The Police Jury of the Parish of Rapides, State of Louisiana, w as duly convened as the governing authority of said Parish by Hon. Craig Smith, President, who welcomed all present and then stated that the Police Jury was ready for the first item of business.

Mr. Randy Harris and Mr. Ollie Overton recognized and presented plaques to Wraparound Program Staff for Eckerd Connects and thank them for the services they provide for citizens and families in Rapides Parish and across the United States.

Mr. Dale Smith, representing the grassroots group, Protect Our Parishes”, addressed those in attendance on transparency of information to the public on carbon capture sequestration and the AI Data Center.

On motion by Mr. Bubba Moreau, seconded by Mr. Ollie Overton to adopt the minutes of the Rapides Parish Police Jury held in Regular Session on July 13, 2026, as published in the Official Journal. On vote the motion carried.

On motion by Mr. Ollie Overton, seconded by Mr. Danny Bordelon that approved bills be paid. On vote the motion carried.

The acquiring person shall submit the required n otifications (R.S. 47:2206 A and B) to the Civil Sheriff for his/her signature, and then notify those persons identified via regular mail, certified mail*, publicati on and/or service of process. *Copies of the “green and white receipts” should be maint ained by the purchaser as indicia of compliance with the notice requirements;

Section 4. • (a) Sixty days, for property on which a tax sale certificate (formerly “ process verbal”) was filed over five years previous of the first publicat ion, or six months if the tax sale certificate (formerly “process verbal”) was fi led less than five years before the first publication of the notice provided for this Subsection.
• (b) The filing of the sale or donation transferring the property.
• (c) The publication required by this Section shall be that whic h is included in R.S. 47:2206 B. (2).

mortgage, lien, privilege or other encumbrance filed after the filing of t he notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the req uest of the acquiring person.

Section 7. At any time after the expiration of the sixty-day or s ix-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notic e requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not exec ute the Act of Cash Sale or Act of Donation until the District Attorney’s office has certified in writing to the President that purchaser or done has complied with the mandates of this Ordinance. The sale price shall be paid by cashier’s chec k or money order at the time of sale.

NOTE: The initial application fee of $75.00 and any other co sts incurred by the purchaser shall not be applied to the purchase price an d shall not be refundable if the purchaser elects not to complete the process.

NOTE: The City of Alexandria and/or the City of Pineville and /or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed but shall convey the surface rights of said property.

Section 8. The acquiring person shall be responsible for filing t he sale or donation and payment of all filing fees.

Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.

• (a) All sales and donations shall be without warranty, either expr essed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against exhibitory defects or vices and the warranty that the thing sold is reasonably fit for its ordinary purpose or the acquiring person’s intended or particular purpose.
• (b) These waivers or exclusions of warranties shall be self-ope rative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardl ess of whether they are brought to the attention of the acquiring person. This provision supersedes the requirements of any other law.
• (c) The writing constituting the sale shall be in the form as prov ided in R.S. 47:2207 B. and the writing constituting the donation shall be that which is included in R.S. 47:2207 C.

Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance. REGULAR MEETING AUGUST 10, 2026

Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation a nd the validity of the sale or donation.

Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors or assigns, ma file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors or assigns, i ntends to be terminated were identified, how the address of each tax sale property was obtained, how the written notice was sent, the results of sending the writ ten notice, and the dates of publication.

• (a) The affidavit may also contain a statement of the intere st of which the purchaser or done takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debto r, as mortgagors.
• (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47:2208.
• (c) With respect to a sale, the filing of the affidavit provided herein sha ll operate as a cancellation, termination, release, or erasure of record of all s tatutory impositions of all political subdivisions then due and owing, of all governme ntal liens, and of all interests, liens, mortgages, privileges, and other e ncumbrances recorded against the property sold and listed in the affidavit.
• (d) With respect toa donation, the filing of the affidavit provided herei n shall operate as a cancellation, termination, release, or erasure of record of all statutory impositions of all political subdivisions then due and owing, of all governme ntal liens, and of all interests, liens, mortgages, privileges, and other e ncumbrances recorded against the property sold and listed in the affidavit.
• (e) Upon filing of the affidavit, the recorder of mortgages or the rec order of conveyances shall treat as canceled, terminated, released, or era sed, all those liens, privileges, mortgages or other encumbrances canceled, terminated, rele ased or erased under subsections (c) or (d) of this Section, only insofar as they affec t the property.
• (f) The owner filing the affidavit shall be liable to and indemnify the recorder of mortgages, the recorder of conveyances, and any other person relyi ng on the cancellation, termination, release, or erasure by affidavit for a ny damages that they may suffer as a consequence of such reliance if the recorded affidavit contains materially false or incorrect statements that cause the recorder to incorrectly cancel, terminate, release or erase any interest listed in the affidavit. The recorder of mortgages and the recorder of conveyances shall not be liable for any da mages resulting to any person or entity because of the cancellation, termination, release or erasure of any interest in compliance with this Section.

