Oliver "Ollie" Overton Jr., Theodore Fountaine Jr., Steve Coco and Scott Perry Jr.
Also present were Mr. Tim Ware, Treasurer; Ms. Donna Andries, Sales and Use Tax Director; Mr. Dennis Woodward, Public Works Director; Mr. Sh ane Trapp, Courthouse Building Superintendent; Ms. Linda Sanders, Civil Service Director; Chief Randy McCain, Fire District No. 2; Ms. Sonya Wiley -Gremillion, OHSEP Director; Mr. Thomas O. Wells, Legal Counsel; and Ms. Angie Richmond, Secretary.
The invocation was given by Mr. Theodore Fountaine.
The Pledge of Allegiance was led by Mr. Richard Vanderlick.
The Police Jury of the Parish of Rapides, State of Louisiana, was duly convened as the governing authority of said Parish by Hon. Richard Billing s, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.
The President asked if there was any Public Comment on any Agenda Item. Ms. Carolyn Vaughn, citizen, said she would like to speak on Agenda Item No. 27, the Silver Pines Subdivision ditch.
On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on April 11, 2011, as published in the Official Jou rnal. On vote the motion carried.
On motion by Mr. Joe Bishop, seconded by Mr. Jamie Floyd and Mr. Scott Perry, that approved bills be paid. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick and Mr. Jamie Floyd, to accept the Treasurer's Report. On vote the motion carried.
Mr. Joe Bishop laid over the appointment to the Esler Industrial Development Area Advisory Board, representing District B, for a five year term to fill the expired term of the late May or Fred Baden, representing District B, term expired on January 8, 2011.
Mr. Ollie Overton laid over the appointment to the Fire District No. 3 Civil Service Board to fill vacancy in an unexpired term created by the resignation of Ms. Wanda Simpson, nom inee of Louisiana College, term will expire on November 8, 2013, until a nomination is received from Louisiana College.
Mr. Buck Lincecum laid over the appointment to the Civil Service Board for a three year term to fill the expiring term of Mr. Michael P. Shamblin, nominee of Louisiana College, term will expire on April 14, 2011, until a nomination is received from Louisiana College.
On motion by Mr. Joe Bishop, seconded by Mr. Theodore Fountaine, to announce the following appointments to be made at the next meeting to: Waterworks District No. 11A Board for a five year term to fill the expiring term of Mr. David C. Bates, term will expire on July 8, 2011; Library Board for a five year term to fill the expiring term of Ms. Mary Ann Heath, represent ing District H, term will expire on July 10, 2011; Coliseum Authority for a five year term to fill the expiring term of Mr. James H. Rachal, representing District B, term will expire on July 16, 2011; and AICUZ Appeal Board for a three year term to fill the expiring term of Mr. Lewell "Bud" Breithaupt, nominee of the Chamber of Commerce, term will expire on July 24, 2011.
On motion by Mr. Jamie Floyd, seconded by Mr. Buck Lincecum, to waive the thirty day announcement rule and reappoint Mr. David C. Ba tes to the Waterworks District No. 11A Board for a five year term, term will expire on July 8, 2016. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Buck Lincecum, to waive the thirty day announcement rule and reappoint Ms. M ary Ann Heath to the Library Board, representing District H, for a five year term, term will expire on July 10, 2016. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to waive the thirty day announcement rule and reappoint Mr. James H. Rachal to the Coliseum Authority, representing District B, for a five year term, term will expire on July 16, 2016. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Joe Bishop and Mr. Richard Vande rlick, to present a plaque to Ms. Cathy Norris, Secretary of the Year. On vote the motion carried.
Mr. Richard Billings presented the plaque to Ms. Norris.
On motion by Mr. Joe Bishop, seconded by Mr. Jamie Floyd, to open for a Public Hearing for th e purpose of taking written and oral comment from the public concerning the proposed reapportionment plan for the Rapides Parish Police Jury, as recommended by the Registrar of Voters. On vote the motion carried.
