PROCEEDINGS OF THE COUNCIL OF THE CITY OF ALEXANDRIA, STATE OF LOUISIANA, TAKEN AT A REGULAR MEETING HELD ON MAY 6, The Council of the City of Alexandria, Louisiana, met in a regularly scheduled meeting session in the City Council Chambers, on Tuesday, May 6, 2025 at 5:35 P.M. Those present were the Honorable Cynthia Perry, Gary Johnson, Lizzie Felter, Jules Green, Chuck Fowler, Jim Villard and Malcolm Larvadain. Also present were Mayor Roy, City Attorney Jonathon Goins and Council Staff. The Council of the City of Alexandria, State of Louisiana was duly convened as the governing authority of said City by the Honorable Cynthia Perry, who stated that the Council was ready for the transaction of business. The invocation was pronounced by Mr. Green and the Pledge of Allegiance was led by Mr. Johnson.

APPROVAL OF MINUTES

On a motion of Mr. Villard and seconded by Mr. Fowler the minutes taken from a regular Council Meeting held on April 22, 2025 were unanimously approved by the Council.

CONSENT CALENDAR

The Council next read all items found under the heading Consent Calendar and assigned them to committees.

Mr. Fowler moved for the introduction of all items appearing under the heading Consent Calendar. Mr. Johnson seconded the motion. It was unanimously carried by the Council. Bids were received for gas meters and Itron ERTS.

The above bid was referred to the Mayor and appropriate committee for tabulation and recommendation. ABANDONED AND BLIGHTED PROPERTY; ADJUDICATION AND ENFORCEMENT Secs. 7- 225- 7- 230. - Reserved. Sec. 7-231. Definitions. The following words, terms, and phrases, when used in this article, shall have the meanings ascribed to them, except where the context clearly indicates a different meaning. Code violation means a violation of any provision of the Code of Ordinances, City of Alexandria related to blighted property, abandoned property, public health, housing, fire prevention, or the environment. Order, judgment or notice ofjudgment means an administrative act of the hearing officer. Violator means person( s), natural or juridical, who has been found liable and/ or guilty of a Code violation and/ or ordered to abate or correct a violation in an order issued under this article. For the purposes of this article, " housing violations" shall include conditions in privately owned structures which are determined to constitute a threat or danger to the public health, safety or welfare or to the environment, regardless of whether those structures are residential or commercial in nature. Blighted property means commercial or residential premises, including lots, which are vacant, uninhabitable, and hazardous and because of their physical condition, are considered hazardous to persons or property, as provided in La. R. S. 33: 1374( B). For purposes of this section, abandoned property means property that is vacant or not lawfully occupied/ unoccupied. Vacant or not lawfully occupied properties shall include but shall not be limited to any premises which are not actually occupied by its owner, lessee, or other invitee or if occupied, without utilities, and which has been left unsecured or inadequately secured from unauthorized entry to the extent that the premises could be entered and utilized by vagrants or other uninvited persons as a place of harborage or any premises which by reason of dilapidation, deterioration, state of disrepair, or other such status is otherwise detrimental to or endangers the public safety, health, or welfare, as provided in La. R. S. 33: 4720. 59( 0)( 2). Sec. 7- 232. Blighted Property Unlawful. It shall be unlawful for any immovable property to be kept in a condition that is blighted or in a state of disrepair such that it presents a hazard and danger to public safety, health, welfare, or the environment. For the purposes of this article, when applicable, multiple violators may be held solidarily liable for the condition of a property. Sec. 7- 233. Authorization. The Planning Division, Fire Department, or any other agency having a responsibility for the enforcement of the code violation( s) at issue may enforce violations of such ordinances by the owners of immovable property or their agents, lessees, or representatives, pursuant to the procedures and authority for administrative adjudication established in this article, the Home Rule Charter, and Louisiana state law, including La. R. S. 13: 2575 and 13: 2576. Page 1of6 Sec. 7- 234. Appointment of hearing officer.