The acquiring person shall send written notice not ifying any tax sale party whose interest the successful bidder or done intends to be termina ted that the party has until the later of the following to redeem the prope rty or otherwise challenge in a court of competent jurisdiction the potential sale or donation:

• (a) Sixty days from the date of the notice provided in this Subsec tion, if five years have elapsed from the filing of the tax sale certificate (formerly “pr ocess verbal”), or six months after the date of the notice provided for in this Subsection, if five years have not elapsed since the filing of the tax sale certificate (for merly “process verbal”);
• (b) The filing of the sale or donation transferring the property.
• (c) The written notice required by this Section shall be that whic h is included in R.S.47:2206 A. (2).

Section 5. • (a) Sixty days, for property on which a tax sale certificate (formerly “ process verbal”) was filed over five years previous of the first publicat ion, or six months if the tax sale certificate (formerly “process verbal”) was fi led less than five years before the first publication of the notice provided for this Subsection.
• (b) The filing of the sale or donation transferring the property.
• (c) The publication required by this Section shall be that whic h is included in R.S. 47:2206 B. (2).

Section 6. The acquiring person may file with the recorder of mortg ages a copy of one of the notices that was sent to the tax debtor or the current owner. A transfer, mortgage, lien, privilege or other encumbrance filed after the filing of t he notice shall not affect the property. The recorder of mortgages or recorder of conveyances shall cancel, erase, terminate, or release the acts upon the req uest of the acquiring person.

Section 7. At any time after the expiration of the sixty-day or s ix-month periods, as applicable, set forth in R.S. 47:2206 (A) and (B), the acquiring person, or his/her successors and assigns, may send to this body a written notic e requesting that the sale/donation to him/her be authenticated. The President of the Jury shall authenticate the sale or donation within ten days from the date of the request or as soon thereafter as practical. However, the President shall not exec ute the Act of Cash Sale or Act of Donation until the District Attorney’s office has certified in writing to the President that purchaser or done has complied with the mandates of this Ordinance. The sale price shall be paid by cashier’s chec k or money order at the time of sale.

NOTE: The initial application fee of $75.00 and any other co sts incurred by the purchaser shall not be applied to the purchase price an d shall not be refundable if the purchaser elects not to complete the process.

NOTE: The City of Alexandria and/or the City of Pineville and /or the Parish of Rapides shall reserve all oil, gas and other mineral rights in and to the property to be conveyed but shall convey the surface rights of said property.

Section 8. The acquiring person shall be responsible for filing t he sale or donation and payment of all filing fees.

Section 9. The only warranty owed by the political subdivision or the municipalities shall be a warranty against eviction resulting from a prior alienation by the political subdivision or the municipality.

• (a) All sales and donations shall be without warranty, either expr essed or implied, even as to return or reduction of the purchase price, including without limitation the warranty against exhibitory defects or vices and the warranty that the thing sold is reasonably fit for its ordinary purpose or the acquiring person’s intended or particular purpose.

• (b) These waivers or exclusions of warranties shall be self-ope rative regardless of whether the waivers or exclusions are contained in the act of sale or donation, and regardless of whether they are clear and unambiguous, and regardl ess of whether they are brought to the attention of the acquiring person. This provision supersedes the requirements of any other law.
• (c) The writing constituting the sale shall be in the form as prov ided in R.S. 47:2207 B. and the writing constituting the donation shall be that which is included in R.S. 47:2207 C.