Mr. John Miller, Executive Director of t he Rapides Area Planning Commission, presented the proposed reapportionment plan for the Rapides Parish Police Jury through powerpoint. He reviewed the first chart, the impact of the population figures reported from the 2010 Census on the existing Police J ury Districts and under the proposed plan the reallocation of that population per District within 5%, the median population per District of the nine being 14,624. Mr. Miller then reviewed the nine elements of the Reapportionment Criteria. He advised four precinct splits would be necessary to implement the proposed plan. He briefly reviewed the maps containing the major change and the precinct splits. In summary, he said the proposed plan looked good statistically.
The President asked if there was any p ublic comment, to which there was no response. He noted a public hearing would be held on Friday, May 13, 2011 at 10:00 a.m. in the Police Jury Meeting Room.
On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, Mr. Scott Perry and Mr. Bu ck Lincecum, that there being no one else who wished to be heard, the public hearing be declared closed. On vote the motion carried.
On motion by Mr. Joe Bishop, seconded by Mr. Buck Lincecum, to present plaques to the Oak Hill Lady Rams Softball Team, who won State Championship. On vote the motion carried.
Mr. Richard Billings and Mr. Richard Vanderlick presented the plaques.
On motion by Mr. Joe Bishop, seconded by Mr. Jamie Floyd, to add the following item to the agenda.

On motion by Mr. Ollie Overton, seconded by Mr. Buck Lincecum, to congratulate the Peabody Magnet Warhorses Powerlifting Team for winning the 4 -AAAA Runner Ups and 2011 Junior National Champions and authorize presentation of plaques. On vote the motion carried.
Mr. Theodore Fountaine and Mr. Ollie Overton, presented the plaques.
On motion by Mr. Ollie Overton, seconded by Mr. Joe Bishop and Mr. Theodore Fountaine, to conduct a public hearing to obtain views on housing and community development needs, discuss the submission of an application for funding under the Louisiana FY 2012- 2013 Community Development Block Grant Program (LCDBG) and conduct a seminar to better inform its citizens of the Fair Housing Program. On vote the motion carried.
Mr. Kendall Magee, Consultant Administrator, distributed a fact sheet on the Louisiana Community Development Block Grant Program, FY 2012- 2013, which provided information on Program Guidelines, Application Rating Criteria, Assurance of Matching Funds, Assurance of Maintenance of Improv ements Constructed under CDBG, and a Schedule of the Application Process. He advised that funding for the FY 2011 Program has been delayed and hopefully by the end of the month, it would be known if the Air Base Road Sewer Improvement Project would be funded. He reviewed the type of activities that could be undertaken under the CDBG Program and suggested continuance of the Air Base Road Sewer Improvements Project (if not funded in FY 2011) and an application for the Henry Street Sewer Improvement Project.
On motion by Mr. Theodore Fountaine, seconded by Mr. Ollie Overton, that there being no one else who wished to be heard, the public hearing be declared closed. On vote the motion carried at 4:04 p.m.
On motion by Mr. Scott Perry, seconded by Mr. Jamie Floyd, to select the Air Base Road and the Henry Street sewer improvement projects as the next applications for LCDBG Funding. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to accept the Secretary's Report. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, that the tax rates for 2011 be levied as per the following items:
RESOLUTION LEVYING TAX FOR PAROCHIAL EXPENSES
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that there is hereby levied on all property in the Parish of Rapides, Louisiana, for the year 2011 subject to taxation in the said Parish of Rapides, Louisiana, a tax of 3.90 mills on the dol lar for the purpose of meeting the General parochial expenses of the Parish of Rapides, Louisiana.
BE IT FURTHER RESOLVED that according to Section 26, Article 6 of the Constitution of 1974, there is hereby levied a tax of 1.95 mills on the dollar on al l property subject to taxation in the City of Alexandria, City of Pineville and the Town of Lecompte, for the year 2011, for the purpose of meeting the General parochial expenses of the Parish of Rapides, Louisiana.
BE IT FURTHER RESOLVED that the Asses sor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend the said assessments on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect sai d tax.