• a) Administrative adjudication proceedings under this article shall be conducted before a hearing officer who has been licensed to practice law in Louisiana for at least two( 2) years.
• b) Hearing officers may be an officer or employee of the Legal Division or an independent contractor.
• c) Hearing officers shall be sworn before the city attorney to uphold the Constitution, the laws and constitution of the State of Louisiana, and the Home Rule Charter and ordinances of the City of Alexandria. Sec. 7- 235. Authority of hearing officer. Hearing officers who have been appointed and sworn in accordance with section 7- 234 shall have the authority to hear and decide any and all Code violations related to blighted property, abandoned property, public health, housing, fire prevention, or the environment. Sec. 7- 236. Powers of a hearing officer. The hearing officer shall have the power to:
• a) Administer oaths and affirmations.
• b) Issue orders compelling the attendance of witnesses, respondents, alleged violators, and violators and the production of documents.
• c) Determine whether or not an alleged violator is liable for code violations.
• d) Levy fines, fees, penalties, and hearing costs.
• e) Order violators to correct violations within a stipulated time.
• f) Take any and/ or all necessary and lawful measures to effect corrections of the violation if the violator fails to do so within the time allocated by the hearing officer.
• g) Record orders, judgments, notices of judgments, or liens in the mortgage records for Rapides Parish. Sec. 7- 237. Procedure for hearing.
• a) A notice of violation shall:

1. Be in writing;
2. Provide the municipal address of the cited property;
3. Provide the date of the inspection;
4. Provide notice of alleged Code violation( s) at the cited property;
5. Provide the mailing address and telephone number of the enforcement agency;
6. Provide the time, date and location of the administrative hearing whereby the alleged Code violation shall be adjudicated;
7. Provide notice that the failure to appear at the hearing shall be considered an admission of liability for the alleged violation( s);
8. Provide the risk of fees, penalties, costs, and liens that may be imposed for continued violation( s), including the risk of daily fines; and
9. Provide the risk of remedial measures that may be ordered by a hearing officer to correct or abate Code violation( s);
10. An explanation that the hearing is for the purpose of making a determination whether the subject property is blighted or abandoned, where applicable.

• b) Proper notice must be given in advance of an administrative hearing, as follows:

1. Prior to holding an administrative hearing for public health, housing, fire code, or environmental violations, the alleged violator shall be notified at least fifteen( 15) days in advance of the date that such a hearing is scheduled. Notice shall be sent by certified or registered United States mail or personally served on the alleged violator at the address for the property owner( s) as listed in the Rapides Parish Assessor' s Office.
2. Prior to holding an administrative hearing for the determination of blight or abandonment of property, the city agency having enforcement responsibility shall notify the property owner( s) and additionally each mortgagee of record in the parish mortgage records at least thirty( 30) days in advance of the date of the administrative hearing. The notice shall be sent by certified or registered United States mail or personally served on the property owner( s) at the address listed in the assessor' s office of the Rapides Parish Assessor' s Office, and on each mortgagee of record at the address provided in the recorded mortgage. In addition to the notice requirements in section 7- 237( a), the notice must also include an explanation that the hearing is for the purpose of making a determination whether the subject property is blighted or abandoned.
3. If the administrative hearing involves a property whose purpose is primarily commercial, and the alleged violator( s) includes an occupant or lessee, notice may additionally be sent by certified or registered U. S. Mail to the address of the registered agent for the occupant or lessee listed with the Louisiana Secretary of State. Notice to the registered agent for the occupant or lessee shall be in addition to and not in place of notice to the property owner(s) and to each mortgagee of record, where applicable.
4. The date of the postmark shall be deemed to be the date of delivery. Any notification so sent and returned by the U. S. Post Office shall be considered as having fulfilled the notification requirement. Proof of notification and attempts at service shall be entered in the record for each case at the outset of the hearing.