Section 10. The provisions of R.S. 41:1338 shall not apply to the property being sold or donated in accordance with this Ordinance.

Section 11. A certified copy of the sale or donation shall be prima facie evidence of the regularity of all matters dealing with the sale or donation a nd the validity of the sale or donation.

Section 12. Contemporaneously with or subsequent to the filing of the sale or donation of adjudicated property, the acquiring person, his/her successors or assigns, ma file with the recorder of mortgages an affidavit indicating how the tax sale parties whose interest the acquiring person, his/her successors or assigns, i ntends to be terminated were identified, how the address of each tax sale property was obtained, how the written notice was sent, the results of sending the writ ten notice, and the dates of publication.

• (a) The affidavit may also contain a statement of the intere st of which the purchaser or done takes subject. The recorder of mortgages shall index the affidavit only under the names of the owner filing the affidavit and the tax debto r, as mortgagors.
• (b) The affidavit described herein shall be sufficient if it follows the form articulated in R.S. 47:2208.
• (c) With respect to a sale, the filing of the affidavit provided herein sha ll operate as a cancellation, termination, release, or erasure of record of all s tatutory impositions of all political subdivisions then due and owing, of all governme ntal liens, and of all interests, liens, mortgages, privileges, and other e ncumbrances recorded against the property sold and listed in the affidavit.

WHEREAS, it is necessary under the program regulations to aut horize certain actions and individuals to perform certain designated functions by the State.

FINANCIAL MANAGEMENT

WHEREAS, it is necessary under the Financial Management regulat ions of the LCDBG program to authorize certain individuals to sign for draw downs for request for payments and to authorize one certain individual to certify the correctness of each signature; and,

WHEREAS, it is further necessary under the Financial Management regulations of the LCDBG program to designate an official depository to hold LCDBG funds;

NOW THEREFORE BE IT RESOLVED, by the as legal authorized recipient of the LCDBG funds, in regular session convened, that Theresa Pacholik a nd Devon Davis are hereby authorized to sign “Authorized Signature Card for Request for Payment;” and,

SECTION II

REQUISITION OF FUNDS

WHEREAS, the State requires adequate financial management co ntrol over LCDBG funds. The establishment of a Requisition of Funds policy is a vital tool to such control.

NOW THEREFORE BE IT RESOLVED, By the Rapides Parish Poli ce Jury that all invoices for work performed or materials used in relation to the LCDBG Program, prior to payment, must have attached a signed pre-printed project requisition form. The form and invoice shall be approved in the following order:

EQUAL OPPORTUNITY

NOW THEREFORE BE IT RESOLVED, that the Rapides Parish Polic e Jury adopts a Section 3 Plan and appoints Theresa Pacholik as its Section 3 Coordinator.

SECTION VI

RESIDENTIAL ANTI DISPLACEMENT

WHEREAS, the LCDBG Program requires that all grant reci pients adopt by resolution a Residential Anti - Displacement and Relocation Assistance Plan,

THEREFORE BE IT RESOLVED, that the Rapides Parish Poli ce Jury hereby adopts the attached Residential Anti-Displacement and Relocati on Assistance Plan appoints Theresa Pacholik as its Coordinator. SECTION VII LANGUAGE ACCESS PLAN

WHEREAS, as part of its Citizen Participation Plan to reach out and inform its citizens, the Rapides Parish Police Jury has developed a language access plan to inform its citizens who may not understand or speak English; AND,

THEREFORE BE IT RESOLVED, that the Rapides Parish Poli ce Jury hereby adopts the Language Access Plan and all updates for the Parish’s LCDBG Program.

SECTION 504 GREVIANCE PROCEDURE

WHEREAS, the LCDBG Program requires that all grant reci pients adopt by resolution an internal grievance procedure providing for prompt a nd equitable resolution of complaints alleging any action prohibited by the regulation of the U. Shall Fire Protection District No. 19 of the Parish of Rapides, St ate of Louisiana (the "District"), continue to levy and collect a 26.48 mills tax (the "Tax") on all the property subject to taxation in the Di strict (an estimated $174,000 reasonably expected at this time to be collec ted from the levy of the Tax for an entire year), for a period of 10 years, beginning with the year 2028 and ending with the year 2037, for the purpose of acquiring, constructing, maintaining and/or operating fire protection and emergency medical service facilities, vehicles, and equipment, including both movable and immovable property, including paying the cost of obtaining water for fire protection purposes, said millage to represent a 1.48 mills increase (due to reapprai sal) over the 25 mills tax authorized to be levied through the year 2027 pursuant to an election held on November 18, 2017, provided that a portion of the Tax proceeds is required to be contributed to state and statew ide retirement systems as provided in R.S. 11:82?