RESOLUTION LEVYING TAX TO MAINTAIN FIRE DISTRICT NO. 2
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held on January 20, 2001, there is hereby levied in Fire Protection Di strict No. 2 for the year 2011 on all property subject to taxation in said District a special tax of 15.52 mills on the dollar for the purpose of acquiring, constructing, improving, maintaining or operating fire protection facilities, vehicles and equipmen t, including both movable and immovable property, that are to be used to provide fire protection in the District.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN SERVICE AREA #1 OF FIRE DISTRICT NO. 2
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held on May 2, 2009, there is hereby levied in Service Area No. 1 of Fire Protection District No. 2 for the year 2011 on all property subject to taxation in s aid District a special tax of 16.31 mills on the dollar for the purpose of acquiring, constructing, improving, maintaining and operating fire protection facilities and equipment.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisia na, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN FIRE DISTRICT NO. 3
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 3 on January 17, 2004, there is hereby levied in Fire Protection District No. 3 of the Parish of Rapides, Louisiana, for the year 2011 on all property subject to taxation in said District a special tax of 13.21 mills on the dollar for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes within said District.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish o f Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN FIRE DISTRICT NO. 4
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 4 on July 19, 2008, there is hereby levied in Fire Protection District No. 4 of the Parish of Rapides, Louisiana, for the year 2011 on all property subject to taxation in said Dis trict a special tax of 15.34 mills on the dollar for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN FIRE DISTRICT NO. 5
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 5 on January 17, 2004, there is hereby levied in F ire Protection District No. 5 of the Parish of Rapides, Louisiana, for the year 2011 on all property subject to taxation in said District a special tax of 40.00 mills on the dollar for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes in said District.

BE IT RESOLVED by the Police Jury of the Parish of Rapide s, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 6 on July 21, 2001, there is hereby levied a special tax of 20.02 mills on the dollar on all property subject to taxation in Fire Protection District No. 6 o f the Parish of Rapides, Louisiana, for the year 2011 for the purpose of acquiring, constructing, improving, maintaining or operating fire protection facilities, vehicles and equipment, including both movable and immovable property, that are to be used to provide fire protection in the District.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 7 on November 15, 2003, there is hereby levied a special tax of 26.00 mills on the dollar on all property subject to taxation in Fire Protection District No. 7 of the Parish of Rapides, Louisiana, for the year 2011 for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING ADDITIONAL TAX TO MAINTAIN FIRE DIST RICT NO. 7
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 7 on July 19, 2008, there is hereby levied an additional special tax of 14.24 mills on the dollar in Fire Protection District No. 7 of the Parish of Rapides, Louisiana, for the year 2011 for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN FIRE DISTRICT NO. 8
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held on November 17, 2001, there i s hereby levied in Fire Protection District No. 8 for the year 2011 on all property subject to taxation in said District a special tax of 44.28 mills on the dollar for the purpose of acquiring, constructing, improving, maintaining or operating fire protect ion facilities, vehicles and equipment, including both movable and immovable property, that are to be used to provide fire protection in the District.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 9 on July 15, 2006, there is hereby levied a special tax of 23.75 mills on the dollar in Fire Protectio n District No. 9 of the Parish of Rapides, Louisiana, for the year 2011 for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes.

BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 10 on July 16, 2005, there is hereby levied in Fire Protection District No. 10 of the Parish of Rapides, Louisiana, for the year 2011 on all property subject to taxation in said District a special tax of 21.28 mills on the dollar for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes in said District.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING ADDITIONAL TAX TO MAINTAIN FIRE DISTRICT NO. 10
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 10 on July 19, 2008, there is hereby levied an additional special tax of 20.00 mills on the dollar in Fire Protection District No. 10 of the Parish of Rapides, Louisiana, for the year 2011 for the purpose of acquiring, constructing, improving, maintaining or operating fire protection facilities, vehicles and equipment in the District.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN FIRE DISTRICT NO. 11
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 11 on October 4, 2003, there is hereby levied in Fire Protection District No. 11 of the Parish of Rapides, Louisiana, for the year 2011 on all property subject to taxation in said District a special tax of 31.09 mills on the dollar for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN SERVICE AREA #1 OF FIRE DISTRICT NO. 11
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held on October 4, 2003, there is hereby levied in Service Area No. 1 of Fire Protection District No. 11 for the year 2011 on all property subject to taxation in said District a sp ecial tax of 37.91 mills on the dollar for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes.