• c) In addition to the notice provided in section 7- 237( b), a copy of the notice of violation shall be affixed in a prominent location on the property upon which violation( s) are alleged or, if safe access to the property is not reasonably practicable, on some prominent fixture on the adjacent public right-of-way as near as possible to the property at least five( 5) days in advance of the date of the hearing. It shall be unlawful for any person other than an agent of the city to remove a notice posted on the public right- of-way prior to the commencement of the hearing.
• d) Any person charged with Code violation( s) may present any relevant evidence and testimony at such hearing and may be represented by an attorney. An alleged violator' s physical presence shall not be required at the hearing if documentary evidence, duly verified by such person, is submitted to the hearing officer via the agency of the city having a responsibility for the enforcement the Code violation( s) prior to the date of the hearing. Nothing contained herein shall be construed to limit the authority or the ability of a hearing officer to determine an alleged violator' s liability based solely upon submitted documentary evidence.
• e) Any order compelling the attendance of witnesses or the production of documents may be enforced by Alexandria City Court or by any other court of competent jurisdiction.
• f) Any administrative adjudication hearing held under the provisions of this article shall be conducted in accordance with the rules of evidence of the Louisiana Administrative Procedure Act, La. R. S. 49: 956. Testimony of any person shall be taken under oath and shall be recorded.
• g) At an initial hearing, the hearing officer may adjudicate the violation(s) or continue and reset the hearing to allow the alleged violator( s) additional time to come into compliance. Such setting of a subsequent hearing date during the initial hearing shall constitute proper notice as to any party present. If it is determined at a subsequent hearing that substantial progress toward remediating the violation( s) has not been met, the hearing officer may assess daily fines accruing from no earlier than the date of the initial hearing. The hearing officer may continue to assess daily fines until the hearing officer determines that the violation(s) have been remediated, as may be determined in subsequent hearings or through verified documentary evidence.
• h) The hearing officer shall issue a reset order, final order, judgment, or notice of judgment in writing within thirty( 30) days of a hearing, excluding legal holidays. A copy of the reset order, final order, judgment, or notice of judgment may be personally served to any party present on the day of the hearing, or it shall be sent to the violator and any property owner( s) by certified or registered U. S. mail within fourteen ( 14) days of issuance. The order, judgment, or notice of judgment shall:

1. Be signed by the hearing officer;
2. State whether or not the alleged violator is liable for each violation and any specific determinations thereto;
3. Provide the amount of fees, costs, and penalties assessed for each violation;
4. Provide the defects to be corrected and the extent by which each violation shall be corrected, repaired, and/ or abated;
5. Provide the reasonable period of time by which each violation shall be corrected, repaired and/ or abated;
6. Notify the violator(s) of their right to appeal and the amount of security required to stay enforcement pending an appeal;
7. Notify the violator that the city may act to abate violation( s) if the violator fails to act in accordance with the order, judgment, or notice of judgment, where applicable; and
8. An explanation of whether the hearing officer determined the subject property to be blighted or abandoned, where applicable.

• i) In addition to the notice requirements in section 7- 237( h), after a hearing to determine whether a property is blighted or abandoned, the hearing officer shall send the written final order, judgment, or notice of judgment to the property owner( s) and to each mortgagee of record in the manner provided for in section 7237( b)( 2), including an explanation of whether the hearing officer determined the subject property to be blighted or abandoned.
• j) The final order, judgment, or notice of judgment may additionally be sent to the occupant or lessee of a property whose primary purpose is commercial. Sec. 7- 238. Penalties.
• a) The penalty for each violation per day shall not exceed the monetary amount set in section 1- 8 of this Code. Penalties in this article shall not include imprisonment.
• b) Each day that violation( s) continue unabated after an initial hearing where a hearing officer has determined that a violation( s) exists may be deemed a separate offense and subject to daily fines. Sec. 7- 239. Costs.
• a) In addition to any fine or penalty, the hearing officer may assess reasonable administrative costs for conducting the hearing, not to exceed$ 250. 00.
• b) The amount of the hearing officer' s compensation shall not be dependent upon the outcome or disposition of any hearing. Sec. 7- 240. Appeal. Any property owner or mortgagee of record of property determined to be blighted or abandoned property, or any person determined by the hearing officer to be in violation of a public health, housing, fire code, or environmental ordinance, may appeal this determination to the 9th Judicial District Court for the Parish of Rapides. Such appeal shall be instituted by filing, within thirty( 30) calendar days of the postmark of hearing officer' s order, a petition with the clerk of court for the district court along with payment of such reasonable costs as may be required by the clerk. Service of notice of appeal under this subsection shall not stay the enforcement and collection of the judgment unless the person who files the appeal furnishes security prior to filing the appeal with the City Finance Division, which shall be authorized to accept such payments in the amount to be fixed by the hearing officer sufficient to assure satisfaction of the finding of the hearing officer relative to the fine, fee, penalty, and costs of the hearing. Sec. 7- 241. Liens.
• a) After the time and procedures have run for a final appeal the city shall have a lien and privilege against the immovable property in, on, or upon which violation(s) occurred. The lien and privilege shall secure all fines, fees, costs, and penalties that are assessed by the city and described in the order, judgment, or notice of judgment. The recordation of the order, judgment, or notice of judgment in the mortgage office of the parish shall constitute a lien and privilege against the land upon which violation( s) exists. Any lien and privilege recorded against an immoveable property under this article shall be included in the next annual ad valorem tax bill.
• b) The city, upon recordation of the order, judgment, notice of judgment, or lien, may:

1. Apply to the clerk of district court for issuance of a writ in accordance with Code of Civil Procedure Article 2253, under the authority of La. R. S. 13: 2575 and 13: 2576, upon describing with particularity the immovable property and the manner in which the writ is to be enforced; or
2. Institute a suit against the owner of record in any court of competent jurisdiction to enforce the order, judgment, notice of judgment, or lien.

• c) In order for the lien and privilege to arise, the order, judgment, notice of judgment or lien shall be final and not subject to appeal when recorded in the mortgage office and all appeal delays have elapsed.
• d) Any monies collected pursuant to a judicial sale shall be credited and applied in accordance with La. R. S. 13: 2575 and 13: 2576.
• e) The provisions of section 7- 241( b)( 1) shall not apply to the enforcement of a lien and privilege encumbering an occupied residential property with a valid homestead exemption. Sec. 7- 242. Enforcement of liens— Additional requirements.
• a) Only if property is unoccupied may the city institute legal proceedings to obtain a writ to cause the seizure and sale of a property with outstanding liens, pursuant to section 7- 241( b)( 1);
• b) Unoccupied properties that maintain a valid homestead per La. Const. art. VII,§§ 18( G)( 5) and 20( A)( 10) shall be exempt from this section upon presentation of a signed affidavit from the assessor or his designee, attesting that the owner is approved for an extension of the special assessment level. This affidavit shall be renewed annually. The owner shall also submit, along with the aforementioned affidavit, a copy of their annual affidavit of intent to return and reoccupy the homestead that is filed with the assessor as required by La. Const. art. VII,§ 20( A)( 10).
• c) Any person with a legally protected interest in a property must be provided notice that is reasonably calculated to apprise them of the seizure and upcoming sale of the property. Sec. 7- 243. Remedies not exclusive. The regulations, procedures, and remedies established by this chapter are nonexclusive and may be pursued independently of each other and in addition to other remedies provided by law. The city may enforce any order assessing fees, costs, and penalties, and/ or stipulating a required correction, repair, or abatement measure by any means provided by law. Sec. 7- 244. Recordkeeping.
• a) At its commencement by notice of violation, every adjudication proceeding shall be assigned a docket number and a style in the form of" City of Alexandria versus" followed by the name of the alleged violator( s). The records pertaining to each proceeding shall be maintained as a separate file in a manner similar to the fashion in which the clerks of court maintain the records of civil cases.
• b) Each agency charged with the enforcement of an ordinance within the scope of this article shall maintain a log or index of all adjudication proceedings which shall set forth information, including but not limited to the following:

1. The style and docket number of the case and the date it was commenced;
2. Alleged Code violation( s);
3. Date of the alleged violation( s);
4. Address or other description of the property upon which the alleged violation(s) exist or have occurred;
5. Date( s) of any hearings or continuances and, if the case is adjudicated, of its final disposition;
6. The outcome of any hearing and of any final order in the case, and whether and when any lien was filed;
7. The date of filing and disposition of any appeal. Sec. 7- 245. Transfer of ownership. It shall be unlawful for any property owner( s) to transfer a property that receives a notice of violation without notifying the enforcement agency of the city that sent said notice of violation. Enforcement of this provision shall be as provided by section 1- 8 of this Code. RS 13: 2575 CHAPTER 8- C. ADMINISTRATIVE ADJUDICATION OF PUBLIC HEALTH, HOUSING, FIRE CODE, ENVIRONMENTAL, AND HISTORIC DISTRICT VIOLATIONS 2575. Blighted or abandoned property; public health, housing, fire code, building code and certain other ordinance violations; administrative adjudication; procedure; appeal; penalties A.( 1) Any municipality or parish may prescribe civil fines for blighted property, abandoned property, or violation of public health, housing, fire code, environmental, and historic district ordinances in the municipality or parish by owners of immovable property, their agents, tenants, or representatives pursuant to the procedures for administrative adjudication provided in this Chapter. For the purposes of this Chapter, housing violations" shall encompass only those conditions in privately owned structures which are determined to constitute a threat or danger to the public health, safety or welfare, to the environment, or a historic district. In municipalities with a population of seventy thousand or more according to the latest federal decennial census, the term " housing violation" as used in this Chapter shall also encompass building codes, zoning, vegetation, and nuisance ordinances. However, nothing in this Section shall be construed to affect activities which occur on the premises of manufacturing facilities and which are regulated by Title 30 of the Louisiana Revised Statutes of 1950.
8. For purposes of this Chapter, " blighted property" shall have the same meaning as provided in R. S. 33: 1374( B), and " abandoned property" shall have the same meaning as provided in R. S. 33: 4720. 59( D)( 2). B.( 1) Any municipality or parish may adopt an ordinance or ordinances establishing an administrative adjudication hearing procedure under the provisions of this Chapter. The ordinance or ordinances shall provide for a time period for persons charged with owning blighted or abandoned property, or violating a public health, housing, fire code, environmental, and historic district ordinance to have a hearing under the provisions of this Chapter. The ordinance shall provide for the appointment of one or more hearing officers who may be the director of health of the municipality or parish or the health officer of the parish in which the municipality is located or the designee of such official or, in the discretion of the governing authority, who may be a person who shall have been licensed to practice law in Louisiana for two years.
9. Any municipality or parish that adopts an ordinance establishing an administrative adjudication hearing procedure for determining property to be blighted or abandoned shall provide notice to the property owners and to all mortgagees of record as provided in Paragraphs ( D)( 2) and ( F)( 2) of this Section.
10. Each municipality or parish shall have the authority to empower the hearing officer with authority

• a) Administer oaths and affirmations.
• b) Issue orders compelling the attendance of witnesses and defendants and the production of documents.
• c) Levy fines, fees, penalties, and hearing costs, the maximum of which shall not exceed those established for the parish or municipal courts.
• d) Order violators to correct violations within a stipulated time.
• e) Take necessary and lawful measures to effect correction of the violation ifthe violator fails to do so within the time allocated by the hearing officer.
• f) Record orders, judgments, notices ofjudgments, or liens in the mortgage office of the parish in which the immovable property, or any portion thereof, in or on which the violation occurred is situated. C.( 1) The municipality or parish shall have a lien and privilege against the immovable property in or on which the violation occurred. The lien and privilege shall secure all fines, costs, and penalties which are assessed by the municipality or parish in accordance with this Section and described in the order, judgment, notice ofjudgment, or lien. For the lien and privilege to arise and exist, the order, judgment, notice of judgment, or lien assessing any fines, costs, and penalties shall be recorded in the mortgage office of the parish in which the immovable property, or any portion thereof, in or on which the violation occurred, is situated. The recordation shall have the effect of a judicial mortgage against the immovable property described therein and may be enforced against the immovable property described therein upon application of the municipality or parish to the clerk of the district court for issuance of a writ in accordance with Code of Civil Procedure Article 2253. The remedies established in this Chapter are nonexclusive and may be pursued independently of each other and in addition to other remedies provided by law. In order for the lien and privilege to arise, the order, judgment, notice ofjudgment, or lien shall be final and not subject to appeal when recorded in the mortgage office. The lien and privilege shall have ranking as provided by R. S. 9: 4821( A)( 1).