SECTION 2. Publication of Notice of Elections. A Notice of Special Elections shall be published in the official journal of the Distric ts once a week for four consecutive weeks, with the first publication to be made not less than forty-five

• (45) days nor more than ninety (90) days prior to the date of the el ections, which Notice shall be substantially in the form attached hereto as "Exhibit A" and incorporated herein by reference the same as if it were set forth herein in full.

Notwithstanding the foregoing, prior to the publication of the Noti ce of Elections, the President is authorized and directed to make any amendments to the foregoing propositions that may be required to comply with any s tate or federal regulatory agencies.

SECTION 3. Canvass. This Governing Authority shall meet at its regular meeting place, the Police Jury Room of the Rapides Parish Courthouse, 701 Murray Street, 2 nd Floor, Alexandria, Louisiana, on MONDAY, JANUARY 11, 2027, at 3:00 P.M., and shall then and there in open and public session proceed to examine and canvass the returns and declare the result of the said special elections.

SECTION 4. Polling Places. The polling places for the precincts set forth in the aforesaid Notice is hereby designated as the polling places at which to hold the said elections, and the Commissioners-in-Charge and Comm issioners, respectively, will be the same persons as those designated in accordance with law.

SECTION 5. Election Commissioners; Voting Machines. The officers designated to serve as Commissioners-in-Charge and Commissi oners pursuant to Section 4 hereof, or such substitutes therefor as may be selected and designated in accordance with La. R.S. 18:1287, shall hold the said special elections as herein provided, and shall make due returns of said elections for the meeting of the Governing Authority to be held as provided in Section 3 hereof. All registered voters in the Districts will be entitled to vote at the speci al elections, and voting machines shall be used.

SECTION 6. Authorization of Officers. The Secretary-Treasurer of the Governing Authority is hereby empowered, authorized and dir ected to arrange REGULAR MEETING AUGUST 10, 2026

for and to furnish to said election officers in ample time for the holding of said elections, the necessary equipment, forms and other paraphernalia esse ntial to the proper holding of said elections and the President and/or Secretary-Treasurer of the Governing Authority are further authorized, empowered and directed to take any and all further action required by State and/or Federal law to arrange for the elections.

SECTION 7. Furnishing Election Call to Election Officials. Certified copies of this resolution shall be forwarded to the Secre tary of State, the Clerk of Court and Ex-Officio Parish Custodian of Voting Machines of Rapides Parish and the Registrar of Voters of Rapides Parish, as notificati on of the special elections, in order that each may prepare for said elections and perform their respective functions as required by law.

SECTION 8. Application to State Bond Commission. Application is made to the State Bond Commission for consent and authority to hold the special elections as herein provided, and in the event said elections carry for further consent and authority to continue to levy and collect the special ta xes provided for therein. A certified copy of this resolution shall be forwarded to the State Bond Commission on behalf of this Governing Authority, together with a letter reque sting the prompt consideration and approval of this application.

SECTION 9. Employment of Counsel. This Governing Authority finds and determines that a real necessity exists for the employment of special counsel on matters related to the special election, and accordi ngly, Foley & Judell, L.L.P., is hereby employed as special counsel for said purpose for a term not exceeding one (1) year from the date of this resolution. The fee t o be paid said special counsel shall be an amount computed at hourly rate base d on the Attorney General's then current Maximum Hourly Fee Schedule, not to exceed $2,000 in the aggregate, together with reimbursement of out-of-pocket expenses, and payment for the work herein specified is hereby approved without further action o f this Governing Authority as and when invoices are presented. The scope of this legal representation does not involve federal claims.

1. When a classified position moves to an unclassified position for a temporary appointment the current rule states the Jury must make a reappointment every thirty (30) days.