RESOLUTION LEVYING TAX TO MAINTAIN SERVICE AREA #2 OF FIRE DISTRICT NO. 11
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held on January 17, 2004, there is hereby levied in Service Area No. 2 of Fi re Protection District No. 11 for the year 2011 on all property subject to taxation in said District a special tax of 32.74 mills on the dollar for the purpose of constructing, operating and maintaining fire protection facilities and paying the costs of obtaining water for fire protection purposes.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN FIRE DISTRICT NO. 14
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held in Fire Protection District No. 14 on January 20, 2001, there is hereby levied in Fire Protection District No. 14 of the Parish of Rapides, Louisiana, for the year 2011 on all property subject to taxation in said District a special tax of 21. 93 mills on the dollar for the purpose of acquiring, constructing, improving, maintaining or operating fire protection facilities, vehicles and equipment, including both movable and immovable property, that are to be used to provide fire protection in the District.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN A JUVENILE COMMUNITY CORRECTION CENTER AND A JUVENILE DETENTION HOME
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held on April 17, 2004, there is hereby levied throughout the Parish of Rapides for the year 2011 on all property subject to taxation in said Parish of Rapides, Louisiana, a tax of 2.00 mills on the dollar for the purpose of continued construction and maintenance and operating expenses of the Juvenile Community Correction Center, Juvenile Detention Center, Juvenile Home Care and Juvenile Shelter Care Center known as "RENAISSANCE" in and for the Parish.
BE IT FURTHER RESOLVED that th e Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect s aid tax.
RESOLUTION LEVYING TAX TO MAINTAIN ROAD DISTRICT 1A
BE IT RESOLVED by the Police Jury of the Parish of Rapides, Louisiana, in legal session convened, that as per election held on November 15, 2003, there is hereby levied in Road District No. 1A of the Parish of Rapides, Louisiana, on all property subject to taxation for the year 2011, a special tax of 22.82 mills on the dollar for the purpose of maintaining and keeping in repair the public roads, highways and bridges within said District.
BE IT FURTHER RESOLVED that the Assessor of the Parish of Rapides, Louisiana, is hereby authorized and directed to extend said assessment on the assessment rolls of the Parish of Rapides, Louisiana, for the year 2011, and the Tax Collector is hereby authorized and directed to collect said tax.
RESOLUTION LEVYING TAX TO MAINTAIN ROAD DISTRICT 2C

SECTION I
WHEREAS, the Parish of Rapides has been afforded the opportunity to participate in the L ouisiana Community Development Block Grant (LCDBG) Disaster Recovery Program administered by the Louisiana Office of Community Development Disaster Recovery Unit under the Economic Resiliency Program for the Diversion Canal Project; and, WHEREAS, the pro jects to be applied for under the CDBG Disaster Recovery Program will require consultants; and, WHEREAS, the Program requires that a procurement process be established by the Parish of Rapides; and, WHEREAS, the procurement process requires a selection committee to be designated to review and recommend to the Parish the professional firm most qualified to perform the duties as required.
All responses to the proposal will be evaluated according to the following criteria and corresponding numerical rating system. The maximum number of points is 100. The proposals will be evaluated on the basis of written materials. Sufficient information must be included in the proposal to assure the correct rating. Incomplete or incorrect information may result in a lower evaluation.

- Consideration can be given to the number and types of local government proposers have worked with in the past. 10 pts.
- Consideration can be given to the number of CDBG projects proposers have completed relevant to the DR proposal. 5 pts.
- Consideration can be given to the diversity of types of programs (housing, public facilities, economic development) proposer has conducted in the past. 5 pts.

The Rapides Parish Police Jury shall authorize proposers, if requested, to identify past or current contracts that are similar in nature to the propo sal and to provide information on problems encountered on the identified contracts and the proposer corrective actions. In the case of proposer(s) without a record of relevant past performance or for whom information on past performance is not available, the proposer may not be evaluated favorably or unfavorably on past performance.