2. Any liens placed against such immovable property shall be included in the next annual ad valorem tax bill and shall be paid along with such taxes, subject, however, to any valid homestead exemption. Failure to pay the liens shall cause the immovable property in or on which the violation occurred to be subject to the same provisions of law as govern tax sales of immovable property when the immovable property has been declared blighted or a public nuisance by an administrative hearing officer acting in accordance with this Section, the property owners and other parties having interests in the property shall not have a right of redemption. However, if the immovable property has been sold for nonpayment of taxes to a tax sale purchaser other than the municipality, and if the right of redemption from the tax sale has not elapsed at least one year prior to the sale pursuant to this Section, the tax sale purchaser shall have a right ofredemption from the sale pursuant to this Section until one year after the right ofredemption from the tax sale elapses. In addition, failure to pay the liens shall also cause such liens and privileges to be subject to enforcement in accordance with R.S. 13: 2576. Any liens placed against immovable property that has a legal homestead exemption from taxes will become payable ninety days after the death of the owner thereof or immediately upon recordation of any conventional mortgage on the immovable property or transfer of title to a new owner, whichever occurs first. D.( 1) Prior to holding an administrative hearing for public health, housing, fire code, environmental, and historic district violations, the municipality or parish shall notify the property owner at least fifteen days in advance of the date that such a hearing is scheduled. This notification shall state the time, date, and location of the hearing, the alleged violations, and it shall be sent by certified or registered United States mail to the violator or personally served on the violator at the address as listed in the assessor's office of the municipality or parish. The date of the postmark shall be deemed to be the date of delivery. Any notification so sent and returned by the United States Post Office shall be considered as having fulfilled the notification requirement. Failure of any person charged with a violation to appear at the hearing shall be considered an admission of liability for the charged violation. Any order compelling the attendance ofwitnesses or the production of documents may be enforced by the city or municipal court of the municipality or the parish court in whose jurisdiction the municipality is located, or in the parish court of the parish initiating the action.
3. Prior to holding an administrative hearing for the determination of blight or abandonment of property, the municipality or parish shall notify the property owner and each mortgagee of record in the parish mortgage records, at least thirty days in advance of the date of the administrative hearing. The notification shall state the time, date, and location of the hearing, the location of the subject property, and an explanation that the hearing is for the purpose of making a determination whether the subject property is blighted or abandoned. The notice shall be sent by certified or registered United States mail or personally served on the property owner at the address listed in the assessor' s office of the municipality or parish, and on each mortgagee of record at the address provided in the recorded mortgage.

• E. Any administrative adjudication hearing held under the provisions of this Chapter shall be conducted in accordance with the rules of evidence of the Administrative Procedure Act. Testimony by any person shall be taken under oath. The person charged with the ordinance violation may present any relevant evidence and testimony at such hearing and may be represented by an attorney at law. However, his physical presence shall not be required at the hearing if documentary evidence, duly verified by such person, is submitted to the hearing officer prior to the date of the hearing. F.( 1) The hearing officer shall issue an order within thirty days, excluding legal holidays, of the hearing stating whether or not the person charged is liable for the violation, and the amount of any fine, penalty, costs, or fee assessed against him, and a date by which the violation shall be corrected. In addition to the enforcement procedure and authority set forth in Paragraph ( B)( 2) of this Section, any order assessing a fine, penalty, costs, or fee or stipulating a correction date may be enforced by the city or municipal court of the municipality or the parish court in whose jurisdiction the municipality is located, or in the parish court of the parish initiating the action.

2. After the hearing to determine whether a property is blighted or abandoned, the hearing officer shall send written post- hearing notice to the property owner and each mortgagee of record explaining whether the hearing officer determined the subject property to be blighted or abandoned and state whether any fine, penalty, costs, or fees are assessed. The post- hearing notice shall be sent to the property owner and mortgagees of record in the manner provided for in Paragraph ( D)( 2) of this Section.

• G. The ordinance shall provide for the amount and disposition of fines, penalties, costs, and fees.
• H. Any property owner or mortgagee of record of property determined to be blighted or abandoned property, or any person determined by the hearing officer to be in violation of a public health, housing, fire code, environmental, or historic district ordinance may appeal this determination to the appropriate district court. Such appeal shall be instituted by filing, within thirty calendar days of the hearing officer's order, a petition with the clerk of court for the district court along with payment of such reasonable costs as may be required by the clerk. After filing a petition for appeal, the clerk of court of the district court shall schedule a hearing and notify all parties of the date, time, and place of such hearing. Service of notice of appeal under this Subsection shall not stay the enforcement and collection of the judgment unless the person who files the appeal furnishes security prior to filing notice of appeal with the agency of the municipality or parish designated by ordinance to accept such payments in the amount to be fixed by the hearing officer sufficient to assure satisfaction of the finding of the hearing officer relative to the fine, fee, penalty, costs of the hearing, and costs, if any, ofcorrecting the violation.