The selection of the finalists to be interviewed, if any is required, will be based on an evaluation of the written responses. WHEREAS, the Parish of Rapides has been afforded the opportunity to participate in the Louisiana Community Development Block Grant (LCDBG) Disaster Recovery Program administered by the Louisiana Office of Community Development Disaster Recovery Unit under the Economic Resiliency Program for the Diversion Canal Project; and, WHEREAS, it is necessary under the program regulations to authorize certain actions and individuals to perform certain designated functions by the State of Louisiana; and, WHEREAS, the project to be applied for under the LCDBG Disaster Recovery Program will require the procurement of engineering services for the Diversion Canal project in Rapides Parish; and, WHEREAS, the procurement process requires a selection committee to be designated to review and recommend to the Rapides Parish Police Jury the professional firm(s) most qualified to perform the duties as required.
NOW, THEREFORE, BE IT RESOLVED that the Pa rish of Rapides, as legal recipient of the LCDBG Disaster Recovery Program funds, does hereby appoint the following persons as the LCDBG Disaster Recovery Program Professional Services Selection Committee: Grants Committee Chairman, Treasurer, Public Work s Director, Police Jury President, the Police Juror(s) of the District in which the project is located and a member from the Red River, Atchafalaya, Bayou Boeuf Levee District
BE IT FURTHER RESOLVED by the Parish of Rapides that the attached point system for engineering services be used as the basis for selecting these services for each LCDBG Disaster Recovery Program project; BE IT ALSO RESOLVED that the selection of engineering services be advertised one time in the Official Journal and the selection be scheduled for June 13, 2011. In the event of a tie, oral interviews will be held with those firms. As a result of the interviews, the Rapides Parish Police Jury will determine which firm will be selected to enter int o contract negotiations. Unsuccessful firms will be notified as soon as possible. On vote the motion carried.
Motion by Mr. Theodore Fountaine, seconded by Mr. Buck Lincecum, Mr. Joe Bishop and Mr. Jamie Floyd, to authorize the President to sign an Inte rgovernmental Agreement with the Red River, Atchafalaya, Bayou Boeuf Levee District for the Police Jury to manage the Diversion Canal Project.
Mr. Tom Wells, Legal Counsel, advised it appeared this project might be able to be included under the original intergovernmental agreement with the Levee Board and the City of Pineville and asked the Police Jury to acknowledge the matter instead.
On substitute motion by Mr. Buck Lincecum, seconded by Mr. Ollie Overton, to acknowledge the authority of the Presid ent that the current Intergovernmental Agreement with the Levee Board and the City of Pineville will include the Diversion Canal Project.
On vote the substitute motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, the f ollowing resolution was presented, a resolution requesting approval to use CDBG Funds in the urgent need for construction of improvements to the Diversion Canal, maximizing benefits to the community through recovery efforts, under the Disaster Recovery Proposal for the citizens of Rapides Parish, and on vote unanimously adopted:
RESOLUTION
WHEREAS, the Office of Community Development has made available funding through the Economic Relisency Program that will assist local governments impacted by hurricane Gustav in completing construction/renovation projects with costs that are FEMA-reimbursement ineligible, and
WHEREAS, the Rapides Parish Police Jury is currently preparing to assist the Red River Atchafalaya and Bayou Boeuf Levee District to make improv ements to the Diversion Canal to assist farmers in Rapides, Avoyelles, St. Landry and Evangeline Parishes in irrigating their crops with Red River water, which is not eligible for FEMA reimbursement, and
WHEREAS, such construction is directly correlated to the Disaster Recovery Proposal for the citizens of Rapides Parish, and
WHEREAS, the proposed construction project at this point is one of "urgent need" due to the fact that the Rapides Parish Police Jury nor the Red River Atchafalaya and Bayou Boeuf L evee District does not have sufficient local funds to finance the prepared costs of the project and will alleviate economic health and safety issues for the citizens of Rapides Parish.
THEREFORE, BE IT RESOLVED by the Rapides Parish Police Jury in regula r session duly convened on this 9th day of May, 2011, it does hereby request approval to use CDBG funds in the construction of improvements to the Diversion Canal, thereby maximizing benefits to the community through our recovery efforts. THEREUPON, the above resolution was duly adopted.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to approve Change Order No. 2 with Pat Williams Construction Inc. for the Courthouse Window Replacement and Lighting Efficiency Upgrade Project No. EEA-1038 for a construction change directive to increase the Contract Time by an additional thirty - five (35) days, as recommended by Barron, Heinberg and Brocato, Project Engineer, and authorize the President to sign all necessary documents. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to set a policy that when a subject matter is defeated twice at a Police Jury meeting, it can only be brought back by the prevailing side or in a case of an extreme emergency before the Police Jury until a six month period has passed. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, the following resolution was presented and on vote unanimously adopted: RESOLUTION
WHEREAS, the Louisiana Aviation Trust Fund was created to support safe and efficient aviation in the State of Louisiana with taxes levied on aviation fuel; and, WHEREAS, the bulk of the funds of the Louisiana Aviation Trust has historically been used to support the construction of safe, effective and efficient infrastructure at commercial and general aviation airports; and, WHEREAS, the Louisiana Aviation Trust Fund has been critical in attracting Federal Aviation Administration safe, effective and efficient infr astructure projects (95/5) that have created thousands of jobs for Louisiana citizens; and, WHEREAS, the Louisiana Aviation Trust Fund has provided additional funds to airports to construct non or partially funded FAA safe, effective and efficient infrast ructure projects also resulting in large number of jobs for Louisiana citizens; and, WHEREAS, the safety, effectiveness and efficiency of Louisiana aviation infrastructure has been greatly improved by the funding and orderly disposition of those funds th rough the Aviation Priority Program; and, WHEREAS, it has been brought to the attention of the Rapides Parish Police Jury by the England Authority that it has been proposed under House Bill No. 302 to reduce the allocation of the Aviation Trust Fund in order to provide 50% of the vital job creating funds dedicated to commercial airport infrastructure to subsidize airline service at the request of the Baton Rouge Chamber of Commerce; NOW, THEREFORE, BE IT RESOLVED that the Rapides Parish Police Jury does hereby oppose House Bill No. 302 which proposes to take 50% of construction money from the Aviation Trust Fund dedicated to commercial airports for reallocation to airline service subsidies requested by the Baton Rouge Chamber of Commerce, BE IT FURTHER RESOLVED that a copy of this resolution to be sent to our Louisiana Legislative Delegation asking them to oppose this Bill or any variation thereof. THUS PASSED AND APPROVED on this 9th day of May, 2011.

On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to grant a 5% cost of living salary increase for paid employees of Rapides Parish Fire Protection District No. 11 employees, effective July 1, 2011, as requested by the Spring Creek Volunteer Fire Department, to be paid out of Fire Protection District No. 11 Funds. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to authorize to purchase a Class A Fire Pumper from Bonaventure Co., Inc. (Rosenbauer America, LLC) under Louisiana State Contract No. 408237 in an amount not to exceed $340,000 (Base Amount plus options), as reque sted by Holiday Village Fire Department Board of Directors to be paid from Fire District No. 4 Funds as budgeted. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to adopt the Parish Hazard Mitigation Plan Update, as required by FEMA every five years, to maintain eligibility for HMGP Funding, current HMP expires May 13, 2011: Rapides Parish A RESOLUTION ADOPTING THE PARISH - WIDE HAZARD MITIGATION PLAN
WHEREAS, the Rapides Parish Police Jury has received grant funds from the Federal Emergency Management Agency, through the Governors Office of Homela nd Security and Emergency Preparedness, for the update of a hazard mitigation plan; and,
WHEREAS, the Parish of Rapides has participated in the process to prepare a DMA compliant Hazard Mitigation Plan based on the FEMA guidance available in the How to Guides; and,
WHEREAS, the Parish of Rapides wishes to participate in the Hazard Mitigation Plan Update prepared by the Rapides Parish government under the oversight of a Steering Committee comprised of Parishwide representatives; and,
WHEREAS, Rapides Parish and local city representatives and governments have participated in the mitigation planning process; and,
WHEREAS, appropriate opportunity for input by public and community officials has been provided through press releases, open meetings and availability of draft documents; and,
WHEREAS, the updated Plan has been recommended for adoption by the Steering Committee; and,
WHEREAS, adoption of the Updated Plan is required prior to further consideration for FEMA funding under the following programs:
- Pre-Disaster Mitigation
- Hazard Mitigation Grant Program
- Flood Mitigation Assistance Program
- Severe Repetitive Loss
- Repetitive Flood Claims
Therefore, Be It Resolved, that Rapides Parish, through the governing authority of the Rapides Parish Police Jury, does hereby adopt the Rapides Parish Hazard Mitigation Plan Update on this 9th day of May, 2011. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to call for a public hearing o n a proposed reapportionment plan for the Rapides Parish Police Jury to be held on Friday, May 13, 2011, at 10:00 a.m. and to ratify publication of the Notice of Public Hearing in the Official Journal, to be paid out of the General Fund. On vote the motion carried.
On motion by Mr. Richard Vanderlick, seconded by Mr. Ollie Overton, to refer to Legal Counsel and the Public Works Director for a recommendation on the proposed acceptance of approximately 400 feet of a rural road (unnamed) off the Trulley White Road for Parish Maintenance. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to authorize to enter into an intergovernmental agreement with the City of Pineville for the striping of the entire length of Stilley Road and installation of reflectors, contingent upon a request from Pineville, part of Stilley Road is within corporate limits, work on the portion outside corporate limits to be paid from Road District No. 9B (District B) Funds, and authorize the President to sign same, and to authorize to negotiate a contract for the work. On vote the motion carried.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to accept the Contract with Monument Roofing Systems for the Reroofing of the Main Library (411 Washington Street) as Substantially Complete, as recommended by the Project Engineer and the Library Board of Control, and authorize the President to sign same. On vote the motion carried.
On motion by Mr. Jamie Floyd, seconded by Mr. Buck Lincecum, that due to the expected severe flooding from high waters in the Mississippi River that will force wildlife in the Saline area to higher ground in Rapides Parish as happened in 1973, the Rapides Parish Police Jury requests the Louisiana Wil dlife and Fisheries to double its fines for hunting violations over the next couple of months, copy of this request to be sent to Avoyelles, Catahoula and LaSalle Parishes urging them to join in this effort. On vote the motion carried.
On motion by Mr. Theodore Fountaine, seconded by Mr. Buck Lincecum, to add the following items to the agenda.

Motion by Mr. Joe Bishop, seconded by Mr. Richard Vanderlick, to authorize to enter into a cooperative endeavor with Cleco and the Rapides Area Planning Commissio n on the project to install approximately 30,000 digital electrical meters, to waive the building code permit requirements and inspection fee, the Planning Commission to provide inspectors and guarantee a certain response time, and authorize the President to sign same upon approval of the agreement by Legal Counsel.
Mr. Tom Wells, Legal Counsel, advised this matter was being worked out internally, no action required by the Police Jury at this time.
The motion was withdrawn from the floor and no vote taken.
Motion by Mr. Buck Lincecum, seconded by Mr. Ollie Overton, to discuss and address whether the residents isolated due to the burnt Rigolette Road Bridge emergency will be able to continue to use the access across the Levee during the State of Emergency of impending high waters. (No vote was taken on the motion.)
Mr. Lincecum said the residents were concerned whether they would have access. Mr. Billings stated he understood the Red River is not expected to experience flooding but if there was a threat, Homeland Security would give adequate warning to evacuate.
On motion by Mr. Ollie Overton, seconded by Mr. Richard Vanderlick, to ratify authorization for the President to sign for acceptance of additional 10% ARRA funding totalling $15,000 to be used for any allowable expenditure in accordance with ARRA and WIA. These funds will be used by the Rapides Business and Career Solutions Center to provide case management to participants who have been entered into scholarship training and/or On-Job-Training in accordance with ARRA and WIA guidelines. On vote the motion carried.
